8 New Bethesda Farms, LLC / CADENCE EQUINE SPORTS ALLIANCE, LLC LIABILITY RELEASE FORM CADENCE EQUINE SPORTS ALLIANCE, LLC. Megan Malan, Owner/ (585) /cadenceCESA@gmail.com NEW BETHESDA FARMS, LLC. David Vittum, Owner/ (585) / dvittum@rochester.rr.com New Bethesda Farms, LLC, 3301 Hopkins Road, Canandaigua NY / Phone (585) or (585) I, ( print name ) would like to participate in horseback riding/ horse-handling/ farm work (all included under the title of horsemanship activities ) around horses at New Bethesda Farms, LLC (NBF) and at Cadence Equine Sports Alliance, LLC (CESA). I acknowledge the risks and potential for risks of horseback riding and related activities. However, I feel that the possible benefits to myself/my son/my daughter/my ward are greater than the risks assumed. I hereby, intending to be legally bound, for myself, my heirs and assigns, executors or administrators, waive and release forever all claims for damages against NBF, CESA Head Instructor Megan Malan, other contracted or employed Instructor(s), any Assistants or Consultants, NBF Owner David Vittum, NBF Manager Megan Malan, Boarders at NBF, Employees/ Interns of NBF and CESA for any and all injuries and/or losses I/my son/my daughter/my ward may sustain while participating in NBF/CESA activities. The following describes some, but not all, of those risks inherent in general horsemanship activities: The propensity of an animal to behave in ways that may result in injury, harm, death, or loss to persons on or around the animal; The unpredictability of an equine s reaction to sound, sudden movement, unfamiliar objects, persons, or other animals; Hazards, including, but not limited to, surface or subsurface conditions; a collision, encounter and/or confrontation with another equine, another animal, a person, or an object. The potential of an equine activity participant to act in a negligent manner that may contribute to injury, harm, death, or loss to the participant or to other persons, including but not limited to, failing to maintain control over an equine and/or failing to act within the ability of the participant. Horses are 5-15 times larger, times more powerful, and 3-4 times faster than a human. If a rider falls from a horse to ground it will generally be from a distance of 3½ - 5½ feet, and the impact may result in injury to the rider. If a horse is frightened or provoked it may divert from its training and act according to its natural survival instincts which may include but are not limited to: Stopping short; spinning around; changing directions and/or speed at will; shifting its weight; bucking; rearing; kicking; biting; running from danger. There are elements of nature and/or sudden and/or unfamiliar sights, sounds and/or sudden movements that can scare a horse, cause it to fall, or react in some other unsafe way. Some examples are: thunder, lightning, rain, wind; wild and domestic animals, insects, reptiles; which may walk, run, or fly near, bite or sting a horse or person; and irregular footing on outdoor groomed or wild land, subject to frequent changes in condition according to weather, temperature, and natural and man-made changes in the landscape. NBF s/cesa's Protective Headgear Policy : I understand and agree that NBF/CESA requires ALL those participating in horsemanship activities to wear SEI CERTIFIED ASTM STANDARD protective headgear/helmet, with the exception of visiting clinicians who decline, and those clients with disabilities and/or equipment such as cranial stents who would be endangered by wearing a helmet. Exceptions must be approved in writing and signed by the client s personal physician within the previous six months to date signed on this form. I am aware that horsemanship activities entail risk of injury or death to any participant. I understand the above description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may
9 result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and with full knowledge of the inherent risks. I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that a representative of NBF has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity. I have carefully read, clearly understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children. Signature ( Parent/ guardian if 18 or under) Date Printed Name ( and TITLE, if not participant) ADDRESS PHONE PHOTO RELEASE (check one) I Do / I Do Not consent to, and authorize, the use and reproduction by NBF/CESA of any and all photographs and any other audiovisual materials taken of me/my son/my daughter/my ward for promotional printed material, educational activities or any other use for its equestrian activities programs.
