3 Welcome from Maple Oaks Red Angus It is our pleasure to welcome you to our 3rd Annual Bull and Female Sale. We would also like to take this opportunity to thank the many customers that have supported our program over the years and invested in our genetics. It makes us very proud to hear of our customer s satisfaction and many success stories as our Red Angus cattle have gone on to enhance many other herds. We made a very conscious decision to invest in Red Angus approximately 15 years ago as a seed stock producer. We travelled the United States and Canada to learn about and invest in world class Red Angus genetics so we can bring some of the Best of the Best to our customers. We believe you will see many of those genetics within our offering, including the likes of the one and only Red Soo Line Annie 7249, Red Six Mile Signature, Red Six Mile Sakic, Silveiras Mission Nexus 1378, Pie One of a Kind 352, Benchmark Transition 10-14, Red Basin EXT 45T5 and so many more. We study the animals well beyond their EPDs and are excited to have the opportunity to pass these genetics on to you. We have been hit hard by the drought and have had to buy and feed fescue hay all summer. We have virtually no pasture so we are having to sell many we would normally retain. We focus on our females and are confident the young females will grow up to be beautiful, productive females with depth of body, great udders and a beautiful presence. Regarding the bulls, we did not have our sale last fall so we carried over the bulls and are offering an impressive group of strong, powerful, productive two year olds, along with 18 month, and yearlings. The bulls are exposed to real world conditions and are bred with multiple trait selection in mind. They are grown slow and get a lot of exercise. They run on approx. 30 acres, no feedlot like environment. They are exposed to the Ozark hills, fescue grass, creeks, rocks, cedars, ponds, etc. They have access to clean water and free choice AMP-T mineral at all times. Their dispositions are terrific, are up on all vaccinations, have passed their soundness exam, are BVD and PI tested, and are ready to go to work! CERTIFICATE OF REGISTRY A transferred certificate of registry will be furnished to the Buyer for each animal. PURCHASER S RISK Each animal becomes the risk of the Buyer as soon as sold, but it shall be the obligation of the Seller to see that animals are fed and cared for free of charge to Buyer, until loaded for shipment or until the expiration of 48 hours after the sale, whichever occurs sooner. HEALTH All animals are eligible for interstate shipment, except as otherwise announced. Interstate health papers will be furnished for each animal in accordance with prevailing State/Federal Regulations. BREEDING GUARANTEE a. All animals are guaranteed by the Seller to be breeders, with the exception of: i. Calves less than 12 months of age. ii. Animals shown by purchaser after sale. The breeding guarantees, if any, shall be such as agreed upon between Seller and Buyer. iii. Gross negligence or willful misconduct on the part of Buyer. b. Bulls are guaranteed breeders if not allowed to run within the herd until at least 14 months of age. Any bull that either: i. Settles one-third or more of the healthy cows he serves. ii. Is the sire of 20 or more animals. iii. Settles cows by natural service and passes a fertility test made by a competent veterinarian during any six-month period of trial (provided on page 40 of Options and Privileges of Return or Adjustment, this section) shall be considered a breeder. Any guarantees with respect to the ability to freeze semen shall be by separate agreement between the Buyer and Seller. c. Safe in Calf Females have been examined by a competent veterinarian and are so guaranteed. d. Served Females are believed to be in calf but are not so guaranteed. e. Pasture-exposed Females have been exposed but are not guaranteed to be in calf. f. Open Females have not been served and are so guaranteed. 8 The Bulls Annie Dam of Lots 1-3 Annie THE SONS OF 7249 ( ) There is simply no denying the impact that Annie 7249 had and continues to have on the Red Angus breed as a whole. She was the definition of a true power cow and left a lasting legacy behind. Annie 7249 was campaigned with great success, being named Reserve Grand Champion Female at the World Red Angus Forum in After that major victory, Annie went on to be named Reserve Senior Champion Female at the 2009 Canadian Western Agribition. She also was the Reserve Grand Champion Female at the 2009 First Lady Futurity with her calf Red Soo Line Annie She was sold in the historic Soo Line Dispersal to Wildcat Creek Ranch in Kansas before making her way to the Maple Oaks Red Angus program. 40 Additional Terms NON-OWNED SERVICE SIRE If a female is bred to a non-owned bull, at the time of natural service exposure, a lease agreement will be required for registration of the resulting calf. The exceptions to this rule are: a. If the bull was owned by a member of the family or an employee of the recorded owner of the dam. b. If the cow was bought bred from the recorded owner of the service bull. OPTIONS AND PRIVILEGES OF RETURN OR ADJUSTMENT a. All claims for adjustment or refund must be made in writing either within six months of the sale date or not later than six months after the animal reaches 18 months of age, with the exception of claims involving defects of parentage. b. In the event an animal is claimed to be a non-breeder, the animal may be returned to the farm/ranch of the Seller if in good condition and complying with the health requirements of the Seller s state. The Seller shall be entitled to six months trial following the return of the animal in which to prove the animal is a breeder. If at the end of six months the Seller is unable to prove the animal is a breeder, the Seller, at the option of the Buyer, shall replace the animal with another of equal value or refund the purchase price. The return of the full purchase price shall in any case be deemed full satisfaction and settlement. Any expenses incurred for transporting an animal claimed to be a non-breeder shall be the responsibility of the Buyer; except that the Seller shall be responsible for transportation cost in the excess of the distance between the Buyer s farm/ranch and the location where the sale took place. If the Seller proves the animal to be a breeder, it shall be the obligation of the Buyer to take delivery of the animal and pay all expenses incurred for transportation. c. If a female sold as safe in calf proves not to be in-calf, the Buyer may receive service from the bull previously used. If the bull is not available, the Seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm/ranch of the Seller. Any adjustment provided for herein shall absolve the Seller from further liability, except in case such female proves to be a non-breeder. If a female represented as safe in calf at time of sale to a certain bull proves to have been bred to a different bull, the Seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm of the Seller (adjustments shall not be considered to be a breeding fee or an allocation of the purchase price to any unborn calf). Any expense incurred for transportation shall be the responsibility of the Buyer, except that the Seller shall be responsible for transportation costs in excess of the distance between the Buyer s farm/ranch and the location where the sale took place. d. If a female sold as served proves not to be in calf, or if a female sold as pasture-bred proves not to be in calf, the Seller only guarantees such female to be a breeder. GENETIC DEFECT AND PARENTAGE GUARANTEE a. The parentage of all animals sold by the Seller is guaranteed to the extent that the animal is by the sire and out of the dam that is indicated on its registration papers. b. All test results confirming an animal s genetic defect status must be disclosed to potential buyers prior to that animal s sale. c. All cattle have met the RAAA requirements for registration as pertaining to genetic defects. In particular, animals containing a known genetic defect carrier in their two generation pedigree (parent or grandparent) without an intervening tested free animal have been tested for said genetic defect. d. Refund of the animal s purchase price or replacement with an animal of equivalent value will be considered satisfactory settlement in the case of incorrect parentage or genetic defect information provided at the time of sale. e. In no event will Seller be liable for any special, incidental, indirect, consequential (including without limitation; lost profits, lost value of progeny, embryos and/or semen, interruption of business), or punitive damages, even if Seller has been advised of the possibility of such loss or damage. f. The Buyer will notify the Seller in writing immediately upon suspicion or verification that parentage or supplied genetic defect information is in error. g. In cases of a returned animal: all expenses related to returning the animal to the Seller will be incurred by the Buyer, and the animal being returned must meet health requirements of the Seller s state. OWNERSHIP, POSSESSION AND SELLER S RIGHTS TO FUTURE USE THROUGH FROZEN GENETICS a. It is common practice for sellers to retain an ownership interest in animals so that they may later use: bull(s) through artificial insemination, or females through embryo transfer. i. Therefore, the percentage of ownership that is being offered for sale must be clearly stated in the catalog, sale supplement sheet and/or announced from the auction block. ii. Likewise, the buyer s rights to possession of the animal(s) and ultimate salvage value of the animal being sold, as well as any semen or future embryo rights retained by the seller must also be stated. RIGHTS AND OBLIGATIONS These terms and conditions of sale constitute a contract between the Buyer and Seller of each animal. Any subsequent sale or resale of an animal constitutes a separate transaction. IDENTIFICATION Seller offers each animal with readable tattoos corresponding to its registration. e. If a female sold as open proves to be with calf, the Buyer may return the animal to the farm/ranch of the Seller prior to calving for a refund of the full purchase price or for replacement with another animal of equal value, whichever is acceptable to the Buyer. It shall be the obligation of the Seller to bear any expense incurred for transportation. 40

EXPECTED PROGENY DIFFERENCE (EPD), is the prediction of how future progeny of each animal are expected to perform relative to the progeny of other animals listed in the database. EPDs are expressed in units of measure for the trait, plus or minus. Interim EPDs may appear on young animals when their performance has yet to be incorporated into the American Angus Association National Cattle Evaluation (NCE) procedures. This EPD will be preceded by an I, and may or may not include the animal s own performance record for a particular trait, depending on its availability, appropriate contemporary grouping, or data edits needed for NCE. ACCURACY (ACC), is the reliability that can be placed on the EPD. An accuracy of close to 1.0 indicates higher reliability. Accuracy is impacted by the number of progeny and ancestral records included in the analysis. HERDBUILDER (HB), is a tool developed to aid producers selecting bulls to develop profitable replacement females and maximize the value of non-replacement marketed progeny. Significant influence is placed on the maternal traits of Stayability, Heifer Pregnancy and Calving Ease. Additionally, with all remaining progeny sold on a quality-based carcass grid, Marbling, YG and growth EPDs also impact the HerdBuilder Index. GRIDMASTER (GM), the Gridmaster Index is used for the primary goal of maximizing profitability of feeders in the feedyard and on the rail. Marbling, YG and growth EPDs are of primary importance in the GridMaster Index. CALVING EASE DIRECT (CED), is expressed as a difference in percentage of unassisted births, with a higher value indicating greater calving ease in firstcalf heifers. It predicts the average difference in ease with which a sire s calves will be born when he is bred to first-calf heifers. BIRTH WEIGHT EPD (), expressed in pounds, is a predictor of a sire s ability to transmit birth weight to his progeny compared to that of other sires. WEANING WEIGHT EPD (WW), expressed in pounds, is a predictor of a sire s ability to transmit weaning growth to his progeny compared to that of other sires. YEARLING WEIGHT EPD (YW), expressed in pounds, is a predictor of a sire s ability to transmit yearling growth to his progeny compared to that of other sires. MATERNAL MILK EPD (MILK), is a predictor of a sire s genetic merit for milk and mothering ability as expressed in his daughters compared to daughters of other sires. In other words, it is that part of a calf s weaning weight attributed to milk and mothering ability. MAINTENANCE ENERGY (ME), predicts differences in daughters mainte- nance energy requirements and is expressed in Mcal/Month. HEIFER PREGNANCY (HPG), predicts the probability of heifers conceiving to calve at two years of age. CALVING EASE MATERNAL (CEM), is expressed as a difference in percentage of unassisted births with a higher value indicating greater calving ease in first-calf daughters. It predicts the average ease with which a sire s daughters will calve as first-calf heifers when compared to daughters of other sires. RED ANGUS STAYABILITY (STAY) EPD is a selection tool to improve overall cowherd efficiency through reducing replacement rate. Cows that stay productive, are problem free and last longer mean a larger percentage of heifers can be cash cropped, instead of developed as replacements. STAY predicts the probability of a bull s daughters remaining productive until at least six years of age. CARCASS The genetic evaluation produces a single set of EPDs for carcass weight, marbling score, Ribeye area and fat thickness. The units of measure are in carcass trait format and analyzed on an age-constant basis. MARBLING EPD (MARB), expressed as a fraction of the difference in USDA marbling score of a sire s progeny compared to progeny of other sires. YIELD GRADE (YG), predicts differences in USDA Yield Grade score and is expressed in USDA Yield Grade units. CARCASS WEIGHT EPD (CW), expressed in pounds is a predictor of the differences in hot carcass weight of a sire s progeny compared to progeny of other sires. RIBEYE AREA EPD (RE), expressed in square inches, is a predictor of the difference in ribeye area of a sire s progeny compared to progeny of other sires. 12TH RIB FAT THICKNESS (FAT), predicts differences for carcass fat depth over the 12th rib, as expressed in inches.
