4 TERMS AND CONDITIONS FOR SUPPLY OF SPORTS KIT ITEMS FOR TRAINESS 1. The word Rate Contract for supply of sports kit for the year should be super scribed on the top left corner of the envelope bearing the name & address of the tenderer. The Tender shall be deposited in one envelope (containing 03 separately sealed envelopes) as given below, in the tender box placed in the office of the Regional Director, Regional Centre Guwahati, New Field Sports Complex, Md. Shah Road, Palton Bazar, Guwahati (Assam). Earnest money as per details given in Annexure V, in the form of Demand Draft issued by Bank in favor of the Regional Director, Sports Authority of India, Regional Centre, payable at Guwahati, (to be submitted in Envelope A ). Cheques will not be accepted and the bid will be rejected. A. Tender document completed in all respect duly signed by the tenderer, alongwith the list of sample(s) of each sports kit items having name of tenderer/brand as per Performa at Annexure II should be submitted to SAI (Envelope B). B. The rates quoted for each item/ brand as per Proforma at Annexure - IV to be submitted in (Envelope C ). The technical bid of the bidders will be opened first and the financial bid will be opened only of those bidders whose technical bid shall be accepted by the competent authority. 2. Bids received without Earnest Money, samples of quoted items, conditional or incomplete is liable to be rejected. 3. The rates / commercial / technical offer / firm will remain valid for one year from the date of finalization of the tender. 4. All tenderers are required to mention the name of firm and brand name on each sample (discipline wise) be kept in polythene pack and submitted in a sealed bag / box which will be opened and counted in front of tenderers along with technical bid. 5. The tenders received without the above will summarily rejected. 6. All kit items must have SAI Logo & name of SAI, Regional Center Guwahati screen-printed on them. 7. The Bidders are required to submit sample(s) for all the quoted items alongwith technical bid. 4

5 8. The Bidders are requested to submit maximum two sample of each item for selection of best sample. 9. The quantity and size of each item will be decided by the Regional Director, SAI, Regional Center, Guwahati. 10. The tentative requirement & technical specifications of different sports kit items is given at Annexure-I. 11. In case of doubt in material, supplied by the firm/ Tenderer the expenditure on testing of material will be born by the tenderer. 12. If even after approval information / facts submitted by the tenderer are found misleading/ incorrect etc., SAI reserves the right to reject the item (s) for the current / future. 13. Interest free security money equivalent to 10% of the total value of the supply order will be deposited by the successful bidder within a week. Security Money will be refunded after expiry of the six month from the date of supply if no complaints are received during this period and after completion of all contractual obligations. 14. EMD to the unsuccessful bidder will be refunded after finalization of the contract. 15. Rates of all the kit items (General Kits and Competition Kits ) should be quoted within authorized amount of Rs.5000/- per head. Competitive rates should be (inclusive of taxes/vat and freight). F.O.R at SAI, Regional Centre, Guwahati, New Field Sports Complex, Md. Shah Road, Palton Bazar, Guwahati (Assam). 16 Material indented for shall be supplied within 30 days from the date of issue of supply order. 17. Subject to the provision of Force Majeure under GCC clause 19, if the supplier fails to deliver any or all the goods or fails to perform the services within the time frame(s) incorporated in the contract, the purchaser shall, without prejudice to other rights and remedies available to the purchaser under the contract deduct from the contract price, as liquidated damages, a sum equivalent to 0.5% per week of delay or part thereof on delayed supply of goods and /or services until actual delivery or performance subject to a maximum of 10% of the contract price 18. The Regional Director, SAI, Center, Guwahati will be legally competent to cancel the tender in case the supplier is ever found to have committed any fraud against supply of material or indulge in any malpractices thereof causing any financial losses during the contract period. 5

6 19. The contract can be terminated or cancelled summarily by SAI in whole or in part any time without assigning any reason, if the supply made by the manufacturer/ supplier is not found according to the sample approved. 20. The successful tenderers will give an affidavit certifying that the quality and brand of goods quoted in the tender are correct and as per specification (Annexure III). 21. SAI taking into account past performance of party, reserves the right to reject any tender. 22. In case any dispute arises in regard to the tender, the decision of the Regional Director, Regional Centre Guwahati will be final and binding. 23. In case of litigation, the courts at Guwahati only will have jurisdiction for deciding case according to Indian law in force. 24. It must be noted that this is just an enquiry and does not amount to any Commitment on the part of Sports Authority of India to order any or all products offered. The decision of Sports Authority of India in this regard would be final and be entirely, at its discretion. 25. The purchaser, without prejudice to any other contractual rights and remedies available to it ( the purchaser), may, by written notice of default sent to the supplier, terminate the contract in whole or in part, if the supplier fails to perform any other contractual obligation(s).
