1 LAPEER COMMUNITY SCHOOLS BID PROJECT: District Athletic Uniforms-Winter and Spring (#15-2) SUBMISSION OF BIDS: INSTRUCTIONS TO BIDDERS Sealed bids will be received until 9:00 AM, EST on Friday, October 3, 2014 at the Lapeer Community Schools, 250 Second Street, Lapeer, MI 48446, at which time they will be publicly opened and read aloud. 1) Bids must be enclosed in a sealed envelope marked with the name of the bidder, the name of the bid project and the date and time due. They must be delivered by the date and time stated above to: Lapeer Community Schools Mary Rundell 250 Second Street Lapeer, MI ) Please use the attached Bid form for your bid submission. Bid forms must be fully filled out in ink or typewritten, with signature in longhand. Completed forms shall be without alterations or erasures. 3) Any bid may be withdrawn at any time prior to the scheduled time and date for the receipt of bids. Bids received after the specified time and date will be returned unopened. The bidder assumes the risk of any delay in the mail or in the handling of the mail by employees of the school district. Whether sent by mail or by means of personal delivery, the bidder assumes responsibility for having its bid deposited on time at the place specified. 4) Bids shall be made in full conformity with all the conditions set forth in the instructions and specifications. Bids shall remain valid for a period of 60 days from bid opening. 5) Questions concerning the bid specifications should be directed in writing to Mary Rundell at mrundell@lapeerschools.org. PRODUCT SPECIFICATIONS: Item descriptions and specifications are outlined on Attachment C. Additional specifications, such as: Logo, size, font, position, etc., will be discussed with the winning bidder and sample illustrations will be requested for each type of uniform prior to approving and placing the actual order. TAXES: Each bid shall include and the successful bidder shall pay any and all applicable taxes. 1

2 DELIVERY/SHIPPING: Bid price shall include delivery/shipping to Lapeer Community Schools, Administrative & Services Center, 250 Second Street, Lapeer, MI by a date to be later determined. In the case of damaged shipment, it shall be the responsibility of the receiver to make an appropriate written notice when signing the carrier documents. The receiver shall inventory the damage and advise the uniform manufacturer in detail. ERRORS/OMISSIONS/DISCREPANCIES: In the event of a discrepancy between the unit price bid and the extension, the unit price shall govern. Bidder shall not be allowed to take advantage of errors, omissions, or discrepancies in the specifications. QUALIFICATIONS OF BIDDER: ADDENDA: Any bidder may be required to furnish financial references during the bid review and evaluation process. Any verbal information obtained from or statements made by any representative of the school district shall not be construed as in any way amending the attached instructions, specifications, or documents. Only such corrections or addenda as are in writing to all bidders shall become a part of instructions, specifications or documents. Make reference to any such written addenda on the Bid Proposal Form. AWARD OF BIDS: The Board of Education reserves the right to accept or reject any or all bids, to award to other than low bidder, to award by item, group of items, or total bid, to waive irregularities and/or informalities, to negotiate with any or all of the bidders, and in general to make the award in any manner deemed by it, in its sole discretion, to be in the best interests of the School District. IRAN ECONOMIC SANCTIONS ACT CERTIFICATE OF COMPLIANCE All bids must be accompanied by a signed Certificate of Compliance in conformance with the Iran Economic Sanctions Act MCL (P.A.517 of 2012). 3 CERTIFICATION OF COMPLIANCE IRAN ECONOMIC SANCTIONS ACT Michigan Public Act No. 517 of 2012 The undersigned, the owner, or authorized officer of the below-named company (the Company ), pursuant to the compliance certification requirement provided in the Lapeer Community School District s Request For Proposal (the RFP ), hereby certifies, represents, and warrants that the Company (which includes its officers, directors and employees) is not an Iran Linked Business within the meaning of the Iran Economic Sanctions Act, Michigan Public Act No. 517 of 2012 (the Act ), and that in the event the Company is awarded a contract by the Lapeer Community Schools District as a result of the aforementioned RFP, the Company is not and will not become an Iran Linked Business at any time during the course of performing any services under the contract. The Company further acknowledges that any person who is found to have submitted a false certification is responsible for a civil penalty of not more than $250, or two (2) times the amount of the contract or proposed contract for which the false certification was made, whichever is greater, the cost of the Lapeer Community School District s investigation, and reasonable attorney fees, in addition to the fine. Moreover, any person who submitted a false certification shall be ineligible to bid on a request for proposal for three (3) years from the date the it is determined that the person has submitted the false certification.
