2 File ID: Consent Item 09 Description/Analysis Issue Detail: The City of Sacramento (City) is required to video inspect pipe penetrations for all pipes within State levees on a minimum 5-year interval, as required in the California Department of Water Resources (DWR) s Urban Levee Design Criteria. Through DWR s Deferred Maintenance Project Phase 1 Evaluation of Levee Penetrations grant program, the City and ARFCD both received separate grants for cleaning and inspecting penetrations within their levee maintenance jurisdictions. Approximately 19 City-owned pipe penetrations are located within ARFCD s jurisdiction. Both the City and ARFCD believe it would be in their best interest, as well as the public s, for the City to administer the cleaning and inspection of these pipes. The City has already entered into an agreement with APS Environmental (C ) to perform inspections within the City s jurisdiction. Upon the authorization of this MOU, the City would execute a supplemental agreement with APS Environmental to include the additional pipes within ARFCD s jurisdiction. The purpose of this MOU is to memorialize the understanding of the parties with respect to ARFCD s reimbursement of costs for cleaning and inspecting City pipes in their jurisdiction. ARFCD will, in turn, be reimbursed for these costs through their DWR grant. Policy Considerations: ARFCD, and the City, are required to perform these inspections under state law. Council approval is required for all City MOUs with outside agencies. Economic Impacts: None. Environmental Considerations: The proposed cleaning and inspection of the existing pipes has been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section Section consists of projects that include the operation and maintenance (inspecting and cleaning) of existing structures, facilities, and mechanical equipment (pipes) involving negligible or no expansion of use beyond that existing at the time of the lead agency s determination. Sustainability: The proposed project is consistent with the 2035 General Plan, goal EC 2.1 Flood Protection as it, verifies the structural integrity of levee penetrations which will improves overall infrastructure reliability. 3 File ID: Consent Item 09 Rationale for Recommendation: Levee maintenance jurisdictions, including ARFCD and the City, are required by DWR to inspect pipe penetrations through levees. Because the City owns some of the penetrations in ARFCD s jurisdiction, and has existing records of them, the City s floodplain management staff believes the City should conduct the inspections, and then be reimbursed for the work by the ARFCD. Financial Considerations: The cost of cleaning and inspection of the penetrations is estimated to be $24,600 and the administration costs are estimated to be $2,500. The proposed MOU is for a total project cost not-to-exceed $27,100. The costs associated with this MOU will be reimbursed to the City through ARFCD. Staff is recommending a budget allocation of $27,100 for revenue and expense budgets, for this MOU, in the SAFCA Levee Maintenance Project (I , Fund 6211). There are no General Funds allocated or planned for this project. Local Business Enterprise (LBE): LBE participation will be included in any professional services agreements administered by the City. 85 RESOLUTION NO Adopted by the Sacramento City Council November 13, 2018 Memorandum of Understanding: Reimbursement of Costs from the American River Flood Control District (ARFCD) for the Phase 1 Evaluation of Levee Penetrations, BACKGROUND A. The City and ARFCD both received grants from California Department of Water Resources (DWR) for cleaning and inspecting penetrations within the areas where they maintain State Plan of Flood Control Levees. These grants are called Deferred Maintenance Project Phase 1 Evaluation of Levee Penetrations (DWR grant). B. Approximately 19 City-owned pipe penetrations are within ARFCD s jurisdiction. Both the City and ARFCD believe it would be in their best interest, as well as the public s, for the City to administer the cleaning and inspection of pipes within ARFCD s jurisdiction and be reimbursed by ARFCD. ARFCD will be reimbursed through its DWR grant. BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS: Section 1. Section 2. Authorize the City Manager or the City Manager's designee to execute a Memorandum of Understanding with ARFCD for inspection of city-owned pipes in ARFCD s jurisdiction, in an amount not-to-exceed $27,100.
