It is essential that you carefully read and understand the conditions set for this Aquatic Licence and ensure full compliance. It is also essential all key event staff read, understand and assist in enforcement of these conditions, before and during the event. This Licence covers the period of 3/9/ /7/2017 between the hours of 13:00 20:00 as requested on your application. Should you have any plans for other events outside this time period, another application is required 6 weeks prior to the first event. The conduct of any aquatic event without the required licence constitutes a breach of the Marine Safety Regulation 2016 (for which a penalty of up to $ may be imposed) and places the event organisers at risk of any insurance policies held being negated. Roads and Maritime Services takes this opportunity to remind you that the organiser of an approved aquatic event must report all incidents involving a fatality, serious injury and/or damage where such is considered significant having regard to the types of vessels involved, to Roads and Maritime within 48 hours of occurrence using a Vessel Incident Report form available on the Roads and Maritime website. The organiser must then report, in writing, the findings of an inquiry into the incident within 28 days of the incident. Roads and Maritime reserves the right to investigate any incident at any time, particularly where a breach of marine legislation may have occurred. 3 Date: 18/08/2016 CONDITIONS FOR AQUATIC LICENCE - AQL34137 STANDARD CONDITIONS 01 Where the licence is no longer required the Licensee is to advise the Roads and Maritime Services's Regional Office. Note that the licence automatically expires at the conclusion of the final event/race referred to in the application. 02 The Licensee is to ensure that the written permission of the owner/occupier of the land(including government and local government authorities), which is intended to be used as departure or arrival points, has been obtained. 03 The licensee is to provide a designated liaison officer to deal with complaints from members of the public. 04 Aquatic licence activities must be confined within the area shown on the plan that accompanied your application. 05 There is a responsibility on the Licensee to postpone or call-off an aquatic licenced event if the conditions under which the event is to be conducted, including weather and water/sea conditions, are or become unstable. 06 The Licensee must, at all times ensure compliance with all applicable provisions of the rules or regulations under which the event is conducted. 07 Course, track or rounding buoys or marks shall not be placed down before sunrise or moved contrary to the directions of an officer of Roads and Maritime Services, and must be removed completely from the enclosed water before sunset on any day except where the application discloses that the race / event will start or continue between sunset and sunrise, or written approval to the contrary has been given by Roads and Maritime Services. 08 Any direction given by an Authorised Officer to the Licensee or designated person, involving the navigation of any vessel, the temporary or complete cessation of any event or activity or the provision of safety control measures involving nonparticipating vessels, shall be complied with. 09 The Licensee is to advise all vessel charter or hire firms in the area of the details of the event, and of control arrangements. 10 The Licensee is to inform competitors that compliance with Boating (Safety Equipment) Regulations is required, where the rules under which the event is to be conducted do not specify alternative equipment. 11 A written record, detailing the reasoning behind and the result of the investigation of each incident involving a fatality, serious injury and/or damage where such is considered significant having regard to the types of vessels involved, is to be maintained for a minimum of 6 months. Such record is to be made available to an Authorised Officer on demand. 12 The Licensee must comply with the "Policy for handling incidents occurring in Aquatic events". 22 This licence is granted on the basis that the licensee expressly and unreservedly indemnifies Roads and Maritime Services from all liability associated with the aquatic licence event and releases Roads and Maritime Services from any actions, of whatsoever nature, that may be instituted in relation to the event. Acceptance of this licence constitutes irrevocable acceptance of this condition. 23 The Licensee is to ensure that adequate safety briefings are given to all competitors prior to the commencement of an event. 25 The Licensee must clearly advise all participants in the Aquatic Event associated with the Licence whether or not they are covered by the Licensee's Insurance should they sustain injury or loss as a result of participating in the Event. This advice must be provided prior to the participation in the Event. 82 All event officials, organisers and controllers must wear appropriate official identifying clothing or clearly display official identification. 83 The licence holder must comply with any requirements of Roads and Maritime Services, either written or verbal, in relation to the safe conduct of an Event. 2

4 ADDITIONAL CONDITIONS 14 - Appropriate power driven vessels shall be in attendance to act as support vessels and to warn approaching vessels that an event is in progress The Licensee is to ensure that vessel noise emission, including that from a public address system, is effectively managed in accordance with the Protection of the Environment Operations Act and (Noise Control) Regulation A written warning must be given to all participants by the Licensee in relation to the particular risks associated with participating in the Event. The warning can be included on the Application Form completed by the participant No Roads and Maritime Services or Port Authority navigation piles/buoys to be used as rounding marks No start marks or rounding buoys to be laid in channels or fairways All rounding marks to display either Yachting Association Identification, club pennant or identifying club insignia Additional Conditions: "Harbour Master" a) The event is not to interfere with or impede the movement of seagoing ships or commercial vessels including ferries b) Event organiser to contact Sydney Ports VTS before the event;. 6 POLICY FOR HANDLING INCIDENTS OCCURRING IN AQUATIC EVENTS PRINCIPLES Roads and Maritime Services (Roads and Maritime) will leave the investigation and management of incidents under an aquatic licence largely to participating clubs or governing bodies/organisations. All race participants competing under governing body regulations must be aware of the risks involved. Roads and Maritime strongly recommends that all aquatic licensees hold a Public Liability Insurance Policy that covers the event, including all participants in the event, and damage to any vessels or property associated with the event. Roads and Maritime may in certain circumstances require as a condition of issuing the licence, that the applicant takes out and maintains a public liability policy and may require Roads and Maritime be named on the policy as a covered party. Roads and Maritime will generally intervene only where it is clear that the incident is significant, and action by the licensee appears to have been inappropriate or incomplete and/or there has been a significant disregard of the marine legislation. Handling incidents occurring under aquatic licences involving sail, power and passive (not driven by either mechanical power or sail) vessels Roads and Maritime requires the organising club to investigate incidents between vessels racing in licensed events on the basis of the applicable rules under which the vessels were competing or racing. The marine legislation will always prevail where racing and non-racing vessels interact and when vessels are racing under different governing body regulations. The licensee of an approved aquatic activity must report all incidents involving a fatality, serious injury and/or significant damage where such is considered significant having regard to the types of vessels involved, to Roads and Maritime within 24 hours of occurrence using a Vessel Incident Report, available on the Roads and Maritime web site. The licensee must then report, in writing, the results of findings of an inquiry to Roads and Maritime within 28 days of the incident. There may also be a requirement for the licensee to report incidents to other agencies. Roads and Maritime reserves the right to investigate any marine incident at any time and will always investigate when there is an apparent significant disregard of the marine legislation. Note: 'Serious injury' is defined as 'attending hospital', other than for treatment of minor injury or for observation only. 'Significant damage' is determined having regard to the types of vessels involved and would generally be in excess of dollar value which is appropriate to the overall value of the vessel (generally $5000 and above). 5

7 NSW GOVERNMENT Roacs & Naritime Services Condition 100 ADDITIONAL CONDITIONS SAILING EVENTS All competitors must maintain a minimum distance of 500m from the bow of any ship' and/or between the Sydney Port escort vessel, 200m from the bow of any ferry2 and no less than 30m from the sides/stern of any ship or ferry underway. All participants must be made aware of the requirements listed in the Sydney Ports Steer Clear brochure which may be viewed at the following web address, or see attached copy. http// data/assets/pdf file/008/17729/steer Clear Flyer 2013.pdf Vessels are not to navigate between moorings whilst competing. All vessels navigating in the vicinity of the safe water mark, 350m from Bradleys Head, should pass to the north of the buoy when proceeding westward, and should pass to the south of the buoy when proceeding eastward. Sydney's ports facilitate over $61 billion of trade each year, with an annual contribution to the New South Wales economy in excess of $5 billion. With hundreds of seagoing ship and large commercial vessel movements on these confined waterways, it is important skippers understand their responsibilities to ensure safety afloat for all concerned. Simple steps to stay safe near seagoing ships Always keep a lookout for seagoing ships. Determine if the vessel is moving towards you or away from you. Always keep a safe distance away from a large vessel. Act early so you can move away from these seagoing ships and also make sure that they can clearly understand what you are doing. Always have your navigation lights on at night so other vessels can clearly see you. Familiarise yourself with the shipping channels or fairways.
