5 Beize Agricutura Heath Authoritv ICAP CHAPTER 211 BELIZE AGRICULTURAL HEALTHAUTHORITY 173f2001. (FISH AND FISHERY PKODUC'I'S INSPEC'I'ION1 REGULATIONS PART I PRELIMINARY [22nd December, 2001.] 1. These Reguations may be cited as the Short tite. BELIZE AGRCULTURALHEALTH AUTHORITY (FISH AND FISHERY PRODUCTS INSPECTION) REGULATIONS. 2. In these Reguations, uness the context otherwise requires- Interpretation. "Act" means the Beize Agricutura Heath Authority Act. CAP "additive" means a food additive specified by the Codex Aimentarius Commission; "aquacuture products" means a fisheq products born and raised in controed conditions unti paced on the market as a foodstuff; "Authority" means the Beize Agricutura Heath Authority estabishedunder section 3 of the Act; "brine" means a soution of common sat (sodium choride) and fresh water, or seawater with or without the addition of sat; THE SUBSLDIARY LAWS OF BELIZE by the Government Printer. the Government of Beize.

6 144 CAP.2111 Beize Agricutura Heath Authority "can" means any hermeticay seaed container; "canncd" fish" mcans any fish or fishcry product that is scacd in a can and is steriized; "certificate of registration" means a certificate issued in accordance with reguation 26 (6); "conveyance" means any vesse, aircraft, motor vehice, cargo container, traier or other means oftransportation of fish, fishery products or containers of fish or fishery products; "corrective action" means the procedure that is to be foowed whenever a deviation fiom a critica imit in a Hazard Anaysis Critica Contro Point Pan occurs or whenever the resuts of monitoring procedures in respect of a prerequisite program pan, or a food safety program for the importing or exporting of fish or fishery products show that there is non-compiance with these Reguations; "critica contro point" means a point in a process operation at which contro is to be appied in order to prevent or eiminate a hazard or reduce it to an acceptabe eve; "critica imit" means the maximum or minimumvaue to which a hazardmust be controed at a critica contro point; "cmstaceans" means a species ofthe cass Cmstacea; "decomposed", with respect to fish or fishery products, means fish or fishery product that have an offensive or objectionabe odour, favour, coour, texture or substance associated with spoiage; THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

7 Beize Agricutura Heath Authoritv ICAP "drainedweight" means the weight ofthe edibe contents of a container of fish or fishery products afier the iquid has been drainedby a method approved by the Managing Director, in consutation with the Minister; "fiets" means- sices of fish fesh of irreguar size and shape that have beenremoved from the carcass of a fish by cuts made parae to the backbone; or (6) sices of fish fesh described in paragraph that have been cut into sections and from which a interna organs, head, fins, bones, except intramuscuar or atera bones, and a discooured fesh have been removed, "finfish" means a species ofthe cass Osteichthyes; "fish" incudes a or any of the varieties of marine or fresh water animas, by whatever description caed; "fish export icence" means a certificate of registration issuedunder reguation 27 (1) that authorizes the hoder to- export ive or processed species ofthe cass Cmstacea; (6) export ive or processed finfish that have been raised in an aquacuture operation; and (c) export ive or processed finfish that have been harvested from the wid; THE SUBSLDIARY LAWS OF BELIZE by the Government Printer. the Government of Beize.

8 146 CAP.2111 Beize Agricutura Heath Authority "fish import permit" means a permit issued in accordance with reguation 8 (1); "fishery products" means a seawater or freshwater animas or parts of such animas, incuding theirroes, excuding aquatic mammas; "food safety program" as it reates to fish or fishery product, means a fish inspection and contro system, that incudes procedures, inspections and records, for the purpose of verifying and documenting the processing of fish and the safety and quaity of fish processed in, exported fi-om or imported into Beize; S.I. 25 of2001. "HACCP Pan" means a Hazard Anaysis Critica Contro Point Pan that is prepared in accordance with the principes of hazard anaysis critica contro point inspection as specified in the Third Schedue of the Beize Agricutura Heath Authority (Food Safety) Reguations, 2001, to ensure contro of hazards during the processing of fish; "hazard" means a bioogica, chemica or physica agent or factor that has the potentia to cause iness or injury to humans in the absence of its contro; "Inspector" means an officia authorized by the Authority to perform the duties of inspection in order to ensure food safety; "ot" with respect to fish and fishery products, means a shipment or part of a shipment of fish or fishery product that is of the same species, is processed in the same manner by the same producer, is packaged in the same size of container and bears the same abe; "Managing Director" means the Managing Director appointed pursuant to section 8 (1) of the Act; "Minister" means the Minister responsibe for Agricuture; THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

9 Beize Agricutura Heath Authoritv ICAP "net weight", with respect to unfrozen or frozen obster meat, means the weight of the edibe contents of a container after the iquid has been drained from the container by a method approved by the Managing Director, in consutation with the Minister, and, with respect to any other fish or fishery products, means the tota weight ofthe edibe contents of a container; "prerequisite program pan" means a series of steps, measures or procedures S.I. 25 0f2001. that are to be appied to ensure compiance with the Beize Agricutura Heath Authority (Food Safety) Reguations, 2001, incuding- estabishment, construction and equipment; (6) estabishment operation and sanitation; (c) the ceaning, sanitizing, ubricating and maintenance of estabishment equipment and faciities, and insect and anima pest contro; (4 fish and fishery products packaging, abeing or ingredient storage rooms or areas in the estabishment; and (e) the system for tracing fish to its first destination; "processing area" means an area of a registered estabishment that is used for the processing or storage of fish or fishery products and any other area designated as a processing area in a food safety program; "producer" means the ast person who processed fish prior to its importation into, or exportation out of, Beize; " product description" means a form on which are recorded the characteristics THE SUBSLDIARY LAWS OF BELIZE by the Government Printer. the Government of Beize.

10 148 CAP.2111 Beize Agricutura Heath Authority of a particuar fish product, incuding- (b) (c) the product name, the source of the raw materia used in producing the product, those characteristics that affect safety and may infuence the growth of disease-causing pathogens, (4 the ingredients that are added to the product, (e) f the packaging of the product, if appicabe, directions to the consumer as to the preparation required for consumption or whether the product is ready-to-eat, ( the product's shef ife, (h) (I) where the product is intended to be sod, and abeing instructions as may be appicabe for safe product distribution and storage, "ready-to-eat fish" means any fish, other than canned fish and ive shefish that does not require preparation except thawing or reheating before consumption; "registered estabishment" means a freezer-factory vesse, barge, onshore THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

11 Beize Agricutura Heath Authoritv ICAP pant, buiding or premise where fish or fishery product are processed or stored for export or oca sae and that is registered pursuant to reguation 26 (6); "registration certificate" means a certificate issued by the Authority to a faciity that certifies that the estabishment meets the conditions ofregistration; "sanitation program" means a written program deveoped in respect of a registered estabishment or in respect of the estabishment, conveyance or equipment of a hoder of a fish export icence, to ensure that the empoyees of the estabishment or the users of the conveyance or equipment, as the case may be, use proper sanitation and hygiene practices, and that the estabishment, grounds or conveyance under the contro ofthe operator or the equipment and conveyances of the hoder are maintained in a cean and sanitary condition and free from serious contamination and insect and anima pests; "serious contamination" means any condition or deficiency that resuts, or is ikey to resut, in an unacceptabe risk to the consumer or in tainted, decomposed or unwhoesome fish or fishery products; "shefish" means a species of bivave mouscs of the cass Bivavia and a marine, carnivorous species of the cass Gastropoda, either shucked or in the she, in whoe or in part, excuding the adductor musces of scaops and the meat of geoducks; "shrimp cocktai" means shrimp meat packed with sauce, spices, seasonings or favourings or any combination thereof; "support area"means an area of aregistered estabishment that is not a processing area and any other area designated as a support area in a food safety program, or an area that is used for- the storage of materias and ingredients used in fish processing; THE SUBSLDIARY LAWS OF BELIZE by the Government Printer. the Government of Beize.

12 50 CAP.2111 Beize Agricutura Heath Authority (b) (c) the maintenance of records for a food safety program; empoyee sanitation, persona hygiene or a change room; "tainted", with respect to fish or fisheryproduct, means fish or fishery product that is rancid or has an abnorma odour or favour; "unwhoesome", with respect to fish or fishery product means fish or fishery product that has in or upon it bacteria of pubic heath significance or substances toxic or aestheticay offensive to man. Appication. 3. (1) Subject to subreguation (2), these Reguations appy ony in respect of fish, fishery products and containers intended for domestic consumption, export or import. (2) Subject to reguation 6 (7), these Reguations do not appy to fish or fishery products that is imported or exported for persona consumption or use. PART I1 IMPORT AND EXPORT Inspection. 4. A fish and fishery products are subject to inspection and an Inspector may take sampes of fish or fishery products free of charge for the purpose of inspection or aboratory anaysis. Cooperation 5. The owner of fish, fishery products or aperson acting on his behaf With Inspector sha make readiy accessibe to an Inspector, any fish, fishery product, documents or containers for which inspection or re-inspection is required under these Reguations. 14 152 CAP.2111 Beize Agricutura Heath Authority of containers for each production code is provided to an Inspector on request; (c) each container has a abe on which the name of the country of origin is ceary identified; and (4 that person is the hoder of a vaid import permit; and (e) written notification of each shipment of fish or fishery product to be imported or that is imported is provided to an Inspector either prior to the importation or within 48 hours foowing the importation. (3) The notification referred to in subreguation (2)(e) sha set out, in respect of each shipment of fish or fishery product imported or to be imported into Beize and each type of fish or fishery product contained in that shipment- (b) (c) the quantity; the producer; the country of origin; (4 the pace where the fish or fishery product sha be hed or stored on its entry into Beize; and (e) the name, address and teephone number ofthe importer importing the fish or fishery THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

(4) Subject to subreguation (5), no person sha move or attempt to move fish or fishery product that has been imported into Beize from the pace indicated in the notification referred to in subreguation (2)(e) uness - uness an Inspector determines the fish or S.I. 25 of2001. fishery product meets the requirements of the Beize Agricutura Heath Authority (Food Safety) Reguations, 2001, and these Reguations; or (b) the person is notified by an Inspector that the fish or fishery product does not need to be inspected. (5) Aperson may, with the permission of an Inspector, move fish or fishery product that has been imported into Beize from the pace indicated in the notification referred to in sub-reguation (2)(e) to a pace specified by the Inspector. (6) No person sha import into Beize or attempt to import into Beize any canned fish uness the cans are embossed or otherwise permanenty marked in a code that identifies the name of the estabishment and day, month and year of processing. (7) No person sha import, process or export from Beize any of the foowing species- poisonous fish ofthe foowing famiies- THE SUBSLDIARY LAWS OF BELIZE by the Government Printer. the Government of Beize.

16 154 CAP.2111 Beize Agricutura Heath Authority Q) Tetraodontidae; (ii) (iii) (iv) Moidae; Diodontidae; Canthigasteridae; and (b) fishery products containing biotoxins such as ciguatera toxins or musce-paraysing toxins. Sef-investigation. 7. (1) A person who has imported, exported or processed fish or fishery product for export or domestic consumption and who receives information that questions the safety of fish or fishery product sha investigate the information. (2) If the resuts of the investigation indicate that the fish or fishery product constitutes a hazard to the pubic, the person sha notify the Authority within 24 hours. (3) The Authority sha then cross-check such information and where it confirms such information sha appy the appropriate reguatory action with the aim ofpreventing the pacing on the market of fish or fishery products considered as being a hazard to human heath. Fish Import 8. (1) The Managing Director, in consutation with the Minister, sha ~errmt. issue a fish import permit on receiving an appication and the appicant paying a fee of $10.00, or $ if a risk anaysis and the eaboration of the specific conditions under which the importation is aowed is needed, uness the Managing Director, in consutation with the Minister, has reasonabe S.I. 25 of grounds to beieve that the appicant winot compy with the Beize Agricuhua Heath Authority (Food Safety) Reguations, 2001, or these Reguations. 17 Beize Agricutura Heath Authoritv ICAP (2) An import permit is not assignabe and uness otherwise noted, expires 90 days after the date of issue indicated on the permit. (3) An importer of fish or fishery product sha maintain, at an address in Beize and for not ess than three years, a record in Engish of- the name and address ofthe person to whom each shipment of fish or fishery product was shipped from the importer and the date on which the fish or fishery product was shipped; (6) the date and time of a information received that questions the safety of fish or fishery product imported by the hoder of the permit; (c) ifthe information is vaidated on investigation- () a description ofthe information; (ii) (iii) (iv) (v) (v$ the date and time it was received; the name, address and teephone number ofthe informant; the method of investigation and the resuts obtained; the corrective actions taken; and the date and time the Authority was notified in accordance with reguation 7 (2); THE SUBSLDIARY LAWS OF BELIZE by the Government Printer. the Government of Beize.

18 156 CAP.2111 Beize Agricutura Heath Authority (4 with respect to canned fish or fishery product- (I) (ii) (iii) the name, address and teephone number of the process authority that deveoped the therma process used; the container type, size and specifications, stye of pack, species packed and if the therma process utiized has not been pubished or described in scientific iterature recognized by the Authority, the steriizing vaue (FO) of the therma process; a statement in writing signed by the representative of the process authority that attests that the therma process resuts in the production of commerciay sterie and safe fish products; (e) with respect to ready-to-eat fish or fishery product- (I) (ii) for a period of one year after the day of the coming into force of these Reguations, evidence of adequate processing; and after the end of the period referred to in subparagraph(i)- THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

23 Beize Agricutura Heath Authoritv ICAP are imported, the means by which the importer reviews abes to ensure their compiance, and documentation that ceary estabishes that the abes meet a appicabe requirements of Beize nationa standard for abeing; (X) in respect of fish or fishery product shipped by an importer, a description of the system used to trace fish or fishery product to its first destination; and ('I) in respect of any person responsibe for any aspect of the food safety program for the importer, evidence of their training or quaifications in fish or food processing or quaity contro. 24 162 CAP.2111 Beize Agricutura Heath Authority (4) Subreguation (3) (4 and (e) do not appy to fish imported fiom a country with which Beize has entered into an agreement regarding the import and cxport of fish or fishcry product if thc agrccmcnt contains provisions by which Beize- (b) recognizes that the fish or fishery product inspection and contro systems in pace in that country are equivaent to those required by these Reguations in respect of canned and ready to eat fish or fishery product; and has access to a information and records that are equivaent to those required by subreguation (3) (4 and (e) and that are hed by the fish or fishery product inspection authority in that country. Suspension 9. (1) The Managing Director, in consutation with the Minister, may etc., of import suspend, revoke or refbse to issue an import permit or export icence where permit, etc.. the Managing Director, in consutation with the Minister, beieves on reasonabe grounds that the hoder of, or the appicant for the permit - (b) (c) has provided fase information to the Managing Director for the purpose of obtaining an import permit or export icence; has faied to provide a written notification required pursuant to reguation 6 (2) (e); has provided fase information to an Inspector in a written notification required THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

25 Beize Agricutura Heath Authoritv ICAP pursuant to reguation 6 (2) (e); (4 has faied to maintain a record in accordance with reguation 8 (3); (e) has outstanding fees payabe under these Reguations; has faied to compy with the requirements of reguation 7; (j$ (h) is not operating a food safety system in accordance with the appicabe requirements of the Beize Agricutura Heath Authority S.I. 25 of (Food Safety) Reguations 2001; or has otherwise faied to meet the appicabe requirements ofthe Beize Agricutura Heath S.I. 25 of Authority (Food Safety) Reguations, 2001, or these Reguations. (2) Where the Managing Director has suspended or revoked an import permit or export icence pursuant to subreguation (), the importer or exporter may, within 60 days after that suspension or revocation, request in writing the Managing Director to determine whetherthe permit or export icence shoud be reinstated. (3) The fee payabe for each inspection that is carried out in the course of a determination pursuant to subreguation (2) is $400. (4) The determination referred to in sub-reguation (2) is fina. (1) Subject to subreguation (2), a icensed importer who imports service fee. fish or fishery product into Beize sha pay in respect of the type of product set out in Coumn I of an item of the tabe to this reguation, an inspection service fee, per kiogram of decared weight of fish or fishery product imported, in the amount appicabe to the eve of permit hed by the importer that is set out in Coumn 11, ofthat item. (2) The fee payabe for an inspection service is $50 for each shipment of fish- if the fish being imported is intended for further processing that wi resut in a substantia transformation of the fish; and (6) the fish is being deivered to a registered estabishment. (1) Where apersonrequests an inspection certificate for fish or inspection fishery products, a duy authorized Inspector of the Authority shacertificate. where the person operates the estabishment in which the fish or fishery products was processed, inspect the processing record of the estabishment to determine whether an inspection ofthe fish or fishery products is required and, if it is required, inspect the fish or fishery products, and (b) in any other case, inspect the fish or fishery products. (2) An Inspector sha issue an inspection certificate for fish or fishery products where- S.I. 25 of S.I. 25 of (b) (c) the Inspector determines that an inspection of the fish or fishery products is not required; the Inspector determines, foowing an inspection of the fish or fishery products, that the fish or fishery products meet the requirements of the Beize Agricutura Heath Authority (Food Safety) Reguations, 2001, and these Reguations; or each consignment of fish or fishery products destined for export must meet the Beize Agricutura Heath Authority (Food Safety) THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

Such fish or fishery products must come from approved estabishments, factory vesses or cod stores of the Authority's registered freezer vesses and be accompanied by a numbered origina heath certificate, duy competed, signed, dated and comprising a singe sheet in accordance with the mode in the Fourth Schedue (Reguation 10) of the Beize Agricutura Heath Authority (Food Safety) Reguations, 2001, or in the case of consignments destined for the European Union, the mode specified in Schedue VI. S.I. 25 of200. Schedue VI. (3) A person who requests an inspection certificate for fish or fishery products sha pay an inspection service fee of- $100, where an inspection of the fish is performed; and (6) $25, where an inspection of the fish is not performed. 16. (1) Where a person interested in a decision of an Inspector in Appea to respect of any inspection, grading, marking or other matter under these Managing Reguations is not satisfied with that decision, the person may, within 30 days Director. after such decision, by notice in writing, appea the decision to the Managing Director, who may, subject to reguation 18, order a re-inspection. A re-inspection sha not be ordered pursuant to reguation 16 (1) inspection. where- the identity of the fish or fishery products or containers of fish or fishery products in dispute has not been preserved; (6) the request for re-inspection was not made within 30 days after the disputed inspection; (c) the fish or fishery products or containers of fish or fishery products have in or upon them any poisonous or harmfu substance; or (4 the fish or fishery products or containers of fish or fishery products have been previousy re-inspected. Re-ispectio at 19. Where an Inspector has reasonabe grounds to beieve that fish or Inspector's fishery products has deteriorated after the date on which it was inspected or instance. that it otherwise fais to meet the requirements ofthese Reguations, he may again inspect such fish or fishery products. (1) No person sha export fish or fishery products, process fish Processing, etc., or fishery products for export or store fish or fishery products for export of fish, etc., for uness the processing or storing ofthat fish or fishery products is carried out in a registered estabishment. (2) Subreguation (1) does not appy in respect of- fish or fisheryproducts imported into Beize by a hoder of an import permit and that are intended for direct sae to consumers without further processing; or (6) fina products produced in a registered estabishment that, before being marketed. exported or made avaiabe to consumers, are temporariy stored in a cod-storage warehouse or other ocation that is not a registered estabishment. (3) For the purpose of subreguation (), "processing" does not incude any of the foowing: the washing, icing or boxing of ive, whoe or dressed unfrozen fish other than- (I) (ii) shefish and echinoderms; fish raised in an aquacuture operation; or THE SUBSLDIARY LAWS OF BELIZE by the Government Printer. the Government of Beize.

36 174 CAP.2111 Beize Agricutura Heath Authority (iii) crustaceans, excuding ive obster or ive crab; (6) the fi-eezing on board a vesse of whoe or dressed fish that are destined for hrther processing in a registered estabishment, other than shefish, echinoderms or crustaceans excuding shrimp; (c) the shucking of scaops to remove adductor musces with or without roe attached, if carried out on board a vesse; (4 the processing ofwhoe or dressedunfiozen fish, or the sating or picking ofwhoe, spit or dressedunfi-ozen fish by fisher packers other than shefish, echinoderms or crustaceans: (e) actions taken by fishers or processors at the time or point of catching, unoading, handing, hoding or transporting fish to preserve its quaity and safety before deivery to a registered estabishment for the purpose of processing, storage or inspection before export, if such actions are done in accordance with these Reguations. (4) fthe Managing Director, in writing, informs a fisher-packer who carries out an activity described in subreguation (3) (4 that there is serious contamination on board the vesse or onshore in the estabishment where that activity is conducted: THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.

(2) The Managing Director may not require an appicant to provide the information referred to in subreguation ()(c) to m, if it his been previousy submitted to the Authority andthere has been no change to the information. (3) The fee that is payabe for the registration of an estabishment with processing areas of a tota size set out in coumn 1 of an item oftabe 111 to this reguation is the amount set out in Coumn 2 ofthat item. (4) In addition to the fee referred to in subreguation (3), the fee that is payabe for the registration of an estabishment with processing areas of a tota size greater than 300 m2 is the amount set out in Coumn 2 of an item THE SUBSIDIARY LAWS OF BELIZE the Government of Bere.
