1 29 THE CORPORATION OF THE CITY OF CRANBROOK BYLAW NO A Bylaw governing the management, maintenance, improvement, operation, control and fee structures for the use of any property held by the City within or without the Municipality, for pleasure, recreation or community uses of the Public, including parks, arenas and swimming pools.... WHEREAS the Municipal Council may make rules and regulations for the use and operation of all Municipally owned parks, recreation facilities, and programmes, and the fees for admission to or for the use thereof, or for programme participation; NOW THEREFORE the Mun i cipal Council of The Corporation of the City of Cranbrook, in open meeting assembled, enacts as follows: 1. This Bylaw may be cited as the "Parks & Recreation Regulation Bylaw, 1979". 2. Within Council policy, the Superintendent of Parks & Recreation shall be responsible for the management, maintenance, improvement, operation and control of Municipal Parks and Recreation Facilities and Programmes. 3. It shall be unlawful for any person to allow a horse under his control to enter or occupy parklands, other than those constructed and maintained as road surface, public parking area, or designated and signed as (a) horse trail(s). 4. It shall be unlawful for a person to allow a motor vehicle, including a snowmobile or motorbike to enter or occupy parklands other than those constructed and maintained as road surface, public parking are as, or designated and signed motor vehicles, snowmobile or motorbike areas. 5. Notwithstanding any designations hereinbefore in force and effect, the Superintendent of Parks & Recreation, his Deputy or assistant, may a) Upon written application and subject to payment of the appropriate fee or fees specified in the Schedule of Fees attached to and forming part of this Bylaw, authorize individuals and/or organizations to use Municipal parks or recreation facilities or parts thereof for special events; b) Upon written application or registration and subject to payment of the appropriate fee(s), as specified in the Schedule of Fees attached to and forming part of this Bylaw, authorize the use of Municipal parks or other recreation facilities or programmes or portions thereof, for recreational, athletic, social and/or special interest programmes. 6. The Superintendent of Parks & Recreation may cause a sign or signs to be placed at the entrances of Municipal parks and/or recreation facilities for the purpose of: a) Displaying programmes and/or fees; b) Prohibiting horses; c) Prohibiting motor vehicles, snowmobiles and motorbikes; d) Displaying any other information or requirements for the good management and control of Municipal parks, recreation facilities and/or programmes. 7. a) Notwithstanding Section 5 preceding, it shall be an offense against this Bylaw for any person to enter or occupy Municipal parks or recreation facilities in contravention of this Bylaw;

2 BYLAW NO Page b) It shall be an offense against this Bylaw for any person to ride or lead a horse or drive motor vehicles, snowmobiles or motorbikes in Municipal parks where prohibited. 8. Any person who commits an infraction of this Bylaw shall be liable, on summary conviction, to a fine or penalty not exceeding Two Hundred and Fifty Dollars ($250.00) and costs recoverable and enforceable in the manner provided by the Summary Convictions Act of the Province of British Columbia. 9. 3 SCHEDULE OF FEES to accompany BYLAW NO For the purposes of this Schedule,. fees in Parts I to IX are applicable to residents and nonresidents. ADULTS means people 19 years of age and older, and CHILDREN means boys and girls 12 years of age and under FAMILY SESSIONS means at least one parent and one child to a maximum of four children unless they are all in one family. Additional child, teen or adult pays the appropriate admission fee NONRESIDENT means any person who is not a bona fide resident of the City of Cranbrook, but does not include a nonresident taxpayer RESIDENT means any person who is a bona fide resident of the City of Cranbrook, and includes nonres~dent taxpayers SENIOR CITIZENS means people 60 years of age and older STUDENTS (School) means boys and girls 5 18 years TINY TOTS means those children not in school, aged 4 and under. w o N C I SWIM POOL A.
