5 Terms of Sponsorship Agreement Payment Terms: 1/3rd upon signing of agreement. Balance, to be paid in 2 monthly payments and to be paid in full by May 10, Initial Payment: Check Number: Check Amount: Payment shall be made upon submission of an invoice with the exception of initial payment. The client agrees to pay any and all costs that San Diego Force Baseball suffer as a result of failure of payment including but not limited to reasonable attorney s or related types of fees incurred in collection. All charges are due and payable according to the payment schedule set forth above under payment terms. All past due accounts shall accrue interest at the rate of 1.5% per month (18% per annum) or at the highest rate permitted by law. Failure to bill or collect any interest on any past due payments shall not operate as a waiver of the rights to collect such interest in the future. San Diego Force Baseball shall have the right to designate the location of spaces on the fence and in the program, and may relocate such space from time to time at its sole discretion. Due to the nature of advertising, media, signage, sponsorships and promotional events, recognizing that such services require advanced expenditures and the reservation of space for the entirety of the baseball season. This contract is non-cancellable with respect to such services. It is understood that no agreement or promise has been made in reference to this contract that is not stated hereon or attached hereto. There is no verbal understanding of any kind that can in any way affect the terms of this contract. In consideration of the acceptance of this advertising order, recognizing advanced expenditures, and because of the necessity of reserving space of the entirety of the baseball season, it is hereby agreed that no part of this contract can be countermanded or canceled.
