PETERSBURG PSI Committee Meeting Minutes February 13, 2014 at 9:28a.m. PRESENT: ABSENT: ALSO: Committee Members William Dudley, Chair; Vice Chair; Steve Kornell, Darden Rice; and James Kennedy, Alternate. Council Members Charlie Gerdes and Amy Foster; City Administrator Gary Cornwell, Chief Assistant City Attorney Mark Winn; Staff Support Ken Betz Golf Course Operations Manager; Transportation & Parking Director Joe Kubicki; Development Coordinator Director Chris Ballestra; USF Student Representatives: included Student Body President, Franklin Albes, William Harris and Brandon Garbett; Bicycle/Pedrestian Coordinator Cheryl Stacks; Deputy City Clerk Amelia Preston and others. The meeting was called to order by Chair Dudley at 9:28 a.m. with the above members present. In connection with the agenda for the February 13, 2014 meeting, Committee Vice Chair Kornell moved that the agenda for February 13, 2014 meeting be approved as submitted. All were in favor of the motion. Absent. Newton. In connection with minutes of the January 30, 2014 meeting, Committee Vice Chair Kornell moved that the minutes of the January 30, 2014 Meeting be approved as submitted. All were in favor of the motion. Absent. Newton. In connection with the New Business relating to Section of the City, Chair Dudley asked Council Member Nurse introduce the item where he shared that Students from the from USF St. Pete Campus were present to make a request. Mr. Nurse commented briefly that there are lots of folks that use skateboards; and made reference to the City which prohibit use on private property and in the downtown area. Mr. Nurse introduced the USF Student Body President, Franklin Albes, who represents the USF Long Board Club. Mr. Albes provided the Committee with a brief history of how long boards are used for transportation by college students. He stated their request to the Committee is to consider removal of the current band on Skateboarding in the downtown area and allow them the ability to use long board's access in the bike lanes. Mr. Albes commented that long boards are their way to commute to school; stated they used it for the Martin Luther King, Jr. Parade; and they all used them to get to the meeting today. It was suggested that the Committee use the Police Department to help regulate them. Committee Member Kennedy inquired if they were aware of the gentlemen who loss his son due to not wearing helmets. He inquired if they could agree and be willing to wear helmets. Chief Assistant City Attorney Mark Winn commented that they would have to do some research to come up with the needed changes to expand the ordinance. Transportation and Parking Director Joe Kubicki commented briefly regarding safety first and how to keep problems from the past with damage to private property which caused the band in the first place.

3 PSI Meeting Minutes Page2 Lieutenant Gary Dukeman of the P0lice Department gave a brief history on the damage that was caused by skateboarders in the downtown, stated recently there has been damage to the Fine Arts Museum ranging from $1,500 to $2,000; commented on the safety of the persons using the sidewalks and commented briefly to those things that could occur when using the roadway. He stated further that the ordinance is a tool they use with a great deal of discretion where only two skateboarding tickets were issued last year. He stated further that his main concern is injury with the amount of congestion of pedestrian and vehicular traffic in the downtown area and feels that safety equipment should be required. Committee Member Kennedy suggested that consideration be given to reducing the area where skateboarding will be allowed; expressed concern relating to use on Central A venue; and inquired if traffic study could be done. Vice Chair Kornell inquired about the use of skateboards in downtown and them not being allowed on the roadway. He would like to see that the USF Long Board Club meet with the Office on Aging and the ability to have some understanding built between the young people and the elderly; and stated his support of removing the band. Committee Member Rice inquired if the students used sidewalks or bike lanes. The response was they currently use the sidewalks when accessible or bike lanes; however, would prefer to use bike lanes only. She inquired about the youth that are under 15 years old. Brandon Garett responded that they vary in age and most are at the age of 16 who use the long board to get back and forth to school. Committee Member Rice inquired if they could limit use to age 16. It was suggested that they limit the size as opposed to age to prevent the grinding which creates the problem. They welcomed the ability of being required to use bike lane, helmet and size of the board so that they can get to where they need to travel. Council Member Gerdes inquired about the push scooters and whether they could be used in bike lanes are limited to just bikes. Cheryl Stacks commented on the use of the roadway and the sidewalk only used when crossing a sidewalk or crosswalk. She cited the State Statute "Section (11) No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, may go upon any roadway except while crossing a street on a crosswalk; and, when so crossing, such person shall be granted all rights and shall be subject to all of the duties applicable to pedestrians." It was shared that there is a limitation. Committee Member Rice also inquired about the use of reflective gear. It was responded that there are other types of wear that can be uses as oppose to helmets. Council Member Nurse cautioned the language that could be input into the ordinance. He suggested that they keep it simple. Development Coordinator Director Chris Ballestra commented briefly on safety and his ability of working hard with the private sector to consider private investment; expressed concern relating to damage from skateboarding and long boarding and the fact that they have spent a lot of money on City Development. He urged Committee Members to go through and see what happens on private development on u-tube because the information is out there. It was shared that only two buildings recently reported any damage; however, the Fine Arts Museum has had damage in the range of $1500 to $2,000. Committee Vice Chair Kornell also voiced concern regarding the

4 PSI Meeting Minutes Page 3 ability to be regulated and indicated support of a skateboard park in close proximity to the downtown. He expressed appreciation to the Students for coming forward and making this request. He commented briefly on the behavior being the problem and expressed agreement with Council Member Nurse earlier comments. Chief Assistant City Attorney Mark Winn shared that the x-games was exempted from this ordinance. Council Member Gerdes stated concern about the statute that has a prohibition of skateboards on the roadway; however, indicated that he would like for Legal to come back by the end of April with language for consideration to eliminate or see what can be done. Since Council Member Gerdes is not on the Committee, Committee Member Darden moved that Legal be directed to come back at the end of April with appropriate language to consider/allow use of skateboard/long boards on the roadway is the bike lane only, if possible and to address the number of topics that have been discussed. All were in favor of the motion. Absent. Newton. Council Member Foster excused at 10:03 a.m. There was discussion regarding the use of helmets in the City and safety equipment as it related to skate boards/long boarding. Committee Member Kennedy commented briefly on the way that someone could fall and the injury that can take place; and suggested that legal consider certain area that they not be able to use that would be considered bad locations. It was stated that they must obey the traffic laws and adhere to safety at all times. Chair Dudley suggested that individuals adhere to the rules; also agrees that they don't want to overkill on this issue. There being no further business, the meeting was adjourned at 10: 13 a.m.
