In addition to the normal business, this is always a great opportunity to interact with the legislators in Michigan. On Tuesday night, we were accompanied by State Senators Tom Casperson and Darwin Booher as well as MI Representatives Ed McBroom and Triston Cole for dinner. Discussion was lively, and I am certain that we could have solved most of the issues that evening given the chance. One interesting side aspect for me was the opportunity to see how they haul firewood in the UP, or at least how they do in the Casperson family. You will have to ask Tom to see the picture for yourself, but suffice to say you will make fewer trips this way although your vehicles won t last as long. A last minute opportunity that came out of this visit and the exceptional timing thereof was for Gary Halpin and me to testify before the Senate Committee Hearing on Senate Bill No. 39 and No. 40. Both bills have to do with the purchase of new and use of existing DNR owned lands in Michigan. While I m always willing to participate in the legislative process, ideally it would have been nice to have more than one day s notice, even less notice for Gary. However the bills are sponsored by both Casperson and Booher and the contents are important to the industry. While reviewing some information for the hearing, we put together some statistical comparisons between Wisconsin and Michigan that I would like to share with you. The comparison is interesting and I feel tells a story about the impact of land management practices. Michigan and Wisconsin are roughly equivalent in total land mass at 36 and 35 million acres respectively. Of that total, Michigan has 4 million acres of state owned forest land while Wisconsin has 3.3 million acres of state and county owned forest land. Now here is the interesting part, Michigan harvests around 60 thousand acres annually of that forest land while Wisconsin harvests around 75 thousand acres annually. So, while Michigan has approximately 21% more forest land, it harvests approximately 20% less of it. This reduction in harvest clearly has an impact on forest products related jobs. Not including pulp and paper, Michigan creates around 8,600 forestry related jobs, ranked 19 th in the country. Wisconsin, on the other hand, creates around 17,500 jobs, ranked 4 th in the nation. That s a comparison that certainly got the attention of the members of the senate committee. This shows you the real world impact of legislative policy. 3 3 THE MICHIGAN REPORT By Scott Everett, LSLA Michigan Legislative Consultant LSLA BOARD OF DIRECTORS, LANSING: On May 18, the LSLA Board of Directors met in Lansing which has now officially become a tradition. The month of May means the LSLA Board travels to Michigan... nothing to do with Indy. For LSLA Board members, (which is most of the Board) traveling from Wisconsin, as the crow flies, isn't really that far given they are next door with a pond in-between. But, as you know... it's a very difficult and long trip but Michigan sure appreciates it. LSLA Board members meeting in Lansing, MI It says a lot when Wisconsin LSLA Board Members take the time away from their family and businesses to travel all the way here to engage for a few hours on issues important to the Michigan timber business. It's a commitment that not everyone is willing to make, but that is what the LSLA organization is all about, and if meeting once a year in Michigan can help, they are willing to take the time to do it. Especially this year, attribute it to luck or talent, the LSLA Board was massively helpful in a number of important policy issues on behalf of Michigan members. Next May, all Michigan LSLA members should attend the LSLA Board meeting in Lansing to see first-hand what this is all about. SB SB 39 and 40 (Casperson, Escanaba and Booher, Evart) introduced in January 2015, this bills proposes new and different ways in how the State of Michigan manages the 4.6 million acres that it owns. A lot of issues within the bill, everything from how much land the State of Michigan should own; how much timber should be cut and where and how and where land should be preserved to do nothing on it. (not allowing for things like motorized access or timbering) At the first Senate Natural Resources Committee meeting, a very heated exchange between those favoring and those opposing (including the MDNR) the bills took place. At the second hearing, it was John Buford and his cavalry arriving in Gettysburg the LSLA Board was in town for their Michigan Board Meeting. LSLA President Gus Welter and Board Member Gary Halpin took the testimony table and explained to the Senators many things including; the economic and environmental importance of the state managing land properly; the great value the timber industry has in that it's a sustainable, on-going resource if managed properly; and they presented some numbers comparing Wisconsin to Michigan, which shows Michigan could do a lot better job in managing its timber resources. LSLA supports SB 39 and 40, when it comes to Michigan's "Natural Resources", there are few other things more important as the State of Michigan properly managing their 4 million acres of timber resources. The legislation remains in the Senate Natural Resources Committee and that is where it's going to stay for the summer. LSLA Board Member Gary Halpin (L) and LSLA President Gus Welter (R) testify favoring SB 39 and 40 before the Senate Natural Resources Committee on May 18 ROAD COMMISSION PERMITS: SB 702, 706, 707, 708 (Casperson, Escanaba) Prevents local road commissions from denying or creating unreasonable payments/demands/permits upon those harvesting timber and using roads/driveways to do so. Some wood processors/loggers apparently are being held hostage by road commissioners in some counties. Discussions continue on this package. WORKERS COMPENSATION: HB 5506 (Goike, Ray Township) Requires workers at a company that process wood products in a sawmill or pallet facility where 3 or more workers are employed to be covered by worker s compensation. The bill remains in the House Commerce Committee.

4 4 THE WISCONSIN REPORT By Gunnar Bergersen, LSLA Wisconsin Legislative Consultant Don't Expect Future Changes in MFL The last issue of The Log included a summary of the provisions of the Managed Forest Law streamlining bill (SB-434) which cleared the legislature after about a decade of wrangling. There was a part of the bill which gave a MFL landowner the option to leave the program without penalty, if the legislature passed a future amendment to the MFL program considered a material change. The "material change out" also applies to any administrative rules from the DNR. With the final language in hand, the LSLA Board was concerned that a MFL land owner could game the system by taking advantage of the tax breaks for a number of years, and when it came time for a planned harvest, could look for and cite any material change which may have occurred and drop off the program without providing a single fiber of wood. Providing a sustainable wood supply to Wisconsin industry was the primary intent of the program. LSLA petitioned the Governor to veto the material change withdrawal feature from the bill. The Governor's staff then sought further clarification on legislative intent and likely DNR administration of that portion of the law change. The result of the Gubernatorial inquiry was the legislature and the DNR clearly understand that future material changes to the MFL law could be costly to the intent of the program and very unlikely. With assurances from the legislature not to tinker with the law in the future, the governor declined to veto and signed the bill into law. With SB-434 now law, the MFL tax program morphs into a long term contract with landowners. It had previously been a tax law subject to multiple changes over the years. The most notable and controversial change to the tax law was the midnight budget provision eliminating leasing of MFL forest lands for hunting. This occurred under the Doyle administration and MFL program land owners howled. It was the MFL landowners who pressed for and got the material change language ostensibly giving them a contract. Did LSLA's veto request do any good? I'd say it did because the Governor's office, the legislature and the DNR are now all on notice to the potential cost of any future material change to the MFL program. Continued on page 10

5 5 LSLA EDUCATION: CAREERS VIDEO By Collin Buntrock, DNR Forest Products Services Program Progress Being Made on Careers Video The LSLA Education Board in cooperation with the North Central Tech film production program is in the later stages of completing a workforce development video highlighting career opportunities in the primary and secondary hardwood manufacturing sector. Several LSLA member companies were gracious enough to allow the video crew to capture footage of their employees hard at work demonstrating the many rewarding opportunities across the industry. The Board and the film crew would like to thank those involved in making this video a reality. Once completed, the video will be posted on YouTube and linked to the LSLA website where it can be accessed by anyone interested in promoting job opportunities in the sector. It will also be distributed to high school guidance counselors and industrial technology instructors for them to share with their students. Please keep an eye out for this video in the coming months. 6 6 NATIONAL FORESTS; HARDWOOD FEDERATION By Dick Krawze Pine River Lumber Co & LSLA Representative to the Hardwood Federation I am taking this opportunity to thank WI Senator Ron Johnson for touring a Stewardship Contract site on the Chequamegon-Nicolet National Forest near Wabeno, WI on Monday May 2, As a result of Senator Johnson s efforts with other Legislators, we are moving in the right direction on the CNNF lands. As a strong supporter of healthy forests, it is encouraging to see more locally-grown wood harvested on the CNNF through programs like Stewardship Contracting and the Good Neighbor Authority (GNA). GNA has promised to increase harvest to levels not seen for over twenty years. Approximately five years ago we were harvesting approximately 58 million board feet per year and by the end of this year that figure will approach 110 million board feet. School administrators joined us on the tour to emphasize how important the jobs and National Forest income are for keeping our schools viable. Plus, it is so important to support our tourism businesses that depend on sportsmen visiting the 1.6 million acre National Forest. Without timber harvest, game populations including songbirds and ruffed grouse decline in numbers. While much more work needs to be done on our National Forest lands, Senator Johnson is right that the U.S. Forest Service, State and Local Government officials should be commended for working together to benefit the Northwoods of Wisconsin, the State and the Nation. In addition, 2016 is becoming probably the most important election year that any living American of voting age will see in his or her lifetime. I m positive by now most of us are tired of hearing the daily bashing of our Candidates for both State and Federal Office on both sides of the aisle. However, it is critical for the future of this Nation that we elect those who truly have the interest and ability to correct the past mistakes and at the same time set a course for the future of all. I would again like to appeal to LSLA Membership for support of the Hardwood Federation. As many readers of The Log know, Lake States Lumber Association is a long time member of the Hardwood Federation, our representatives in Washington, D.C. The Federation monitors legislative issues that will impact our industry and lobbies Congress, the Administration and U.S. agencies and departments on behalf of all U.S. hardwood businesses, including those in the Lake States region. They are your eyes and ears in Washington D.C. The Federation works hard to maintain a healthy business environment for our industry, but they cannot do it without the necessary financial support from the industry. As a proud member of the Hardwood Federation Board, I am asking you to consider making a financial commitment to the Federation to support the fine work they do. There are two ways to support the Hardwood Federation. The DNR will need to develop administrative rules to define what is and what is not a material change. LSLA will want to stay on top of the rule making process which is a multistep procedure. Comments will be solicited, rules drafted and hearings held cumulating in a hearing before the legislative Joint Committee for Review of Administrative Rules. The committee is chaired by Senator Steve Nass, Whitewater and Joan Ballweg, Markesan. Former LSLA President Scott Sawle raised a question about how material change language could potentially be used in cases where a MFL management plan might be silent on a method or timing of a harvest. Clear cutting aspen is how the species propagates. However, a land owner might claim that clear cutting was not a part of his management plan. If the DNR were to order clear cut of aspen could the landowner claim the order to be a material change and withdraw from the program? DNR's Silvicultural handbook covers the aspen management practices and is the basis for land owner compliance orders. As a result of SB-434, DNR will review its administrative rules and clarify that adherence to the Silvicultural Hand book cannot be used as a basis to claim political process. As we move through this election year, don t forget those elected officials that have or will represent your interests. Support them through the campaign process and certainly support them at the ballot box in November. If you are not a part of the process, you become part of the problem since there will always be those that oppose what we do. However, if you make your voice heard, you can become part of the solution. This concluded our business in Lansing, but not our day. Certainly most of us had a number of miles to travel, but not before stopping over at Scott Everett s little blue house on the square. While this gave us a chance to reflect on our day s meetings, more importantly, it was a chance to meet Scott s family and thank him for hosting such a great meeting. With a little less travel commitment, sitting on his front porch with a cold beverage would have been a perfect way to celebrate the day. When last we caught up with David B, he was hanging out in Senator Tom Casperson s office in Lansing, MI. It appears that David B is making his presence known among the powers-that-be in Lansing and is throwing his weight around on various legislation. Here is he is consulting with Senator Casperson on an important policy matter.
