(like Captain Steve's Tee's and Hoodies!) * Most of all your desire to have a great time, catch lots of nice fish, admire the beautiful scenery and eat lots of wonderful food!...note: Don't forget you don't need to bring ice chests or fish boxes to get your fish home. Boots, rain gear, rods, reels and tackle are all included in your package. You can bring rods and reels but please check with us about the poundage or diameter of the fishing line so they all match and we don't get any tangles while fishing. Remember the less you bring the cheaper it will be to get your fish back home. Most clients after their first trip with us bring a carry on only. With the information you provide we will be able to have your fishing license ready when you arrive at the lodge, know in advance of any dietary needs you may need, know if you would like your fish shipped back to your home, and importantly, know which airport and when to pick you up and drop you off. 6 Other Participant Agreement: Release of Liability and Assumption of Risk Please read all pages of this document carefully. Please sign, mail, FAX or back to Captain Steve's Fishing Lodge This agreement is between Captain Steve's Fishing Lodge, it's Agents, Owners, Operators, Employees and all other persons or entities associated with it ( collectively ) referred to below as ''Captain Steve's Fishing Lodge" and Name of Participant Phone Number reservation is under. The parties agree to the following: Introduction: Welcome to Captain Steve s Fishing Lodge. We operate a World Class Fishing Lodge and do everything possible to ensure you enjoy your stay with us. There are a few risks involved in your stay with us that may not be obvious and which we feel every guest should be aware of. Many of the risks cannot be eliminated without jeopardizing the overall quality of your visit. Since an accident could result in property damage, physical or emotional injury or death to your or others, it is important to us that you are aware of these risks. Trip Activities & Risks: As part of your trip with Captain Steve s Fishing Lodge you could be traveling by Passenger Van to and from the lodge. You will load and unload yourself into the boats via a step ladder. You will walk on what are sometimes wet and slippery walkways. You may be fishing in rough water: and come within close proximity to wild animals. You may also chose to walk around the grounds of the lodge. Please be aware there may be wild animals around the lodge (i.e. bears, moose, wolves, coyotes and other animals) These activities and those not specifically stated entail risks including, but not limited to: slipping and falling: drowning, exhaustion: hypothermia: prolonged exposure to cold water: boating and/or navigation hazards: cold, heat, sun, rain, fog and wind: increased risk of heart attack or heat stroke: guide misjudgment: negative reaction from air or waterborne bacteria or virus. In the event of an accident, there could be a prolonged delay in obtaining medical assistance, due to the sometimes remote areas in which Captain Steve s Fishing Lodge guides operate and the location of the Lodge. Evacuation will take place as quickly as possible, but could take several hours. We could also experience communication failures and breakdowns or faulty equipment. Please understand that the description of activities and rich is not intended to be a complete list of all possible activities and risks, and we ask you to acknowledge that the trip may include other risks that could result in property loss or damage, physical or emotional injury or even death. 7 Free Time Activities: Your Trip may allow for free time activities in which you are unaccompanied by a guide to other person acting on behalf of Captain Steve s Fishing Lodge. You acknowledge that free time activities are at your sole risk and Captain Steve s Fishing Lodge is not responsible for injury or loss arising from or in any way related to participation in free time activities. Acknowledgement: You are aware that the activities and risks listed above and otherwise mentioned in the agreement in include risk of property loss or damage, physical or emotional injury, or death to you and/or others. We and You understand that your participation in the trip and all included activities is purely voluntary. Independent Contractors: Captain Steve s Fishing Lodge sometimes employs independent contractors for services, including transportation. Captain Steve s Fishing Lodge does not retain control over these entities and will not be liable for any acts, negligence or willful or failure to act of any such person, entity or third party. Dangerous Weather Conditions: Please be aware and advised that schedules can change without notice due to dangerous weather conditions. Should weather occur, Captain Steve s Fishing Lodge reserves the right to change the scheduled fishing excursion without notice. Scheduled saltwater trips can be substituted with freshwater trips and vise versa. Your safety is our highest priority, and we will do everything in our control to protect the safety of our clients. Though it may not be obvious to clients at the time a decision is made, please know we do this for your own safety. Lingcod Special Trips: Lingcod special trips are subject to weather conditions. Please be advised that this trip can be canceled at any time. Weather conditions are checked in the morning before departure. If weather is not conducive to a safe fishing experience Captain Steve s Fishing Lodge has the right to change the Lingcod Special trip to Halibut and/or Salmon fishing. There is an additional $75.00 fee per person per day for the Lingcod Special trip. If it is determined that it is unsafe to do the Lingcod Special Trip, no additional fees will be charged. Limits: Currently the halibut limit is two fish per day of which only one can be over 29 inches and five total per year, if you have already been out prior with a Guide you will let the Captain (Guide) know how many halibut you have currently retained. It is the ultimate responsibility of the fishing license holder (client) to not break any laws knowingly or otherwise. If you are a state or federal employee you will obey all laws and if you see a law being broken deliberately or unknowingly you will bring it to the attention of the captain (Guide) immediately. Cancelations & Refunds: A 50% deposit (of the total cost), non-refundable deposit, is required at the time of booking your trip with Captain Steve s Fishing Lodge. Balances are due April 1st of the year of your vacation. No credit card to check payments will be excepted within 30 days of your vacation. Only cash will be accepted. **if you make final payment upon arrival. No refunds due to late arrivals, early departures, misscheduling or airline delays. Please check into travel. No refunds will be given on additional payments or balances paid after January 1st of the year of your vacation. Cancellations must be sent (in writing) to Captain Steve s Fishing Lodge, P.O. Box 39143, Ninilchik, Alaska or trophies@captainstevesfishinglodge.com. No telephone cancelations will be accepted. In some instances you may also be able to apply your deposit to future trips. Terms & Conditions: We reserve the right to withdraw any trip, at any time and make changes, substitutions and/or alterations, due to unsafe, unfishable waters, mechanical problems or scheduling issues (light loads). Mediation, Choice of Law, Venue: Any dispute between Captain Steve s Fishing Lodge and me, my heirs, succors, parents or guardians concerning, relating or referring to thus agreement, the trip or any information and/or literature concerning the trip shall be resolved exclusively in the state of Alaska, city of Anchorage. Such proceedings shall be governed by substantive Alaska Law. If I have a legal dispute which cannot be settled through discussions between parties, I will attempt to settle the dispute first through mediation before a mutually acceptable mediator in the state of Alaska. Disclosure of Information and Assumption of Risk: I have read all information applicable to my Captain Steve s Fishing Lodge Trip that I am to participate in and have properly filled out all required forms and information. I agree to assume and inherit risk of any loss or injury that arises from or related to events occurring during my visit to the Lodge. I further acknowledge that by signing this agreement, I am releasing Captain Steve s Fishing Lodge from liability for the acts or omissions which may occur in the future to extent provided herein. This release shall be binding upon the undersigned and their assignees, saboragtes, distributes, heirs, next of kin, executors, personal representatives, and administrators of the signatures.
