1 PENDLETON ROUND-UP QUEEN AND COURT CONTRACT 2017 This QUEEN AND COURT CONTRACT is entered into between THE ROUND-UP ASSOCIATION, which is referred to in this Contract as Round-Up or as we and, who is referred to in this Contract by name or as you. RECITALS A. Round-Up has selected you to serve as a member of the Round-Up Court. As a member of the Round-Up Court, you will be a very public representative of the Round-Up, and in a more general way of eastern Oregon. This means it is and will be important for you to conduct yourself at all times in a way that is consistent with the high standards and ideals of the Round-Up, and of your community in general. B. The purpose of this Contract is to identify in a general way some of the responsibilities and duties you will have as a member of the Round-Up Court; to identify some of the expectations that the Round-Up has of you in terms of the way you conduct yourself, both when you are acting as a member of the Round- Up Court, and in your private life; and to explain some of the additional terms you agree to as a member of the Round-Up Court. C. By signing this Contract, you are agreeing to perform all of the responsibilities and duties of a member of the Round-Up Court; you are agreeing to meet (or exceed) the expectations the Round-Up has of you in terms of the way you conduct yourself; and you are agreeing to all of the terms set forth in the Contract. D. It is not possible to list all of the responsibilities and duties you will have as a member of the Round-Up Court, as those responsibilities and duties may change from time to time; it also is not possible to list all of the ways you can and cannot conduct yourself as a member of the Round-Up Court. By signing this Contract, you are also agreeing and recognizing that whether you have performed your responsibilities and duties, and whether you have met the expectations the Round- Up has of you in terms of the way you conduct yourself, will be determined solely by the Round-Up, and by its Board of Directors, based solely upon the exercise of their discretion. AGREEMENT 1. Responsibilities and Duties: In general, your foremost responsibility and duty to the Round-Up is to serve as a public representative and ambassador of the Round- Up, and to project in public and in your private life an image consistent with the high standards and ideals of the Round-Up, and you agree to do this. Specifically, but without limitation, you also agree:

2 Round-Up Queen & Court Contract Page 2 (a) Round-Up Court duties come first throughout the year, before work, school events or other events including, but not limited to vacations; 1 Round-Up functions generally are scheduled well in advance. 2 Occasionally, you will be asked to make a change or appear on short notice. Round-Up activities must have priority over your personal schedule. 3 Flexibility on your part to meet the needs of the Round-Up Association will be required to meet this responsibility. 4 Court members will not be allowed to compete in rodeo events or other athletic events during the summer season if it in any way conflicts with their Round-Up related activities. If a Round-Up event is changed the Court member must be willing to miss a rodeo or athletic event. (b) That you will perform to the very best of your ability such specific responsibilities and duties as may from time to time be assigned to you; (c) That you will be on time for all required functions; promptness, you are expected to be at the meeting point on time, not five minutes late. It is a good idea to allow minutes extra time for unexpected delays when leaving home for appointments. (d) (e) That you will make sure your appearance is at all times appropriate to your position as an ambassador of the Round-Up, and that you will be dressed and groomed appropriately for all required functions. 1 When in Round-Up outfits, appearance and good grooming are top priority. This includes such details as attitude, tone of voice, and the "look" you offer in public--you are the Round-Up image. Professionalism is paramount. 2 The Court is to be poised, but not stuffy" and above all, friendly. For example, introduce yourself to other courts when attending luncheons. You are the example or mentors of all others. You are ambassadors of the community. As such when on Court travel and appearances and general duties the focus will be upon Court duties. 3 The use of cell phones will not be allowed during Court duties. 4 Make-up and Hair: Hairstyle and length will be uniform and determined by Court Director and Chaperone. Round-Up pays for original haircut and styling. It will be up to each girl to maintain that style and length for the season. Appointments for haircuts and styling will be scheduled as a Court to maintain uniformity. Makeup will be determined by the Chaperone or Director and will be maintained as directed. Either fix your hair and apply your make-up before leaving home or allow adequate time to do so at the meeting point. 5 Tongue rings or other body piercing (besides normal ear piercing) and visible tattoos will not be allowed. Only jewelry designated by the Chaperone or Director will be allowed. You must furnish a horse and equipment that is acceptable to the Round-Up Director. If your horse is deemed unmanageable by the director, you must be willing to provide another mount.

3 Round-Up Queen & Court Contract Page 3 1. Horses and equipment are expected to be properly maintained and cleaned for each function. 2. The Court member and parents will agree to follow the defined Horse Grooming standard. This usually means washing the horse before each function. 3. Clear hoof polish will be used on hooves, and all horses will be clipped in general uniform presentation. 4. A bay or sorrel horse is required for use in all Court activities. 5. Two horses must be available for use throughout the Round-Up Year. 6. Alteration of the natural color of the horse will not be allowed to attain a bay or sorrel horse appearance. (f) Financial responsibilities 1. The Round-Up furnishes: multiple outfits, boots, hat, etc., official portrait and travel expenses for Court. 2. Pin money or spending money for items that are beyond those provided for by the Pendleton Round-Up will be the responsibility of the Court member and her family. 3. Financial responsibilities of this year could cost a family between $7, and $10, or more (this is an estimate only) specifically these expenses include the Tack and Trappings for the Court, the party put on by the Parents for those who have gifted the Court during the year, and travel with horses to official activities and related court functions. This does not necessarily include additional travel costs when parents are invited at their own expense. 2. Conduct. We expect you to, and you agree to, conduct yourself at all times in a way that is consistent with the high standards and ideals of the Round-Up, and of your community in general, as determined by the Round-Up and by its Board of Directors, based solely upon the exercise of their discretion. Specifically, but without limitation, you agree: (a) That you will not drink alcoholic beverages, or take or use illegal drugs, during the term of this Contract. Illegal drinking of alcoholic beverages or use of any controlled substance is cause for dismissal from the court. (b) That you will not smoke cigarettes or use tobacco during the term of this Contract. (c) That you will not get married, or become pregnant, during the term of this Contract. (d) That if you have a boyfriend, your contact with him will be discrete, and you will not engage in any public displays of affection that would be inconsistent with the high standards and ideals of the Round-Up. Boyfriends may not accompany court members or their families during Round-Up related functions. This includes travel to and from Round-Up functions, as well as during these functions.

4 Round-Up Queen & Court Contract Page 4 (e) That you will not compete for or accept any other titles or positions which interfere with your ability to perform your responsibilities and duties as a member of the Round-Up Court; (f) That you will immediately report to your chaperone any condition or problem which may, in any way impair your ability to perform your duties and responsibilities, or which may constitute a breach of this Contract; (g) Behavior and/or medical conditions that prevent a court member from fulfilling the expectations and duties of the court, or that detract from the expectations of the court will also be cause for dismissal from the court. (h) That you stay in the Round-Up Court group at all times while at Round-Up activities. The image of the Pendleton Round-Up Court is the presentation of five members as a unit, therefore, general expectations should be that all members leave from a designated area and will be arriving back at that same area as a group. The Court will travel as a group to and from all events unless other arrangements are approved by Court Director. (i) Deciding the Dress Code requirements for all events is the decision of the Director and or Chaperone. You will dress to the code the Director or Chaperone has asked of you. You will also wear the make-up and hairstyle asked by the Director or Chaperone. 1. Clothing must be complete at all times 2. Round-Up outfits shall only be worn when making official appearances. 3. The Court will travel as a group to and from all events unless other arrangements are approved by Court Director. The image of the Pendleton Round-Up Court is the presentation of five members as a unit therefore the Dress Code will be worn when traveling as a Court from the time the group leaves until arriving back to the area as a group. 4. All provided outfits will need to be maintained in clean, ready to go condition. Some of the summer outfits may be handwashed in cold water. Check with Court Chaperone on clothes care. Leathers can be wiped off with damp sponge. Dry cleaning must be done as directed by the Court Director and/or the Chaperone. If items are lost or not maintained, replacements will be at the expense of the Court member and her family. (j) Proper etiquette and manners 1. All invitations requesting, RSVP" will be answered promptly. 2. All parties and gifts will be acknowledged with a personal thank you note from each member of the court (and parents) within ten days following the event.

If in doubt, the instruction of your director should be requested and observed. (k) Make sure everyone remains at all required events as a court. Use the buddy system, always at least two girls together, even to go to the restroom, to go back through a buffet line, or walking around at any function. (l) Any member of the court that displays behavior not consistent with the Round-Up standards as given in the Pendleton Round-Up Queen and Court Contract" or in the guidelines, as determined in the sole discretion of the Round-Up Board of Directors, will be subject to such disciplinary action as the Round-Up Board of Directors deems appropriate, including without limitation removing you as a member of the Round-Up Court. You understand and agree that if you are removed as a member of the Round-Up Court, you will lose all of the rights, privileges, and Round-Up property associated with that honor. You also agree to hold harmless the Round-Up, and its Board of Directors, from any claims you may have as a result of removal, or other disciplinary action. 3. Conduct of Parents. Parents must be at all times supportive of the Round-Up, Court members, the Court Director and Chaperone. Any opinions on the Court should be expressed in good taste and at a time that won't interfere with the execution of court duties. Any parents who persistently cause problems in court matters will be putting their daughter's position on the court in jeopardy. The parents and families traveling with the Pendleton Round-Up Queen and Court to activities will be viewed as part of the entire team by the public and should attempt to present a consistent image that embodies and reflects our legendary and historic organization and the high standards it represents. 1. Harassment/Bullying/Teasing. Attached here as an addendum. 2. Social Media Policy. Attached here as an addendum. 3. Horse Grooming Guidelines. Attached here as an addendum. 4. Parent Questionnaire. Attached here as an addendum. 5. Medical Release and Insurance. Attached here as an addendum. 6. Our Discretion: If, in the sole discretion of the Round-Up, or its Board of Directors, you breach this Contract, or in any way conduct yourself in a way that is inconsistent with the standards and ideals of the Round-Up, which standards and ideals shall be determined in the of the Round-Up or its Board of Directors, then you agree that the Round-Up may take such actions as it deems appropriate in its sole discretion, including without limitation removing you as a member of the Round-Up Court. You understand and agree that if you are removed as a member of the Round-Up Court, you will lose all of the rights and privileges and Round-Up property associated with that honor. You also agree to hold harmless

6 Round-Up Queen & Court Contract Page 6 the Round-Up, and its Board of Directors, from any claims you may have as a result of removal, or other disciplinary action. 7. Term of this Contract: This Contract shall become effective on the date is signed by the Round-Up and by you, and shall remain in effect until you have performed all of your responsibilities and duties as a member of the Round-Up Court or expiring one year from the date of this agreement, whichever is earlier. 8. Round-Up Property. The Round-Up will provide you with various outfits and apparel items for you to wear in performing your responsibilities and duties as a member of the Round-Up Court. These items remain the property of the Round- Up during the term of this Contract. After you have performed all of your responsibilities and duties as a member of the Round-Up Court, these items are typically given you as a souvenir of your time on the Round-Up Court. 9. Liability Release and Hold Harmless Agreement. You understand and acknowledge that some of your responsibilities and duties are inherently dangerous and may place you at risk of serious injury, or even death. You agree to release and hold harmless the Round-Up, its Board of Directors, Officers, employees, agents and assigns, from any and all claims, losses, and liabilities of any kind arising from or connected with the performance of your responsibilities and duties, or with the subject matter of this Contract generally. You also agree to maintain a policy of health insurance during the term of this Contract and to provide proof of insurance upon request. The Round-Up Association provides liability insurance to cover any accidents involving spectators and participants. Any injuries or damage incurred by a Court member will first be covered by their own personal insurance with the Round-Up insurance as secondary coverage only and only if applicable to the subject injury or loss. This Contract and release form must be signed by Court members and their families and helpers.
