1 SMG Youth Group Paintball Event Date / Time: March 4 th, :30 pm to 6:00pm Place: Mansfield Paintball Adventure Park 1600 Ousley Road Mansfield, TX Cost: $30 per person Pay at event the day of (includes everything needed to play mask, chest protector, air gun, 500 paintballs per person, etc.) Transportation: Each youth is responsible for their own transportation to and from the event. Forms: Please fill out the paintball park release form (attached) and the SMG Form B release form at: (put apoteet@smgparish.org as ID of Youth Minister) Info./Bring: Paint will wash out of clothes. Wear a shirt with long sleeves, long pants, sneakers. Bring towels or plastic for car ride back to avoid cleaning car. I recognize and understand that playing Paintball (hereinafter called the Game ) involves certain risks. Those risks include, but are not limited to, the risk of injury resulting from possible malfunction of the equipment used in the game and injuries from tripping or falling over obstacles in the game playing field. In addition, I recognize that the exertion of playing the game could result in injury, heat exertion/heat stroke, or death. 2. Despite these and other risks, and having a full understanding of these risks, I wish to play the Game and hereby assume the risks of playing the Game. I also hereby hold harmless Mansfield Paintball Adventure Park and indemnify them against any or all claims, actions, suits, procedures, costs, expenses (including attorney fees and expenses), damages, and liabilities arising out of, connected with, or resulting from my playing the Game, including without limitations, those resulting from any manufacture, selection, delivery, possession, use, or operation of such equipment. I hereby release Mansfield Paintball Adventure Park from any and all such liability, and I understand that this release shall be binding upon my estate, my heirs, my representatives, and assigns. I hereby certify to Mansfield Paintball Adventure Park that I am in good health, and DO NOT suffer from ANY heart condition or other ailment, which could be exacerbated by exertion involved in playing the Game. (Females: I further certify that I am NOT pregnant.) 3. I further certify that I am 18 years of age or older, or that my parent/legal guardian is 18 years of age or older. Release of Liability, Waiver of Claims, and Indemnity Agreement In consideration of participating in the Game, I hereby agree as follows: 1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against Mansfield Paintball Adventure Park, their directors, officers, employees, agents, and representatives, all of whom are hereinafter collective referred to as the releases. 2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, or expense that I may suffer or that my next of kin may suffer as a result of my participation in the Game due to any cause whatsoever, INCLUDING negligence on the part of the releases. 3. TO HOLD HARMLESS AND IDEMNIFY THE RELEASEES from any and all liability for any damage to property of, or personal injury to, any third party, resulting from my participation in the Game; and that this agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, and assigns, in the event of my death. 4. Any paintball playing photos of you or your child may be used in our marketing materials, including print, video, web, or any other forms of marketing media, are property of Mansfield Paintball Adventure Park. I can speak and read English. I have read and understood this agreement. I am aware that by signing this agreement I am waiving certain legal rights, which I or my heirs, next of kin, executors, administrators, assigns, may have against the releases. INITIALS REQUIRED PARENTAL CONSENT (required for participants under the age of 18) I, the minor s parent and/or legal guardian, have read every section of this waiver and understand the nature of above referenced activities and the minor s experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge, covenant not to sue and agree to indemnify and save and hold harmless each of the releases from ALL liability, claims, demands, losses, or damages on the minor s account caused or alleged to have been caused in whole, or in part, by the negligence of the releases or otherwise, including negligent rescue operations, and future agree that if, despite this release, I, the minor, or anyone on the minor s behalf makes a claim against any of the above releases, I will indemnify, save, and hold harmless each of the releases from any litigation expenses, attorney fees, loss liability, damage, or cost any release may incur as the result of such claim. 3 Mansfield Paintball AdventurePark Safety Rules and Terms of Agreement Form Safety Rules 1. All players will use an ASTM-approved paintball goggles at ALL TIMES in any shooting area. 2. All players will keep their mask on at ALL TIME while in any shooting area. The only time masks may come off is in the designated safety zones. If a player s mask becomes damaged in anyway, he or she must immediately bring it to the attention of the referee, who can then issue new equipment to the player. All players will put their Barrel Bag on at the end of the Barrel when off the field or chrono area. 3. All paintball markers must be covered with a paintball-manufactured barrel cover in all non-shooting, safety areas. Barrel plugs are NOT allowed at Mansfield Paintball Adventure Park. Players may rent a barrel cover for $2.95 or players may buy a barrel cover for $ Mansfield Paintball Adventure Park does not refill CO2 gas tanks. Players may rent a compressed air tank for $4.00. Never tamper with a gas bottle or propellant, as these are potentially dangerous and should only be filled and serviced by a qualified personnel. 5. Players will NOT shoot paintball markers into or around the registration area, staging area, neutral zones, parking areas, or any other non-shooting, safety areas. 6. If faced with an opponent at a short distance (less than 20 feet), they must ask them to surrender. Players will NOT shoot paintball markers at an opponent close range (5 ft. Or less). The first one to simply get tagged out (Touched) will be eliminated. 7. Players will not bring or use any alcohol or tobacco related products at any time on Mansfield Paintball Adventure Park grounds. 8. Mansfield Paintball Adventure Park is a field paint only facility. Players will use only Mansfield Paintball Adventure Park paintballs. Employees and Referees reserve the right to inspect hoppers, gear bags, pods, loaders, caddies or coolers at any time. 9. All players must watch a safety orientation video before entering the fields. 10. Players will avoid all field hazards; man-made or natural. Player will NOT curse, use vulgar or hateful language. 11. Players will NOT climb any trees, fences, walls, or on top of any structures. 12. Glass containers are not allowed on Mansfield Paintball Adventure Park grounds. 13. All spectators and players must stand at least 5 feet from all netted areas. Leaning on or standing too close to these areas could cause injury. I further agree and understand that I am NOT TO REMOVE THE PROTECTIVE FACE MASK while on the playing field or the surrounding area, and I understand that removing the protective face mask while on the playing field or surrounding area may result in permanent loss of eye sight. 14. All paintball markers must be chronographed under 280 fps by an employee of Mansfield Paintball Adventure Park before they can play. Players CANNOT adjust their marker after it has be chronographed. Any player found adjusting their mark after it has be chronographed will be ejected from the park grounds. The MAX Rate of Fire for any Paintball Marker here at Mansfield Paintball is 10bps. 15. All Referees decisions are final. Players are not allowed to argue with any Mansfield Paintball Adventure Park employees or referees. 16. These are NOT all the rules and regulations of Mansfield Paintball Adventure Park. Players must follow any rules or regulations stated by any Mansfield Adventure Park Employee, Referee AND in our Safety Video. No refunds will be given if any rules are NOT followed. 17. WE MAINTAIN THE RIGHT TO REFUSE PARTICIPATION TO ANY ONE ON ANY GROUNDS DEEMED APPLICABLE BY MANSFIELD PAINTBALL THERE ARE NO REFUNDS ON ANY PURCHASE IF YOU ARE ASKED TO LEAVE FOR ANY VIOLATION. (initials) I can read English, and I understand and agree to follow all the rules and regulations listed above and any additional rules and regulations as stated by any Mansfield Paintball Adventure Park Employee or Referee. (initials) I agree to use only Mansfield Paintball Adventure Park s paintballs at all times. Terms of Agreement I accept for use any equipment I rent from Mansfield Paintball Adventure Park, including, but not limited to, markers, goggles, mask, tanks, hoppers and I accept full responsibility for the care of the equipment while it is my possession. I will be responsible for the replacement (at full retail value) of any equipment that is rented, not returned, or damaged in any way to Mansfield Paintball Adventure Park. I agree and understand that I am responsible for my own personal property and will not hold Mansfield Paintball Adventure Park responsible in any way for any damage or loss of said property. All of the agreements contained herein shall be binding on my heirs, successors, assignees, administrators, and executors. This document is intended to be a legally binding contract. (I have also read and discussed these rules with my child/minor.) If you have any doubts concerning any aspect of its contents, consult an attorney BEFORE signing it. I have read every item of this contract. I hereby agree to the above terms. I speak and read English. I have read and understand what each item means, and I agree to abide by the terms of this contract. This contract applies to any and all paintball games or rentals that I participate in at this time or in the future. 5 2/18/2018 Form B - Consent to Participate, Code of Conduct, and Consent for Emergency medical Treatment (Parent/Guardian's Name) Area Code - Phone Number Diocese of Fort Worth Code of Conduct,expectations of all participants and dress code The purpose of this Code of Conduct is to identify personal behavior that is consistent with the purpose and objectives of the Diocese of Fort Worth. The items within the Code are based upon performance and are designed to protect the welfare of all participants. CODE OF CONDUCT OF ALL YOUTH PARTICIPANTS Youth will respect themselves, other people, other people s property, and church property. Youth will participate and contribute in a positive way in all activities and obey the instructions of the youth ministry, adult volunteers, and staff. During the event youth will show respect by not causing disruptions. Harassment, intimidation or bullying will not be tolerated under any circumstances. Youth will use language that reflects a Christian attitude. Youth will not use curse words or other foul language. Youth will maintain a Christian witness to the dignity of each person: no tickling, wrestling, piggyback rides or inappropriate touching (which means: do not touch anyone anywhere that a bathing suit would cover). In addition, physical displays of affection such as kissing, full body hugs, sitting on laps, and lying or sleeping next to each other are inappropriate. Being isolated or alone with another student is not allowed. Youth will wear modest clothing. No clothing that is sexually suggestive or spiritually degrading. T- shirts or other clothing with evil, vulgar, illegal, or inappropriate content will not be acceptable. In addition there should be: no midriffs, no low-cut tops, no spaghetti straps, no see through clothing, and no sagging pants to where underwear shows. Please do not wear short shorts. Shorts must follow the same guidelines as the school system. Youth will stay with the group at all times during the event and will not leave early unless approval from a parent or guardian ahead of time or in person. Youth will not possess any weapon of any kind (knife, gun, etc.) at any youth ministry activity at the church or event. Youth will not use, possess or be under the influence of alcohol, tobacco, marijuana or any other illegal drugs at any youth ministry activity. Youth will not engage in sexual intimacy or sexual harassment, and will not possess pornography at any youth ministry activity. Any illegal activity will prompt reporting to proper authorities depending upon the situation. In the event the Code of Conduct is violated by a youth, proper diocesan protocols will be handled by the diocesan employee, pastor, youth minister or adult volunteer in charge. Failure to comply with the Code of Conduct will result in disciplinary action, up to and including removal from the event.
