School capacity mitigation for grades K-5 has been met through the conveyance and construction of Flora Ridge Elementary School. An increase in residential density from the approved approved 2,341 single family and 1,670 multi-family dwelling units within the adopted City of Kissimmee Comprehensive Plan could potentially result in additional students which may impact whether or not permanent student stations are available to accommodate the students within the EFBD. Any increased residential density resulting in additional school capacity impacts is subject to further negotiation and mitigation with the School District. The School District maintains its rights and entitlement consistent with applicable law and ordinances to collect school impact fees for all residential development within the Tapestry Development. School District records currently indicate that 1,098 residential dwelling units have been constructed at the time these comments have been submitted. Kissimmee Middle School is currently utilizing ten (10) relocatables on site to accommodate its existing enrollment. 10 THE SCHOOL DISTRICT OF OSCEOLA COUNTY, FLORIDA PLANNING SERVICES DEPARTMENT SCHOOL CAPACITY REPORT - THREE YEAR OUTLOOK Date: 5/1/18 SDOC #: 2017/ Jurisdiction: Kissimmee DRC #: Comments cont. Osceola High School is approaching capacity and is currently utilizing twenty-two (22) relocatables on site to accommodate its existing enrollment. Based on the approved 5-Year Capital Improvement Plan a new high school is planned to open in the 2018/2019 school year and may provide relief to Osceola High School. Flora Ridge Elementary School, Kissimmee Middle School and Osceola High School are projected NOT to have capacity to serve the potential students generated through school year 2019/2020. Flora Ridge Elementary School will be redistricted to accommodate the additional students generated by this development within the Flora Ridge Educational Facilities Benefit District. School impacts are based on 788 multi-family dwelling units. The development application does not provide a breakdown of the type of units being proposed. A more accurate School Capacity Report can be generated with the submittal of a detailed site development plan application which indicates the actual number of dwelling units and type of units being developed on the property. This report is provided as a planning tool for use by the public and reflects the DOE COFTE, projected enrollment, school capacities and includes the potential number of students generated from previously approved residential developments located within the impacted schools' attendance boundaries. To qualify for a School Impact Fee Exemption, the residential facility must provide 24 hour a day medical care as outlined in County Ordinance , Sec 24-2 definitions. If not, the applicant may apply for a Housing for Older Persons Application (HOPA). Please Note: To obtain an exemption from the payment of Educational System Impact Fees, an application for a Housing for Older Persons Impact Fee Exemption must be submitted to the Superintendent of Schools for the School District of Osceola County, Florida ( SDOC ) prior to receiving a building permit. No such Application has been submitted to SDOC; therefore, the potential development would not be entitled to an exemption from Educational System Impact Fees at this time. If the developer intends for the development to be age-restricted, then it must comply with the requirements of Chapter 24, Article III, Educational System Impact Fees, Osceola County Code of Ordinances (the Impact Fee Ordinance ). Specifically, in order to receive consideration for the exemption, the developer must record a declaration of covenants and deed restrictions that run with the land, cannot be revoked or amended for at least 30 years from recording, and prohibit any person under the age of 18 years of age from residing within any dwelling unit within the development as a permanent resident. Until such time that an approved Impact Fee Exemption is on file, school impact fees will be collected at the time of Certificate of Occupancy. Upon submission and approval of the Developer s Application for an impact fee exemption, SDOC will update its analysis to reflect no impact to school capacity, and will exempt the proposed age-restricted development identified in the application from the collection of Educational System Impact Fees.
