Rates are subject to change without notice. All deliveries are subject to a fuel surcharge; please confirm at time of ordering. Minimum Delivery (GTA): All orders are subject to a minimum $ delivery charge. Delivery lead time within these zones is 48 hours. Please confirm minimum quantities, lead time and charges for delivery in Zone 6 and greater when ordering.

6 TERMS & CONDITIONS OF SALE 1. All orders are accepted and subject to prevailing taxes, and subject to the cost of cartage applying at the time of shipment. 2. The acceptance by the seller of an order shall constitute a binding contract of purchase and sale in accordance with the terms set out in this agreement. 3. These terms and conditions, together with the purchase order, form the complete contract and there are no representations, warranties, or conditions expressed or implied affecting this contract other than as contained herein. 4. All sales are made in accordance with the seller's samples that the purchaser has seen and approved. No guarantee of exact colour shades is made. 5. "F.O.B. JOB SITE" means "DELIVERED TO THE CURB LINE". 6. Use of any delivered materials by or on behalf of the purchaser shall be deemed to constitute acceptance of the materials by the purchaser. 7. Excessive defective material delivered to the purchaser will be replaced free of charge if a claim is made within five days of delivery. Free replacement will be the extent of the seller's warranty. Any such claims will not constitute a reason for delaying payment. 8. Unsiutable or unsatisfactory material must be available for inspection by the seller to entitle the purchaser to an adjustment or credit. 9. No material may be returned for credit without the consent of the seller. Where the seller agrees to accept the return of the goods, these goods are subject to cartage charges and 25% of their value restocking charge. All goods must be returned in their original packaging. "Custom orders" will not be accepted for return. 10. Seller does not accept responsibility of delays in deliveries due to fire, flood, strikes, or any other conditions or contingencies beyond its control. 11. The purchaser is responsible for installation of the material on the job site and the seller has no responsibility in this regard. 12. Interest will be charged on overdue accounts at 1.5% per month calculated monthly on the balance owing at the beginning of the period. When in default of payment of any part of any money due under this account, the whole remaining unpaid amount shall, at the option of the seller, immediately become due and payable. 13. Title and ownership of the goods shall not pass to the purchaser until the amount owing, including interest, is paid in full. 14. In case of default by the purchaser, the seller may at any time without notice enter upon the premises where the goods are located, take posession of and remove them. 15. All "custom orders" must be delivered or picked up within 30 days of their production. 16. Excessive delays incurred on the delivery will be billed to the purchaser at $80.00 per hour. Excessive delay is defined as "MORE THAN ONE HOUR". 17. All prices are F.O.B. of production. 18. Placing charges for DuraHold, DuraHold2 and Siena Stone products are billed at $80.00 per hour, plus applicable taxes. 19. All orders are subject to a minimum $ delivery charge in the GTA only. Contact for shipping schedules, rates, conditions, and any fuel surcharges outside of the GTA. 20. Refundable shipping skid charge is $20.00 each. Skid(s) returned back to the seller from the buyer by December 31 of the year in which they were purchased will receive a credit of $17.00 per acceptable skid. Skids that are picked up by a truck at the same time as a delivery will be credited $17.00 per acceptable skid. A $2.00 per skid charge will be deducted if is requested to pick up skid(s) without making a delivery to the site. Minimum freight charges apply. Skid charges and credits only apply to the GTA. 21. Configurations may vary from time to time due to mold design changes. 22. A sectioning charge of $7.00 is applied to all items where the bundles are split. 23. "Custom orders" refer to non-standard inventoried items. Deposits representing up to 100% of the order value with a minimum of 20% will be required. Minimum quantities apply on custom orders. Custom orders may be subject to a 500 sq. ft. over-run charge. Purchase orders will be required for custom materials. Full amount of purchase order will be invoiced. 24. All prices are plus delivery, plus skids if applicable, plus applicable taxes. Confim prices at the time of ordering as they are subject to change without notice. 25. Engineering services are available; please contact your local representative to confirm charges and polices as they are currently under review.
