1 March & April 2010 Volume 45 Number 2Organized 1966 Club located at the Marina, Treasure Island in the center of San Francisco Bay Commodore s Message W e ve had a busy January starting off with twenty members joining the around the island cruise. We had three boats joining us El Nido, Jim and Sandy Aberer, Sea Bird, Rich and Mary Holden and Ted and Kathy Karavidas boat Kilohana. Afterward we had a pot luck dinner at the club, with the club supplying a Standing Rib Roast. The next week we had our first cruise in of the year from Bay View Boat club. They did a pot luck dinner and had a great time. They liked doing the pot luck and the bar did great. Bottom line it was a lot easier on us. They said they would definitely be back again at the beginning of next year. On the 16 th of January we had our annual COW and Crab feed. I noted that the maximum number of persons allowed in the clubhouse was 49 and we were at the limit. Another great feed by George Knies, Thanks again George. On Jan 30 th we all attended the PICYA COW to see our own Reggie Smith become Commodore On February 7 th we had our Superbowl party. At the same time the Womens group got together on Sandy s boat for Power Boat 101 Thanks sandy for all that good info. After the game we had a pot luck dinner with the club supplying all the ribs (beef and pork) you can eat. Thanks Jim for the help. On February 27 th Treasure Island will have their History Day. Come on down and join us. We will have our first work day on March 6; also Russ Breed will be giving OOD training on that Day. On March 20 th we will have our St Paddies Day Dinner. We also will have a cruise in or two coming in that weekend. Should be a great time (and lots of help will be needed). 2 Vice Commodore s Report Matt Farnsworth T he 2010 season is just getting started and we have several events on the schedule. In March we'll be celebrating St. Patrick's Day on Sat. the 20th. We're planning a dinner of corned beef and cabbage, and we might have one or more clubs cruising in; so please reserve early. The Sailstice group is planning a new event -- the Equinox cruise. This a warm-up/trial -run for the Sailstice planning committee. Club Nautique may be coming, as well as, a new group -- GotWindAndWater. Some of the GotWindAndWater group are members of other clubs, but some of their guests might be interested membership. Also, tentative is the Grand Banks Owner's Association. Let's show them all a warm pirate welcome. Aaargg,... (hmm, there's no phrase that's fit to print for combining leprechauns with pirates; so think of something else...) The first weekend in April, we'll be welcoming Encinal YC for a return visit on Sat. the 3rd. They really enjoy our hospitality, and your company, so please join us. This is really fun group and we want them to have a great time. We'll have our Opening Day event last weekend in April. If you're planning on participating in the South Bay Opening Day, and you're coming from some distance, this might be a fun time to cruise in. If you'll stay the week anchored out, ask TIDA for a permit. The parade will be Sunday the 25th. I'm sure our fleet will appreciate your help if you want to come down help with staging in the morning. Try the crew list if you need crew or want to take a ride. Looking back on the past two months, we've had several great events. The weather was superb for the fireworks show on New Year's eve. We had a large turn out for the annual crab feed. The Superbowl event was super fun, and our youngest member came out in style. Rear Commodore s Report Jerry Huff W e had our first cruise out to Presidio Yacht Club to take advantage of their crab feed dinner. We all blacktopped it and had 9 people representing TIYC. There was a slide show presentation about a completed northwest passage in a 57' sailboat with lots of iceberg shots. Then we had a wonderful crab dinner, however no one took advantage of the live band up stairs. We have the Boat Fest in Alameda this weekend 19-21, and the PIYCA leadership conference in Benicia on the 20th. Our next cruise outs are proposed to be a blacktop to Hornet on March 27th and the SBOD April 9-10th Continued next page TIYC Newsletter JIBE March & April 2010 Page 2

4 Staff Commodore s Report Russ Breed B oating season is just around the corner. The officers are planning an active year and the watch list has been sent out. All that is left is to be open for our visitors. As they said in Field Of Dreams, Build it and they will come! We just need to get the word out and be there when they arrive. The first person that many people will meet is the Watch Officer or OOD (Officer of the Day). So, what is involved in being the OOD? you ask. The best way to find out is to come to our first watch day, March 6th and stay for a pirate burger dinner. Watch starts at 12:00 PM (Noon). Come by and learn about the changes that have occurred and what you need to know to stand watch. Or perhaps just come by to keep me company. Just a quick overview. With the size of TIYC, many of our potential members join by stopping by and attending functions at our TIYC Clubhouse. Because we are a volunteer club, in order to have our clubhouse open on weekends between March and November, our Members (other than Non-Resident, Honorary or Junior) are asked to stand watch. Due to the size of our membership we now have to include Senior and Life Members in the rotation. Each month there is a Watch Captain, which is a Board Member who is assigned to ensure that the clubhouse is open. Your Watch Captain will contact you regarding your watch. The OOD Watch List was published in the Jan/Feb JIBE. A copy is maintained in the OOD Book at the club and the names are listed on the members only version of the calendar on the web site. If you are not able to stand watch duty on the date(s) assigned to you, it is your responsibility to find a replacement by trading dates with another member and advising your Watch Captain and the club manager. The OOD is responsible for the operation of the Clubhouse while on duty making sure that Club rules are followed. Please contact your Watch Captain or a flag officer with any questions. The OOD Opens the club and checks to see what the Plan-Of-The-Day is. (We will go over the opening routine on our first watch day.) The OOD represents TIYC to both members and the public, welcomes them and has guests sign in. Greet prospective members who have an interest in yachting. Share with them the benefits of participation in TIYC. Refer them to the calendar for club activities. Make a point of giving them an informational brochure and fill out an interest card. If requested, provide a membership application found in the rack by the single door entrance. The OOD is to see that proper order is maintained at the Clubhouse and Club rules are followed. At day s end, secure the premises. If a club officer is present and wishes to keep the bar open longer than the duty hours, make sure you apprise him of your leaving and also make sure that he/she will be closing the bar and the club. 5 TIYC SAFETY OFFICER Russell Breed Safety Check List Before you go boating this season be sure you check all of the following items and call your local Power Squadron or Coast Guard Auxiliary for Vessel Safety Check. Coast Guard Approved Flares * Always carry aerials and handheld. Replace expired flares Fire Extinguisher When required: Must be USCG Approved. Marine Type in good, serviceable condition, properly charged. Correct number aboard for the size and type of vessel. Life Jackets Must be Coast Guard approved. One wearable life jacket for each person aboard and a throwable device when required; correct size, condition and fit properly stowed (The Coast Guard recommends always wearing a life jacket when underway. Children under 13 life jacket must be worn.) Whistle for each vest. First Aid Kits Based on how and where you boat, choose a kit that will handle most minor emergencies. Signaling Devices All vessels are required to carry a sound signaling device. Whistles, air horns and replacement air, should be aboard all boats. Required in fog and can be used for signaling bridges, and as an emergency signaling device. Anchor and Anchor Line Replace worn lines. Lines should be at least 5 to 7 times the depth of the water. Use anchor chain to attach anchor to line. * Pyrotechnic Devices Pyrotechnic Visual Distress Signals must be Coast Guard Approved, in serviceable condition, and readily accessible. They are marked with an expiration date. Exired signals may be carried as extra equipment, but can not be counted toward meeting the visual distress signal requirement, since they may be unreliable. Launchers manufactured before January 1, 1981, intended for use with approved signals, are not required to be Coast Guard Approved. If pyrotechnic devices are selected a minimum of three are required. That is, three signals for day use and three signals for night. Some pyrotechnic signals meet both day and night use requirements. Pyrotechnic devices should be stored in a cool, dry location, if possible. A watertight container painted red or orange and prominently marked DISTRESS SIGNALS or FLARES is recommended. U.S.C.G. Approved Pyrotechnic Visual Distress Signals and associated devices include. Pyrotechnic red flares, hand-held or aerial. Pyrotechnic orange smoke, hand-held or floating. Launchers for aerial red meteors or parachute flares Non-Pyrotechnic Devices Non-Pyrotechnic Visual Distress Signals must be in serviceable condition, readily accessible, and certified by the manufacturer as complying with U.S.C.G. requirements. They include: Orange Distress Flag Day Signal Only Must be at least 3 x 3 feet with a black square and a ball on an orange background. TIYC Newsletter JIBE March & April 2010 Page 5 Continued next page

6 Must be marked with an indication that meets Coast Guard requirements in 46 CFR Most distinctive when attached and waved on a paddle, boathook, or flown from a mast. May also be incorporated as part of devices designed to attract attention in an emergency, such as balloons, kites, or floating streamers. Electric Distress Light Accepted for night use only Automatically flashes the international SOS distress signal ( ) Must be marked with an indication that it meets Coast Guard requirements in 46 CFR Under Inland navigation Rules, a high intensity white light flashing at regular intervals from times per minute is considered a distress signal. Such devices do NOT count toward meeting the visual distress signal requirement, however. Regulations prohibit display of visual distress signals on the water under any circumstances except when assistance is required to prevent immediate or potential danger to persons on board a vessel. All distress signals have distinct advantages and disadvantages. No single device is ideal under all conditions or suitable for all purposes. Pyrotechnics are universally recognized as excellent distress signals. However, there is potential for injury andproperty damage if not properly handled. These devices produce a very hot flame and the residue can cause burns and ignite flammable materials. Olin recommends all launchers and signals be checked each year prior to the boating season to be sure they are in good working order. Will my Visual Distress Signals Expire? Pyrotechnic signaling devices (including aerial flares and hand-held signals) expire 42 months after the date of manufacture in accordance with the Coast Guard requirements. Typically, this means that you must replace your flares every three boating seasons. The Coast Guard regulations require that each pyrotechnic signaling device must be stamped with the expiration date. Accordingly, check the expiration dates on your flares and signals. If they have expired or will expire during the boating season, you must replace them. B MW Oracle of the United States won Race 2 of the 2010 America's Cup on February 14th to capture the best-of-three series, making it the first American winner since The American boat, sailing under the flag of San Francisco's Golden Gate Yacht Club, finished the three-leg, 39-mile triangular course more than five minutes ahead of two-time defending champion Alinghi. BMW Oracle wins America's Cup for USA BMW Oracle won Race 1, a two-leg, 20-mile race by more than 15 minutes. After a postponement, the competitors set off Sunday, 14 February though only after the Swiss boat was given a penalty. Each gained an advantage on the first leg, with Alinghi leading and flying a protest flag just before the windward mark. But BMW Oracle moved past the Swiss yacht and was ahead by 28 seconds at the first mark, then sped away. BMW Oracle was ahead by just under three minutes at the second mark, and from there the American craft cruised to the victory, 5:26 ahead of Alinghi, which dropped the protest once the race ended. Compilation by George C. Knies The victory brings the Cup back to the United States for the first time since Team New Zealand's Black Magic beat Dennis Conner's Young America in 1995 off the coast of San Diego. Alinghi first won the Cup in 2003, defeating Team New Zealand off the coast of Auckland. The Swiss boat repeated the feat with a triumph over New Zealand off the Valencia coast in Both boats costing $200 million each were designed and built specifically for a best-of-three match. They have no use beyond this event, but are awesome: highly-engineered, massive and so fast and powerful that crews are said to be apprehensive about racing them There are only two owners in this regatta due to the ugly dispute that has raged between them over the past 30 months. A recent flurry of court activity in New York court rooms has gradually set out the parameters under which the so-called Deed of Gift match took place. LITGATIO : The 33rd America's Cup has been the subject of extensive court action and litigation surpassing in acrimony even the controver- TIYC Newsletter JIBE March & April 2010 Page 6 Continues net page

7 - sial 1988 America's Cup. Since the two parties were unable to agree otherwise, the match took place as a one-onone Deed of Gift match in gigantic, specialized multi-hull racing yachts with no other clubs or teams participating. The litigated issues included which club would be the Challenger, the dates and venue for the regattas, certain rules governing the regattas (in particular the measurement rules), and the construction of the boats. When Société Nautique de Genève (SNG) successfully defended the trophy in the 32nd America's Cup they immediately accepted a challenge from Club Náutico Español de Vela (CNEV) a Spanish organization formed expressly for the purpose of challenging for the cup and keeping the regatta in Valencia. When SNG and CNEV published their protocol for the 33rd America's Cup challenge, there was widespread consternation over its terms, with some teams and yacht clubs calling it the worst protocol in the history of the event. Golden Gate Yacht Club (GGYC) filed its own challenge for the Cup and then filed a court case asking that CNEV be removed as Challenger of Record as being unqualified under the Deed of Gift. GGYC also asked that it be named as the rightful Challenger of Record, being the first club to file a conforming challenge. As the legal proceedings progressed, SNG continued to work with the other teams on the protocol, and by December 2007 twelve challengers had met the entry deadline and were preparing to race in a multi-challenge America s Cup. There followed a long and acrimonious legal battle, with the New York Court of Appeals finally deciding on April 2, 2009 that CNEV did not qualify as valid challenger, and that the GGYC was thus the rightful Challenger of Record. Additional litigation followed, however, the match started on February 8, 2010, in Valencia, Spain. The San Francisco Bay may be the venue for the next America s Cup (Ellison s call), lets hope that the Deed of Gift protocol returns to a field of entries (louis Vuitton) competing for the honor of challenging BMW Oracle.
