1 B i rc h w o o d Co m m u n i ty Co u n c i l Sprucecrest Drive Chugiak, Alaska A Resolution Affirming the Need for a Separate Chugiak-Eagle River Land Use Regulation Chapter within Title 21 of the Anchorage Municipal Code WHEREAS the Updated Chugiak-Eagle River Comprehensive Plan states its intention to be the guiding document for land use as well as present and future development via zoning and platting decisions within our area; and WHEREAS the current draft for review of Title 21 of the Municipal Code, referring to Land Use (Title B, ), cites its pre-eminence to all provisions contained in Comprehensive Plans, stating that if any provision is more restrictive or less restrictive than any provision in the Plan then the provision of the Title shall govern; and WHEREAS the Chugiak-Eagle River community envisions itself as unique in both land use patterns and growth development within the Municipality of Anchorage; and WHEREAS it is our intent to maintain and assert the validity of our Updated Comprehensive Plan as the guiding document for our area; therefore be it RESOLVED, That Birchwood Community Council endorses the Updated Chugiak - Eagle River Comprehensive Plan as the guiding document for Land Use and Development in our area, and that this Document be used to create a separate Chapter in Title 21 that will govern Land Use and development within the Chugiak- Eagle River community of the Municipality of Anchorage. CALL TO ORDER The Eagle River/Chugiak Parks & Recreation (ERCP&R) Board of Supervisors convened on Monday, October 10, 2005 at 7:10 pm at Business Blvd. 2 nd Floor Conference Room, Eagle River, Alaska. Chair Brian Fay called the meeting to order. II. ROLL CALL Board members present: Mr. Brian Fay, Chair, Eagle River Community Council Ms. Lexi Hill, Birchwood Community Council Mr. Andrew Brewer, Southfork Community Council Mr. Ray Burger, Chugiak Community Council Ms. Janet Brand, Eagle River Valley Community Council Staff present: John Rodda, Manager Linda Vizenor, Administrative Officer Reid McDonald, Manager, HJMC III. MINUTES The minutes were approved as presented. VI. NEW BUSINESS A. Title 21 Andrew presented that the area wide committee is supporting a separate chapter within Title 21 for Chugiak/Eagle River - BCC & SFC have both passed that resolution also. A motion to support writing a separate chapter within Title 21 dealing with open spaces, density, zoning & platting & other differences within Chugiak/Eagle River passes with 1 opposing & 1 abstention. 4 EAGLE RIVER VALLEY COMMUNITY COUNCIL Post Office Box Eagle River, Alaska RESOLUTION Be it known that on October 12 th, 2005 the Eagle River Valley Community Council adopted the following: WHEREAS the Municipality of Anchorage is currently updating and rewriting the land use regulations commonly known as Title 21. WHEREAS the regulations, once rewritten, will apply equally to the areas of Eagle River/Chugiak. WHEREAS the communities of Eagle River/Chugiak envisions itself as unique to Anchorage and values unique characteristics separate and different from the MOA. WHEREAS by this resolution this council proposes the adoption of a separate and specific chapter in the Title 21 documents. This separate chapter is intended to summarize land use regulations that will protect and promote the unique characteristics so valued by this community. WHEREAS be it known that it is the intention of this council to support similar actions throughout the Eagle River area community to secure separate chapter placement in Title 21. 6 ERCC understands that the process to create a separate chapter can take a considerable amount of time. That being the case, we request that the new Title 21 include a placeholder for a separate Chugiak-Eagle River chapter within Title 21 of the Anchorage Municipal Code. Baldwin'; 'Bill & Dixie Waddell'; 'Hammond, Cathy A.'; Subject: Chugiak Community Council Request for Separate Chugiak-Eagle River Chapter in Title 21 (Land Use Regulations) At the November 17, 2005 Chugiak Community Council (Council) meeting, the Council had a thorough discussion regarding the way-forward for the update of AMC Title 21 (Land Use Regulations). A motion was made and seconded to coordinate with the other Chugiak-Eagle River community councils (Birchwood, Eagle River, Eagle River Valley, Eklutna Valley, and South Fork) to add a separate Chugiak-Eagle River chapter to Title 21. Until this new chapter is approved, the new Title 21 language shall state that the Chugiak-Eagle River chapter is Reserved and to be drafted following further discussions. Motion was approved unanimously. The Council recognizes that, until such time that the new chapter would be approved, a transition plan would have to be implemented to identify the old or new Title 21 regulations that would apply to Chugiak-Eagle River.
