2 1) Vendors shall have the sole responsibility for obtaining and displaying a Class A Food Permit and for obtaining all applicable business privilege licenses as required by law or ordinance, and are solely responsible for the collection and payment of all applicable City and State taxes. Tucson telephone number for City Business License is (520) Pima County Health Department number is (520) ) It is agreed that the only items authorized for sale under this Agreement at the 2011 Tucson Rodeo are the following: Soft drinks and bottled water may be sold only if they are Coca Cola or Dr. Pepper products or, in the case of bottled water, Dasani Bottled Water. Soft drinks may only be sold in 20-ounce plastic bottles. Sports drinks, juice and enhanced bottled water must be Coca Cola/Dr. Pepper/Dasani products. These products must be purchased on-sight from Coca Cola. 3) Vendor agrees to maintain premises covered by the Agreement in accordance with all Health Department Regulations that may be required for a Class A rating. Vendor agrees to allow inspections of said premises by Tucson Rodeo Committee representatives or representatives of governmental entities. 4) All food vendors participating in the 2011 Tucson Rodeo will provide the Tucson Rodeo Committee with Certificate of Liability Insurance, which must name the Tucson Rodeo Committee, Inc., its directors, officers, employees and volunteers, and the City of Tucson, Arizona as additional insured's. Failure to provide said insurance will result in the forfeiture of vendor space. Insurance Requirements Are As Follows: * All insurance coverage must be effective on the first date of entry on the property through the date of departure. * Fire and extended coverage coverage must include fire and fire damage as well as occurrences included in the standard extended coverage endorsement, including vandalism and malicious mischief on equipment, fixtures and other personal property owned by vendor. * Public liability and property damage coverage must include $500,000 single limit per occurrence bodily injury, property damage and product liability coverage. * The Certificate of Liability Insurance must indicate the effective dates of fire, liability and property damage insurance policies, and the amount of insurance provided by those policies. The Certificate must also provide that if the policy or policies should be cancelled by the insurance company or the vendor during the term of this Agreement, ten days written notice prior to the effective date of such cancellation will be given to the Tucson Rodeo Committee. 5) The term of the Agreement shall begin upon its execution and terminate at 11:59 p.m. February 28, ) Rental fee under this Agreement shall be 35% of daily gross sales, rounded to the nearest dollar. Daily rental fee shall be due and payable no later than 11:00 a.m. the following day, except on Sunday, February 27th, payment is due following the rodeo no earlier than 6:00 p.m. and no later than 6:30 p.m. or after 11:00 a.m. on Monday, February 28th, at the west side Rodeo Office. Payment must be made in cash, money order or cashier's check. There are no refunds and the Tucson Rodeo
3 Committee authorized representatives have the right to inspect and audit any records of revenue, sales and services performed. 7) Vendor will not be permitted to sell any alcoholic beverages. 8) The terms Tucson Rodeo", "La Fiesta de los Vaqueros and Tucson Rodeo logo are registered trademarks and cannot be used in any way. 9) Vendors shall be open for business no later than 11:00 a.m. on all days and shall close no earlier than 5:00 p.m. February and 5:00 p.m. February 24-27, Slack days (February 21 & 22) are optional - it is up to the Vendor whether to open or not. There will be no activities planned for Wednesday, February 23 rd, so there is no need to be at the rodeo grounds. Vendors who operate during this Slack time shall operate during appropriate times to serve customers. 10) Vehicles used for unloading goods must be outside of the perimeter fence no later than 10:30 a.m. each day. 11) All gates will be locked at 7:00 p.m. daily, and all vendors and their vehicles must be out by that time. The Tucson Rodeo Committee, Inc., and the City of Tucson will not be responsible for the loss of any property for any reason. 12) Vendors are solely liable for the security of their merchandise and for their own booth set-up, security and daily cleaning of leased space. 13) Persons staffing concession areas shall be employed by vendor and shall not be employees of the Tucson Rodeo Committee or the City of Tucson. Only the personnel performing services for vendor shall be granted admission to rodeo grounds. Designated tags must be presented to gain admittance and must be worn at all times while on the property. 14) A designated parking area will be provided for vendor vehicles. There will be no electric, sanitary or water services available. There is no parking in unauthorized areas. Vendors must present authorized parking pass when entering the designated parking area gate. No vehicles may be left within the perimeter fence overnight. All vehicles operated on rodeo grounds property will be operated in a safe and prudent manner at all times. Speed limit on all rodeo grounds property is 10 miles per hour. Every concessionaire will receive two (2) parking passes and two (2) vendor passes. If you need more parking passes, they will cost $10 each. For more vendor passes, they will also cost $10 each. Please see Bud Krietemeyer for more passes. 15) Vendor may not sublet concession space. Subleasing is grounds for immediate termination of this Agreement. 16) No selling in the stands, bleachers or any area other than the designated space assigned will be permitted at any time. 17) No amplification equipment, televisions, radios or music of any kind will be allowed in the concession area. 18) Only food preparation equipment will be allowed. Space heaters and other electrical or gas equipment will not be permitted.
4 19) The signature of the vendor on this Agreement signifies that he/she understands and will comply with all terms of this Agreement. 20) The signature of the vendor on this Agreement signifies that he/she agrees to indemnify and save harmless the Tucson Rodeo Committee, Inc., its directors, volunteers, employees, sponsors and the City of Tucson, Arizona from all fines, suites, claims, demands or action of any kind and nature by reason of any and all vendor s operations hereunder, and does agree to and does assume all risks in the operations of his/her operation hereunder. 21) Failure to comply with the conditions found herein, misrepresentation of sales statistics in any way, misrepresentation of any nature and/or failure to abide by any rules, laws or regulations will result in the immediate removal from the Tucson Rodeo grounds and the loss of future participation with the Tucson Rodeo. 22) Vendor agrees to abide by all rules and regulations adopted by the Tucson Rodeo Committee. 23) Vendors will be allowed on the Tucson Rodeo grounds beginning Wednesday, February 16, Vendors will not be allowed to park or store equipment on the rodeo grounds prior to that date. 5 VENDOR INFORMATION SHEET Vendors will not be allowed on the Tucson Rodeo grounds prior to Wednesday, February 16, Vendors must park in designated area. No electric, sanitary or water services will be available in vendor parking area. Every concessionaire will receive two (2) parking passes and two (2) vendor passes. If you need more parking passes, they will cost $10 each. For more vendor passes, they will also cost $10 each. Please see Bud Krietemeyer for more passes. While there is security present on the Tucson Rodeo grounds, vendors are solely responsible for the security of their property - vehicles may not be left within the perimeter fence overnight. RODEO GROUNDS CONCESSION ENTRY SCHEDULE February 19 through February 27 entry and set-up between 7:00-10:30 a.m., except on Thursday, February 24, Parade Day. The Tucson Rodeo Parade is on Thursday, February 24 at 9:00 a.m. and lasts until about noon. The route encircles the Rodeo grounds. Thursday, February 24 you must enter the Rodeo grounds between 6:00-7:00 a.m. in order to avoid the street closures. Enter through Gate #23 on 3rd Avenue off Irvington Road. Vehicles must be removed from inside perimeter fence area no later than 10:30 a.m. TICKET GATES OPEN AT 11:00 A.M. THE RODEO BEGINS AT 1:00 P.M. AND LASTS UNTIL APPROXIMATELY 4:30 P.M. PLEASE READ THE AGREEMENT CAREFULLY, RETURN IT TO THE TUCSON RODEO NO LATER THAN NOVEMBER 1, 2010 AND PLEASE RETAIN THIS SHEET FOR YOUR INFORMATION.
