2 1. General Infrmatin 1.1 Frewrd This dcument was prepared t fulfil the requirements f the NSW Prtectin f the Envirnment Legislatin Amendment Act 2011 (POELA Act) in terms f preparatin and implementatin f a pllutin incident respnse management plan. This plan frms a part f the verall Bral Emergency Respnse Plan that was reviewed and amended t ensure that they cver all the new requirements f the POELA Act. The plan is kept, tested and implemented in accrdance with the Act and the POEO (G) Regulatin. 1.2 Backgrund and legislative requirements The POELA Act intrduces several changes t imprve the way pllutin incidents are reprted, managed and cmmunicated t the general cmmunity. The Act includes a new requirement under Part 5.7A f the Prtectin f the Envirnment Operatins Act 1997 (POEO Act) t prepare, keep, test and implement a pllutin incident respnse management plan. The bjectives f these plans are t: ensure cmprehensive and timely cmmunicatin abut a pllutin incident t staff at the premises, the Envirnment Prtectin Authrity (EPA), ther relevant authrities specified in the Act (such as lcal cuncils, NSW Ministry f Health, WrkCver NSW, and NSW emergency services) 1 and peple utside the facility wh may be affected by the impacts f the pllutin incident minimise and cntrl the risk f a pllutin incident at the facility by requiring identificatin f risks and the develpment f planned actins t minimise and manage thse risks ensure that the plan is prperly implemented by trained staff, identifying persns respnsible fr implementing it, and ensuring that the plan is regularly tested fr accuracy, currency and suitability. The specific requirements fr pllutin incident respnse management plans are set ut in Part 5.7A f the POEO Act and the Prtectin f the Envirnment Operatins (General) Regulatin 2009 (POEO(G) Regulatin) 1. Definitin f a pllutin incident As per the POEO Act, pllutin incident means an incident r set f circumstances during r as a cnsequence f which there is r is likely t be a leak, spill r ther escape r depsit f a substance, as a result f which pllutin has ccurred, is ccurring r is likely t ccur. It includes an incident r set f circumstances in which a substance has been placed r dispsed f n premises, but it des nt include an incident r set f circumstances invlving nly the emissin f any nise. A pllutin incident is required t be ntified if there is a risk f material harm t the envirnment, which is defined in sectin 147 f the POEO Act as: 1 See Bral Cement Cffs Harbur Page 1 f 12
3 (a) harm t the envirnment is material if: (i) (ii) it invlves actual r ptential harm t the health r safety f human beings r t ecsystems that is nt trivial, r it results in actual r ptential lss r prperty damage f an amunt, r amunts in aggregate, exceeding $10,000 (r such ther amunt as is prescribed by the regulatins), and (b) lss includes the reasnable csts and expenses that wuld be incurred in taking all reasnable and practicable measures t prevent, mitigate r make gd harm t the envirnment. Industry is nw required t reprt pllutin incidents immediately t the EPA, NSW Health, NSW emergency services, WrkCver NSW and the lcal cuncil. Immediately has its rdinary dictinary meaning f prmptly and withut delay. These strengthened prvisins will ensure that pllutin incidents are reprted directly t the relevant respnse agencies s they will have direct access t the infrmatin they need t manage and deal with the incident in a faster time. There are new assciated ffences, fr individuals and crpratins, fr nt preparing a plan, nt keeping the plan at the premises t which it relates, nt testing the plan in accrdance with the Regulatins and nt implementing the plan in the case f an incident. 2. Risk Assessment and Preventive Actins 2.1 Ptential Site Risks Ptential envirnmental pllutants are summarised in a site risk register entitled Envirnment Aspects and Impacts (CMT-ENV-002-Frm1 Cffs Harbur_Envirnmental Aspects and Impacts Register) (see appendix C). This dcument cnsiders; Aspect, Impact, Cntrls and Imprvements fr the sites knwn envirnmental hazards in the fllwing areas: Fugitive dust emissins frm plant areas Spills f liquids (e.g. diesel, il) r pwdered slid materials (e.g. cement), ptentially leaving the site. Large spill f pwdered slids may result in significant dust nuisance r lead t depsitin f significant quantities f high ph particulate matter in the natural water curses. Fire and smke. Only small quantities f prcess chemicals and lubricating ils are stred in a shed in the Cffs Harbur Dept. The maximum vlume stred des nt exceed 1,000 L. 2.2 Harm Reductin Spill Preventin (liquids and slids): The risk f harm t any persns wh are n the premises r wh are present where the scheduled activity is being carried ut is reduced by measures utlined in Bral Cement Crprate SOP CEM-ENV-014 Spill Preventin and Cntrl. These measures include: Placement f spill-risk facilities away frm sensitive envirnments (sufficient t allw fr effective interventin prir t pllutin ccurring in the event f a spill) Bral Cement Cffs Harbur Page 2 f 12
4 Use f secndary spill cntainment facilities such as bunding arund all strage tanks and ther areas where hazardus substances are stred; Ensuring that areas where risky activities such as strage tank/sil lading are undertaken are bunded and sealed; Aviding risky activities at times when weather events may magnify the harm caused by a spill; Ensuring drainage structures can be sealed t halt passage f spilt fluids r pwdered slids; Training f emplyees and cntractrs in gd envirnmental practice. The bunded areas must be capable f preventing the migratin f any spillage r leakage t the surrunding envirnment. The requirement fr bunding is relative t the level f risk and type f area. Bunding specificatins are summarised in Australian Standard AS 1940:2004. Maintenance: All sils, tanks and pipe-wrk are inspected regularly and at least annually fr signs f damage. Any defect in the walls r lining is repaired immediately using apprpriate techniques. Damage t the tank r transfer hses is dealt with immediately t prevent failure. Any spilt liquid r pwdered slid material must be prmptly cleaned up in an apprpriate manner usually as cntaminated matter. D nt allw spilt liquid r strmwater t remain in the bund it may accumulate and lead t verflwing. Rainwater entering the sump r bunded area shuld be regarded as ptentially cntaminated and must be dispsed f in an authrised manner. 2.3 Safety Equipment The site utilises a prtable il spill kit lcated in the Office. This kit is capable f cntaining hydrcarbn spills up t 40L in vlume. The bag s cntents include: 10 x Plyprpylene il absrbent pads 1 x Spill Shark petrleum-based absrbent 1 x waterless hand cleaner (Tmahawk) 1 x Quick Cure (steel-filled repair cmpund) 1 x brush and pan 1 Pair nitrile glves (slvent resistant) 1 Pair f safety glasses Instructin fr use and a bag with ties fr dispsal. Heavy grate cvers are available t prtect the strmwater grates in case f a cementitius material spill. Fire prtectin system n site is addressed in the Emergency Respnse Plan. The types f fire extinguishers used n site are apprpriate fr their applicatin. 2.4 Site Maps The detailed map belw shws the lcatin f the premises the licence refers t, the surrunding area that is likely t be affected by a pllutin incident, the lcatin f ptential pllutants n the premises and the lcatin f any strmwater drains n the premises. Early Ntificatins 3.1 Immediate Ntificatin f Gvernment Authrities Any pllutin incident that causes r threatens material harm t the envirnment r peple must be ntified t gvernment authrities immediately upn becming aware f the incident. When new infrmatin cmes t hand fllwing the initial ntificatin, this infrmatin must als be cmmunicated immediately. Fr the definitin f material harm caused by a pllutin incident refer t Sectin 1.2. Immediately means withut unreasnable delay. Remember, safety first. Only nminated Bral persnnel are authrised t make ntificatins t the Authrities: Brian Sper NSW Dept Manager Ed Richardsn HSE Advisr Belinda Prideaux Envirnment Manager: Bral Cement All ntificatins are t be in line with standard peratin prcedure CMT-ENV-001 Cffs Harbur Pllutin Incident Ntificatin, lcated in WizBiz Reference Library (Site Prcedures - Depts - NSW). The cntact list f Cmpulsry Authrities is presented in Appendix A. Other Authrities may need t be ntified as apprpriate; hwever the Cmpulsry Authrities must be ntified in ALL cases requiring envirnmental ntificatin. All immediate ntificatins and updates are t be recrded in the Pllutin Incident Immediate Ntificatin Lg (CMT-ENV-001 Cffs Harbur Pllutin Incident Ntificatin SOP). In brderline situatins, where the exceedance f the trigger level f material harm f a pllutin incident may nt be clear, a quick assessment including cnsultatin with Bral envirnmental persnnel shuld be undertaken t help the decisin whether t ntify r nt. Bral s Senir Crprate Management must be infrmed prmptly f the fact f immediate ntificatin t the Authrities. This includes envirnmental persnnel listed abve, Garry Murphy, Jim Yung, Katie Faulkner and Richard Strauch. 3.2 Ntificatin f Neighburs In case f pllutin incidents that may ptentially pse threat t the health and safety f the neighburs (e.g. txic fumes, fire, fuel spill int the street r t castal verge, release f a thick dust clud, etc.), the neighburs must als be urgently ntified. The early warning f the neighburhd ntificatin will be undertaken by Geff Walter by phne. The current cntact list fr neighburs is attached in Appendix B. The initial ntificatin shuld be brief and cntain nly a descriptin f the envirnmental threat tgether with instructins what t d. Fr example: - Due t a dust baghuse failure, we are experiencing elevated dust emissins frm the site. Please keep yur drs and windws clsed until further ntice. - Due t a diesel spillage nt a street frm the site, a cleanup peratin is being rganised. Please be watchful fr rad clsures in relatin t this peratin. A fllw up infrmatin n the reslutin f emergency situatin wuld be timely cnducted als n the phne. 7 4. Pllutin Incident Emergency Respnse In the event f a pllutin incident the risk f harm t human health will be minimised by engaging an apprpriate pllutin respnse as utlined belw 1. Stp the surce: If it s safe t d s, stp the prcess causing the spill/leak r ther envirnmental incident. 2. Islate the area: The first persn t ntice the spill r leak shuld remve themselves frm the immediate area and take measures such as barricading the area t reduce the risk f expsure t thers. This must ccur withut expsure t danger. 3. Cmmence early ntificatin: The Manager r Supervisr must be ntified immediately f the envirnmental incident. They in turn must immediately infrm ne f the persns nminated fr ntificatin f Authrities (see Appendix A). If the envirnmental incident is significant, the nminated persn implements early ntificatin prcedures t the relevant Authrities including emergency services. Alerting the ptentially affected neighburs may als be required (see Appendix B), with regular updates prvided as needed. 4. Prvide a 1 st aid respnse (if required): First aid kit including a trauma pack and instructin fr use is lcated in the lunch rm. Emergency shwer is available in the blending shed, near the dr. Eye wash is lcated in the lunch rm. Apprpriate PPE is wrn by all staff during perids f ptential expsure as utlined in relevant SDS. 5. Identify the release t the greatest extent pssible: D s withut being at risk. This includes identifying: a. The type f material released, e.g. i. Class 2 Gases - cmpressed, liquefied r disslved under pressure. ii. Class 3 Flammable Liquids iii. Slid material spill. b. The label and Safety Data Sheet fr the prduct shuld give infrmatin n safe cleanup. c. The size f the release and whether the release has stpped; d. Whether chemicals invlved may be ptentially incmpatible; and e. Any unusual features such as faming, dur, smke, etc. 6. Determine the level f emergency: review chemical risk assessments, seek internal advice frm area specialists, review SDS s and seek prfessinal advice frm the fire brigade and/r hazardus material specialists. 7. Determine if evacuatin is required and cnsider the impact that wind, rain, lcal gegraphical features such as hills and strmwater drainage systems may have in expsing persns at emergency assembly pints. If in dubt cmmence evacuatin t cld znes Fllwing a Pllutin / Hazardus Material Incident the Emergency Site is t be divided int Ht, Warm and Cld Znes - fr management purpses. The Site Manager (r Weighbridge Operatr if nt present) is respnsible fr the management f the COLD ZONE, all persnnel are t be evacuated frm the ht/warm zne. Ht Zne This is the area f likely cntaminatin. Only persnnel wearing the apprpriate level f prtective clthing and equipment are t enter this zne. The area f the Ht Zne is defined, cntrlled and c-rdinated by the Hazmat Cntrller (FIRE BRIGADE). Bral Cement Cffs Harbur Page 6 f 12
8 Warm Zne This is the area immediately surrunding the Ht Zne where decntaminatin takes place and persnnel and equipment are prepared fr deplyment. Only persnnel wearing the apprpriate level f prtective clthing and equipment are t enter this zne. The area f the Warm Zne is defined, cntrlled and c-rdinated by the Hazmat Cntrller (FIRE BRIGADE). Cld Zne This is the area immediately surrunding the warm zne. It is the supprt area where access is limited t supprt agencies persnnel and equipment. This zne cntains the Site Cntrl, triage and treatment facilities and ther marshalling and assembly areas. The Cld Zne is free f cntaminatin and persnnel prtective clthing is nt required. The area f the cld zne is defined by the site cntrller in cnsultatin with the Hazmat Cntrller and managed by the Site Manager (r Weighbridge Operatr if nt present). 8. Stp further release (if nt dne prir): prevent further release by islating the surce f the release. (Trained persnnel nly with suitable PPE) 9. Stp the release frm spreading (if safe t d s): a. Prevent ff-site release f cntaminated strmwater: Prtect strmwater grates with bms, cvers r drain scks. b. Liquid spills: Deply spill kits t prevent further cntaminatin dispersal, using apprpriate absrbent/cntainment materials such as lse absrbent, scks r pads (land) and bms (water). See als CEM-ENV-014 Spill Preventin and Cntrl. c. Pwdered slid spills: Lwer dwn the sil rlling drs t minimise dust, cver strmwater grates t prevent ingress f slids. d. Releases f pllutants int the air: Shut dwn ventilatin systems t keep gases, vapurs and dust frm spreading. 10. Large spills: Summn specialist spill emergency respnse cntractrs (e.g. Transpacific Industrial Slutins, 1800 SPILLS). 11. Fire: If pssible, endeavur t prevent fire-fighting water frm entering the strmwater drains as it typically carries cntaminatin. If pssible, divert fire frm areas cntaining materials that may generate txic fumes when burned (e.g. stres f chemicals, cleaning aids, mtr il, etc). 12. Dispse f cntaminated spill clean materials and wastes using a licensed cntractr. 13. If required, remediate the site. Bral Cement Cffs Harbur Page 7 f 12
