Deer Creek will hold its annual 4th of July Celebration and Ice Cream Social on Tuesday June 26th, and the annual National Night Out event on Tuesday, August 7th. 2 Homeowners Association Dues Deer Creek Homeowners Association (HOA) Annual Dues will be billed semi-annually for January June 2018 and for July December January invoices will be mailed in early January and are delinquent if payment is not received by January 31st. July invoices will be mailed in early July and are delinquent if payment is not received by July 31st. Finance charges will be assessed on all delinquent accounts. To better serve Deer Creek Homeowners, there are several payment options: (1) Deer Creek HOA, P.O. Box , Montgomery, AL (2) Checks will be accepted at the Information Center during offi ce hours (Monday - Thursday 8:30 a.m. 5:30 p.m.; Fridays 8:30 a.m. - 12:00 p.m.; Saturday and Sunday 1:00 p.m. 5:00 p.m.). (3) Checks may be placed in the drop boxes, which are located outside of the Information Center door or island near the drive through. The Homeowners Association is enforcing all rights and remedies allowed for the collection of delinquent dues. To avoid finance charges, attorney s fees and other collection enforcements, dues should be paid in a timely manner. For this reason, we would like to remind all homeowners to respect and completely follow the Amenity Center Rules & Regulations. Remember, you must access the amenities with an amenities access keycard. If you are new to Deer Creek and do not have a keycard, please make arrangements to stop by the Deer Creek Information Center. Keycards are available for pickup at the Deer Creek Information Center Monday Friday 8:30 a.m. 5:30 p.m. The keycard system provides added security to the amenities while providing a log of when each homeowner enters and exits the amenities. Homeowners must provide proof of residency, valid photo identification, and complete a registration form and amenity usage agreement before a keycard will be issued. If you have lost or found something in Deer Creek you may want to call our office or check the website In the past, we have received strollers, cell phones, keys and even a guitar, so call or check the website if you misplace an item. As you probably already know Deer Creek will be holding an upcoming election. The election will be very important so please make sure to read all the information you receive in the mail and plan to cast your vote! 3 Love Your Dog, Leash Your Dog We love dogs we really do. That s why the association is committed to enforcing the City of Montgomery leash law on association property. According to the U.S. Humane Society, an unleashed dog has an average life span of less than four years. Allowing your dog to run free threatens your dog s health and welfare and the happiness it brings to you. We also love our community. That s another reason the association is committed to enforcing the City of Montgomery leash law so all residents may enjoy our community. We trust we can count on you for voluntary compliance with the leash law. We don t like to call animal control, but we won t have any choice if your dog is running free and a threat to others. Leash Law Please note that the City of Montgomery honors a leash law and any dogs that are not on a leash may be picked up by the City of Montgomery s Animal Control/Humane Society. Mailboxes shall contain the street number, as approved by the ARC, but no further inscription, painting, ornaments, or artistry shall be allowed. 4 Thunderstorm Safety Avoiding a Lightning Strike Warm weather usually means fun in the sun, but summer heat also can bring severe weather. Threatening thunderstorms often loom large on summer afternoons so it s important to be prepared for downpours and accompanying lightning, which can strike outdoors or indoors. Consider the following suggestions when planning both outdoor and indoor events this summer to reduce the risk of a lightning strike. Watch the weather. Pay attention to your local weather forecast before participating in outdoor activities. If there s a chance of thunderstorms, consider rescheduling or moving events indoors. If that s not possible, have an emergency plan in place in case a severe storm rolls in and designate a sufficient nearby structure as an emergency shelter. Stay inside. If severe thunderstorms are imminent, go indoors and wait until they pass. Safe, enclosed shelters include homes, schools, offices, shopping malls and vehicles with hard tops and closed windows. Open structures and spaces do not provide adequate protection. Duck and crouch. If you re caught outside during a severe storm, it s important to crouch low on the ground, tuck your head and cover your ears to help protect yourself from harm. Do not lie down; lightning strikes can produce extremely strong electrical currents that run along the top of the ground, and laying horizontally increases electrocution risk. Turn off faucets. During a thunderstorm, lightning can sometimes be conducted through the plumbing. Avoid any type of contact with running water, including bathing, showering, and washing your hands, dishes, or clothes. Turn off electronics. All electrical appliances televisions, computers, laptops, gaming systems, stoves, and more that are plugged into an electrical outlet could carry a current from a lightning strike. Surge protectors will reduce the risk of damaging electronics. Stay away from windows. Not only is lightning a threat, but high winds and hail create flying debris that could be harmful during a thunderstorm. Close all windows and doors and keep away from them. 5 On second, forth, and fifth Saturday s citizens of the City of Montgomery may take trash to the North Montgomery Landfill at 115 Division Street between the hours of 9:00 am and noon. At these times it is free of charge for Citizens of Montgomery. Disposal Material must be acceptable at the Landfill, and the disposal material must come from the residence of the person wishing to dispose. We do not accept, at any time, liquids. If a paint can/bucket are brought for disposal, there cannot be any liquid consistency in the can/bucket. Also, if a customer brings in material on a Double Axle Trailer, there will be a charge for disposal. In addition, there will be a disposal charge for any commercial material that is brought in. There is a bathroom for residents next to the fitness center. Playground Rules 1. Play equipment is available during daylight hours and dry weather conditions only. Use of playground after sundown is prohibited. 2. Adult supervision is required at all times. 3. Proper footwear is required, no bare feet allowed. 4. Proper attire must be worn at all times. 5. No climbing, jumping, or swinging on playground gate and/or fence. 6. Playground cover is necessary for reducing fall impact and should not be picked up, thrown, or kicked for any reason. 7. Food, drinks or gum are not allowed at the playground. 8. No pets are allowed inside the playground. 9. Playground equipment should only be used as intended. 10. No running, pushing, or shoving is allowed. 11. Management reserves the right to adjust or add any rules as needed. Additional playground rules may be posted at the playground area or may be implemented without notice. Management reserves the right to refuse anyone the use of the playground and its facilities. Failure to adhere to these rules may cause the loss of playground privileges. COMMUNITY CONCERNS The Deer Creek Homeowners Association receives many calls and s regarding pets. Below is a list of the most common concerns. Dogs off Leash - The City of Montgomery requires all dogs to be leashed. Leashes must be used in the areas around the lakes, on the roadways and walking trails and in any open spaces. There have been reports of loose dogs frightening children and scaring and injuring the wildlife. Barking Dogs - Dogs that bark or howl constantly disrupt the quiet and make it very unpleasant for neighbors. If you have a howling dog, please make an effort to keep it from disturbing neighbors. Scoop the Poop - Please be courteous and take a pooper scooper and bag with you when you walk your pets. No one likes to fi nd a surprise left by a pet when they are walking on the grass or sidewalk. There are pet waste bags located throughout Deer Creek for your convenience. Catting Around Cats are not required to be leashed but are trespassing when they enter another person s property. Please be courteous to your neighbors and keep the cat at home. 9 IMPORTANT NOTICES Vacant Lots The Deer Creek Information Center is working with builders to keep vacant lots clean and cut. To keep the vacant lots and your neighborhood looking their best, we ask that you do not place trash or grass clippings in front of or on the vacant lots. The city will not pick up trash in front of vacant lots. DROP BOXES For your convenience, there are two drop boxes outside the Information Center office. There is one located in the island along the drive, in front of the office and one on the wall next to the office doors. Homeowners can use the drop boxes for key returns, payments and ARC applications. The drop boxes are checked daily by the Deer Creek management. Please do not place mail to be delivered by the USPS in the Deer Creek drop boxes. Amenity Center Rules & Regulations Did you know that the tennis courts close at 11:00 p.m.? Did you know that pets are not allowed in the playground? Did you know that you must be 14 years of age or older to enter the fitness center? Did you know that food and drinks are not allowed on the Splash Park surface? It is important that all homeowners become familiar with the Deer Creek Amenity Center Rules & Regulations. The most current copy of the Deer Creek Amenity Center Rules & Regulations can be found on the web at www. deercreekhomeowners.net. If a Member or its Guests violate any of the Rules & Regulations, the Association and / or the General Manager reserve(s) the right to bar the Member from using the Deer Creek Homeowners Association, Inc. facilities. No Fishing Fishing is not permitted in the Vaughn Road Entrance Pond located immediately behind the guardhouse. Fishing is also not permitted in the Ponds in Marston, just prior to crossing the bridge. There are No Trespassing and No Fishing Signs posted at that location. 10 For the People, By the Homeowners Community associations like ours have a lot in common with municipal governments. As members of a governing body, our board members meet regularly to discuss and vote on important community issues, like paying the association s bills, funding our reserves and contracting with vendors to keep our community amenities in good repair. The board makes decisions about these and other important topics using a democratic process. Also like a government, our association board has the legal authority to enforce rules and regulations somewhat like laws and to collect assessments, like a government collects taxes, to pay to maintain shared amenities like parking lots, general landscaping and street lights, and to pay the association s bills. Our association also has the authority to take legal action, if necessary, if a homeowner fails to meet his or her obligations that we all agreed to when we purchased in this community. These obligations include paying regular assessments on time, abiding by architectural or design policies, and observing community rules. Deer Creek s Annual National Night Out Celebration 2018 Tuesday, August 7th Beginning at 5:30 pm Deer Creek Amenity Center Join your neighbors, the Montgomery Police Department, Montgomery Multisport, and other local agencies for an exciting evening. You can help celebrate Community Partnerships by being a part of National Night Out! Fishing Season is here! Please observe the following rules when using the ponds: Fishing is for Deer Creek Homeowners Association members only. Members may have no more than 3 guests at any one time. Guests may fi sh only when accompanied by a member. Members may fi sh in lakes directly adjacent to their lot. Other members may fi sh in the Clubhouse Lake and the lake at Deer Creek Crossing on common area property only. Please remember, lake areas located adjacent to lots can only be fi shed by the owners of the adjacent lots. Boating is NOT permitted in lakes. The chemical balance, structure or drainage of the lakes should NOT be tampered with. Swimming in lakes is prohibited. Ducks, swans, etc. may not be introduced into the lakes without prior written consent of the General Manager. Remember, the lakes are for Deer Creek Residents only. Visitors are welcome, but only if accompanied by a resident while fi shing. Please help by having your Deer Creek access keycard with you or come by the Information Center and pick up a FISHING PERMIT sticker. Homeowners can also obtain a Deer Creek access keycard at the Information Center. Offi cers from the Alabama Wildlife Freshwater Fisheries periodically patrol Deer Creek lakes and residents may be asked to show proof of residency. The State of Alabama does have 12 limit for bass and all members of the Association must abide by this limit. After fi shing, please leave only your footprints behind and take any trash with you for proper disposal. Please note that the clubhouse parking area will be closed to vehicles. We encourage you to walk or ride a bike to the event. If you choose os to drive, you can park on Deer Creek Blvd. If your child will be participating in the bike rodeo you will need to bring a bike and a helmet.
11 POOL/SPLASH PARK RULES 1. Access to the pool area is by use of a keycard. 2. Swim at your own risk. 3. Children ages 13 and up, who can swim the length of the pool, may swim unaccompanied by an adult. These children may be asked by the lifeguard, at any time, to demonstrate the ability to swim the length of the pool. An adult 18 or older must accompany Members and guests of Members the age of 12 and under using the swimming pool. Children ages 8-12 years old, who can swim the length of the pool, may swim unaccompanied as long as a parent or guardian is on the pool deck at all times. Children age 7 and under must be accompanied in the water by a parent or guardian at all times. 4. Users of the wading pool must be accompanied and supervised by an adult at all times. 5. The pool is open when lifeguards are on duty. Instructions given by lifeguards must be obeyed at all times. Members cannot be on the pool/splash park deck or inside the pool if a lifeguard is not on duty. 6. Diving is not allowed. 7. Please shower before entering pool. 8. Pool hours will be posted and/or are available at the Information Center. Loitering at the pool for any reason other than sunbathing and swimming will not be permitted. 9. Profane language and shouting are prohibited. Public intoxication and/or disorderly conduct will not be tolerated. Running, shoving or rough play will not be allowed. No objects may be thrown in the pool or on the deck area. 10. Glass containers and bottles are not allowed in the pool area. Please help keep the pool deck clean and dispose of all trash. 11. Please use the bathhouse restrooms for changing. Proper swimwear, as determined by Management, must be worn to enter the pool. Unhemmed cut-offs are not allowed. Bathing suits are not allowed inside the Amenity Center. 12. Children s disposable diapers are not allowed in the pool. Appropriate swimming diapers and plastic pants must be worn at all times. 13. Radios, televisions, etc. may be used as long as they do not cause a disturbance to others. 14. The only flotation devices allowed in the pool area are as follows: water wings, swim vests, noodles, small blow-up balls and baby swim rings. Floats and boogie boards are not allowed. 15. Emergency equipment is to be used by lifeguards only. Do not play on or around the lifeguard stand. 16. Return all pool furniture in a neat and orderly arrangement. Semi permanent pool furniture (i.e. picnic tables) should not be moved. 17. If the pool/splash park deck or restrooms need attention, Members should notify the lifeguards. 18. Please be considerate of your neighbors. 19. The bather load is 263 persons for the main pool and 57 persons for the wading pool. 20. Adult Swim this time is for adult swimming only (for ages 18 and up). Adult Swim will be called by lifeguards. 21. Lifeguards are on duty for the protection of Members and their guests. Do not distract them in any way unless there is an emergency. If a member or guest needs to talk with one of the lifeguards, that member or guest should wait until the lifeguard is no longer guarding and is on break. 22. There is a strict no smoking policy for the pool area. Other tobacco uses are also prohibited. 23. Animals are not allowed on the pool deck unless use is for aid in disability. 24. Management reserves the right to adjust or add any rules as needed. Additional pool rules may be posted at the pool area or may be implemented without notice. 25. Management reserves the right to refuse anyone the use of the pool and its facilities. 26. Failure to adhere to these rules may cause the loss of pool privileges. The Pool guest policy may be revoked or changed at any time by Association Management. POOL / SPLASH PARK WEATHER CLOSURES 1. The pool/splash park may be closed at times due to inclement weather. 2. The pool/splash park must be cleared immediately at the direction of the lifeguards at the first sound of thunder or sight of lightning. Members and their guests will be told to keep a safe distance from the pool and from all objects that would endanger them. Members, or their guests, are not permitted to go near water, take showers, sit on picnic tables or use the telephone (except in the case of an emergency) until conditions permit. 3. Closure will be until thunder has not been heard and/or lightning has not been seen for at least 30 minutes. 4. Any condition that causes the lifeguard s vision of the bottom of the pool to be distorted is reason to close the pool. This includes raining (without lightning or thunder), increase in algae growth or chemical imbalance. Once the condition is cleared, re-entry will be allowed. SPLASH PARK RULES 1. Food or drinks are not allowed on the splash pad surface. 2. Pool furniture should not be placed on the splash pad surface. 3. Members and/or guests should not climb on, or swing on, splash park equipment. 4. Toys and/or sports balls should not be used on the splash pad surface. 5. Manual manipulation of drop buckets is prohibited. 6. All pool rules apply to the splash park area. POOL / SPLASH PARK GUEST RULES 1. Each Family may have three (3) guests at any one time. All guests must be accompanied by a Member. Members are responsible for the actions of their guests. Guests are defined as anyone other than a Member of the Deer Creek Homeowners Association, Inc. Guests must follow the pool rules. Violation of this rule can result in the loss of pool/splash park privileges. DO YOU WANT TO SPEND YOUR SUMMER AS A CRAWFISH? Deer Creek residents can join the team by completing an application and paying a small fee to the YMCA. The Crawfish Team will accept swimmers throughout the summer. All levels / ages of swimmers can participate. If you can swim one lap of the pool, you may become a member. The Crawfish Swim Team is a good source of exercise and a great way to learn and master swimming techniques, but most of all - IT S FUN!
