All responses to the subject solicitation must be received no later than 2:00 P.M. (ET) on Monday, April 3, 2017 (see Addendum No. 1, Item #1). A response received after the exact time specified will not be considered. Failure to file a protest within the time prescribed in Section (3), Florida Statutes, or failure to post the bond or other security required by law within the time allowed for filing a bond shall constitute a waiver of proceedings under Chapter 120, Florida Statutes (F.S.). Written notices, formal requests and proceedings must conform with the requirements set forth in Chapter , Florida Administrative Code (F.A.C.). Protests must be filed with the Purchasing Office, Fish and Wildlife Conservation Commission, Suite 100, 2590 Executive Center Circle, Tallahassee, Florida within the time prescribed in Section (3), Florida Statutes and Chapter , Florida Administrative Code. 3 Page 3 Item #2: Change to TERM: The TERM section is hereby revised to read as follows: The contract will be effective from issuance of the Purchase Order through December 31, There will be no renewal of this contract. Projects started prior to June 1 st shall be completed by the Contractor by the Completion Date of June 30, 2017 or within the timeframe specified for the project (see revised Specification 2.6 below), whichever is shorter. Projects started after July 1 st shall be completed by the Contractor by the Completion Date of December 1, 2017 or within the timeframe specified for the project (see revised Specification 2.6 below), whichever is shorter. Projects started between June 1st and June 30 th shall be completed by the Contractor within the time frame specified for that project (see revised Specification 2.6 below). If circumstances constituting Force Majeure have occurred, or if anything occurs beyond the Contractor s control, the Contractor may request in writing an extension of Completion Date. The Contract Manager and the Contract Administrator, upon review of the extension request, will determine and approve if the extension can be made. Item #3: Changes to SCOPE OF WORK: The SCOPE OF WORK is hereby revised as follows: Specification 2.6 is hereby revised to read as follows: All work shall be completed within 1) thirty (30) calendar days for the aquatic plant project and 2) 15 calendar days for the cypress project of the work commencement date unless otherwise specified in writing by the Project Manager or specified in the purchase order and written notice to proceed. Work may be performed during week-days (Monday-Friday) during daylight hours (sunrise to sunset). The Project Manager shall make a final inspection with the Contractor. The Project Manager shall determine work completeness before payment is authorized. Extension of work commencement dates and work completion dates shall be requested, in writing, by the Contractor. Any extensions granted or rejected by the Contract Manager shall be provided in writing to the Contractor. Specification 3.2 is hereby revised to read as follows: 3.2 All giant bulrush and Egyptian paspalidium plants will be planted on two-foot centers, unless otherwise specified by the Project Manager: Five (5) stands of 3,000 bulrush plants (15,000 total) will be planted on Philadelphia Point, Lake Kissimmee (general location = LAT N, LON W and Figure 2) A total of 25,000 Egyptian paspalidium plants will be planted in North Cove, Lake Kissimmee (general location = LAT27 58'3.27"N, LON 81 14'51.21"W and figure 2) Five (5) stands of 3,000 bulrush plants (15,000 total) will be planted in North Cove, Lake Kissimmee (general location = LAT 27 58'3.27"N N, LON W and Figure 2). 4 Page Five (5) stands of 3,000 bulrush plants (15,000 total) will be planted on the southwest shore (south of Philadelphia Point), Lake Kissimmee (general location = LAT N, LON W and Figure 2) A total of fifty (50) 25-gallon bald cypress trees will be planted on minimum tenfoot centers at locations designated by the Project Manager within North Cove, Lake Kissimmee and may vary dependent on environmental conditions the days of transplanting at the discretion of the Project Manager (general location = LAT 27 58'3.27"N, LON 81 14'51.21"W and Figure 3). Trees may be planted in inundated conditions depending on water level elevation in Lake Kissimmee. All excavated planting holes for trees planted under non-inundated conditions will be of a depth such that a slight depression will remain after the containerized plant is placed in the planting hole and back-filled with soil. The depression will create a slight catchment basin for capture and retention of rainfall during the plant establishment and acclimation period. Areas around planted trees must be raked flat to prevent piles of soil. Trees planted under inundated conditions (up to 18 water depth) must be planted to a depth that the root-ball is level with or not more than 3 below the surrounding lake substrate elevation. Each tree shall be staked with three (3) 7-foot studded metal t-posts (minimum 1.25 pounds per linear foot) driven through the root-ball to a minimum depth of three (3 ) feet below the surrounding lake substrate elevation. Specification 3.5 is hereby revised to read as follows: 3.5 All plants shall be planted within twenty-four (24) hours of harvesting unless otherwise specified in writing by the Project Manager. All trees shall be thoroughly irrigated by the Contractor no more than 24 hours prior to arrival at the staging Area. If the Contractor stockpiles trees at the staging site, all trees at the staging site shall be irrigated at no greater than 48-hour intervals. The Contractor shall be required to provide transport for all plants from the plant origination sites (nursery, wild collection site, etc.) to the staging area for the recipient waterbodies. The Contractor shall be required to provide their own vessels to transport all aquatic plants to planting locations within the recipient waterbodies. The Project Manager and Commission staff will provide assistance to the Contractor in transport of trees to the planting sites (i.e., via barge pontoon or provide at least one airboat and/or 4-wheel drive vehicle [swamp buggy] and high-axle trailer with Commission drivers). The Contractor shall be solely responsible for loading trees in Commission vehicles and unloading trees at planting site(s) and any staging site(s). Plants and trees shall be transported in a manner which prevents the roots, stems and leaves of the plants from drying out. The Project Manager shall approve, in advance of harvest, the method of keeping the plants and trees hydrated. Plant and tree material shall be planted at the project site in the manner and pattern described by the Project Manager. Specification 5.1 is hereby revised to read as follows: The Contractor will have fourteen (14) calendar days following project completion to submit all invoices for the Projects.

5 Page 5 Figure 1 and Figure 2 are hereby deleted and replaced with Figure 1 (Revised) and Figure 2 (Revised). Figure 1 (Revised) and Figure 2 (Revised) have been uploaded separately to the Vendor Bid System. Item #4: Change to ATTACHMENT E: Attachment E, Price Sheet, is hereby deleted and replaced with Attachment E (Revised), attached hereto and made a part hereto. END OF ADDENDUM NO. 1

6 FWC 16/17-96 ATTACHMENT E (Revised) PRICE SHEET CONTRACTOR SHALL NOT ALTER THE PRICE SHEET IN ANY WAY. Price quoted shall not contain any Federal or State sales or use taxes. The bidder recognizes that the State of Florida, by virtue of its sovereignty, is not required to pay taxes on services, goods and/or equipment purchased incident to such service. Quoted price shall include all necessary items to complete the project. Bidder shall provide a price for each item under the Project and multiply the bid price times the estimated quantity to get a total bid price per item. For Project 1, the total bid prices per item shall be added together to get a Total Bid Price for the Project. Bidders are not required to bid on both Projects; however, failure to submit prices for all plants for a bid-upon Project shall result in disqualification of that Project Bid.
