Tender documents can also be downloaded from Hospital website ( or from HQ website ( in that case DD/Banker Cheque for the cost is to be enclosed with Tender. Tender form is to be submitted complete in all respects alongwith prescribed EMD in favour of ESIC FUND ACCOUNT NO.1,NEW DELHI.in form of Demand Draft/ Banker s cheque only. Earnest money is to be enclosed with the Technical bid. Technical bid should contain all the technical detail and the documents required as mentioned in the tender.the price bid should contain the commercial terms in the format given in the Tender. Tender complete in all respect must be deposited in tender box kept in Hospital store from 10 a.m to 1 p.m on due date of opening. Tender received late will not be entertained. Tender will be opened on the due date at 2.00 p.m in Hospital Store in the presence of bidders or their authorized representative. If due date of opening is declared holiday, tender will be opened on next working day at same time and place. Medical Superintendent reserves the right to reject any tender or all without assigning any reason(s) thereof. Medical Superintendent Terms and Conditions for Medical gases and liquid Medical oxygen General Information

2 ESI Hospital Basaidarapur is a 600 Bed Hospital and is proposed to become a post graduate institute of Medical Sciences shortly. The present consumption pattern of Medical gases is as follows:- A. Oxygen D type cylinder bulk of 475 ltr. Water capacity (7 cum each)- 40 cylinder daily B. Oxygen A type cylinder of 5 ltr water capacity (1.0 cum each)- 5 cylinder per day C. Oxygen B type cylinder of 10 ltr. Water capacity (1.5 cum each)-30 cylinder daily D. Nitrous oxide in bulk of ltr. Gas capacity (17 cum )-3 to 4 per month. It is now proposed to provide liquid oxygen for which a five kl. Vessel will required to be installed. However the consumption pattern of B type and A type of oxygen cylinder as mentioned above will persist and may even increase in due course of time. The firms participating in the tender should be able to provide regular liquid oxygen supply of 400 kg. per day approximately besides the above mentioned B & D type of oxygen cylinder. Nominal quantity of carbon dioxide gas in A type cylinder and liquid nitrogen for cyro surgery will also have to be provided. General Terms and conditions 1. The firm must be manufacturer of Medical Gases i.e. Medical oxygen IP. Nitrous oxide and should be have valid manufacturing licence issued from the state Drug controller as per the provisions of the Drug and cosmetic Act 1940 and rules there under (Attested copies of the licences must accompany the tender) 2. The firm should have a valid license for storage, filling and cylinder testing licence issue by CCE Nagpur attested copies of the letter to be attached. 3. Prospective bidders are advice to visit site of the installation for liquid medical oxygen before submitting their bids. 4. Firm should have its own fully fledged lab with full time chemist to test each batch and to provide best testing reports of previous year on demand. 5. The firm should have in-house facility for testing/trace impurities in P.P.M/P.P.B range for CO, NO, phosphines, Polymers, SO2 and argon etc. the facilities should be open to scrutiny by the Hospital Authorities. 6. The firm should be able to maintain uninterrupted supply of Medical gases even in emergencies. Firm should give and undertaking to the Hospital and make alternate arrangement for the supply of gases at their risk and responsibility 7. The firm should be responsible if any mishap takes place on account of non conformities of safety standard and rules. 8. The firm should enclose a certificate indicating Total nos. of liquid Oxygen transport tanks in possession and permission to ply on Delhi road at all times of the day including restricted hours from the Delhi Police. 9. Incomplete/Conditional tender will not be accepted. 10. The rejected supply, if any, should be taken back and replaced by the firm at its own cost within the specified period and without causing any interruption to the Hospital services. 11. The details of enclosures should be numbered and total number of pages should be mentioned on the forwarding letter. 12. No figures or words should be overwritten incorrect figures or words should be struck out and rewritten under your initials.

In case if the supplier fails to supply the material as per demand and as and when required the order will be liable to be cancelled and the security money/earnest money whichever is available at that time will be forfeited. 14. Quotation will be strictly according to the required specification and in case of formulation details formula along with the name of Mfg. and the brand under which the product is marketed should also be stated. 15. Rates should be quoted on FOR, ESI Hospital Basaidarapur. 16. The firm should have a supply depot in Delhi/NCR Region in order to ensure timely regular supply of the Medical gases. 17. In case of disputes, the same shall be referred to any arbitrator appointed by the Medical Superintendent and the decision of the arbitrator will final and binding to both the parties. 18. Validity of the bid should be minimum period of 12 months 19. Rates quoted should not be higher than that quoted in any other organization/institution (certificate to be enclosed). 20. The tenderer shall furnished a non black listing certificate on Rs 10 Non Judicial Stamp Paper that there is no vigilance/cbi case pending against the firms and the firm has not being blacklist in the past. 21. M.S reserves the right to select different vendors for LMO/CMO and other gases. 22. Medical superintendent reserves the right to reject any quotation without assigning any reason(s) there of. Experience The firm should be a reputed one and should have been supplier to at least three Central and/or state Government Hospital of more than 200 beds. This should be supported with a certificate issued by the user department along with copy of supply order. LMO (Liquid Medical Oxygen) 1) A 5 Kl. Vessel will have to be installed by the vendor. No charges will be paid for the cost of the vessel. New connection of the liquid oxygen tank to be existing manifold will have to be provided. Howsoever initial installation charges and transportation charges of the vessel should be quoted separately. These charges will be taken into account while ranking the tenders. Necessary certification of CCE Nagpur will have to be provided by the vendor for the installed vessel. 2) Safety/security facilities for the liquid tanks should be provided by the firm Example grill, fence, etc. Charges for the same may be included in the initial installation Charges. 3) No rental charges for the vessel will be payable. 4) Repair and maintenance of the vessel will be the responsibility of the vendor. 5) No additional transportation charges for liquid oxygen will be payable. 6) Firm should have separate tanks and filling decks for Medical and industrial oxygen to avoid any chance of mix up which may be harmful to the patients. It is therefore essential that they must have separate identified cylinders for medical and industrial oxygen. 7) The entire cylinder tank should be tested and specified for filling of medical gas by CCE. The firm should provide certificate to this effect. 8) Medical oxygen supplied in cylinders/tank should be filled from liquid medical oxygen directly through liquid pump to avoid contamination. 9) Firm should not demand any security for vessel.

4 CMO (Compressed Medical Oxygen) 1) All cylinders supplied by the firm must strictly be made as per regulatory requirements including filling norms as per rule ) The vendor shall have to supply the gas in the cylinder which are available in the hospital. Howsoever any additional requirements of various type of cylinder will have to be met by the vendor. 3) Firm should be able to provide the services within the existing infrastructure available in the manifold room of the hospital. And must quote for all gases including oxygen, liquid oxygen, N2O, CO2, & Liquid nitrogen. 4) Successful tenderer will also be responsible for the repair/testing/painting of hospital cylinders, quote the charge of all services in price bid. a) If any repair/testing/painting is due on hospital cylinders then the firm should inform in advance to the hospital only then the same will be considered. b) If any spare parts is changed or any repair/testing/painting done on hospital cylinders then the charges will be paid EXTRA as per quotation plus by the govt. on prior information. c) The supplier should quote the rate of the spare part testing and painting charges of bulk as well as all cylinders. d) All cylinders should be properly painted as per their respective colour code. The cylinder No, name of the company and name of gas cylinder contents should be clearly indicated on the neck of the cylinder. 5) All the cylinder of Medical Gases should have. a) Valve protection caps. b) Valve with nickel plating only. c) History card of the cylinder. 6) Transportation charges for the cylinders should be quoted separately. 7) Rental charges should be quoted for all type of cylinders. 8) The rejected supply, if any, should be taken back and replaced by the firm at its own cost within the specified period and without causing any interruption to the hospital services. 9) Every cylinder should have a ring to know when the testing of the cylinder is due. 10) The firm should be able to maintain uninterrupted supply of medical gases even in emergency. Specification of Medical Oxygen and Liquid Oxygen 1) Certified for Medical use as IP 1996 or the latest IP 2) Not less than 99.0 V/V of oxygen 3) Not more than 5 PPM of carbon monoxide 4) Not more than 300 PPM of carbon dioxide 5) Free of any kind of halogen and polymers. 6) Free of all forms of oxidizing substances. 7) Absolutely free of moisture. 8) Filled out of liquid oxygen from manufacturer with valid licence.

5 Specification of Medical Nitrous oxide 1) As per IP 1996/latest I.P. certified as inhalation analgesic. 2) Manufactured form IP grade ammonium nitrate. If any alternate technology or manufacturing process is used the same to be specified and all inputs regarding quality assurance and probable impurities etc must be provided. 3) Should not contain less than 98.0% V/V of nitrous oxide in both liquid and gaseous phase. 4) Less than 300 PPM of CO2 as impurity. 5) Less than 10 PPM of CO as impurity. 6) Free of hydrogen sulphide 7) Note more than 2 PPM V/V of nitrogen dioxide or nitric oxide in both liquid and gaseous phase 8) Free of all form of reducing and oxidizing substances. 9) Each batch must have passes tests for alkalinity, arsenic, phosphine, ammonia and other recommended tests. EMD (Earnest money deposit) 1) The tender must accompany an earnest money deposit for an amount of Rs /- (Fifty thousand) in the form of bank draft in favour of ESI account No-1 drawn on any nationalized bank. The tender unaccompanied with the earnest money shall be rejected outright and no communication shall be entertained. The earnest money shall be returned to all unsuccessful tenderers without any claim for accruals of interest. Withdrawal of the tender at any stage after submission shall forfeit refund of earnest money. Performance Security The successful tenderer shall have to submit a performance security of Rs. 2.5 lacs in the form of a fixed deposit/ Bank guarantee for the due compliance & fulfillment of the terms and condition of the contract in favour of Medical Superintendent payable in ESI fund Account No. 1. On due performance and successful completion of the contract the security money deposit shall be returned without any interest. On unsatisfactory performance or violation of terms and conditions of the contract will make the contractor liable for forfeiture of security deposit. The decision of Medical Superintendent will be final in this count. Period Of Contract The contract will be valid for two year from the date of finalization of the tender and the same can be extended by the M.S on mutual agreement. M.S has reserved the right to terminate the contract at any stage if the supplies and or services are found unsatisfactory. Documents to be Attached.

Certificate stating that the rate quoted are not higher than those quoted elsewhere. 6) Non black listing certificate. Certificate stating that the firm has not being black listed in the past and there is no vigilance enquiry pending. 7) Undertaking that uninterrupted supply of gas will be maintained or else alternative arrangement will be made at own risk of the firm. 8) Certificate mentioning total no. liquid oxygen transport tank in possession and permission to ply on all time of the day issued by Delhi Police. 9) Certificate stating that all terms and condition of tender are acceptable. Commercial Terms 1) The rate at which the cylinder will be delivered in the hospital must be quoted both in the words and figures per cylinders of A.B. D (Bulk)A A type for any other type mentioning the volume/pressure gauge of gas to be contained in each of the cylinder. The rate should be shown separately. a) Cost of gas per cylinder b) Transportation charges c) Rental charges d) Taxes to be mentioned e) Cost of any other chargeable component if any per cylinder. 2) Rate for liquid medical oxygen should be quoted in Rs/Kg. 3) Initial installation and transportation charges of the vessel should be quoted. There should not be any revision of rate during contract period except change in taxes, whenever notified by govt. 4) Price bid to be quoted in the following format.
