1 Highway Committee MINUTES OF MEETING October 1, 2018 Meeting of the Highway Standing Committee of the Chemung County Legislature Minutes of a meeting of the Highway Committee of the Chemung County Legislature held in the Legislative Chambers, 5 th Floor, Hazlett Building, 203 Lake Street, Elmira, New York on Monday, October 1, 2018 Members and officials present: John Pastrick, David Manchester, L. The Commissioner provided the Legislators with a written update. Mr. Collins asked for an update on the emergency repairs to Dry Run Road. Mr. Avery stated that the repairs are complicated and involve the replacement of two major culverts. The boxes for one of the culverts were set last week. NYSEG needs to move some power lines before the other box can be set. Mr. Avery is hopeful that the work will be completed in four to five weeks. Mr. Avery stated that the County is responsible to pay for damages to county roads caused by the recent storm. Other highway projects will be deferred and/or fund balance will be used to cover the expense of repairs. He noted that even if the county is awarded disaster assistance the money may not be received for years. Mr. Miller asked about repairs to Christian Hollow Road. Mr. Avery stated that the work there is complicated by private repairs that need to be done before the County can finish the necessary repairs. Mr. Miller raised concerns regarding the use of oil and stone on county roads. Mr. Avery stated that Chip Seal (oil and stone) is a common maintenance practice that is used to extend pavement life. It provides a good driving surface at a very low cost, about one fourth to one fifth the cost of a conventional asphalt overlay. Chip Seal surfaces are generally used on less traveled routes with open drainage systems. Mr. Avery will provide a Chip Seal fact sheet to the Legislators. Mr. Brennan asked if the work being done on the Sing Sing retention pond could be completed on a more timely basis. Mr. Avery stated that the work is being done by the Chemung County Soil and Water Conservation District as their work schedule allows. Mr. Miller asked what the criteria was for the Webb Mills Fire Department receiving grant funding for the paving of their parking lot and truck platform areas. Mr. Krusen stated that the Town of Southport had approached the county seeking help with the paving project for the Webb Mills Fire Department. The county encouraged them to apply for Dormitory Authority of the State of New York ("DASNY") funding, noting that other fire departments have been able to purchase equipment through DASNY funding awards. Mr. Avery stated that the funding from DASNY will pay the cost of the materials and the labor will be provided by the Town of Southport and Chemung County. There will be no outlay of cost for the county other than the in-kind service ($49,100). The grant is being administered by the Town of Southport, Mr. Avery noted. Motion made by Rodney Strange, seconded by David Manchester, and Passed with a vote of 6-0, authorizing Intermunicipal Agreement between the Town of Southport, Webb Mills Volunteer Fire Department, and

Motion made by Joseph Brennan, seconded by David Manchester, and Passed with a vote of 6-0, approving Supplemental Agreement #3 with the New York State Department of Transportation on behalf of the Chemung County Department of Public Works (PIN Horseheads Connector Road). Motion made by Joseph Brennan, seconded by Richard Madl, and Passed with a vote of 6-0, authorizing agreement with the New York State Department of Transportation on behalf of the Chemung County Department of Public Works (PIN Connector Road Levee Project). Motion made by Rodney Strange, seconded by Richard Madl, and Passed with a vote of 6-0, awarding bids for Supply of Tires and Related Services on behalf of the Chemung County Purchasing Department. The meeting was adjourned on the motion by Mr. Brennan, seconded by Mr. Manchester. Motion carried.

12 CHEMUNG COUNTY ROUTE SLIP * PERSONNEL REQUISITION Resolution authorizing Intermunicipal Agreement between the Town of Southport, Webb Mills Volunteer Fire Department, and Chemung County Resolution #: 01 Slip Type: CONTRACT SEQRA status State Mandated False Explain action needed or Position requested (justification): This agenda item respectfully requests Legislative review and approval of an IMA between the Town of Southport, Webb Mills Fire Department, and Chemung County. This IMA is for the paving of the Webb Mills Fire Department's asphalt parking lots and truck platform areas. Materials for the project will be paid through a New York State "SAM" grant; the labor will be provided by the Town of Southport and Chemung County. Estimated materials are $86,300, including a 15% contingency. The value of the in-kind services is estimated at $49,100. Any contracted services will be billed to the Webb Mills Volunteer Fire Department, per the attached IMA agreement. Also see the attached estimate, prepared by the County DPW. The Town of Southport is the recipient of the SAM funds, and will administer the grant. The Chemung County DPW will provide assistance as needed. Other than in-kind services, there will be no outlay of County funds at the conclusion of the project (and any required reimbursement from the Webb Mills Fire Department.) 29 SAMPLE RESOLUTION BY MUNICIPALITY (Locally Administered Project) RESOLUTION NUMBER: Authorizing the implementation, and funding in the first instance 100% of the federal-aid and State "Marchiselli" Program-aid eligible costs, of a transportation federal-aid project, and appropriating funds therefore. WHEREAS, a Project for the Horseheads Center NY 13 Connector Road, in the Town and Village of Horseheads, County of Chemung, P.I.N (the Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of 100% Federal funds (20% via Toll Credits), and; WHEREAS, the County of Chemung desires to advance the Project by making a commitment of 100% of the nonfederal share of the costs of the Horseheads Center NY 13 Connector Road, in the Town and Village of Horseheads, County of Chemung. NOW, THEREFORE, the Chemung County Legislative Board, duly convened does hereby RESOLVE, that the Chemung County Legislative Board hereby approves the above-subject project; and it is hereby further RESOLVED, that the Chemung County Legislative Board hereby authorizes the County of Chemung to pay in the first instance 100% of the federal and non-federal share of the cost of Design, Right of Way Incidentals, and Acquisition Phase work for the Project or portions thereof; and it is further RESOLVED, that the sum of $3,295,000 is hereby appropriated from [or, appropriated pursuant to ] and made available to cover the cost of participation in the above phase of the Project; and it is further RESOLVED, that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the County of Chemung shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the New York State Department of Transportation thereof, and it is further RESOLVED, that the Chairperson of the Chemung County Legislative Board of the County of Chemung be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or Marchiselli Aid on behalf of the County of Chemung with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, and it is further RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement connected with the Project, and it is further RESOLVED, this Resolution shall take effect immediately Item # 2

30 CHEMUNG COUNTY ROUTE SLIP * PERSONNEL REQUISITION Resolution approving Supplemental Agreement #3 with the New York State Department of Transportation on behalf of the Chemung County Department of Public Works (PIN Horseheads Connector Road) Resolution #: 02 Slip Type: CONTRACT SEQRA status State Mandated False Explain action needed or Position requested (justification): This agenda item respectfully requests the Legislature review and approve Supplemental Agreement #3 with NYSDOT for the Horseheads Connector Road Project. This supplemental agreement amends the previous agreement by adding the Right-of-Way Acquisition funding for the road and bridge portion, and adjusting the current funding due to the remaining levee design & ROW work being funded from a separate State source. This agreement increases the ROW funding from $218,000 to $2,013,000, and reduces the design funding from $1,462,000 to $1,282,00, however, the total funding for the overall road, bridge and levee project will remain unchanged. The road and bridge portion of the project is Federal funded, the levee portion is State funded and will be under a separate PIN ( ), and there is no local share for any of the project. The main objective of the Connector Road Project is to build a new connector road between State Route 13 and the HOST industrial facility on Old Ithaca Road in Horseheads. In order to build this new road over Newtown Creek and the existing Newtown Creek levee, the levee needs to be rehabilitated and certified. Our consultant, Erdman Anthony, is currently working on final design for the project and our ROW sub consultant, RK Hite, is performing ROW incidental work. The project is scheduled for levee construction and certification in 2019, although the current schedule is very aggressive. 68 CHEMUNG COUNTY ROUTE SLIP * PERSONNEL REQUISITION Resolution authorizing agreement with the New York State Department of Transportation on behalf of the Chemung County Department of Public Works (PIN Connector Road Levee Project) Resolution #: 03 Slip Type: CONTRACT SEQRA status State Mandated False Explain action needed or Position requested (justification): This agenda item respectfully requests the Legislature review and authorize a State-Local Agreement with NYSDOT for the levee portion of the HOST Connector Road Project. The main objective of the Connector Road Project is to build a new connector road between State Route 13 and the HOST industrial facility on Old Ithaca Road in Horseheads. In order to build this new road over Newtown Creek and the existing Newtown Creek levee, the levee needs to be rehabilitated and certified. Since the restart of the HOST Connector Project (PIN ), the project team, led by DPW and our consultant, Erdman Anthony, has progressed through the preliminary design and ROW incidental phases. At this time, it has been determined by NYSDOT and FHWA the remaining work needed to certify the Newtown levee will be paid with State funds. This State-Local Agreement assigns a new PIN ( ) to the levee portion of the project, and allocates funds for Final Design and ROW Acquisition of the levee only. The State funding, $180,000 for Final Design and $185,000 for ROW, is replacing the previously allocated Federal funding, and not increasing the overall Connector Road Project budget.
