Acceptance of any Premium Benefits may subject you to sales and/or other applicable federal, state and local taxes. The Premium Benefits are subject, individually and collectively, from time to time and at any time, to availability, change, modification and/or cancellation at any time, with or without notice and with or without substitution. Premium Benefits may be changed, modified or canceled before, during and/or after the conclusion of the MLB regular season and are subject to such other restrictions, terms and conditions as the Yankees shall deem appropriate, in its sole and absolute discretion. The Premium Benefits are not necessarily exclusive to Delta SKY360 Suite Licensees and each Delta SKY360 Suite Licensee acknowledges that neither the Delta SKY360 Suite License Agreement nor the Delta SKY360 Suite Ticket License Agreement was entered into based upon or by reason of any promise or expectation pertaining to the Premium Benefits or the receipt of any other prospective benefits and/or experiences that the Yankees may provide. The discontinuance and/or termination (either temporarily or permanently) of the Premium Benefits and/or the unavailability, change, modification and/or cancellation of any of the same, all of which are offered in the Yankees sole and absolute discretion, shall neither constitute a breach by the Yankees of the Delta SKY360 Suite License Agreement and/or the Delta SKY360 Suite Ticket License Agreement, nor entitle any Delta SKY360 Suite Licensee to any compensation, credits, rebates, refunds, make goods or any other consideration.
