Tender form is to be submitted complete in all respects along with prescribed EMD in favour of ESIC M ODEL HOSPITAL FUND ACCOUNT NO.1 payable at Baddi in form of Demand Draft/ Banker s cheque only. The p rice bid should contain the commercial terms in the format given in the Tender. T ender complete in all respect must be deposited in tender box kept at Hospital medical store ( at basement) till 1.00 P.M. of 26/11/2012. Tender received late will not be entertained. Tender will be opened on the due date at 2.00 PM in MS office, ESIC model Hospital, Baddi (H.P.) in t he presence of bidders or their authorized representative. If due date of opening is declared h oliday, tender will be opened on next working day at same time and place. 3 `3 T erms G eneral and Conditions for Medical gases Terms and conditions 1. The firm must be manufacturer of Medical Gases i.e. Medical oxygen IP. Nitrous oxide a nd should have valid manufacturing licence issued from the state Drug controller as per the provisions of the Drug and cosmetic Act 1940 and rules there under (Attested c opies of the licences must accompany the tender) 2. The firm should have a valid license for storage, filling and cylinder testing licence issue b y CCE H imachal P radesh a ttested copies of the letter to be attached. 3. Firm should have its own fully fledged lab with full time chemist to test each batch and t o provide best testing reports of previous year on demand. 4. The firm should have in-h ouse facility for testing/trace impurities in P.P.M/P.P.B range for CO, NO, phosphines, Polymers, SO2 and argon etc. the facilities should be open to s crutiny by the Hospital Authorities. 5. The firm should be able to maintain uninterrupted supply of Medical gases even in e mergencies. Firm should give an undertaking to the Hospital and make alternate a rrangement for the supply of gases at their risk and responsibility 6. The firm should be responsible if any mishap takes place on account of non conformities o f safety standard and rul es. 7. I ncomplete/conditional tender will not be accepted. 8. The rejected supply, if any, should be taken back and replaced by the firm at its own cost within the specified period and without causing any interruption to the Hospital s ervices. 9. T he details of enclosures should be numbered and total number of pages should be m entioned on the forwarding letter. 10 No figures or words should be overwritten incorrect figures or words should be struck o ut and rewritten under your initials. 11 I n case if the supplier fails to supply the material as per demand and as and when required the order will be liable to be cancelled and the security money/earnest money w hichever is available at that time will be forfeited. 12 Q uotation will be strictly according to the required specification and in case of formulation details formula along with the name of Mfg. and the brand under which the p roduct is marketed should also be stated. 13. R ates should be quoted on FOR, ESIC Model Hospital Baddi. H.P. 14. T he firm should have a supply depot in TRI CITY BBN/Solan/Chandigarh Region o rder to ensure timely regular supply of the Medical gases. 15. In case of disputes, the same shall be referred to any arbitrator appointed by the in

4 16. M edical Superintendent and the decision of the arbitrator will final and binding to both t he parties. V alidity of the bid should be minimum period of 12 months. 17. Rates quoted should not be higher than that quoted in any other o rganization/institution (certificate to be enclosed). 18. T he tenderer shall furnished a non black listing certificate on Rs 10 Non Judicial Stamp Paper that there is no vigilance/cbi case pending against the firms and the firm has not b eing blacklist in the past. 19. M edical superintendent reserves the right to reject any quotation without assigning any r eason(s) thereof. `4 E xperience The firm should be a reputed one and should have been supplier to at least one Central a nd/or state Government Hospital of more than 50 beds. This should be supported with a certificate issued by the user departm ent along with copy of supply order. C MO (Compressed Medical 1) Oxygen) All supplied by the firm must strictly be made as per regulatory requirements i ncluding filling norms as per rule ) T he vendor shall have to supply the gas in the cylinder which are available in the hospital. Howsoever any additional requirements of various type of cylinder will have to b e met by the vendor. 3 ) Firm should be able to provide the services within the existing infrastructure available i n the manifold room of the hospital. And must quote for all gases including oxygen, N 2O, CO2, & Liquid nitrogen. 4 ) Successful tenderer will also be responsible for the repair/testing/painting of hospital c ylinders, quote the charge of all services in price bid. a ) If any repair/testing/painting is due on hospital then the firm should i nform in advance to the hospital only then the same will be considered. b ) If any spare parts are changed or any repair/testing/painting done on hospital c ylinders then the charges will be paid EXTRA as per quotation plus approved by the govt. on prior information. c ) The supplier should quote the rate of the spare part testing and painting charges o f bulk as well as all. d ) A ll should be properly painted as per their respective colour code. S pecification of Medical Nitrous oxide 1 ) A s per IP 1996/latest I.P. c ertified as inhalation analgesic. 2 ) Manufactured form IP grade ammonium nitrate. If any alternate technology or manufacturing process is used the same to be specified and all inputs regarding quality a ssurance and probable impurities etc must be provided.

E MD (Earnest money deposit) T he tender must accompany an earnest money deposit for an amount of Rs / - (Rupees Ten thousand) in the form of bank draft in favour of ESI account No- 1 payable at Baddi, drawn o n any nationalized bank. The tender unaccompanied with the earnest money shall be rejected outright and no communication shall be entertained. The earnest money shall be returned to all unsuccessful tenderers without any claim for accruals of interest. Withdrawal of the tender a t any stage after submission shall forfeit refund of earnest money. P erformance Security The successful tenderer shall have to submit a performance security of R s. 1.0 lakh (one lakh) in the form of a fixed deposit/ Bank guarantee for the due compliance & fulfillment of the terms and condition of the contract in favou r of Medical Superintendent, ESIC Model Hospital fund Account No. 1. Payable at Baddi On due performance and successful completion of the contract the security money deposit shall be returned without any interest. On unsatisfactory p erformance or violation of terms and conditions of the contract will make the contractor liable for forfeiture of security deposit. The decision of Medical Superintendent will b e final in this count. P eriod of Contract T he contract will be valid for two year from the date of finalization of the tender and the same c an be

7 `7 extended by the M.S on mutual agreement. M.S has reserved the right to terminate the c ontract at any stage if the supplies and or services are found unsatisfactory. Certificate stating that the rate quoted are not higher than t hose quoted elsewhere. 6 ) Non black listing certificate. Certificate stating that the firm has not being black listed i n the past and there is n o vigilance enquiry pending. 7 ) Undertaking that uninterrupted supply of gas will be maintained or else alternative a rrangement will be made at own risk of the firm. 8 ) Certificate mentioning total no. liquid oxygen transport tank in possession and p ermission to ply on all time of the day issued by H imachal Police. 9 ) C ertificate stating that all terms and condition of tender are acceptable. C ommercial Terms 1 ). The rate at which the cylinder will be delivered in the hospital must be quoted both in the words and figures per of A. B. D (Bulk) A A type for any other type mentioning the v olume/pressure gauge of gas to be contained in each of the cylinder.
