2 CITY OF MERRIAM PARK AND RECREATION ADVISORY BOARD MEETING MINUTES Tuesday, October 23, :00 PM Roll Call The October meeting of the Merriam Parks & Recreation Advisory Board was called to order at 6:01 pm, by chairperson Billy Crook. Board members in attendance included: Kathy Stull, Grant Getzlow, Thelma Fowler and Katie Leary. Suzanne Downey, Tom Heffron and Lavera Howard were absent. Staff members in attendance included: Anna Slocum, Director; Dave Smothers, Assistant Director; Renee Nagle, Recreation Supervisor and Ingrid Berg, Assistant Program Coordinator. Public Comments No public present. Approval of Meeting Minutes Billy Crook made a motion to accept the September meeting minutes and Katie Leary seconded the motion; motion was approved unanimously. Staff Reports Director s Report Recreation Supervisor Welcome Renee Nagle. Merriam Drive Live Evaluation Attendance was 325 for the day despite the cold, drizzly weather. Staff will be looking at the site plan for next year and probably keep one stage under the Marketplace trying not to stretch thing out too much. They will also work on trying to secure another sponsor for the event. Looking at the direct expenses of the event, there is a positive bottom line. This is due to the inflatables being canceled prior to the event. When scheduling the bands will try to leave 30 minutes between. This will allow for people to move between stages, eliminates one band allowing for more money to attract larger regional bands. Shorten the touch a truck time frame, not do caricature artist again due to the wait/sit time and just stick to having the face painter and balloon artist. Evaluate VIP tent signage and will need a larger tent. MDL is scheduled for Saturday, October 5 th Assistant Director s Report Updates Waterfall Park Playground Relocation Update The playground is in. Due to a change in the swings cross bard, new chains are needed prior to completing the inspection. The construction safety fence must remain until the inspection is complete. The official opening will be Friday, November 2 nd. Additional inspections completed were concrete pads for the picnic tables and grill that had formerly been at Vavra Park. It was asked if there is a plan to add a shelter. Currently, a shelter is in the 2025 Capital Improvement Plan. High School Show The deadline for entries is Thursday, October 25 th.

3 Upcoming Events Opening Night Reception Tim Murphy Art Gallery-What We Have Come to Know The reception is scheduled for Thursday, November 1 st h from 7-8:30 pm and will feature works from the Johnson County Camera Club. Recreation Supervisor Report Holly Jolly, Holiday Lights and Homemade Soup Staff is working to finalize details for the event that is scheduled for Friday, November 30 th from 6:30-8:30 pm Breakfast with Santa This event is scheduled for Saturday, December 1 st from 10-11:15 am. Event volunteers will be needed. New Business There is a meeting on Friday, October 26 th at 1:00 pm will Billy Crook and Suzanne Downey to explore ideas for ways to honor Esther Brown beyond the plague at Brown Park. A recap of the meeting will be provided in November. Other Business None. Adjournment Katie Leary moved to adjourn the meeting at 6:33 pm and Kathy Stull seconded; motion was approved unanimously.

7 To: Merriam Parks and Recreation Advisory Board From: Anna Slocum, Director of Parks and Recreation Subject: Ordinance Parcourse, hiking and biking trails and walking paths Date: November 29, 2018 Currently, the City of Merriam Ordinance Chapter 47 Article III Division 2 Sec Parcourse, hiking and biking trails and walking paths. The code originally written in 1967 and updated in 1995 reads: Any paved trail identified within a park as a walking path may be used by pedestrians, bicyclists, and skaters; no motorized forms of vehicles allowed. Persons operating non-motorized forms of transportation on the trail shall yield right-of-way to pedestrians. Pedestrians shall move to the right and allow room for oncoming traffic and for faster same-direction traffic. Trails identified as "parcourses" shall only be used for walking, running and exercising. (Code 1967, 19-2; Ord. No. 1242, 1, ) The United States Department of Justice revised the American with Disabilities Act ADA which requires local governments to adopt / revise reasonable policies to allow other power driven mobility devices OPDMD to be used by individuals with mobility disabilities in areas open to pedestrian use. With the development of new technology, the definition and access to OPDMD is changing quickly. There are currently three classes of E-bikes, various E-scooters as well as various motorized wheelchairs. There have been conversations among area directors to unify trail regulations to provide consistency between local ordinances. This discussion is pertinent especially on multi-use trails that link multiple cities, counties and states. In working to make a change to the ordinance there are several aspects that will need to be considered. They include: 1. Define various devices such as E-bikes, E-scooters, and OPDMD 2. Determining acceptable and permitted use 3. Verification of eligibility 4. Regulation 5. Education 6. Enforcement Recognizing that a change is required to remain in compliance with ADA, staff will be working with Mid America Regional Council, Bike Walk KC, other local municipalities, Merriam Police Chief and City legal counsel to draft an ordinance for review and recommendation to City for approval in upcoming months. Action Required: This memo is for informational purposes in preparation for future discussions.
