1 PUBLIC MEETING - REZONING APPLICATIONS In accordance with the provisions of the Planning Act, S.O., 1983, a Public Meeting was held by the Bracebridge Municipal Council on April 6th, 1988 in the Municipal Auditorium, commencing at 7: 30 p.m. to consider rezoning applications (Cosgrove, Wyjad, Johnson), 4-88 (Watt), 5-88 (Rodwell), 6-88 (Brown), 9-88 (Wright) and (Evans). All members of the Bracebridge Municipal Council were in attendance. (a) (Cosgrove, Wyjad, Johnson) Hinistry of Natural Resources statement of approval. (v) District of Muskoka Engineering & Public Works Department advising that with regard to water and sewer they have no objection to the application. Mr. Doug Morrison of Cambrian Planning Consultants on behalf of the applicant, attended the meeting and made representation with respect to the application. (b) 4-88 (Ross Watt) The follmtling documents were presented: on Or be effected by the proposed rezoning. (v) District of Muskoka Engineering & Public Works Department advising that with regard to water and sewer they have no objection to the application. /APRIL 6th, 1988 PAGE 1
2 - 2 - Mr. Norm Rosewarne, Manitoba Street, Bracebridge, Ontario, addressed the meeting noting that his residence is located directly opposite from the subject property and outlined his concern with respect to possible damage to five (5) maple trees which will occur if the proposed grade surrounding the building is maintained as set out in the site plan. He noted that if the grade remains the same around the trees then it will create a buffer to protect the view from his property. Glenna Grimes, 293 James Street, Bracebridge, Ontario, expressed her concern about the proposal interferring with her driveway \"hich is immediately adjacent to the subject property. Municipal Planner Peter Neice outlined the details of the proposed by-law with respect to setbacks. Mr. Fred Barty, 35 Spencer Street, Bracebridge, Ontario, that the planting strip should consist of trees that not grow up and infringe on parking as they mature. noted will Mr. Ross \'Iatt, applicant, addressed the meet ing and advised that he must maintain the grade proposed in the site plan and as a result, the trees must go. He presented a letter from a professional pointing out that the trees are overmature and should be replaced, noting that the trees will become more and more susceptible to wind damage as time goes on. Mr. 11att noted that his insurance becomes invalid if there is damage to others caused by trees falling which he has known to be a hazard. Mr. ~Iatt pointed out that he would like to have this building as compatible with surrounding areas as possible and that he will replace at least one new tree for every tree removed and with trees of better quality. Mr. John Spooner, on behalf of the applicant, displayed a cross section exhibit showing the grade if the existing trees were to be undisturbed and illustrated how this would damage the trees and be unacceptable from a construction point of view. Mr. Ross \'Iatt again addressed the meeting noting that he has considered other areas for the location of a driveway but has concluded that the James Street location is the only logical one, further noting that part of Mrs. Grimes' driveway actually crosses his property. (c) 5-88 (Rodwell) (v) District of Muskoka Engineering & Public \'Iorks Department advising that with regard to water and sewer they have no Objection to the application. APRIL 6th, 1988 PAGE 2
3 - 3 - Mr. Dave Rodwell, applicant, attended the meeting and made representation with respect to the application. A letter was presented from Mr. John Challis, 77 Front Street, Bracebridge, Ontario, wherein he noted that he has no objection to the creation of a duplex residential unit on the subject property but requesting that a row of red pines across the front of the lot be left standing. Mr. Robert Frewin, Front Street, Bracebridge, Ontario, addressed the meeting, stating that he is speaking for all the people of Front Street and expressed the view that all of the residents were opposed to this rezoning as they feel they already have their fair share of multiple dwellings in the area. He pointed out that the proposal will have a detrimental affect on water pressure in the area, further aggrevate parking on a narrow street, create an absentee landlord situation which could result in messy yards, etc., and concluding that the proposal seems to be haphazard from a planning point of view. Mr. Fred Nortin, Front Street, Bracebridge, Ontario, noted that the proposal could further aggrevate storm flooding in basements and asked Council to recognize the value of the single family dwellings in the area. He further noted that there are a number of springs in the area which affect the water table and requesting that the Town construct a storm sewer along the closed part of Gow Street. Mr. Fred Barty, 35 Spencer Street, Bracebridge, Ontario, addressed the meeting, noting that he has tenants in his buildings and that they are good people who need homes but can't afford to buy single family dwellings. Mr. Al Clarke, Chairman of the Bracebridge Industrial Commission, pointed out to the meeting that one problem in Bracebridge is providing affordable housing for residents and suggesting that Council should do everything they can to provide the same. Mr. Dave Rodwell, applicant, further explained to the meeting that there is a distinct need for rental units, noting that parking conflicts as outlined by others at the meeting will be resolved at the site plan stage and noting that his present tenants in other buildings take very good care of their property. He also stated that he felt one more roof in the area would not contribute to the flooding difficulties on the street. (d) 6-88 (Brown) ( i ) ( ii ) Robert E. 4 - 4 - (v) TransCanada Pipelines, advising that their gas transmission mains cross the property and asking that any building recommended for the property be setback at least 10 metres from the TransCanada Pipeline rightof-way, also setting out certain rgulations with respect to grading or excavation that might take place on the right-of-way and setting out notice required by the company with regard to such work. Mr. Doug Morrison of Cambrian Planning Consultants, on behalf of the applicant, attended the meeting and made representation with respect to the application but considering the comments of TransCanada Pipelines, asked that Council defer the application to a future meeting. (e) 9-88 (Wright) Mr. Currie, the meeting application. solicitor, and made on behalf of the applicant, representation with respect attended to the Barbara Andrews, Bracebridge, Ontario, attended the meeting and noted that she has no objection to the proposal, however, she noted that, due to a deviation in the actual roadway, it was her understanding that the subject property does not front on the road. She further stated that they would be willing to give access to the subject property over their lands which are adjacent to the road and she has expressed that point to representatives of the applicant, Muskoka Parry Sound Broadcasting Limited. 5 - 5 - (f) (Bruce Evans - l'iilliam's Cove) Plan of the Muskoka planning area, as amended, and further noting that the District Engineering and Public Works Departments have advised that they will require an agreement to be entered into with respect to roads and access points and that a servicing agreement is also required respecting the proposed development. A further letter confirmed that his department has reviewed the site plan for the proposal. Ministry of the Environment noting that an area adjacent to the Wellington Street bridge on the east side of the subject property was previously used for disposal of solid wastes and requesting that the proponent be made aware that special handling procedures may be required to be implemented with respect to this part of the site. fll: /i. Jager, 59 Brofoco Drive, Bracebridge, Ontario, wherein it was noted that development is necessary in the area but expressing concern on the impact of the proposal on the rural sett ing and lifestyle of Bracebridge, noting the high density that is possible within the proposal, the number of boats that uj.ll be added to the Muskoka River and expressing their view that the Bracebridge Councillors have a responsibility to maintain the natural environment and to provide for a well planned waterfront with parks and facilities. accomplish the purpose required and further reviewed the details of the project, expressing how the development as proposed has been designed to compliment the area while being developed within sound planning principals. Mr. Bruce Evans, applicant, addressed t41e meeting and gave a brief outline with respect to the background of the property noting that a great deal of thought has gone into the proposal over a number of years and that he would do nothing to hurt the Muskoka environment. He outlined that this proposal would not happen overnight, that it is a long-term development project and will provide affordable housing in a variety of lifestyles. Mr. Steve Moorhead, on behalf of the applicant, briefly outlined the project, noting that it is a ten-year development plan and, while it is to be phased, they have chosen to show the totally developed proposal at this time. Mr. Moorhead noted that because of the number of units proposed that it will be an affordable housing project. He also advised that they have reviewed other methods of developing this property and have selected this as the best proposal. A slide presentation on the proposal was displayed to the meeting. 6 - 6 - Linda McQuillen, Beaumont Drive, Bracebridge, Ontario, addressed the meeting noting that her residence is directly across the river from the proposed property and advised the meeting that this is a quiet residential area and that their residential property will be disturbed by the size of the project, both when completed and for the construction period. She also enquired about the tannery vats that possibly existed on the property years ago. Mr. John Wood, Brofoco Drive, Bracebridge, Ontario, addressed the meeting and questioned the height measurement of the plans and made certain enquiries with respect to the walkway. Mr. Wood noted that the Town has to grow and prosper but that the Town has maintained its character to date and that by increasing the height provision in the zoning by-law that a precedent could be set. He requested more information about the capacity of the present sewer and water systems and suggested that a referandum be held on the proposal so that all residents of the municipality can have a say in its development. Mr. Fred Barty, 35 Spencer Street, Bracebridge, Ontario, made enquiries with respect to fire fighting equipment in the municipality and noted that the project will be quieter than the previous sawmill and constractor' s yard that existed on the property. Mr. Joe Hemmings, 18 Spencer Street, Bracebridge, Ontario, pointed out that this residential area is quiet and because of the development the traffic will all have to go right by his residential property which, he pointed out, has not been shown on the plan. Mr. Bruce Evans, applicant, pointed out to Mr. Hemmings that they were aware of this error in the drawing but the setbacks from his property as shown on the plan were accurate. Mr. Robert Frewin, Front Street, Bracebridge, requested information of Council with respect to studies that have been done in this area. Ontario, traffic Mr. Fred Barty again addressed the meeting stating that additional traffic from this proposal may warrant traffic lights at the corner of Gordon Street and Wellington Street. Mr. Dave Stevens, Kimberley Street, Bracebridge, Ontario, requested information with respect to what effect this development will have in elevating prices of properties in the area and what percentage of the total households in Bracebridge this development represents. He also made enquiries of the applicant as to what they mean by affordable and whether or not a housing study has been done in the municipali ty. Mayor Lang pointed out that the Ministry of Housing have conducted housing studies in Bracebridge and they are updated regularly. Bruce Kruger, Beaumont Drive, Bracebridge, Ontario, requested information on the order of the phasing for the proposal and assurance that the amenities and landscaping will not be left until all the buildings have been constructed. Mr. Bruce Evans, applicant, advised that the amenities will be carried out promptly in order for the condominiums to be marketable and the entire project will be scheduled in site plan agreements. 7 - 7 - Mr. Harold Dawson, Wilshier Boulevard, Bracebridge, Ontario, noted that the drawings and pictures provided are very pleasing and stated his pleasure that the applicant has seen fit to develop this area. He also noted that Mr. Evans was a resident of Bracebridge and can be trusted based on his very creditable record and would not be one to vacant a plan once commenced. Mr. Al Clarke, Golf Course Road, Bracebridge, Ontario, stated that he was very impressed with the presentation and noted that by people buying these condominium units they create an available unit from their previous residence for others to purchase. He also noted that the development had t he appearance of a first class proposal. Mr. Paul Hammond, Bracebridge, Ontario, offered his congratulations to the applicant for doing a fine job with the presentation and noted that there is a lack of luxury condominiums in the area. Mr. Don Barrick, Beaumont Drive, Bracebridge, Ontario, the meet ing that he owns a motel building and noted is constantly getting enquiries from people who want condominiums. advised that he to buy Greg McChesney, Bradebridge, Ontario, requesting information on the amount of labour that would be going into the project and the applicant responded that the project will cost between 30 and 35 million dollars.
