Matthews (Life Member) that apologies for the Annual General Meeting of Council also be accepted for Council meeting CARRIED Announcements W. Archer AM (President) Sadly, Jean Peare OAM and Grace McDonald from Randwick have passed and we have extended our condolences to both families. Kath Fullagar and Barbara Long received an OAM in the Australia Day Honours list for their services to Netball. Very excited that Amber Cross, Gima Crowdy, Therri Ellison, Marjorie Parr, Adele Caesar and Megan Anderson have all achieved their Advanced Coaching accreditation. Lenore Blades and Maria Lynch have been appointed to the National Selectors for the 17/U and 19/U Panels. Our 21 s finished third at their recent Nationals with Taylah Davies, Kristina Brice, Kristiana Man ua and Gretel Tippett being selected into the Australian 21 s squad. Sharon Kelly, Rachel Ayre, Jemma Carlton, Tara Warner, Helen George and Michelle Phippard have been appointed to the ANZ Championship for Umpires at the 21 s Nationals in Adelaide Bronwen Adams, Hayley Burgess, Emma Davey. Umpires to the Underage Nationals in Melbourne in April Emma Burgess, Kate Howard, Rebecca McKinnon, Haydn Mackay. Mo onia Gerrard was one of four finalists for the 2014 NSW Premier s Award for Woman of the Year. CEO: introduced new NNSW staff members: Tristan Prosser-Shaw - General Manager - Commercial and Communications Mike Anderson General Manager - Corporate Services Paul McMahon (Finance Manager) (not present at Council) (b) Confirmation of the minutes of the Extra Ordinary Council meeting held on Saturday 2 November 2013 Correction: Delegate K. Archer: Grading Panel was removed from Constitution; Rules Review Panel to be appointed by Board at its next meeting (next Tuesday) in accordance with previous practice. City of Sydney: Can Grading Panel be put back into Constitution? o W. Archer: That could only be taken with a notice of motion in line with the requirements of the Constitution. MOVED: Blacktown Seconded: Charlestown for the adoption of the Board report CARRIED Ex gratia payment to J. Hahn R. Watson recommended to Council an ex gratia payment of $5,000 to J. Hahn in recognition of work done and continuing to be done in 2014 on Netball Central. MOVED: Port Stephens Seconded: Eastwood/Ryde for an ex gratia payment of $5,000 to J. Hahn for work done in 2014 on Netball Central. CARRIED Reports: Finance Discussion: City of Sydney: Sought clarification of Income in Advance and GST is Income in Advance in relation to Netball Central? Page 5 of 45

Anderson (General Manager Corporate Services): Yes, Income in Advance relates to state funding for Netball Central funds will not be recognised until Netball Central is handed over to Netball NSW. GST is a combination of NNSW operations and projects. Sutherland: Worried about meeting budget Netball NSW budgeted for same surplus last year and ended up in the red. Is there enough in budget? Wish to avoid increases in membership costs. o CEO: Netball NSW only uses contracted sponsorship sums and grants in budget, any sponsorship or grants which are up for renewal are excluded from budget (even though they may be renewed through the course of the year). Staff realise that there is no additional funding apart from that already in budget and the newly created position of Finance Manager assists in monitoring this. We are conscious of generating new revenue streams to minimise reliance on membership subscriptions. MOVED: Liverpool Seconded: Randwick for the adoption of the Finance Report CARRIED Reports: Netball Central CEO spoke to the Netball Central report presented in Council papers and provided further update, noting that roofing would be onsite on 28 April and that builder s anticipated finish date is between end August and end September. MOVED: Blacktown Seconded: Orange for the adoption of the Netball Central Report CARRIED Reports: CEO s Operational Report MOVED: Grafton Seconded: Blue Mountains for the adoption of the CEO s Report CARRIED (k) Any other Reports Nil General Business Presentation by NSW Fair Trading: Responsibilities of Associations Shobhna Pandaram, Community Liaison Officer of NSW Fair Trading, addressed Council about Associations obligations, minimum requirements and processes. She also recommended that Associations check that they understand those obligations and regularly review their Constitution and processes to ensure compliance. Shobhna also stated that Associations should select appropriate insurance policies for their needs and communicate freely with insurers to ensure compliance. Camden: Could this presentation be made available to Associations? o W. Archer: Will be sent out with minutes and is available as a handout at Council meeting. Presentation by V-Insurance: Responsibilities of Associations Rob Veale of Willis/V-Insurance addressed Council on current insurance claims, claim trends, Associations obligations under new legislation, breadth of insurance environment (including cross training), need for Associations to comply with their own processes, importance of Match Day checklist and various Page 6 of 45

7 recommendations and due diligence considerations. A handout is available today for Associations to take back to their members. R. Veale specifically recommended Associations review all agreements currently in place (such as those with their local Council/property owner) to check if Associations have provided indemnity for a risk which is not covered by the Association s insurance. He suggested that Associations send any agreements to Willis/V-Insurance via Netball NSW and insurer will review those agreements. Willis/V-Insurance welcomes the opportunity to provide any comment/answers to any Association regarding insurance matters. Rob particularly noted that if Associations have any issues with Council or property owner not providing facilities in safe condition then contact Willis/V-Insurance to assist. CEO: Comprehensive policies are available from Netball NSW and Netball Australia and member Association s policies need to comply with policies of Netball NSW and Netball Australia. Netball NSW strongly encourages any questions from Associations on insurance just ask. Newcastle: Is the insurance year from 1 January to 31 December? o R. Veale: Yes. Sutherland: Should we be monitoring umpires to prevent insurance claims? o R. Veale: In the insurance claim case discussed, the player had sued the umpire personally, not the Association. Associations have an obligation to ensure that umpires are adequately trained. Sutherland: Noted the increase in claims about coaches training techniques do we have duty of care to warn coaches of the risk of being sued? o R. Veale: If training occurs in the correct manner then the risk of injury is minimised Associations need to ensure that coaches are appropriately trained. Rob gave example of a player who had informed coach of an injury so the coach modified that player s training appropriately. W. Archer: Due diligence for Associations would include accreditation and updating of qualifications of umpires, bench officials, coaches, trainers and administrative staff to mitigate the risk of injury or claims. R. Veale: Restated that all Associations should feel free to contact insurer or Netball NSW about any insurance matter. Presentations and workshop led by Marne Fechner and Alana Thomson: 2015 Netball World Cup Marne Fechner addressed Council on progress of 2015 World Cup, volunteering mechanism, impacts on Associations and opportunities for netball in Australia. Alana Thomson gave detailed overview on legacy opportunity of Netball World Cup and led Council in workshops on legacy. Each group s individual results to be collated and distributed via Netball NSW. Presentation by Nathan Walker (Competitions Coordinator - Netball NSW) 2015 Netball World Cup Legacy Nathan reviewed the legacy work to date by Netball NSW and presented a number of options for consideration by Associations for their planning of 2015, including a draft calendar and possible competition opportunities to entice new players to netball. Nathan s presentation to be ed out to Associations and made available on the Netball NSW website on 30 March. Sutherland: With summer sports still running at end of March, the draft calendar shows conflict between local sporting bodies scheduling. Page 7 of 45

8 o W. Archer: An opportunity to engage with other sporting groups in the community, explain the rationale for the change in schedule. Encourage them to be amenable to date change in view of the widespread support in the community for the Netball World Cup. City of Sydney: Has subscribed to Centre Circle on the Netball Australia website, where does one enrol for volunteering? o M. Fechner: Centre Circle list will have first bite at volunteering opportunities so encourage everyone to subscribe to Centre Circle as first step in volunteering. City of Sydney: Will volunteers have the opportunity to watch games while volunteering? o M. Fechner: Yes, volunteers will have the opportunity to watch games. City of Sydney: What will be ticket cost? o M. Fechner: Ticket costs not yet finalised as we are in final stages of broadcast negotiations which will impact ticket pricing. Prices due to be finalised in May City of Sydney: If potential volunteers do not have access to internet, how will they subscribe to Centre Circle or volunteer? o W. Archer: Netball Australia and Netball NSW will work together to establish protocols, probably utilising services of local library s internet support services. Sutherland: If Netball competition starts in February then clubs will need to register players in January, even before start of school term timetable is unrealistic. o W. Archer: Draft timetable is not mandatory, just pointing out various options for Associations consideration. Just asking Associations to consider what will work for them in their local environment, accept that one solution may not work for all Associations. o CEO: Netball World Cup presents a once in a lifetime opportunity to capture new interest in netball we must share ideas and be ready to capitalise on the excitement of Netball World Cup. o N. Horton: Netball clinics held in school holidays can also attract players inspired by Netball World Cup. Bankstown: Worried about workload on Associations additional workload caused by earlier season and volunteering for Netball World Cup. o W. Archer: Fully understand the workload on Associations, volunteering for World Cup is not mandatory. Baulkham Hills: 1991 Netball World Cup fell in the middle of the NSW netball season and we worked around that schedule Cup generated a huge amount of interest and increase in players. Everyone involved in 1991 Cup has wonderful memories of it. If we don t work at it we cannot complain if we don t get anything out of it. General Business (continued) Liverpool passed on thanks from Barbara Long for the many messages of congratulations she received on the award of OAM. Mt Druitt: noted that it is now in its 30th year of competition. Lyn Burgess OAM: Historical Committee is seeking copies of Council minutes from 2006 or 2007 for archives also seeking programs of netball events held in 1970s, 80s, 90s. If any current member has any connection with older players of state or national teams please let the Historical Committee know so it can ask to record or gather any mementos/memories Eastwood/Ryde - celebrating 60 years of Netball this year. Camden: Will SMS weather service be available with My Netball Page 8 of 45

9 o S. Gouveia: Yes, available by paid subscription, contact Interact direct (will send out information with minutes) Camden: in discussions with local council, moving to new complex within next 3 years with 44 courts Manly requested additional scorers and sought training dates: o N: Horton already scheduled and will be provided Orange: Has come to an arrangement with local Toyota dealer which has supplied the Association with a new Corolla at no cost, also sponsoring Division 1 competitions and state league. Media frenzy expected on Monday at the announcement. Sutherland: Wish to record the fiasco of My Netball lack of support from IT (excluding NNSW from criticism) new system has caused untold work for our volunteers, lots of communication back and forth with My Netball administrators, necessitating bringing in local IT support to get the system working. o W. Archer: Completely understand. Netball NSW has been extremely vocal to Netball Australia about just these issues. Have had Netball NSW staff on working party to get it functioning at grass roots level. o CEO: Our people have been doing everything we can to get My Netball working - we are having same frustration with Netball Australia we apologise we will take your comments back to Netball Australia. Baulkham Hills: Will it assist Netball NSW if Associations record in writing their dissatisfaction and the problems encountered with My Netball? o WA: Yes, definitely. Please send to Netball NSW a summary of your My Netball registration and functionality experience before the May Strategic Forum so we may pass the feedback to Netball Australia. L. Quinn OAM (Life Member): Netball NSW budget shows $62,000 for My Netball, why can t we produce a My Netball for Dummies style instruction set - no paperwork is provided by Netball Australia. o CEO: $62,000 in NSW budget is license fee. o S. Gouveia (Association Development/Membership Manager, Netball NSW): Instructions are available on the website: 4 manuals and a quick guide, Netball NSW can it to Associations if required. o W. Archer: If any Association has any questions, please Netball NSW. Bankstown: Commendation to Kristy Guthrie, Netball NSW team, for work done in Bankstown District, including the very successful come and try program - this year s registrations have increased. Believe that cultural issues experienced at Bankstown will spread to other Associations and commends the programs available through Netball NSW and personal enthusiasm of Kristy Guthrie. Shoalhaven: Thanks for support of Schools Cup, including great effort from Regional Development Manager Nicole Bowles had 40 teams participate in Schools Cup (including 12 high schools). 10 BUSINESS ARISING NOTICES OF MOTION (i) Changes to Rules for Championships & Competitions The proposed Rule changes below have been put forward in consultation with the Netball NSW Rules Review Panel as well as the Netball NSW Board. Page 10 of 45

11 1. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that the word District be removed from the entire document. 2. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 4 of the Grading Procedure Region 1 State League be amended as follows: 4. A District Association is permitted to have one team only in each a division of State League. 3. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 9 of the Grading Procedure Region 1 State League be amended as follows: 9. a.) Where a player s name appears on more than one team entry form the player will be contacted by Netball NSW personnel prior to grading and the player must then immediately nominate the District Association that they will be playing with. The District Associations concerned will be advised accordingly. The Association not nominated by the player will be given 48 hours from the time of advice to replace the player without penalty. b.) c.) Where a player s name is removed from a team entry form by Netball NSW personnel prior to grading the Associations concerned will be advised accordingly. The Association will be given 48 hours from the time of advice to replace the player without penalty. Where a player s name is removed from a team entry form by Netball NSW personnel prior to grading Associations will be given 48 hours to replace the player concerned. Associations will be allowed to move one player up from lower divisions to replace the removed player. Associations will be allowed to nominate one (1) player (per player removed by Netball NSW personnel) who was not on the original entry forms. Grading will then be completed after this time. 4. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 10 of the Grading Procedure Region 1 State League be amended as follows: 10. District Associations are permitted to register only one (1) import player into the Waratah Cup Division 1 competition. An import player is defined as a player who is registered in a Tasman Trophy team in the current year or an international (non Australian citizen) player who has played at the international level in an Open competition within the previous calendar year. An import player can only be registered in the Waratah Cup competition. 5. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 17 of the Grading Procedure Region 1 State League be amended as follows: 17. Subject to Clauses 154 and 165, grading will be based on the seven (7) players with the highest player status. District Associations with teams who retain five (5) players from the previous year will receive a bonus of six (6) grading points which will be added to that team(s) accumulated status points used for the purpose of grading. In this circumstance, five (5) players from the previous year will be included in the teams accumulated status points. Page 11 of 45

12 6. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 21 of the Grading Procedure Region 1 State League be amended as follows: 21. Where two or more teams have equal status points the grading priority will be determined by which team has the most players from a same team in the previous season. If teams are still equal grading will be determined by the final finishing position of the teams in the previous year. Where two teams have equal status points and played in different divisions in the previous year or did not compete in any division in the previous year the grading priority will be determined by the team that played in the higher division. NB: For the purpose of Clause 210, ladder positions will be based on the team that the majority of the current team played in in the previous year, noting that this may not be their current association. 7. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 25 of the Grading Procedure Region 1 State League be amended as follows: 25. On completion of final grading all official team entries together with player status will be updated on the Netball NSW player database and maintained by the Netball NSW office. The database is only available to Netball NSW staff, the Grading Panel and the Appeals Tribunal. 8. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 26 of the Grading Procedure Region 1 State League be amended as follows: 26. The player status details as identified in Rule 232 will remain on the Netball NSW website for two subsequent years after the completion of the current competition. 9. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 5 of the Playing Rules for Region 1 State League Competitions be amended as follows: 5. Each team is to provide up to two (2) approved scorers/timekeepers who have completed the IFNA INF Bench Officials Workshop according to the draw. District Associations shall provide an approved stopwatch. Where a District Association fails to provide the appropriate number of approved scorers/timekeepers a fine of $50.00 will be imposed. Netball NSW will remove any person who has not completed the IFNA INF Bench Officials Workshop from the bench and a fine of $50.00 will be imposed on the offending District Association. 10. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that the following clause be inserted into the Playing Rules for Region 1 State League Competitions be amended as follows: 7. Each team will be allowed a maximum of 2 forfeits throughout the competition without penalty. On the 3 rd occasion the forfeiting team s association will be fined $ Each subsequent forfeit, the fine will increase by $ A team who withdraws from the competition after the commencement will be classed as forfeiting each match after this date. Extenuating circumstances may be considered at the complete discretion of NNSW Page 12 of 45

13 11. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 18 of the Playing Rules for Region 1 State League Competitions be amended as follows: 198. Players may play up to two (2) matches in any given week subject to the following conditions: a) Games must be in alternate time slots if played on the same night b) One game must be in the team in which the player is registered c) Additional game must be in a higher graded team from the same association as the player is currently registered for A player may participate in a maximum of two matches per week provided that they play either in the team in which they are registered or in teams in higher divisions. At all times the player must play with the District Association with which they are registered. A playing week is deemed to be from Wednesday to Tuesday. 12. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 19 of the Playing Rules for Region 1 State League Competitions be amended as follows: Where a player plays five (5) matches games in a division higher than that originally graded, on playing her fifth game in the same higher graded team, the player will remain in that higher graded team for the remainder of the season. season and cannot then participate in any other game in any higher graded division for the remainder of the season. Players must have played a minimum of five (5) games in their original team and division to be eligible to play their fifth game in a higher graded team. A player may only be a member of a team in a maximum of two divisions in one season. Once a player becomes a member of the higher graded team, the player may be borrowed by a team in a higher grade than this team, but only a maximum of 4 times. 13. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 1 (i), (ii) of the Grading Procedure for Regions 2-8 State League/Inter District Competitions be amended as follows: 1. The format for the competitions shall be divisional. Up to eight (8) divisions shall be used as required, according to the number of entries received. Teams will be graded into Divisions based on two age classifications. (i) (ii) Open Divisions(s) with a minimum age of 1516 years as at the 31st December in the year of play. Netball NSW can use discretion in extenuating circumstances. 17 and Under for players who have not attained the age of eighteen (18) years as at December 31 in the year of play. With a minimum age of 1415 years as at the 31st December in the year of play 14. MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 9 of the Playing Rules for Regions 2-8 State League and Inter District Competitions be amended as follows: 9. Players need to have played two (2) matches with the relevant team, to qualify for finals series in single round (ie. each team plays each other once) competitions. Exemption to this rule will be granted where Associations are able to provide a medical certificate outlining a players reasoning for not meeting this match requirement. Page 13 of 45

MOVED Lynn Quinn OAM and seconded by Jane Hauser (on behalf of the Rules Review Panel) that Rule 10 of the Playing Rules for Regions 2-8 State League and Inter District Competitions be amended as follows: 10. If double or more rounds are played (ie. teams play each other twice or more), players must have played at least three (3) games to be eligible for the finals series. Exemption to this rule will be granted where Associations are able to provide a medical certificate outlining a players reasoning for not meeting this match requirement. 16. The Associations concerned will be advised accordingly. The Association not nominated by the player will be given 48 hours from the time of advice to replace the player without penalty. b.) c.) Where a player s name is removed from a team entry form by Netball NSW personnel prior to grading the Associations concerned will be advised accordingly. Where umpire nominations are not received by this date the District Association will be fined $ and must nominate umpires as per Rule 2 (a) within 24 hours of notification of $ fine. District Associations, withdrawing umpires after the confirmation date will be fined $ per umpire withdrawn unless a medical certificate is produced that certifies the umpire s unavailability due to illness or injury or other extenuating circumstances. If an umpire is not replaced with an equivalent badged umpire a further fine of $ is enforced. Where an umpire withdraws on the day for other than medical reasons or other extenuating circumstances, or does not show that District Association will incur a fine of $ per allocation per day. 26. General (r) If, in the opinion of Netball NSW games are unable to be played due to severe inclement weather or adverse court conditions, each team fixtured to play will be awarded one (1) point. No points will be awarded for teams having the Bye. (w) No venue will be considered to host an event unless all necessary facilities are in place. (x) Netball NSW will determine the suitability of venues to host a division of the Championships having regard to the total operational environment as detailed in the Netball NSW State Events Checklist. Forfeits (a) District Associations entering teams that forfeit or withdraw after fixtures have been arranged, may be liable for a fine of up to $50 per team, such fine shall be paid to the District Association conducting the carnival within seven (7) days of receipt of the account, provided the account is forwarded to the offending district association within twenty one (21) days of the date of the carnival. However, the host District Association will be entitled to charge a $100 fine on any team which does not appear on the day of the carnival. such fine shall be paid to the Association conducting the carnival within seven (7) days of receipt of the account, provided the account is forwarded to the offending association within twenty one (21) days of the date of the carnival. 20 1. Vision 2015 An update will be a presented by the Board to the November Council meeting on how we have tracked against the strategic priorities. 2. Netball Central Included in the papers is a full report on the progress of Netball Central. The Board continues to monitor the progress of the building through the monthly reports generated. 3. Annual General Meeting 2015 Please be advised that the Annual General Meeting and 1 st Council Meeting will be held on Saturday 21 March A calendar detailing other key dates will be available at the Council meeting. 4. Membership Fees As Netball Australia capitation fees from 2015 onwards will no longer be charged on a per member basis, the Netball Australia component will no longer be itemised for simplicity. The fee increase for 2015 is based on the Australian Bureau of Statistics CPI increase of 3% for June 2014 which is consistent with the increase model adopted by Netball Australia. The Finance report details an increase in membership fees for 2014 of $1.92 for Senior, $1.45 for Junior, $1.23 for NetSetGo!, $0.65 for PWD and $0.98 for Non Players. The Board commends this increase to Council. 5. Policies Updated There have been amendments made to a number of policies over the period between March and October. Any amendments to these policies are notified by to Association Secretaries. By referencing policies through the Netball NSW website you will always access the most recent version. 6. In recent years there have been further increases in the operational costs in the provision of security, walkways and first aid attendants. These costs along with the increased costs imposed by local government have seen the cost of staging these events continue to rise. A fee increase of 10% is proposed. 25 As you will see from the following report Netball Central is well and truly on its way to being completed. We are now in the stage of packing up the Anne Clark Centre and we are very excited to be moving into Netball Central. State team trials have commenced with some great talent coming through our pathways. The 2015 NSW Swifts roster has been completed and we are looking forward to an exciting year in the ANZ Championship. Netball NSW has had the following staff changes: Rosa Comis and Rebecca Pollard were due to return from maternity leave however, they have resigned from their respective roles. Paige Wilson resigned from her role as Corporate Receptionist and Julie Wade has commenced in the role of Receptionist & Customer Service Officer Mimi Vekic ceased her employment with Netball NSW. Rebecca Donaldson has commenced in the position of Membership & Ticketing Sales Coordinator. Amy Quirk was appointed to the position of Community Engagement and Legacy Officer (funded by Netball Australia). This is a contracted position until December We have agreed to a secondment for Amy with right of return to her current position at the end of her contract. Carolyn Waite has been appointed to the position of Junior Development Coordinator. Paul McMahon has ceased employment with Netball NSW. Rana Ensor has replaced Paul in the role of Finance Manager. Sarah Sugar has been offered an opportunity to join the NWC2015 team commencing from September 1. Netball NSW has offered Sarah a 13 month secondment to support her. Ashleigh Wedd has been appointed to the role of Sponsorship Coordinator. Mikaela Caldwell resigned from her position as Sport Development Administrator. Mikaela finished with NNSW on Friday 29 August. Ella Durheim will be replacing Mikaela as the Sport Development Administrator on a temporary contract. Ben Jessimer has been appointed Venue Operations Manager for Netball Central. Netball Central Megan Simpson November 2014 The development of the Netball Central project at Sydney Olympic Park has progressed through a number of issues including: Construction Works Forecourt and external areas: o Stair 23 with permanent handrails and temporary balustrading installed. o Exposed aggregate topping to footbridge area completed. o Sewer side line works completed. o Works to lower forecourt proceeding with a number of the precast concrete seats installed. o Southern storm water system still in progress. o Landscaping soil installed in forecourt. o Commencement of palm tree plantation.
