2 NOTICE TO BIDDERS Notice is hereby given by the City of Ottawa, that sealed bids will be received for bicycle pavement markings along both sides of the roadway for 2016 BICYCLE PAVEMENT MARKINGS for the City of Ottawa. Sealed bids will be received up to the hour of 10:00 A.M. MARCH 9, 2016 and all bids received will be publicly opened and read aloud in the City Hall on the said date at the said hour. Proposals shall be addressed to the City Clerk and shall be inserted in an envelope clearly marked on the outside proposal for 2016 BICYCLE PAVEMENT MARKINGS No proposal will be received unless accompanied by a bid bond, certified check, bank money order or bank draft drawn on a solvent bank in the State of Illinois payable without condition to the City of Ottawa, in an amount not less than 10% of the total amount bid. The City reserves the right to reject any or all bids and or to waive any technicalities in bidding. No bid may be withdrawn after the scheduled closing time for receipt of bids for 30 days. The Contract Documents are on file at the office of the City Clerk, City Hall 301 W. Madison St, Ottawa, Illinois, all copies of which may be acquired from the City Clerk at no charge. The bid security of the successful bidder shall be retained until final acceptance of all work. The Contractor shall pay Prevailing Wages as required for public contracts and conform to the requirements of a Responsible Bidder as defined by City Ordinance. See for more information. 5 RETURN WITH BID CONTRACT THIS CONTRACT, made as of the day of, 2016 by and between the City of Ottawa, Illinois, hereinafter called the OWNER, and. WITNESSETH, that the OWNER and CONTRACTOR, for the considerations stated herein, agree as follows: 1. GENERAL RESPONSIBILITIES The CONTRACTOR shall be responsible for completing 2016 Bicycle Pavement Markings as described herein by the calendar date of June 30, SCOPE OF WORK The CONTRACTOR shall provide and furnish all necessary labor, supervision, materials, tools, barricades, expendable and permanent equipment, and services required to perform and complete in a workmanlike manner. All work shall be performed in strict accordance with the Notice to Contractor, Instructions to Bidder, Proposal, General Conditions and Unit Specifications entitled: 2016 Bicycle Pavement Markings 3. PAYMENT The OWNER shall pay the CONTRACTOR, and the CONTRACTOR shall accept, in full, payment for the performance of this Contract, the amount determined by the quantities actually constructed, to the satisfaction of the CITY ENGINEER, times the unit prices in accordance with the attached proposal submitted by the CONTRACTOR. 6 PROJECT SCOPE Base Bid Install thermoplastic bike lanes, bike symbols and sharrows along both sides of Main Street from Boyce Memorial Drive to Columbus Street, approximately 6,500LF of roadway. Alternate #1 Install thermoplastic bike lanes, bike symbols and sharrows along both sides of Main Street from Columbus Street to Green Street, approximately 4,000LF of roadway. Alternate #2 Install thermoplastic sharrows on both sides of McKinley Road from Adams Street to Route 23, approximately 2,600LF of roadway. GENERAL REQUIREMENTS 1. Contractors shall be registered with the City of Ottawa. See: 2. Contractor shall pay prevailing wage and conform to requirement established in City of Ottawa Responsible Bidder Ordinance: a. Following forms shall be completed and submitted with the bid: i. ii Bike Lane Symbol and Sharrows shall be placed at approximately 600 intervals, adjusting near intersection. 4. 8 GENERAL PROVISIONS Suspension of Work, Termination and Delay Suspension for Convenience: 1. The City reserves the right to suspend and reinstate execution of the whole or any part of the work without invalidating the provisions of the Contract. Orders for suspension or reinstatement of work will be issued by the City to the Contractor in writing. The time for the completion of work will be extended for a period equal to the time lost by reason of suspension. 2. Extra costs and expenses, which are caused by work suspension ordered by the City, will be paid by the City to the Contractor. Termination for Convenience: The City may for its convenience, terminate work under the Contract in whole or part at any time by written notice to the Contractor. Such notice shall state the extent and effective date thereof. Utilities The Contractor shall be responsible for locating and protecting all existing utility lines. During the performance of this contract, the Contractor agrees as follows: 1. That it will not discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin or ancestry; and further, that it will examine all job classifications to determine if minority persons or women are under-utilized. 2. That, in all solicitations or advertisements for employees placed by it on its behalf, it will state that all applicants will be afforded equal opportunity without discrimination because of race, color, religion, sex, national origin or ancestry. Subcontractors Each subcontractor shall be approved by the Engineer before work begins. Unexpected Conditions The Contractor shall promptly, and before such conditions are disturbed, except in the event of an emergency, notify the City by Written Notice of 1.) Physical, including subsurface, conditions at the site differing materially from those indicated in the Contract Documents; or 2.) Unknown physical conditions at the site of unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent in the Work of the Character provided for the Contract Documents. The City will promptly investigate the conditions and if it finds that such conditions do so materially differ and cause an increase or decrease in the cost of, or in time required for, performance of the work, an equitable adjustment will be made and the Contract Documents will be modified by a Change Order.
9 Insurance All Contractors and Subcontractors on this work will be required to carry Workmen s Compensation Insurance and Public Liability and Property Damage insurance in the following amounts; Public Liability $500,000/$1,000,000 Property Damage $500,000 Certificates so stating shall be furnished the Owner upon request. All certificates and policies shall indicate that the insuring company will not cancel or materially alter the policies without giving the City notice in writing thirty (30) days prior to effective date of cancellation or alteration. In the event of such cancellation or alteration notice, Contractor shall obtain alternate insurance coverage in compliance with specification requirements. Interpretation of Contract Documents No oral interpretation will be made to any Bidder as to the meaning of the Contract Documents or any part thereof. Every request for such an interpretation shall be made in writing to the Local Public Agency. Any inquiry received seven or more days prior to the date fixed for opening of bids will be given consideration. Every interpretation made to a Bidder will be in the form of an Addendum to the Contract Documents, and when issued, will be on file in the office of the Local Public Agency and the office of the Engineer at least five days before Bids are to be opened. In Addition, all Addenda will be mailed to each person holding Contract Documents, but it shall be the Bidder s responsibility to make inquiry as to the Addenda issued. All such Addenda shall become part of the Contract and all bidders shall be bound by such Addenda, whether or not received by the Bidders. The Engineer shall interpret all drawings and specifications and their decision as to the true intent and meaning thereof and quality and sufficiency of the material and workmanship furnished there under shall be accepted as final and conclusive. The Contractor shall submit waivers of lien for all purchased materials before payment is made. Contractor to Protect Work Damage to existing sidewalks, bituminous sections or seeded areas, trees, shrubs, as a result of Contractor s operations shall be repaired by the Contractor at his expense. Standard Specifications Material and construction method for placement of the pavement markings shall conform to Standard Specifications for Road and Bridge Construction and Manual on Uniform Traffic Devices (MUTCD). 10 Method of Measurement Quantities for payment shall be determined by measuring the area of the completed work and calculating the quantities. Payment shall then be calculated at the contract unit price. No measurement shall be made if Engineer is not notified in advance of Contractor s activities. In the event the Engineer finds the materials or the finished product in which the materials are used or the work performed are not in conformity with the specifications and details and have resulted in an inferior or unsatisfactory product, the work or materials shall be removed or otherwise corrected by and at the expense of the Contractor. The Contractor shall submit waivers of lien for all purchased materials before payment is made.
