3 Dear Texas Longhorn Friends, Who would have imagined 30 years ago that we would be here today celebrating Texas Longhorns at the RM? We have seen it all at our sales and parties-floods and drought, steamy hot days and freak, wind-blown cold fronts. You never know what will happen with Texas weather in the spring. What we do know is that our focus has always been on having great people and outstanding cattle with a good time had by all. We appreciate your roll in the sale, whether you are a consignor, a buyer or just a visitor. In our last sale catalog we told you that we had added some impressive and exceptional cattle to the herd and we invited people to tour the ranch and see them for themselves. The ranch is open to our visitors and you may pick up a map at the ranch office if you would like to look at our cattle while you are here. We are excited to have made arrangements to use the great Butler bull Desperado, owned by Loeffler Ranches, for the 2008 breeding season. We started acquiring some straight Butler cattle in 2001 and have dedicated ourselves to breeding a small but top notch herd of Butler cattle since that time. Today we have approximately 60 Butler females and many of them are sired by such great Butler bulls that we have used as Coach, Double Droopy (a fullbrother to VJ Tommie), Leonidas and Windstar. This will be the first breeding season that we have concentrated our efforts toward breeding most of our Butler cows to one bull, Desperado. We are delighted with our battery of young bulls, so much so that we have dedicated the cover of this catalog to them! You will see in the sale offering some special RM cattle bred to these great bulls and we know you will take home some cattle that will be exceptional as they mature and that will make you money. Super Bowl is bred to several lots in the sale. He has gained the reputation of siring exceptional early horn growth and has more over 70 sons than any other bull in the business. Smart buyers will invest in cows bred to Super Bowl. Touchdown of RM is a Super Bowl son we Super Bowl raised and he currently is being bred to many of our best cows. He has done everything we have hoped for and his daughters are starting to create a lot of attention in the sale ring. At our October sale two of them brought over $20,000. We do not anticipate offering very many cows bred to him in the future at auction. We recommend you take a good look at what he is bred to in this sale. MC Super Rex is another Super Bowl son that we are using heavily. His first calves were born in October. We are very impressed with the muscle and uniformity we are getting with him. RM King Midas is a straight Butler son of Coach. His dam is out of our best cow family. We have one calf crop out of him and expect great things from him. BH Butler Shi-Zam is a straight Butler Dark Star Chex son we bought from Buck and Sharon Adams. His first calves have been spectacularly colored and we believe he will be an important part of our Butler program. We will be using a young bull we own in partnership with Hudson Longhorns this year. Ring of Fire is a JM Sue son out of a cow we bought from Hudson, Mellow Yellow. He will be bred to some of our top 2006 heifers this year. We are very grateful for our 30 years of fun and profit with these cattle. We invite each of you to come to the sale, bring your friends and associates and be a part of the Texas Longhorn weekend here at the ranch. We have experienced a growing interest in people who want to consign to this sale. In order to consign we have in the past asked that you be a buyer at one of our last three sales. It seems that we have a larger group who want to consign after each sale. This year we had to turn down a number of you who wanted to consign. Consignors to our 2009 sale will first be selected from the buyers at this sale. The warranties and guarantee set forth in the Terms and Conditions are in lieu of all other warranties, either expressed or implied, and the remedies provided therein shall be the sole and exclusive remedy of the buyer, or any party claiming through buyer, for any breach or warranty or guarantees therein provided, and all other obligations or liabilities. 1. Bidding Each animal will be sold to the highest bidder. The auctioneer in charge will settle any disputes as to bids, and his decision shall be final. 2. Terms Terms of the sale are cash or check or approved credit. Settlement must be made to the clerk at the conclusion of the auction. 3. Purchaser s Risk Each animal becomes the risk of the purchaser as soon as sold, but will not be delivered until settlement has been made. 4. Certificate of Registry When full settlement has been made, a certificate of registration will be furnished and transferred to the purchaser. Give full name and address to the secretary when making payments so the Certificates of Registry will be transferred properly. 5. Health All animals are eligible for interstate shipment except as otherwise noted. The cattle have been tested for tuberculosis and Bangs disease within 30 days of sale date. A certificate will be furnished. 6. Announcements Announcements from the auction box take precedence over printed matter in this catalog. All cattle will be sold by lot numbers, as announced by auctioneer. 7. Breeding Guarantee (A) All animals are guaranteed to be breeders with the exception of: (a) injury or disease occurring after sale, (b) negligence or willful misconduct on the part of the purchaser. (B) Any female is considered a breeder if she is pregnant at the time of this sale and/or she has a calf at side. (C) Any bull which either: (1) produces viable semen; (2) settles 1/3 or more of the healthy cows he serves; (3) is the sire of 20 or more animals; or (4) settles cows by natural service, and passes a fertility test made by a competent veterinarian during any six month period trial, shall be considered a breeder. 8. Embryo Transfer Guarantee All donor cows that have been worked successfully in embryo transfer are guaranteed to produce good embryos with the exception of other guarantees stated in the footnotes of this catalog or announced from the auction block. It is understood that these guarantees are valid only if: (1) a qualified person or persons do the transfer; (2) donor cow is managed properly in embryo transfer (i.e. not over conditioned and/or overworked); (3) injury or disease does not occur after the sale and (4) the purchaser is not negligent or willfully mistreats the donor cow. 9. Options and Privileges for Return or Adjustment (A) All claims for adjustment or return must be made in writing within six months of the sale date. (B) Any animal that has not proven itself a breeder within the time limits specified above, if in healthy condition, may be returned to seller at buyer s expense. The seller reserves the right and privilege of trying for a period of six months to prove the animal a breeder. If proven a breeder, an animal will be returned at buyer s expense. Should the animal fail to breed, the seller, at his option, may either return the purchase price or make replacement of the animal with another of equal value. (C) Any animal returned must have a veterinarian s certificate that it is free of Bangs and tuberculosis. 10. Rights and Obligations (A) The above terms and conditions of sale shall constitute a contract between the buyers and sellers of each animal and shall be equally binding upon both. (B) Animals resold following the purchase in this sale shall constitute a separate transaction, and the rights and obligations of the two parties connected thereto are not covered by the terms and conditions of this sale. (C) All persons who attend the sale do so at their own risk and the owners nor any person connected with the management of the sale assume any liability, legal or otherwise, for any accidents which may occur. 11. Applicable Law All cattle (or horses) in this sale are offered according to the laws of the State of Texas.
