1 MINUTES MALIBU PUBLIC SAFETY COMMISSION AND PUBLIC WORKS COMMISSION JOINT SPECIAL MEETING MARCH 29, 2017 CITY COUNCIL CHAMBERS 6:30 P.M. APPROVAL OF AGENDA Public Works Commission Vice Chair Grisanti moved and Public Works Commissioner Sidley seconded a motion to approve the agenda. The motion carried 9-0, Public Safety Commissioner Addison absent. REPORT ON POSTING OF AGENDA Recording Secretary Linden reported that the agenda for the meeting was properly posted on March 22, ITEM 1 NEW BUSINESS A. Pacific Coast Highway Parking Study Draft Final Report Staff recommendation: Receive and provide feedback on the Pacific Coast Highway (PCH) Parking Study Draft Final Report.

2 Page 2 of 8 Assistant to the City Manager Shavelson presented the staff report. She noted two corrections to the staff report, namely that the matrix of public comments is provided in Appendix D (second paragraph on page 2), and the meeting with California Coastal Commission staff was held on February 22, 2017 (last paragraph on page 2). She welcomed Daniel Tran, Southern California Association of Governments (SCAG) Associate Regional Planner, and Joseph Kibe, Caltrans Senior Traffic Engineer. Assistant to the City Manager Shavelson introduced Rock Miller of Stantec Consulting Services, Inc., the consultant for the PCH Parking Study. Mr. Miller provided a slide presentation displaying an overview of the PCH Parking Study, as well as key findings and recommendations included in the Draft Final Report. Mr. Miller announced that written comments would be accepted through April 7, 2017 for inclusion in the revised report. Assistant to the City Manager Shavelson confirmed the revised report was tentatively scheduled to be presented to the City Council in June Meril May stated any improvement is good improvement and the sooner, the better. He commended Caltrans for improved maintenance on the shoulders along PCH. He stated how to manage overcrowded days needed to be addressed. He thanked the City for new signage. He suggested ensuring the road had a smooth surface after striping. He thanked the City, SCAG, Caltrans and Stantec for doing the study. Tara Trenda discussed recreational vehicles parking on PCH near Coastline Drive. Public Safety Commission Chair Randall advised Ms. Trenda that Coastline Drive was not included in the PCH Parking Study as it is outside the Malibu city limits. Annie Ellis thanked the City for replacing No Parking signs near El Matador Beach. She displayed photos of illegal and unsafe parking. She stated some vehicles parallel parked in the bike lane. She expressed concern about narrowing traffic lanes. Andy Cohen discussed increased parking problems on PCH near El Matador Beach in recent years. He agreed with prohibiting parking on the inland side of PCH to prevent pedestrians running across the highway. In response to Keith Canter, Deputy Winn confirmed a motorist parallel parking by stopping, using a turn signal, then backing into a parking space has the right of way. In response to Cheryl Spurlock, Deputy Winn confirmed a cyclist may not enter the traffic lanes when there is a dedicated bike lane except to safely pass another bicyclist in front of them in the bike lane. Lt. Royal clarified that cyclists could use the traffic lanes rather than the shoulder if there was no dedicated bike lane. Ms.

3 Page 3 of 8 Spurlock expressed hope that adding dedicated bike lanes would alleviate some of the dangers from bicyclists riding in traffic lanes. Catherine Ferguson agreed with Ms. Ellis about the dangerous conditions near El Matador due to limited sight lines, speeding vehicles, and pedestrians running across the highway. She agreed with restricting parking on the inland side due to the blind hill. She commended the City for the bike lane near Zuma Beach. Norm Haynie discussed an area near Tuna Beach where approximately 70% of vehicles cut the corner on the eastbound curb by as much as two to three feet over the white line. He suggested making that area a No Parking zone and adding signage advising motorists not to cross over the white line. Ilana Urman suggested adding signs warning pedestrians to not cross or to cross at their own risk. She expressed concern that narrowing traffic lanes would increase traffic accidents. She questioned the justification for the cost of paving shoulders. Public Safety Commissioner Wright expressed concern about the lack of code enforcement of parking. She stated the report showed a larger number of accidents occurred between 2:00 to 4:00 p.m., which coincided with the general timeframe for shift changes. She agreed with the need for increased enforcement of parking on PCH near El Matador. She suggested using Volunteers on Patrol (VOP) for parking enforcement and acknowledged that more law enforcement vehicles was a deterrent for illegal parking. She discussed missing signs. She expressed concern about increased collisions resulting from narrowing traffic lanes. Public Works Commissioner Sidley agreed with adding pedestrian signage and reducing landside parking in many areas. In response to Public Works Commissioner Sidley, Public Works Director Brager stated speed limits could not be reduced on PCH. Mr. Miller discussed what would be required to reduce speed limits. Public Works Commissioner Sidley asked if the City could get more VOPs. Assistant to the City Manager Shavelson stated VOPs have been enforcing parking since 2014 and have used electronic citation devices since 2015, resulting in an increased number of citations issued. She stated the cost of the ticket does not always deter illegal parking, but tow away zones might. Public Works Commissioner Sidley discussed the dangers of parking on Winding Way and near Paradise Cove due to narrow shoulders. Public Safety Commissioner Hanson expressed concern with narrowing lanes. He agreed with paving of shoulders and enhanced signage maintenance. Public Works Commissioner Palmer stated signage is critical and must be enforced. He asked how many parking spaces would be added or removed based on the recommendations of the PCH Parking Study. Mr. Miller stated the study would not add to the total number, but the reallocation would increase or improve available

4 Page 4 of 8 parking in the more heavily parked areas. Public Safety Commissioner Palmer agreed with restricting parking on inland PCH where pedestrians are more likely to run across the highway. Public Safety Commission Vice Chair Frost discussed problems of curb-to-curb U- turns across the highway. He stated crosswalks give pedestrians a false sense of security. He stated pedestrian signs on the west end would be beneficial but only if they were easily seen. He commended the VOPs for citing, but agreed that many motorists preferred to pay the cost of a ticket in order to get the better parking spot. He discussed parking restrictions previously installed near Paradise Cove that were removed by the California Coastal Commission (CCC). Public Works Director Brager stated the signs were put back up and are being enforced while CCC and Caltrans discuss the issues. Public Safety Commission Vice Chair Frost discussed dangers near Corral Beach with pedestrians going between the beach, the RV park and restaurants. Public Works Commissioner Merrick discussed higher numbers of collisions near or at restaurants on PCH. He asked if the study investigated whether that involved parked vehicles of employees or guests. Mr. Miller stated the ownership of vehicles was not part of the study. Public Works Commissioner Merrick stated many residents complained about the lack of available street parking due to restaurant employees parking on the Street. He discussed weeds growing near Zuma Beach that resulted in vehicles parking into the traffic lanes. He asked whether the City could have its own parking division or if enforcement must be under the Sheriff s Department. Assistant to the City Manager Shavelson discussed the increase in enforcement since implementation of the VOPs. Public Works Commissioner Merrick suggested installing Botts dots or other traffic calming methods to alert motorists of areas prone to pedestrian crossing. In response to Public Works Commissioner Dittrich, Public Works Director Brager stated the speed for adjusting traffic signal timing between intersections for the PCH Signal Synchronization Project had not yet been determined but would allow more traffic to flow on PCH. Public Works Commissioner Dittrich commended Stantec for a great job identifying statistics. He asked if there was a significant difference in the number of cars parked on the inland side versus the ocean side. Mr. Merrill said there were few differences. Public Works Commissioner Dittrich stated he was surprised that the number of accidents did not increase near narrower lanes, but that increases were more based on time of day. He stated the City cannot lose parking spaces as it is visitor serving. He disagreed with losing parking spaces, even in remote areas. He stated the Public Works Commission had suggested slanted parking, rather than parallel parking, near Westward Beach. He discussed the impact of distracted driving on the number of collisions with parked cars or vehicles in the process of parking. In response to Public Works Commissioner Merrick, he suggested grooves in traffic lanes could also be considered to keep motorists alert. Mr. Miller discussed the impacts of noise and rumbling from

5 Page 5 of 8 grooves or Botts dots on nearby residents. He clarified that approximately 13 percent of all traffic collisions were related to parking or parking maneuvers, and 75 percent of those collisions involved parked vehicles being hit. Public Works Commissioner Dittrich asked about statistics in the number of traffic accidents related to narrower lanes. Mr. Miller stated most studies do not indicate significant variances in accidents in narrower lanes. He stated he had suggested to Caltrans in the past to at least try narrowing a small section of lanes for a period of time and re-evaluate the collision statistics after a given period of time to determine its success or failure. Public Works Commissioner Dittrich discussed higher number of accidents near Las Flores, one of the narrowest lanes in Malibu. He agreed with Public Works Commissioner Merrick that restaurant employees utilized a large number of street parking spaces. He asked if the City has identified how many business employees use public parking spaces. He suggested shuttling them, perhaps to City Hall, to increase public parking. Public Works Director Brager stated time restrictions for parking on Cross Creek Road had been successful in increasing parking turnover. Public Works Commissioner Dittrich agreed with adding pedestrian signage. Public Works Commission Vice Chair Grisanti agreed about the impact of distracted driving and unsafe turning across the highway. He suggested considering adding parking meters on PCH. He stated areas where motorists were willingto pay a citation should be changed to tow away zones or wheel boots should be used. He agreed with utilizing the right of way for retaining walls to open up parking near Winding Way and Paradise Cove. He discussed risks associated with large groups of cyclists riding in traffic lanes. He discussed unsafe crossing near El Matador Beach. He suggested shifting lanes to increase safe parking on the ocean side. Public Safety Commission Chair Randall stated she thought Caltrans did not like to use Botts dots. Mr. Kibe confirmed Caltrans equipment often removed them during maintenance: He stated he thought Botts dots were being phased out. Public Safety Commission Chair Randall discussed the problems at El Matador. In response to Public Safety Commission Chair Randall, Mr. Kibe discussed enhancements near Malibu Seafood included in the Caltrans median improvements project. Public Safety Commission Chair Randall discussed problems near Paradise Cove. She stated bus stop signage needs to be improved. She discussed problems with CCC. Mr. Kibe reported that 60 to 70 percent of the missing signs had been replaced. Public Safety Commission Chair Randall expressed concern about criticizing people who cross the highway. She discussed dense housing in the eastern section of town and the lack of parking in front of homes. She stated residents had little choice but to park on the inland side and cross to their homes. She stated visitors were not as educated about how to safely cross the highway.

6 Page 6 of 8 Public Safety Commission Vice Chair Frost discussed problems with crossing near Escondido. He stated pedestrians have to stop in the median area and are difficult to be seen by oncoming traffic. Public Works Commissioner Merrick discussed increasing problems in Solstice Canyon and Winding Way due to larger numbers of visitors due to a heavier social media presence. Public Works Commission Vice Chair Grisanti suggested most pedestrians killed on the highway were crossing to get to or from their parked vehicle. He agreed with Public Safety Commission Chair Randall that visitors were less likely to be a good judge of when it was safe to cross. Public Safety Commission Chair Randall discussed the need for improved street lighting on PCH. In response to Public Safety Commission Chair Randall, Lt. Royal stated approximately 30 to 35 pedestrian deaths in approximately the past 10 years were pedestrians crossing the highway in darkness. Public Works Commissioner Dittrich suggested adding signage near restaurants and other busy locations warning people about unsafe crossing. Public Works Director Brager stated the City could work with Caltrans about that type of signage. Public Safety Commission Chair Randall suggested the City work with restaurants to provide warnings for their customers. She stated lanes near her home were originally nine feet wide, but widening to 11 feet did not result in calming traffic. Mr. Miller stated changes to lane widths would have to be done prior to evaluating a reduction of the speed limit. In response to Public Safety Commission Chair Randall, Mr. Miller discussed statistics related to collisions near traffic signals. Public Works Commissioner Dittrich moved and Public Works Commissioner Merrick seconded a motion to request the City work with local restaurants an.d businesses located along PCH to post warnings for their customers about safely crossing the highway. The motion carried 9-0, Commissioner Addison absent. Public Works Commissioner Sidley moved and Public Works Commission Vice Chair Grisanti seconded a motion to support the PCH Parking Study Draft Final Report. FRIENDLY AMENDMENT Public Works Commissioner Merrick requested the motion be amended to include consideration of adding signage related to safe pedestrian crossing. The amendment was accepted by the mover and seconder. The question was called and the motion carried unanimously for the Public Works Commission. The motion failed for the Public Safety Commission, 2-2, Public Safety Commissioners Hanson and Wright dissenting, and Public Safety Commissioner Addison absent.

7 Page 7 of 8 Public Works Commissioner Dittrich moved and Public Works Commissioner Palmer seconded a motion to remove any reduced lane widths from the PCH Parking Study Draft Final Report. Mr. Kibe stated that before any changes would be approved for implementation, Caltrans would require that the City convince Caltrans that reducing lane widths would not make traffic safety worse. Public Works Commissioner Dittrich withdrew his motion. He requested the City Council be asked to be particularly careful before approving any lane width reductions. Public Works Commission Vice Chair Grisanti moved and Public Safety Commissioner Hanson seconded a motion to: 1) advise the City Council that the Public Safety Commission and Public Works Commission agreed to put forward the PCH Parking Study Draft Final Report to the Council with consternation about narrowing of lanes; and 2) request that the City Council look at that part of the study carefully and with extra diligence. The motion carried 8-1, Public Safety Commissioner Wright dissenting, Public Safety Commissioner Addison absent. Public Works Commissioner Dittrich reiterated his objection to losing any parking spaces. Public Works Commissioner Dittrich moved and Public Works Commissioner Palmer seconded a motion to request that the Consultant revisit the elimination of 675 net parking spaces and change the recommendation to eliminate only those parking spaces absolutely necessary for safety. Public Safety Commission Chair Randall stated the CCC and Caltrans would be reviewing the recommendations prior to implementation. She discussed parking spaces eliminated near Zuma Beach that were approved by the CCC in the past for safety reasons. Public Works Commission Vice Chair Grisanti stated the CCC might agree to a smaller number of eliminated spots if the original request was submitted for 675 spots. Public Safety Commission Chair Randall expressed concern that the CCC is concerned only with public access, not safety. The question was called. The motion failed, 2-7, Public Works Commission Vice Chair Grisanti and Commissioners Merrick and Sidley, and Public Safety Commission Chair Randall, Vice Chair Frost, Commissioners Hanson and Wright dissenting, and Public Safety Commissioner Addison absent. Lt. Royal stated Sheriffs Department personnel who work regularly in Malibu support the study but would like to see the El Matador area be made a priority.

8 Page 8 of 8 Public Safety Commission Vice Chair Frost agreed that El Matador is very important. He added that he would be cautious about taking emphasis away from other areas, such as the Corral Canyon area. Public Safety Commissioner Wright moved and Public Works Commission Vice Chair Grisanti seconded a motion to have Zone A listed as the highest priority area due to its high fatality and collision rates and the recommendation from the Los Angeles County Sheriff s Department. FRIENDLY AMENDMENT Public Safety Commission Chair Randall requested the motion be amended to replace Zone A with the area around El Matador State Beach within Zone A. The amendment was accepted by the maker and seconder. ADJOURNMENT Public Works Commissioner Dittrich suggested additional signage be added for El Matador. The question was called, and the motion carried 9-0, Public Safety Commissioner Addison absent. At 9:18 p.m., Public Works Commissioner Merrick moved and Public Safety Commission Vice Chair Frost seconded a motion to adjourn. The motion carried 9-0, Commissioner Addison absent.
