SELECTION SYSTEM U.S. Paralympics ATHLETE SELECTION PROCEDURES 2016 Paralympic Games Track and Field October 7, Provide the minimum eligibility requirements for an athlete to be considered for nomination to the Team: ity/passport requirements: Athlete must be a national of the United States prior to the time of selection and prior to the entry deadline of the 2016 U.S. Paralympic Team Trials-Track and Field. Athlete must hold a valid U.S. passport that will not expire for six months after the conclusion of the Games Minimum International Paralympic Committee (IPC) standards for participation: Any competitor in the Olympic, Paralympic, Pan American or Parapan American Games must be a national of the country of the Olympic Committee (NOC) or Paralympic Committee (NPC) which is entering such competitor. For additional information regarding an athlete who is a national of two or more countries, has changed his or her nationality or acquired a new nationality, refer to the IOC Charter (Rule 42), the IPC Handbook (Section 2, Chapter 3.1), or the PASO Statutes (Article XXII, Sections 4 and 5) Minimum International Federation (IF) standards for participation (if any): Rio 2016 Paralympic Games Qualification Guide: To be eligible for selection by an NPC, athletes must: be age fourteen (14) by 31 December in the year of competition to compete. Athletes in sport classes 40 and 41 must be age 1

2 eighteen (18) by the date of competition ( IPC Athletics Rules and Regulations-Rule 2.1); hold an active IPC Athletics Athlete License for the 2016 season (also applies to guide runners); have achieved at least one (1) BQS performance at an IPC Athletics Recognized Competition (IPC Competition, IPC Sanctioned Competition, or IPC Athletics Approved Competition) for each of their respective events between 15 October 2014 and 14 August 2016 in accordance with the Athlete Licensing Programme Policies valid for the seasons exceptions may be made via the Bipartite Commission Invitation Allocation method; be internationally classified with a Confirmed sport class status or a Review sport class status with a review date after 31 December To be eligible for a relay event, athletes must: have entered an individual event (with exception of any relay specialist slots that may be allocated by IPC Athletics) Other requirements (if any): Athletes (including guide runners) must hold a current IPC Athletics License prior to the start of the event for the performance to count toward achievement of the AQS or BQS. IPC License information can be found on the U.S. Paralympics website: Note: An AQS or BQS will not be counted retroactively from the issue date of the IPC License, so the athlete must hold a current IPC Athletics License prior to the start of the event where the AQS or BQS is met. Medal Events, including the AQS and BQS and other pertinent standards, are listed in Attachment C. Note: IPC Athletics Recognized Competitions (IPC Competition, IPC Sanctioned Competition, IPC Approved Competition) are referred to as IPC Approved Events in the USA and throughout this document. 3 At the time of selection an athlete must have an IPC/IF International Classification with an international sport class status of C-Confirmed or R-Review with a review date after 31 December Athletes eligible for nomination to the team through the Marathon Qualifiers must have at a minimum a Classification and/or an international sport class status of N-New or R-Review, and must complete the international classification process prior to the entry deadline for the 2016 U.S. Paralympic Team Trials-Track and Field. Nomination to the team will be dependent upon the outcome of the international classification evaluation. A description of sport-specific classification requirements and current athlete sport class status can be found within the Classification Masterlist as posted on the IPC Athletics website: Athletes must submit all of the required documentation and be included on the Rio 2016 Accreditation Long List (deadline 31 March 2016) Athletes must enter and compete in all of the events at the 2016 U.S. Paralympic Team Trials-Track and Field for which they wish to be nominated to the Paralympic Games Team (for example, an athlete must compete in the 100m at the Trials if they want to be considered for nomination in the 100m during team selection). In addition, athletes will be considered for nomination to the team in all of the events in which they compete at the Trials (for example, an athlete who competes in the 100m, 200m, 400m and Long Jump will be considered for nomination to the team in all four of those events). Note: It is the athlete s responsibility to submit official results from IPC Approved Events for the Paralympic Games AQS and BQS and entry time/distance purposes. Results should be submitted prior to the entry deadline of the 2016 U.S. Paralympic Team Trials-Track and Field by sending a completed Proof of Performance Form (see website link below) or the website link of the results as soon as possible or within seven days after the event and prior to the close of the qualification period. Tryout Events: Provide the event names, dates and locations of all trials, events and camps to be used as part of the selection process U.S. Paralympic Team Trials-Track and Field Charlotte, NC Johnson C. Smith University June 30-July 2, 2016 All information including but not limited to requirements and deadlines pertaining to the 2016 U.S. Paralympic Team Trials-Track and Field will be posted on U.S. Paralympics website once finalized: U.S. Paralympics Marathon Qualifier (Men s and Women s T52/53/54 Marathon events only) Bank of America Chicago Marathon October 11, U.S. Paralympics Marathon Qualifier (Men s and Women s T11/12 and Men s T45/46 Marathon events only) California International Marathon (CIM) December 6, Provide event names, dates, locations and description of how athletes qualify for the trials, events and camps listed above in (if any). Athletes must achieve the 2016 U.S. Paralympic Team Trials-Track and Field Entry between 1 January 2015 and the entry deadline for each event entered. Entry s must be achieved at a qualifying event (defined below) and verified as part of the entry process. Athletes can submit results from indoor competitions for field events and for all track events with exception of the 60m and 100m. Qualifying event results that will be accepted for entry into the 2016 U.S. Paralympic Team Trials-Track and Field (between 1 January 2015 and the entry deadline): IPC Athletics Approved events USATF or IAAF events NCAA/NAIA or NJCAA events 4

5 WASUSA events State High School meets The competition must have automatic/electronic timing, wind gauge readings for required events as outlined in the IPC Athletics Rules (i.e., 100m, 200m, Long Jump, Triple Jump) and use IPC or USATF certified officials to conduct the competition. Only athletes who compete at the 2016 U.S. Paralympic Team Trials- Track and Field will be considered for Team selection (with the exception of Discretionary Selection and the Marathon Qualifiers) U.S. Paralympic Team Trials-Track and Field qualification requirements and event entries see Section Provide a comprehensive, step-by-step description of the method that explains how athletes will go through the selection process to become Team nominees (include maximum Team size). Team Size will be determined based on the IPC Athletics slot allocation. General provisions as outlined in the Rio 2016 Paralympic Games Qualification Guide: An NPC can be allocated a maximum of forty-eight (48) male qualification slots and thirty-two (32) female qualification slots. Exceptions may be granted through the Bipartite Commission Invitation Allocation method. If an NPC is unable to use all of the allocated qualification slots in a given gender, the unused slots cannot be transferred to the other gender. They will be reallocated in the respective gender to other NPCs through the Bipartite Invitation Commission Allocation method. A maximum of three (3) eligible athletes per individual medal event can be entered provided each has achieved at least a BQS performance in that event. A maximum of one (1) team can be entered in each relay medal event comprising up to six (6) eligible athletes. Eligible athletes can be entered in an unlimited number of medal events as long as the athlete has achieved at least a BQS performance in each of these medal events. A maximum of six (6) eligible athletes can be entered in each marathon medal event. A maximum of three (3) athletes can be entered in each marathon medal event as their only event. 5

6 IPC Direct Invitation The IPC may award Bipartite slots for the 2016 Paralympic Games using the Bipartite Invitation Allocation Method. The IPC awards these Bipartite slots by name. Bipartite slots are allocated by the IPC based on the principles below (in no particular priority order): to ensure participation of top athletes who may have not had the opportunity to formally qualify through other methods due to extraordinary circumstances; to ensure the representation of athletes with high support needs; to ensure medal events will have sufficient representation for viability; and to enable greater representation by gender. Prior to awarding Bipartite slots the IPC may invite each Paralympic Committee to submit an application requesting that an athlete or athletes be considered for a Bipartite slot. U.S. Paralympics may, but is not required to, submit an application for a Bipartite slot depending on whether or not, as determined by the Discretionary Selection Committee, there are athlete candidates who meet the above principles and who are capable of a top three (podium) result, can positively impact team performance, or are considered to be on track to produce a top three (podium) result in the near future. The selection of a particular athlete for submission to the IPC for a Bipartite slot will be based on the above and on the discretionary selection criteria set forth in Section 2.1. The Discretionary Selection Committee shall be responsible for making any such selection. U.S. Paralympics will disclose on its website at the submission of a particular athlete to the IPC for a Bipartite slot. If the IPC awards a Bipartite slot to an athlete by name, U.S. Paralympics will accept such athlete to the Team. U.S. Paralympics will disclose on its website at the name of any athlete named to the Team through the Bipartite Invitation Allocation Method Discretionary Selection Prior to the objective selection process (outlined below) a maximum of 10% of the athletes per gender may, but are not required to, be nominated to the team according to Discretionary Selection (see Section 2) Team Selection Ranking List Athletes will be ranked using the results (finals/final round only) from the 2016 U.S. Paralympic Team Trials-Track and Field according to the following system. 6

7 If 100m, 200m and Long Jump results from the 2016 U.S. Paralympic Team Trials Track and Field are wind-aided, the eligible athletes place finish will determine start right order as long as the eligible athlete has a valid and recognized result included on the IPC Athletics Minimum Qualification Ranking list. All results for each eligible athlete will be given a percentage score. The score is calculated by comparing the athlete s result from the 2016 U.S. Paralympic Team Trials-Track and Field to the 2016 Team A standard for each event using the following formula. o Track events: (2016 Team A / result) x 100 o Field events: (result / 2016 Team A) x 100 The percentage will be provided with two decimal points (to the onehundredth of a percent) with the highest percentage compared to the 2016 Team A standard being the better result. Slots and start rights will be filled based on the Team Selection Ranking List (highest to lowest percentage) for the medal events scheduled to be contested at these Games (Attachment C) in the following order: 1. Athletes who have achieved the AQS between 15 October 2015 and the completion of the 2016 U.S. Paralympic Team Trials-Track and Field. 2. Athletes who have achieved the BQS between 15 October 2015 and the completion of the 2016 U.S. Paralympic Team Trials-Track and Field. 3. Athletes who have achieved the AQS or BQS between 15 October 2014 and the completion of the 2016 U.S. Paralympic Team Trials-Track and Field. Nomination will continue until either all slots, by gender, have been filled or all eligible athletes who have achieved the BQS have been nominated to the team. Marathon The U.S. winner and runner-up (in that order) will be nominated to the team in the Marathon event based on results from the U.S. Paralympics Marathon Qualifiers provided each eligible athlete has achieved a 2015 Team A (track events or marathon) prior to or at the Marathon Qualifier (1 January 2015 date of Marathon Qualifier) and has achieved the BQS in their respective marathon event (15 October 2014 date of the Marathon Qualifier). 7

8 Tie- Breaking Procedures If a tie exists for the final team slot or for a final event start right at any point during the implementation of these procedures, the athletes who qualifies will be, in order, those athletes: Who have the highest place (or preliminary round) finish in their sport class of the individual event or sport class of the combined event at the 2016 U.S. Paralympic Team Trials-Track and Field. Who have the highest ranking on the current IPC Athletics 2016 Annual Best Performance Ranking list in the event(s) that he/she is eligible to enter. Start Rights Start rights remaining open after the slots have been filled may be assigned by the High Performance Director ( HPD ) to eligible athletes already nominated to the team. In assigning start rights, the HPD may consult with the athlete and the relevant discipline assistant coaches. The following factors may be considered (not in priority order): The desire of the athlete to start the event, The athlete s number of events and the time schedule of events, The likelihood of the athlete winning a medal in the event, IPC World Ranking lists, and performances Relays The assignment of athletes to the relay pool and of start rights in all relays shall be determined by the HPD in consultation with the relevant discipline assistant coaches, considering all of the following factors (in no particular order): The athlete must have already been nominated to the team and be entered in at least one individual event. Building a team that is most likely to medal in the event. The athlete s commitment to the relay team including the athlete s attitude towards the team, physical readiness and participation/performance in relay training sessions. The athlete s results leading up to the relay, including the Trials and any at the most current Paralympic Games/World Championships. The number and schedule of other events in which the athlete will be entered. 8

9 Guide Athletes Guide athletes will be nominated based on Discretionary Selection as outlined in Section DISCRETIONARY SELECTION (if applicable) 2.1. Provide rationale for utilizing discretionary selection (if any): A minimum of 90% of the athletes, per gender, nominated to the Team will qualify themselves by the objective selection (times and distances) from results obtained from Marathon Qualifiers and the 2016 U.S. Paralympics Team Trials- Track and Field. With a fixed allocation of Team slots and start rights for each event, U.S. Paralympics sees benefit to the entire U.S. delegation and overall team and medal performance in nominating top performing athletes to the Team before objective selection. In the event where the 2016 U.S. Paralympic Team Trials-Track and Field will not be conducted or fully completed due to natural disaster or other unforeseen circumstance, the entire team will be nominated based on discretionary selection List the discretionary criteria and explain how they will be used (if any): Only the athletes who submit a discretionary selection petition may, but are not required to, be considered by the Discretionary Selection Committee except for in the case of Guide Athletes and the Replacement of Athletes (Section 4). Athletes must submit a discretionary selection petition request in writing to the U.S. Paralympics Track and Field HPD before or no later than one hour following the conclusion of the 2016 U.S. Paralympics Team Trials-Track and Field in order to be considered. Petitions must be submitted in person at the 2016 U.S. Paralympic Team Trials-Track and Field or via sent to the HPD, and must include the reason to be considered for discretionary selection and any supporting documentation (e.g., medical documentation). The petition submission does not guarantee that the athlete will be nominated to the team. The Discretionary Selection Committee will consider input and recommendations from relevant assistant/discipline coaches and may, but is not required to, make discretionary selections from among all athletes who submit a discretionary selection petition up to a maximum of 10% of the total Team slots per gender. Each athlete selected by discretion will be assigned one or more start rights in individual events at the time of selection. The Discretionary Selection Committee will consider the following performancerelated factors (not in priority order): 9

10 If the athlete experienced an injury or illness that impeded maximal performance during the 2016 U.S. Paralympic Team Trials-Track and Field; If the athlete was subject to equipment failure, weather, interference, or other external factors, either natural or caused by others, that impeded what otherwise likely would have been a qualifying performance at the 2016 U.S. Paralympic Team Trials-Track and Field; If the athlete has achieved at least the BQS at an IPC Athletics Approved Event from 1 January 2016 the end of the 2016 U.S. Paralympic Team Trials-Track and Field and is ranked in the top 8 in their medal event on the Minimum Qualification Ranking List for the 2016 Paralympic Games as posted on the IPC Athletics website at the time of nomination; If the athlete has achieved at least the BQS at an IPC Athletics Approved Event from 1 January 2016 the end of the 2016 U.S. Paralympic Team Trials-Track and Field and was unable to compete at the 2016 U.S. Paralympic Team Trials-Track and Field due to unforeseen circumstances to be determined by the Discretionary Selection Committee; The athlete s likelihood of winning a medal or medals at the 2016 Paralympic Games; If the IPC changes or makes amendments to the medal events, current rules or qualification criteria; If the IPC allocates a relay specialist slot. Guide Athletes The Discretionary Selection Committee will nominate guide athletes to the team through discretionary selection. Guide athletes are used for the T11/12 and F11/12 sport classes (visually impaired). The guide athletes are not included in the maximum team size as determined by the qualification slots allocated by the IPC nor are the guide athletes accounted in the 10% (per gender) total of discretionary selection as outlined above. A guide athlete will typically work with one athlete during practice, competition and day-to-day activities; therefore accreditation allocation is typically provided for one guide per qualified athlete as outlined in the IPC Rules: However, accreditation allocation is not guaranteed and the number of guide athletes will be based on final NPC (U.S. Paralympics) credential allocation. 10

11 The below factors will be considered in the selection of a guide athlete: Track events: the speed of the guide athlete in relation to the athlete being guided. The guide athlete must be faster than the visually impaired athlete. Field events: voice command and positioning experience. Preference of the qualified visually impaired athlete. Demonstrated expertise of the guide athlete must have expertise and experience in the assigned athlete s specific event(s). Knowledge and understanding of the IPC Rules pertaining to guide athletes. Guide athletes will be held to the same standards and code of conduct as outlined in these Procedures. The guide athlete position is contingent on the nomination and participation of the designated athlete to be guided. The guide athlete will be removed unless otherwise reassigned by the Discretionary Selection Committee Provide the name of the committee that will be responsible for making discretionary selections, along with a complete list of the members titles currently serving on the committee: Discretionary Selection Committee: Team Leader, Sport Performance High Performance Director, Paralympic Track and Field Associate Director, Paralympic Track and Field Teams 2016 Paralympic Games Team Coaching Staff (maximum of four) Athlete Representative Athlete Representative Specify the process that will be used to identify and handle any potential conflicts of interest involving a member of the committee. Any member of the selection committee that has a possible conflict of interest must disclose it. If such conflict exists, the selection committee member must recuse him/herself from committee discussions and voting. Further, the committee member should not otherwise influence other members of the committee in the nomination process. However, a committee member who recused him/herself, but who has relevant and necessary information with respect to athlete performance, for example a national team coach or high performance director, may, if requested by the selection committee, provide such information to the committee so long as such information is provided in a fair and unbiased manner and the 11

REMOVAL OF ATHLETES committee member who declared the conflict of interest does not vote toward the final decision Prior to acceptance of nominations by the USOC, U.S. Paralympics has jurisdiction over potential nominees. An athlete who is to be nominated to the Team by U.S. Paralympics may be removed as a nominee for any of the following reasons, as determined by U.S. Paralympics: Voluntary withdrawal. Athlete must submit a written letter to the Director, High Performance, Paralympic Track and Field Injury or illness as certified by a physician (or medical staff) approved by U.S. Paralympics. If an athlete refuses verification of his/her illness or injury by a physician (or medical staff) approved by U.S. Paralympics, his/her injury will be assumed to be disabling and he/she may be removed Violation of the U.S. Paralympics Code of Conduct (Attachment A) Violation of the U.S. Anti-Doping Code or if the athlete is currently serving a USADA/WADA sanction Re-classification by the IPC such that the athlete s qualifying performance would not have qualified him or her for the Team Removal by the IPC of the event in which the athlete qualified for the Team from the program of the 2016 Paralympic Games. An athlete who is removed from the Team pursuant to this provision has the right to a hearing per the USOC Complaint Procedures for U.S. Paralympics Teams and Paralympic Programs and the USOC s Bylaws, Section Once an athlete nomination is accepted by the USOC, the USOC has jurisdiction over the Team, at which time, in addition to any applicable U.S. Paralympics Code of Conduct, the USOC s Code of Conduct and Grievance Procedures apply. The USOC s Code of Conduct and Grievance Procedures can be found at: Ombudsman/Resources/Code-of-Conduct An athlete may be removed as a nominee to the Team or from the Team for an adjudicated violation of IOC, PASO, IPC, WADA, IF, USADA and/or USOC anti-doping protocol, policies and procedures, as applicable. 12

13 4. REPLACEMENT OF ATHLETES 4.1. Describe the selection and approval process for determining replacement athlete(s) should a vacancy occur: prior to submission of Entries by Name to the Local Organizing Committee, including any applicable group or committee: The Replacement Pool of Athletes will be comprised of qualified and eligible athletes. Replacement athletes will be selected via discretionary selection (Section 2). The replacement athletes are not required to submit a discretionary selection petition nor are the replacement athletes accounted in the 10% (per gender) total of discretionary selection after submission of Entries by Name to the Local Organizing Committee, including any applicable group or committee: 5. SUPPORTING DOCUMENTS If approved by the IPC and the organizing committee of the 2016 Paralympic Games, the Replacement Pool of Athletes will be comprised of qualified and eligible athletes. Replacement athletes will be selected via discretionary selection (Section 2). The replacement athletes are not required to submit a discretionary selection petition nor are the replacement athletes accounted in the 10% (per gender) total of discretionary selection. U.S. Paralympics will retain the approved Selection Procedures and all supporting documents, including scouting or evaluation forms, etc., and data from the selection process for six months past the date of the Closing Ceremony of the Games. 6. REQUIRED DOCUMENTS In addition to the USOC Code of Conduct, the following documents are required to be signed by an athlete as a condition of nomination to the Paralympic Games and are included as attachments: USOC Code of Conduct for U.S. Paralympics Teams and Paralympic Programs (Attachment A) USOC Complaint Procedures for U.S. Paralympics Teams and Paralympic Programs (Attachment B) 13

14 7. PUBLICITY/DISTRIBUTION OF PROCEDURES The USOC approved Selection Procedures (complete and unaltered) will be posted/published by U.S. Paralympics in the following locations: 7.1. NGB/HPMO Web site: These procedures will be posted as soon as possible, but not more than five business days following notice of approval by the USOC Other: N/A Copies of these procedures will be available upon request in print or electronic format from the U.S. Paralympics office ( ). 8. DATE OF NOMINATION The Nomination of Athletes form, including replacements, will be announced to all athletes and submitted to the USOC on or before: Team Nominations will be announced on July 3, MANDATORY TRAINING AND/OR COMPETITION All Team nominees (members) are subject to the provision of the USOC Code of Conduct that require each athlete to maintain the level of fitness and readiness that qualified him or her for the Team and that will allow for his or her best performance at the 2016 Paralympic Games. The 2016 Paralympic Games assistant/discipline coaches will advise each Team member on training between the 2016 U.S. Paralympic Team Trials-Track and Field and the Paralympic Games, and these coaches will monitor Team members training during this period. Athletes nominated to the 2016 Paralympic Games Team will be invited to participate in mandatory Games specific training camps. The details of the camps will be published with the U.S. Paralympics Track and Field 2016 Athlete and Sport Program Plan. While waivers for any mandatory training will not be unreasonably withheld, waivers will primarily be granted only for illness, injury or other incapacity, or for personal/family emergency. All selections to the team should arrange for appropriate time off from school, work or other obligations well in advance of team activities. Requests for a waiver may be submitted in writing to the Director, High Performance, 14

15 Paralympic Track and Field for review. A written response to all requests will be issued to the athlete within 72 hours of the request. 10. ANTI-DOPING REQUIREMENTS Athletes must adhere to all IOC, IPC, PASO, WADA, IF, USADA and USOC antidoping protocols, policies and procedures, as applicable. This includes participation in Out-of-Competition Testing as required by the IOC, IPC, PASO, WADA, IF, USADA and USOC Rules, as applicable. 11. INTERNATIONAL DISCLAIMER These procedures are based on IOC, IPC, PASO, as applicable, and/or IPC Athletics rules and regulations as presently known and understood. Any change in the selection procedures caused by a change in IOC, IPC, PASO, as applicable, and/or IPC Athletics rules and regulations will be distributed to the affected athletes immediately. The selection criteria are based on the latest information available to U.S. Paralympics. However, the selections are always subject to unforeseen, intervening circumstances, and realistically may not have accounted for every possible contingency. If any force of nature, or force majeure, should cause the altercation or cancellation of any of the selection events listed in this document, these selection procedures will be revised, pursuant to their resubmission to the USOC. 15

17 Attachment A UNITED STATES OLYMPIC COMMITTEE CODE OF CONDUCT FOR U.S. PARALYMPICS NATIONAL TEAMS AND U.S. PARALYMPICS PROGRAMS November 26, 2013 ATHLETE PLEDGE AND AGREEMENT I pledge to uphold the spirit of this Code of Conduct (the Code ), which offers a guide to my conduct as a member of a U.S. Paralympics Team or a U.S. Paralympics Team to international competition (the Team ). This Code applies to those Paralympic sports in which the United States Olympic Committee (USOC) has not recognized a Governing Body or a Paralympic Sport Organization to govern the sport. I acknowledge that I have a right to a hearing if my opportunity to compete is denied or if I am charged with a violation of this Code. I have familiarized myself with the Code and understand that acceptance of its provisions is a condition of my membership on the Team. As a Member of the Team, I hereby promise and agree that I: will abide by all published rules related to the Team selection procedures as approved by U.S. Paralympics or the USOC; have acted and will act in a sportsmanlike manner consistent with the spirit of fair play and responsible conduct; will maintain a level of fitness and competitive readiness that will permit my performance to be at the maximum of my abilities; will submit to a physical examination by USOC medical personnel if my ability to compete is compromised due to physical injury, illness or incapacity and I understand that such physical injury, illness or incapacity may be cause for my not being selected to the Team, being removed from the Team, or not being allowed to participate if I remain on the Team. will not commit a doping violation as defined by the World Anti-Doping Agency (WADA), the United States Anti-Doping Agency (USADA), the International Paralympic Committee (IPC) or USOC rules; am not currently serving a doping violation and/or do not have a pending or unresolved doping charge; 17

18 will not engage in any conduct that is criminal under any laws applicable to me, including, but not limited to laws governing the possession and use of drugs and alcohol and providing of drugs to any person and of alcohol to minors; will not participate or assist in any gambling or betting activities associated with any event related to my sport or my participation; am eligible to compete under the rules of the IPC and its pertinent committees, and its pertinent member organizations and under the rules of the USOC; am in possession of a valid USA passport, that will not expire prior to six months following the conclusion of any international competition, should I be chosen for an international team that requires a passport; will refrain from conduct detracting from my ability or that of my teammates to attain peak performance; will respect the property of others whether personal or public; will maintain a level of personal hygiene and cleanliness appropriate to respect my teammates; will respect members of my Team, other teams, spectators and officials, and engage in no form of discriminatory behavior nor in any form of verbal, physical or sexual harassment or abuse; will follow the Team rules, whether set by Team leadership or adopted by consensus, including by way of example, rules regarding curfew and required attendance at Team meetings; agree to wear the uniforms approved by U.S. Paralympics at official activities sponsored by the USOC or U.S. Paralympics as directed by U.S. Paralympics staff, and I agree to compete in the U.S. Paralympics-approved Team uniform, where such a uniform is provided, in competitions at which I am supported by U.S. Paralympics. I agree to wear the names and logos of U.S. Paralympics sponsors, suppliers and licensees on Team competition wear, other uniforms and casual wear as provided by U.S. Paralympics. I agree to not alter any Team uniform, either by removing or obstructing the names or logos of U.S. Paralympics sponsors, suppliers and licensees or by adding patches, stickers, or other means of displaying unauthorized names, logos or messages; agree to not demean or defame the USOC, U.S. Paralympics or its sponsors, their names, logos, marks, products or services. I acknowledge that endorsing and supporting U.S. Paralympics sponsors through my actions and words reflects well on the team and on those supporting the team. agree to be filmed, videotaped and photographed, and to have my image and voice otherwise recorded, in any media, during any event I am attending under the auspices of the USOC or U.S. Paralympics, by U.S. Paralympics official photographer(s), film crew(s) and video crew(s), and by any other entity authorized by U.S. Paralympics, under the conditions specified by U.S. Paralympics. 20 Attachment B UNITED STATES OLYMPIC COMMITTEE COMPLAINT PROCEDURES FOR U.S. PARALYMPIC NATIONAL TEAMS AND U.S. PARALYMPIC PROGRAMS January 7, 2008 Section 1. Jurisdiction. These Complaint Procedures are applicable to those Paralympic sports in which the USOC has not recognized a Governing Body or a Paralympic Sport Organization to govern the sport. Only matters concerning those Paralympic sports fall within the jurisdiction of these Complaint Procedures. Section 2. Designation of Complaints. The following kinds of complaints may be filed with the USOC: a. Administrative Grievance. The USOC or any aggrieved individual may file a complaint pertaining to any matter relating to the cognizance of the USOC, including but not limited to any alleged violation of or grievance concerning any USOC rule, regulation or code of conduct. b. Right to Compete. Any athlete, coach, trainer, manager, administrator or official may file a complaint pertaining to any alleged denial, or alleged threat to deny, of that individuals opportunity to compete in a USOC sponsored competition. Section 3. Manner of Filing. The complainant shall file the complaint with the USOC Chief Executive Officer. The complaint shall set forth in clear and concise language, preferably in numbered paragraphs: (i) the alleged violation, grievance, denial or threat to deny and (ii) the remedy requested. The complainant shall sign the complainant. Section 4. Statute of Limitations. A complaint filed under these Complaint Procedures shall be filed within one hundred and eighty (180) days of the occurrence of the alleged violation, grievance, denial or threat to deny. Section 5. Field of Play Decisions. The final decision of a referee during a competition regarding a field of play decision (a matter set forth in the rules of the competition to be within the discretion of the referee) shall not be reviewable through the procedures for, or the subject of, Administrative Grievances or Right to Compete Complaints unless the decision is: (i) outside the authority of the referee to make or (ii) the product of fraud, corruption, partiality or other misconduct of the referee. For purposes of this Section, the term referee shall include any individual with discretion to make field of play decisions. Section 6. Hearing Panel. Upon the filing of a complaint, the USOC Chief Executive Officer shall appoint a hearing panel consisting of three (3) individuals to hear the complaint. The Chief Executive Officer shall also appoint a chair of the hearing panel from among the three individuals appointed. At least one member of the hearing panel shall be an athlete. The Hearing Panel shall be responsible to ensure that all complaints are heard in a timely, fair and impartial manner. 20

21 Complaint Procedures January 10, 2008 Page 2 of 3 Section 7. Administration. The USOC General Counsel s Office shall generally administer and oversee all administrative grievances and right to compete matters filed with the USOC. Section 8. Conduct of the Proceeding. The hearing panel shall rule on all motions and other matters raised in the proceeding. If the complaint is not dismissed, the hearing panel shall hold a hearing on the complaint. The hearing panel shall set such timelines and other rules regarding the proceeding and the conduct of the hearing as it deems necessary. The hearing shall be informal, except that testimony shall be taken under oath. The hearing may be conducted by teleconference, if necessary or convenient to the parties. Each party shall have the right to appear personally or through a legal representative. All parties shall be given a reasonable opportunity to present and examine evidence, cross-examine witnesses and to present argument. Members of the hearing panel shall have the right to question witnesses or the parties to the proceeding at any time. Any party may have a record made of the hearing. A court reporter may be present at the hearing at the request of a party. The court reporter shall be paid for by the party requesting the court reporter, or if mutually agreed, the cost may be equally divided. Any transcript shall be paid for by the party requesting the transcript. Section 9. Expedited Procedures. Upon the request of a party, and provided that it is necessary to expedite the proceeding in order to resolve a matter relating to a competition that is so scheduled that compliance with regular procedures would not be likely to produce a sufficiently early decision to do justice to the affected parties, the USOC Chief Executive Officer is authorized to order that the complaint be heard and decided within forty-eight (48) hours of the filing of the complaint. In such a case, the hearing panel is authorized to hear and decide the complaint pursuant to such procedures as are necessary, but fair to the parties involved. Section 10. Complaints Involving Selection to Participate in a Competition. Where a complaint is filed involving selection of an individual to participate in a competition, the complainant shall include with the complaint a list of all other individuals, together with their contact information, that may be adversely affected by a decision rendered on the complaint. The hearing panel shall determine which additional individuals must receive notice of the complaint. The complainant shall then be responsible for providing appropriate notice to these individuals. Any individual so notified then shall have the option to participate in the proceeding as a party. If an individual is notified of the complaint, then that individual shall be bound by the decision of the hearing panel even though the individual chose not to participate as a party. Section 11. Decision. A decision shall be determined by a majority of the hearing panel. The hearing panel s decision shall be in writing, shall state the reasons for the decision and shall be distributed to the parties. Section 12. Arbitration. Any party may appeal a decision of the hearing panel to the American Arbitration Association. The arbitrator appointed by the American Arbitration Association shall have the authority to hear the matter anew or if requested by a party to render a decision on a more limited review. Either party may submit the 21
