2 Description/Analysis Issue: Under the California Vehicle Code (CVC), a section of a highway or street is a speed trap if the prima facie speed limit is not justified by an Engineering and Traffic Survey (E&TS) performed within a specified time period, and the enforcement of the speed limit involves the use of radar or any other electronic device for measuring the speed of moving objects. The evidence of a speeding violation based on a speed trap is inadmissible in court and may result in the inability to prosecute violators of the speed limit. Additionally, the City is required to reevaluate speed limits on segments of the roadways that have undergone a significant change in roadway characteristics or surrounding land uses. In order to ensure compliance with these requirements, an E&TS has been performed for establishing speed limits on 34 speed zones on various streets. City Council approval through resolution is necessary for re-establishing and reducing speed limits as well as changing speed zone boundaries on the subject 34 speed zones. The previously adopted City Council Resolution No for the Citywide posted speed limits needs to be repealed and superseded with a new Resolution in order to re-establish speed limits. Policy Considerations: The action requested herein is consistent with the City s Strategic Plan goals to improve and expand public safety; and achieve sustainability and enhance livability. Environmental Considerations: California Environmental Quality Act (CEQA): The Community Development Department, Environmental Planning Services Manager has reviewed the proposed action and determined that this project is exempt from the provisions of the California Environmental Quality Act (CEQA) under Class 1, Section 151(c) of the CEQA Guidelines. Projects exempted under Class 1, Section 151(c), consist of the operation, repair, or minor alteration of existing highways, streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities involving negligible or no expansion of use. Sustainability Considerations: This project is consistent with the City s Sustainability Master Plan. It is aimed at addressing the goals and targets set forth in Transportation Infrastructure and Air Quality Focus Areas by improving and optimizing transportation infrastructure with streets that also encourage pedestrians and bicycles. Other: None. Commission/Committee Action: None. Rationale for Recommendation: This report recommends that the City Council adopt a Resolution: re-establishing speed limits on 23 speed zones on various streets; reducing speed limits on 8 speed zones on various streets; changing 2 of 46

3 boundaries for 3 speed zone; and repealing City Council Resolution No for the Citywide posted speed limits and replacing it with a new Resolution incorporating these 34 speed zones. These recommendations are to ensure compliance with CVC in regards to prima facie speed limits. Furthermore, as required by CVC, these recommendations are made on the basis of an E&TS that were performed in accordance with the established traffic engineering practices. Financial Considerations: No additional funding is requested. The costs associated with performing the speed surveys, and manufacturing and installation of speed limit signs is funded with local transportation funds from the Traffic Signs and Markings Program (S ) and from the Department of Transportation, Traffic Engineering Division s Operating Budget (Fund 2002). There were no general funds allocated for this project. Emerging Small Business Development (ESBD): Any goods and services will be procured in accordance with established City policy. 3 of 46

4 BACKGROUND INFORMATION: Attachment 1 1. limits in California are governed by Sections 32, 627, through 22413, 40802, and of the California Vehicle Code (CVC). According to CVC Section ( Traps ), a section of a highway or street is a speed trap if the prima facie speed limit is not justified by an Engineering and Traffic Survey (E&TS) performed within the specified time period, and enforcement of the speed limit involves the use of radar or other electronic device for measuring the speed of moving objects. Under CVC Section ( Trap Evidence ), the evidence of a speeding violation based on a speed trap is inadmissible in court. This could result in the inability to prosecute violators of the speed limit. In view of this, the prima facie speed limits on various streets of the City must be determined and established on the basis of an E&TS. Conducting an E&TS for establishing speed limits is governed by the CVC, and the California Manual on Uniform Traffic Control Devices (MUTCD). When a speed limit is posted on the basis of an E&TS, it should be established using the 85 th percentile speed of free-flowing traffic. Since an E&TS is usually valid for a period of seven years, the City must update the E&TS for each existing speed zone prior to their expiration date. Additionally, the City is required to reevaluate the speed limit on segments of roadways that have undergone a significant change in roadway characteristics or surrounding land uses. 2. In order to ensure compliance with the requirements set forth in the CVC, an E&TS has been performed for 34 speed zones on various streets of the City. These 34 speed zones include: (I) (II) (III) Re-establishing the speed limit for 23 speed zones; Reducing the speed limit for 8 speed zones; and Changing boundaries for 3 speed zones. 3. The E&TS for justifying the proposed speed limits were performed in accordance with the requirements set forth in the CVC, California MUTCD and established traffic engineering practices. Attachment 2 presents the summary of the E&TS for each of the 34 speed zones along with the proposed speed limits. A brief discussion for each of the proposed speed limits is presented in Attachment Based on the background information presented herein, Staff recommends that the City Council adopt a Resolution approving the re-establishment and reduction of speed limits, and the change of boundaries on the above referenced speed zones. Attachment 4 presents the list from previously adopted Council Resolution No for Citywide posted speed limits. The mark-ups reflect changes to the speed limits recommended herein for City Council approval. 4 of 46

5 5. A list of Citywide posted speed limits that are recommended to be adopted as part of a new City Council Resolution is presented in Attachment 5. The subject list incorporates the re-established speed limits for the 23 speed zones, the reduced speed limits for the 8 speed zones and the change in boundaries for 3 speed zone as summarized in Attachment The previously adopted City Council Resolution No for the Citywide posted speed limits will need to be repealed and superseded with a new Resolution in order to incorporate the re-established speed limits for the above referenced 23 speed zones, the reduced speed limit for the above referenced 8 speed zones and the change in boundaries for the above referenced 3 speed zones. 5 of 46

11 Attachment 3 DESCRIPTION FOR EACH PROPOSED SPEED LIMIT: (A)Changing Boundaries for Existing Zones 1) Ehrhardt Avenue (Franklin Boulevard to Center Parkway): The existing boundary for this speed zone currently has a length of 2,003 feet and covers the segment of Ehrhardt Avenue between Franklin Boulevard and Lockborne Drive. Further east of Lockborne Drive, approximately 2,798 feet away, is Center Parkway. This segment currently has no posted speed limit, but has somewhat similar characteristics to the above existing speed zone. In view of the above, it is recommended to extend the boundary of this speed zone as shown on the table below: Surveyed Street Segment Bounded by These Streets Limit 85 th % Proposed Ehrhardt Avenue Existing Franklin Boulevard / Lockborne Dr mph Proposed Franklin Boulevard / Center Parkway 35.1 mph mph The existing posted speed limit for this zone is mph. The average 85 th percentile speed as indicated by an E&TS is 35.1 mph. However, Valley High School is located at the corner of Center Parkway. There are 12 unmarked uncontrolled crosswalks in addition to nine speed humps located intermittently along this segment. Furthermore, there is a high density of single family residential homes fronting this corridor. Therefore, the speed limit for this speed zone should be re-established at mph. 2) Lake Forest Drive / Wissemann Drive (Bennington Way to Folsom Avenue): Lake Forest Drive east of Bennington Way becomes Wissemann Drive. Based on the current resolution for speed limits, the roadway segment of Lake Forest Drive/Wissemann Drive between Bennington Way and Folsom Avenue is comprised of two speed zones: a. Lake Forest Drive from Notre Dame Drive to Bennington Way; and 11 of 46

12 b. Wissemann Drive from Bennington Way to Folsom Avenue These two speed zones have similar roadway configurations and land use characteristics. (B) Reducing Limits for Existing Zones 1) 14 th Avenue (Stockton Boulevard to 73 rd Street): The average 85 th percentile speed as indicated by two E&TS is 36.6 mph. This zone has a posted speed limit of 35 mph. Hiram Johnson High School is located at the corner of 65 th Street and John Paul II School is located across 57 th Street. Furthermore, there are numerous residential uses fronting 14 th Avenue. The zone has sixteen unmarked, uncontrolled crosswalks, and five marked uncontrolled crosswalks. Therefore, it is recommended that the speed limit for this speed zone be reduced to mph. 2) 24 th Street (Broadway to Sutterville Road): This speed zone has a posted speed limit of mph. Sierra School Park is located at the corner of 4 th Avenue. There is a high density of residential uses fronting along this segment. Furthermore, there are eleven unmarked uncontrolled crossings, and four marked uncontrolled crosswalks within this corridor. Since the 85 th percentile speed as indicated by two E&TS is 27.6 mph, it is recommended that the posted speed limit for this speed zone be reduced to 25 mph. 3) 24 th Street (Sutterville Road to Meadowview Road): This speed zone has a posted speed limit of 40 mph. The average 85 th percentile speed as indicated by four E&TS is 12 of 46

13 41.6 mph. This speed zone is characterized with a mix of commercial and residential uses. In addition to the numerous residential uses fronting along 24 th Street, there are several schools that are adjacent or at close proximity to this zone. Woodbine Elementary School is located at the corner of 52 nd Avenue. Charles Goethe Middle School and Rosa Parks Middle School are both located at close proximity to the corner of 68 th Avenue. Mary Hopkins Elementary School is located at close proximity to the corner of Matson Drive. This speed zone has thirty-seven unmarked, uncontrolled crosswalks, and one marked uncontrolled crosswalk. Therefore, it is recommended that the speed limit on this speed zone be reduced to 35 mph. 4) 43 rd Avenue (Gloria Drive to 14 th Street): This speed zone has a posted speed limit of 35 mph. Reichmuth Park is located at the corner of South Land Park Drive and while Alice Birney Elementary School is located at the corner of 13 th Street. There are high density residential uses fronting along this segment. Furthermore, this segment has horizontal and vertical curve roadway alignments, in addition to five unmarked uncontrolled crosswalks. The 85 th percentile speed as indicated by an E&TS is 33.7 mph, therefore, it is recommended that the speed limit for this speed zone be reduced to mph. 5) 71 st Street (14 th Avenue to 21 st Avenue): This speed zone has a posted speed limit of mph, and is characterized by high density residential uses fronting along the corridor. There are four street undulations along this segment, in addition to the unmarked uncontrolled crosswalks at 18 th Avenue and the marked uncontrolled crosswalk at 20 th Avenue. The 85 th percentile speed as indicated by an E&TS is 27.8 mph, therefore, it is recommended that the speed limit for this speed zone be reduced to 25 mph. 6) Blair Avenue (14 th Street to Freeport Boulevard): This speed zone has a posted speed limit of 35 mph, and is characterized by a mix of residential and commercial uses. This zone is at close proximity to the Birney School Park, has two unmarked uncontrolled crosswalks and one marked uncontrolled crosswalk. Additionally, Blair Avenue is a bike route where a share the road legend is installed on the street pavement. The 85 th percentile speed as indicated by an E&TS is 34.7 mph, therefore, it is recommended that the speed limit for this speed zone be reduced to mph. 7) Fair Oaks Boulevard (H Street to east of University Avenue): This speed zone has a posted speed limit of 45 mph, and is characterized by a mix of multi-residential and commercial uses. This segment has vertical and horizontal curve alignment, in addition to the three unmarked uncontrolled crosswalks. The segment just east of the bridge (southwest bound lanes) has no shoulder, curb, or sidewalk. Roadways east and west of this segment are posted at 40 mph. The average 85 th percentile speed as indicated by two E&TS is 44.2 mph, therefore, it is recommended that the speed limit for this speed zone be reduced to 40 mph. 8) Seamas Drive (Riverside Boulevard to South Land Park Drive): This speed zone has a posted speed limit of 40 mph. The John Cabrillo Elementary School and Park are located at the corner of Karbet Way, and the Belle Cooledge Park and Library are located at the corner of South Land Park Drive. The Sam Brannan Middle School and 13 of 46

14 Park are also at close proximity to this segment. There are seven unmarked uncontrolled crosswalks along this segment, and there are no striped bike lanes on the roadway. The average 85 th percentile speed as indicated by an E&TS is 39.5 mph it is recommended that the speed limit for this speed zone be reduced to 35 mph. (C) Re-establishing Limits for Existing Zones 1) 10 th Street (N Street to Broadway): This speed zone currently has a posted speed limit of mph. Since the average 85 th percentile speed as indicated by two E&TS is 32 mph, the posted speed limit for this speed zone should be re-established at mph. 2) 14 th Avenue (MLK Jr. Boulevard to Stockton Boulevard): This speed zone currently has a posted speed limit of mph. Since the 85 th percentile speed as indicated by an E&TS is 33 mph, the posted speed limit for this speed zone should be re-established at mph. 3) 14 th Street (73 rd Street to Power Inn Road): This speed zone currently has a posted speed limit of 40 mph. Since the 85 th percentile speed as indicated by an E&TS is 40.5 mph, the posted speed limit for this speed zone should be re-established at 40 mph. 4) 26 th Avenue (24 th Street to Franklin Boulevard): This speed zone currently has a posted speed limit of mph. The Sacramento City College is located at the corner of Sutterville Road, and the CK McClatchy High School is located at the corner of Bidwell Way. Furthermore, there are 12 unmarked uncontrolled crosswalks and 2 marked uncontrolled crosswalks along this corridor. Therefore, the posted speed limit for this speed zone should be re-established at mph. 17)Front Street (O Street to Broadway): This speed zone currently has a posted speed limit of 40 mph. Since the 85 th percentile speed as indicated by an E&TS is 42 mph, the posted speed limit for this speed zone should be re-established at 40 mph. 15 of 46

28 RESOLUTION NO. Adopted by the Sacramento City Council RE-ESTABLISHING AND REDUCING SPEED LIMITS ON VARIOUS STREETS; CHANGING ZONE BOUNDARIES; AND REPEALING RESOLUTION NO BACKGROUND A. According to California Vehicle Code (CVC) Section ( Traps ), a section of a highway or street is a speed trap if the prima facie speed limit is not justified by an Engineering and Traffic Survey (E&TS) performed within the specified time period, and the enforcement of the speed limit involves the use of radar or any other electronic device for measuring the speed of moving objects. Furthermore, the evidence of speeding violation based on a speed trap is inadmissible in court (CVC Section 40803, Trap Evidence ). In view of this, the prima facie speed limits on various streets of the City must be determined and established on the basis of an E&TS. Conducting an E&TS for establishing speed limits is governed by the CVC and the California Manual on Uniform Traffic Control Devices (MUTCD). Since an E&TS is usually valid for a period of seven years, the City must update the E&TS for each existing speed zones prior to their expiration date. Additionally, the City is required to reevaluate the speed limits on segments of the roadways that have undergone a significant change in roadway characteristics or surrounding land uses. B. In order to ensure compliance with the requirements set forth in the CVC, an E&TS have been performed for 34 speed zones on various streets of the City. These 34 speed zones include: (I) (II) (III) Re-establishing the speed limit for 23 speed zones; Reducing the speed limit for eight speed zones; and Changing boundaries for three speed zone. A summary of the 85 th percentile and proposed speed limits based on an E&TS for each of these 34 speed zones is presented in Exhibit A. C. The E&TS for justifying the proposed speed limits were performed in accordance with the requirements set forth in the CVC, California MUTCD, and established traffic engineering practices. 28 of 46

Based on the background information presented herein, Staff recommends that the City Council adopt a resolution changing the speed zone boundaries, and reducing and re-establishing on 34 speed zones as summarized in Exhibit A. E. The previously adopted Council Resolution No for the Citywide posted speed limits will need to be rescinded and superseded with a new resolution in order to incorporate the recommended speed limits for the above referenced 34 speed zones. F. A list of citywide speed limits that is recommended to be adopted as part of this City Council Resolution is presented in Exhibit B.
