2 The Legett Legacy Garden In honor of Drs. Georgia and Carey Legett, Jr. The YMCA of the Rockies Columbarium has been named in recognition of our dear friends, Drs. Georgia and Carey Legett, Jr. of Austin, TX. The Legetts love for and involvement with the YMCA of the Rockies spanned over 50 years. Even a casual tour of the Estes Park Center and Snow Mountain Ranch testifies to Georgia and Carey s generous support of our Mission. While the many YMCA of the Rockies facilities bearing the Legett name are a wonderful legacy, perhaps the greatest testimony of their love for this organization is the fact that their great affection for the Mission of the Association has been passed down to the fifth generation of Legetts. Words cannot adequately express how honored we are that Georgia and Carey chose the Estes Park Center as their final earthly resting place. The YMCA of the Rockies is indeed grateful that the generosity of the Legett family has made this beautiful legacy garden possible. 2 The Legett Legacy Garden Columbarium is located at the Estes Park Center just north of the Schlessman Executive offices. The Garden provides many beautiful niches in a tranquil setting designed for services, meditation, and reflection. The Mission of the Legett Legacy Garden Columbarium is to provide the friends of the YMCA of the Rockies a final resting place, consecrated and conserved in a spirit of dignity and reverence. In keeping with our core values of Caring, Honesty, Respect, Responsibility and Faith, our vision is to provide and maintain a sacred and beautiful environment in which family and friends may gather for remembrance and prayer. 3

4 COLUMBARIUM POLICIES AND PROCEDURES YMCA of the Rockies The following Policies and Procedures govern the ownership and operation of the Association Columbarium: 1. The YMCA of the Rockies Columbarium is named the Legett Legacy Garden. 2. Management: The YMCA of the Rockies shall have the right and obligation to manage the Columbarium. This shall include the reservation of the niches, as well as the general maintenance and upkeep of the Columbarium and memorial areas. 3. Reservation of Niches: In keeping with the inclusion policy of the YMCA of the Rockies, the reservation of niches in the Association s Columbarium is open to all people of good will. 4. Payment for Niches: Payment for use of a Columbarium niche shall be in an amount and manner approved by the Association. Columbarium niches will be assigned and engraved plates ordered only after the YMCA of the Rockies has received payment in full. 5. Title to Niches: Legal title to all Columbarium niches shall remain with the YMCA of the Rockies. The exclusive right to place cremains in the Columbarium is based on the following terms: a. The person(s) or family has reimbursed the Association for the cost of the niche and has received a certificate granting the right to use the niche. b. The exclusive right to use a niche may not be sold or otherwise transferred to another individual without the approval of the YMCA of the Rockies. 6. Lapse and Termination of Rights after 30 years: If a Columbarium niche is not used within 30 years after the date of the Columbarium Agreement/ Reservation between the Grantee and the YMCA of the Rockies, such Agreement/Reservation shall be terminated, all rights under such Agreement/Reservation shall lapse, and all rights, including the right to use the niche, shall revert back to the Association, unless the Association has been informed in writing by Grantee/Designees continued interest in the niche. 7. Payment for markers and for opening and closing of niches: The costs of opening and closing the niches and the engraving of the markers are inclusive in the Association s inurnment Agreement/Reservation. There will be no additional costs. 8. Use of Niches: The use of each niche shall be limited to the cremated remains of one or two, but no more, persons. The remains of pets shall not be allowed to be placed in the Columbarium niches, alone or with human remains. The contents of Columbarium niches are limited to cremated human remains inside an urn. All urns will be supplied by the YMCA of the Rockies. 9. Niche Markers: All Columbarium markers will be ordered through the YMCA of the Rockies and will conform to the standards approved by the Association. 10. Maintenance: Although the YMCA of the Rockies intends to maintain the Columbarium, the Association assumes no liability or responsibility for the preservation, or loss of or damage to, any urn placed or the remains of any person inurned in the Columbarium. 11. Insurance: The YMCA of the Rockies may, but is not required to, insure the Columbarium or its contents. 12. Change of location or termination of Columbarium: The Board of Directors of the YMCA of the Rockies may change the location of or terminate the use of all or part of the Columbarium, in which event the Association shall remove the urns from the niches affected by such change or termination and arrange for the placement of such urns in another niche or in another appropriate place as the Association may determine at its sole discretion at the Association s expense. 13. Remodeling of Columbarium: The YMCA of the Rockies in its discretion may enlarge or remodel the Columbarium at any time. 14. Grantee Change of Address: The grantee and their designees shall be responsible for notifying the YMCA of the Rockies of any change of address or contact information. 15. Removal of cremains: No cremains may be removed from a niche except by and with the prior written consent of the YMCA of the Rockies. In the event a duly appointed representative of the family wishes to have an urn removed, a written request must be sent to the YMCA of the Rockies for approval. The grantee may name a designated representative on the Columbarium Agreement/Reservation. 16. Flowers and other decorations: No flowers, real or artificial or other decorations, may be placed in the Columbarium area by individuals except at the time of inurnment. 17. Amendment of Policies and Procedures: The Board of Directors of the YMCA of the Rockies has the authority to amend these Policies and Procedures. 6 7
