2 PREFACE This report is based upon the premise of providing equal access for handicapped persons to public transportation infrastructure, including sidewalks, curb ramps, driveway approaches, and transit shelters. As such, streets where pedestrian facilities do not exist or are only intermittent are considered as part of the City of Dinuba s normal Sidewalk Construction Program and not included in the City s ADA Program. Intermittent pedestrian facilities are defined as pedestrian facilities that are missing on five (5) for more properties within block or where one half of the block is missing pedestrian facilities. The evaluation of the pedestrian facilities for compliance with ADA requirements is based upon the Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way, published in the Federal Register on July 26, The evaluation considered sidewalk widths and cross-slope; curb ramp dimensions and slopes, and driveway accessibility for pedestrian access. Transit shelters were evaluated considering the clear path dimensions between the transit shelter and the face of curb, the distance between the shelter wall and the bench for wheelchair access, and the existence and adequacy of the landing area. The evaluation utilized the combination of Google Earth, Field Reviews, City Documentation, and discussions with City Staff in order to determine the adequacy of the City facilities reviewed. The City transportation infrastructure was then segregated into two Types: Facilities that are Included in the City s ADA Program; and Facilities that are Included in the City s Sidewalk Program. The segregated facilities were then further segregated into categories for each Type. Recommended improvements to pedestrian facilities range from simple modifications, such as grinding lip at gutter interface and installing truncated dome matting, to construction/reconstruction of existing facilities. In most cases where driveway approaches are not ADA compliant, additional right of way for a compliant sidewalk at the back of the driveway approach will be required to bring the driveway approaches into compliance. An alternative to purchasing the right of way behind the driveway approach is to reconstruct the driveway approach in a modified ADA Compliant driveway approach (see figure in Attachments Section of this Report). Recommended improvements to transit facilities include relocation of benches to accommodate wheelchairs to construction of an ADA compliant transit landing. P-1

5 SECTION 1 ORGANIZATION OF THIS REPORT Background: This Report has been prepared by the City of Dinuba in accordance with Title 42, Public Health and Welfare, Chapter 126, Equal Opportunity for Individuals with Disabilities, in order to determine the extent of City owned transportation facilities that are not in compliance with the requirements of the Americans with Disabilities Act (hereinafter referred to as the ADA). The evaluation of City owned transportation facilities is based on the Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of Way, published in the Federal Register on July 26, This report has been organized in the following manner: Preface; Organization of this Report; ADA Compliance Requirements; Existing Facilities Evaluation; Recommended Improvements; Budget And Constraints; Schedule of Improvements: Estimated Construction Costs. Evaluation Organization: This Report evaluates two types of transportation facilities: pedestrian facilities along the transportation corridors within the City Limits (herein after referred to as pedestrian facilities); and transit shelters. The evaluation separated the pedestrian facilities into two types: 1) Facilities that are included in the City s ADA Program; and 2) Facilities included in the City s Sidewalk Program. Those facilities that are included in the Facilities Included in the City s ADA Program are evaluated and included in the Transition Plan Schedule of Improvements Section. Those facilities include in the Facilities Included in the City s Sidewalk Program are areas in the City where pedestrian facilities do not exist or are so intermittent within an area (five or more properties with no sidewalk along the frontage, on each side of the street, within one block ) that pedestrian facilities can reasonably be assumed not to exist. These types of pedestrian facilities are included in the City s Sidewalk Program or will be constructed as part of the City s Street Reconstruction Program and as such are considered as separate from the City s ADA Program. Facilities Included in the City s ADA Program: This type of pedestrian facility has been separated into four Categories: Category 1- Pedestrian facilities that are in compliance with ADA requirements; Category 2 Pedestrian facilities with sidewalk gaps (where gaps in sidewalk are four properties 1

6 frontages or less) or non-compliant sidewalks widths; Category 3 Pedestrian facilities with driveway approaches that are not in compliance with ADA requirements; and Category 4 Pedestrian facilities with curb ramps that are not in compliance with ADA requirements. Facilities Included in the City s Sidewalk Program: This type of facility has been separated into two Categories: Category 1 Blocks where Pedestrian Facilities Do Not Exist (on one side or both sides); and Category 2 Blocks Where Pedestrian Are Intermittent. Transit Shelters: Transit Shelters are evaluated under three basic criteria: Criteria 1 Adequate distance between the transit shelter and the face of curb; Criteria 2 Adequate distance between the transit shelter wall and the transit bench for wheelchair access; and Criteria 3 Adequate landing area. Federal Aid Requirements Regarding ADA Improvements: Agencies receiving Federal Aid for reconstruction or rehabilitation of streets under the local agencies jurisdiction are required, as part of the conditions of receiving Federal Aid, to bring all pedestrian facilities into compliance with current ADA requirements. The City of Dinuba, as standard policy and in compliance with Federal requirements, includes improvements to the pedestrian facilities within the street reconstruction project limits. 2

12 SECTION 2 ADA COMPLIANCE REQUIREMENTS General This Report is based upon the Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way, published in the Federal Register on July 26, 2011 as proposed by the Architectural and Transportation Barriers Compliance Board (hereinafter referred to as the Board ). The Board s Guidelines are an important component in the implementation of the three federal laws governing accessibility for disabled persons. Those laws include: the Americans with Disabilities Act (hereinafter referred to as ADA ), 42 U.S.C ; the Rehabilitation Act, Section 54, 29 U.S.C. 794; and the Architectural Barriers Act, 42 U.S.C The ADA was enacted 1990 in response to findings that there were widespread barriers to accessibility for disabled persons in critical areas such as employment, public accommodation, government services, and transportation. The stated purpose of the ADA is: to provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities and to provide clear, strong, and consistent, enforceable standards addressing discrimination against individuals with disabilities.. 1 The ADA was revised on January 13, 1998 and again in July 23, 2004 and was known as the Americans with Disabilities Act and Architectural Barriers Act Accessibility Guidelines. Three major issues addressed in the 2004 revisions: 2 Alterations to Existing Facilities The proposed guidelines clarify that where elements, spaces, or facilities are altered, each altered element, space, or facility within the scope of the project must comply with the applicable requirements for new construction. Existing Facilities that are Not Altered The proposed guidelines clarify that the guidelines do not address existing facilities unless they are included within the scope of an alteration undertaken at the discretion of a covered entity. Allowances for Typical Roadway Geometry The proposed guidelines include the following allowances for typical roadway geometry: 1 42 U.S.C Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way, published in the Federal Register on July 26,

13 1. The Grade of Pedestrian access routes within sidewalks is permitted to equal the general grade established for the adjacent street or highway; 2. A maximum cross slope of 5 percent is permitted for pedestrian access routes within pedestrian street crossings without yield or stop control where vehicles can proceed through the intersection without slowing or stopping; 3. The cross slope of pedestrian access routes within midblock pedestrian street crossings is permitted to equal the street or highway grade; 4. The cross slope of curb ramps, blended transitions, and turning spaces at pedestrian street crossings without yield or stop control where vehicles can proceed through the intersection without slowing or stopping, and at midblock pedestrian street crossings are permitted to equal the street or highway grade; and 5. Clear spaces required at accessible pedestrian signals and pedestrian pushbuttons and at other accessible elements are permitted to have a running slope consistent with the grade of the adjacent pedestrian access route. Overview of Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way The proposed guidelines ensure that the following facilities for pedestrian circulations and use located in the public right-of-way are readily accessible to and useable by pedestrians with disabilities: 3 Sidewalks, pedestrian overpasses and underpasses, and other pedestrian circulation paths, including requirements for pedestrian access routes, alternate pedestrian access routes when pedestrian circulation paths are temporarily closed, and protruding objects along or overhanging pedestrian circulation paths; Pedestrian street crossings, medians, and pedestrian refuge islands, including requirements for curb ramps or blended transitions, and detectable warning surfaces; Pedestrian street crossings or roundabouts, including requirements for detectable edge treatments, where pedestrian crossing is not intended, and pedestrian activated signals at multi-lane pedestrian street crossings; Pedestrian street crossings at multi-lane channelized turn lanes at roundabouts and at other signalized intersections, including requirements for pedestrian activated signals; 3 Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way, published in the Federal Register on July 26,

14 Pedestrian signals, including requirements for accessible pedestrian signals and pedestrian pushbuttons; Transit stops and transit shelters for buses and light rail vehicles, including requirements for boarding and lighting areas at sidewalk or street level, boarding platforms, and route signs; Pedestrian at-grade rail crossings, including requirements for flangeway gaps; On-street parking that is marked or metered, and passenger loading zones; Pedestrian signs, including requirements for visible characters on signs and alternative requirements for audible sign systems and other technologies; Street furniture for pedestrian use, including drinking fountains, public toilet facilities, tables, counters, and benches; and Ramps, stairways, escalators, handrails, doors, doorways, and gates. 10

21 SECTION 3 EXISTING FACILITIES EVALUATION General: As with most cities, the City of Dinuba, CA, has a mix of conditions where there are no pedestrian facilities, no wheelchair ramps at the curb returns, and/or driveway approaches that are not ADA compliant to pedestrian facilities that are in compliance with ADA requirements. This Report categorizes the pedestrian facilities first into transportation facilities that are included in the City s on-going Sidewalk Program and transportation facilities that are included in the City s ADA Compliance Program. Once the facilities that were determined should be included in the City s ADA Compliance Program, those facilities were then further categorized into four categories: Category 1 Pedestrian Facilities That Are In Compliance With ADA Requirements; Category 2 Pedestrian Facilities With Sidewalk Gaps Or Non-Compliant Sidewalks; Category 3 Pedestrian Facilities With Driveway Approaches That Are Not In Compliance With ADA Requirements; and Category 4 Pedestrian Facilities With Curb Ramps That Are Not In Compliance With ADA Requirements Or Are Missing. There are two types of facilities that are not included in the City s ADA Program: blocks where pedestrian facilities do not exist and blocks where pedestrian facilities are only intermittent. These types of facilities are more appropriately included in the City s ongoing sidewalk program. Street reconstruction projects will include bringing City pedestrian facilities that are listed under the City s ADA Compliance Programs will be reconstructed to ADA requirements at the time the street is reconstructed. Pedestrian facilities that are included in the City s on-going sidewalk program will be constructed if adequate funding is available as part of the street reconstruction program. Trip hazards and sidewalk differential settlement, under California State Law, is the responsibility of the property owner to repair. The City s transit shelters were reviewed for compliance with clear space requirements and landing area requirements.
