1 INDIAN RIVER COLONY CLUB PROCEDURE Date: August 22, 2013 Approved SUBJECT: GOLF COURSE & CART RULES & REGULATIONS 1.0 PURPOSE 1.1 In order to provide for the enjoyment of all golfers on the IRCC golf course and to define those privileges and responsibilities essential to the smooth operation of the golf facilities, the following procedure is established in addition to the provisions contained in IRCC Procedure Insurance Required for Golf Carts. Golf is a sport in which etiquette and common sense are of paramount importance. Enforcement of this simple procedure is essential to provide for the enjoyment of all members and their guests on the course. All golfers are responsible for proper and courteous performance everywhere on the course and the various practice facilities. Consideration of others is perhaps the most important rule of golf. Complaints, comments and suggestions from club members are always welcome. They should be submitted in writing to either the Golf Advisory Committee or the Director of Golf and Recreation for resolution. The Director of Golf and Recreation shall forward the correspondence to the General Manager for action, if appropriate. 2.0 ORGANIZATION 2.1 Golf Advisory Committee: This committee is a General Manager s initiative to provide a forum for the many organized golfing groups to assist the GM with his supervision of the Director of Golf and Golf Course Superintendent operations, in addition to, coordination of all golfing activites, improvements, policies, and rules. Membership of the GAC is at the discretion of the GM but normally will include of representatives from: Men s Golf Association, Ladies Golf Association, Women s Golf Association, Couples, Blue/Gold, White, and Black tee groups, 200 Club, Handicap Chairman, Director of Golf and Golf Course Superintendent. 2.2 Group Play: Group play (shotgun start) is an important part of golf at IRCC because it: Maximizes the number of members who may play the course Allows all group players to finish at the same time. Thus, facilitating members getting together following a round for informal social affairs or meetings in the 19 th Hole, At Ease Club or Colony Hall Generally does not use all tees available Allows golfers from one to four players the opportunity to play during a shotgun start by calling the Pro Shop. It is not necessary for golfers to join groups; i.e. Mens, Ladies Golf Associations in order to play.

2 2.3 Fee Structure: Golf is available to any IRCC member without any condition other than paying the established IRCC fees. The fee structure is approved by the Board of Directors of IRCC and may change from time to time. The fee options are either (1) annual fees paid monthly or (2) daily fees There are fees for golf (greens fee) and for golf carts (trail fee) whether privately owned or IRCC provided. If annual fee status is cancelled, the annual status can be re-established only by either (1) paying fees for the missed months or (2) waiting out a period of one year prior to reinstating the membership. The General Manager may suspend members fees no less than three months for medical conditions upon presentation of medical documentation of the impairment from a physician Type of Payment: Resident and non-resident members may charge their purchases at IRCC or pay cash. This includes the Pro Shop. Guests of members are generally paid for by the member; however, in cases where the guest or outside groups is expected to pay, Visa or Mastercard, cash or check will be accepted. 3.0 GOLF CART RULES 3.1 The following rules apply to all carts operating on the IRCC golf course, privately owned and IRCC-owned, except as provided in the Section 3.2 of this procedure entitled Golf Carts Displaying Medical Flag or Sticker Daily rental fees for IRCC golf carts will be determined by the IRCC Board of Directors All golf cart operators including rental golf carts must be at least 16 years of age and have a valid driver s license/permit Operation of an IRCC golf cart or a private golf cart is at the member s risk The member shall reimburse the Club for any and all damages the club may sustain by reason of operation, including without limitation, damage to other golf' carts and any property of the Club resulting from misuse by a member or his guest. IRCC is not responsible for any personal injury to a member or guest occasioned by the operation of an IRCC golf cart IRCC owned rental carts may be used for golf play without charge by annual trail fee paying members if their cart is being used in another golfing event or is temporarily out of service for repairs. The cart must be returned to the cart barn parking area daily upon completion of play. It cannot be stored at home or used for purposes other than golf play Private golf carts must be properly insured. One needs to be careful in selecting appropriate coverage to include not only use on the golf course but also use on the streets within IRCC. (Refer to Procedure: Insurance Required for Golf Carts) Registration forms are available at the Administration Office. Proof of insurance is required. The golf carts must be equipped with the necessary and proper safety equipment. (At minimum, working parking brake and reverse gear warning horn.)

3 3.1.6 Members may loan their golf carts to the Pro Shop for approved tournaments. In those cases, IRCC will assume liability for damages to loaned carts pursuant to Section 2.5 (Responsibility for Non-IRCC Property) of the IRCC Bylaws. For certain tournaments, a golf shop credit may be credited to the member s account A golf annual trail fee is defined as a cart fee paid by a golfer in order to be permitted to drive a golf cart on the golf course while playing golf. A trail fee is not a fee paid to drive on the cart paths. (See Section 15.9) An annual trail fee, on a single or family basis, for privately owned golf carts shall be established by the Board of Directors. The trail fee will be due annually, and will be billed monthly. The trail fee shall not be prorated except as approved by the Board of Directors on a case-by-case basis. An annual trail fee decal will be issued, as appropriate This will be an IRCC decal affixed to the lower left inside corner of the windscreen, DIRECTLY ABOVE the IRCC registration decal or if a windscreen is not available, the front section of the cart where easily visible. It will be reissued annually in a different color and shape.(attachment1) Houseguests, day guests and members who do not pay annual trail fees shall pay the individual daily cart fee when they ride in a member s private cart while playing golf When a member owned golf cart is no longer used in the trail fee program, the annual trail fee decal shall be removed from the cart Carts should be driven on the cart paths or in the rough where possible. Carts are permitted to drive on all fairways The Golf Course Superintendent, Director of Golf and /or General Manager have the authority to decide when the course is fit to play and to decide on the use of golf carts. When the course is closed or restricted, it can only be opened by one of the above persons. All carts must stay off fairways and/or use the 90 degree rule in wet weather when so directed Golf carts are not to be driven within 30 feet of greens nor through areas marked No Carts and mulch areas Carts should abide by the cart path stop signs when crossing streets Carts are prohibited from driving on the grass on the residential side of the cart path All carts must carry sand to fill divots Only battery powered golf carts may be used on the golf course and streets of IRCC. 3.2 Golf Carts Displaying Medical Flag or Sticker: Medical flags or stickers will be:

4 Issued to members who have a state issued automobile handicap tag Issued to members who have medical waivers from a physician Renewed on an annual basis or for a shorter term as prescribed by the physician Carts displaying a medical flag or sticker may be driven to within 10 feet of greens but NOT through areas marked No Carts and mulch areas Carts displaying a medical flag or sticker must remain on cart paths when play on the course is limited to cart paths only. 4.0 PLAY ON THE COURSE 4.1 All golfers must check in at the Pro Shop either individually or through their group leaders, prior to teeing off. 4.2 Rules of the USGA shall prevail except where modified by local rules and published on offical score cards and in this published regulation. 4.3 In the event of a dispute over the rules, the Director of Golf s decision shall be final. 4.4 All players shall start on the tee assigned to them. Players will not cut in without Pro Shop approval. 4.5 No group of golfers exceeding four players shall be permitted on the golf course without permission from the Pro Shop. 4.5 Singles and twosomes, when permitted to play, shall have no special standing on the course to pass other players. 4.6 Each player shall have a set of clubs. 4.7 Keep up with the group ahead. It is the responsibility of slower players to wave the following players through when there is an open hole ahead. 4.8 Players looking for lost balls must signal to the group behind them to play through after five minutes and, having given such a signal, shall not resume play until these players are out of range. 4.9 Players behind a group looking for a lost ball should be patient and fair, allowing a reasonable time (5 minutes) for recovery of the ball All members of a group should help look for a lost ball Environmental concerns prohibit the use of rakes or rake-type ball retrievers in ponds Avoid replaying putts and lingering on the greens. Recording scores should be done at the next tee.

5 4.13 The Thor Guard Lightning Warning System is installed to monitor the atmosphere within a 12 mile radius of IRCC and to sound a warning of lightning activity within a radius of 2.5 miles. This warning system is for the protection of members and their guests and must be observed. When the alarm is sounded (ONE PROLONGED BLAST) golfers must vacate the course and seek shelter. The course, driving range and golf practice greens will remain closed until the all-clear signal is sounded (A SERIES OF THREE SHORT BLASTS). For current status, there is an amber strobe light on the north peak of Colony Hall that flashes while the storm warning is in effect and all outdoor recreation facilities are shut down. 5.0 IRCC LOCAL RULES 5.1 USGA and local rules will apply. 5.2 Imbedded ball rule applies through the green, no penalty. 5.3 Play the ball as it lies unless otherwise directed. 5.4 Red stakes and lines are to be played as lateral hazards and Yellow stakes and lines are to be played as water hazards. Orange flags indicate presence of water or lateral hazards. Out of bounds are marked by White stakes. Red pin flags indicates hole is positioned in front 1/3 of the green. White flag in center 1/3 and Blue flag in back 1/3 of the green. Vertical striped yardage posts are installed at 100 (red and white), 150 (green and white), and 200 (blue and white) yardages straight line distances to center of greens. 5.5 All St. Augustine grass including all residential yards and included mulch areas are to be played as if they are ground under repair areas with play in those areas governed by USGA Rule 25. Relief is mandatory. 5.6 On the golf course, mulch or pine straw areas the ball will be played as it lies unless the course superintendent designates these areas as temporary ground under repair when fresh pine straw has been installed. If these areas are specified as ground under repair and a player s ball or stance lies in or touches any freshly laid mulch or pine straw, then relief without penalty is permitted. 5.7 If all members of the group are virtually certain that the ball was not hit out of bounds, yet cannot be found, in ground under repair the player shall play another ball from the point where the original ball last crossed the margins of the ground under repair/st. Augustine area and do so without penalty (other than some loss of distance). 5.8 If the ball is found out of bounds, stroke and distance penalty is in effect and the ball must be played from a point as near as possible to the point of the original shot. 5.9 If a ball is hit into one of these ground under repair areas is found, it will be taken to the nearest point of relief, no closer to the hole and dropped within one club length without penalty If a players ball flies into and stays lodged within a tree whose roots are contained in the area played as ground under repair, is located and identified, the ball is to be dropped within one club length of the point of nearest relief without penalty.

6 5.11 If a player is virtually certain that his/her ball flies into a tree that is in ground under repair and is not located or identified, a replacement ball is dropped without penalty within one club length of nearest point of relief from point of entry. In the absence of such knowledge or certainty, the player MUST proceed under Rule 27-1 lost ball If a players ball flies into and stays lodged within a tree that is not in ground under repair and the ball is not located and identified the player MUST proceed under Rule 27 lost ball. If the player can indeed identify his/her ball lodged into the tree the player may proceed under Rule 28 of the USGA rules, ball unplayable Procedure for taking relief: When facing cart path or ground under repair, drop ball within one club length of the nearest point of relief When back is to cart path or ground under repair, player takes stance (club head is now nearest point of relief) and drops ball within one club of that point Those areas marked Drop Area may be used if desired on holes # 5, 8, 13, 14, & When a drop is required, execute the drop in accordance with USGA rules Hole #1. A ball resting in the ditch to the right side of the fairway is in a lateral hazard. A ball coming to rest on the opposite side of the ditch is out of bounds. Stroke and distance apply Holes #2, 3, 4, 5, 6, 7, 8, 10, 11, 12, 13, 16, 17, and 18. A ball coming to rest in the area beyond a lateral hazard (side of the water hazard away from the fairway of the hole being played) is out of bounds. The water s edge is the out of bounds line. Stroke and distance apply Hole #5. If any shot enters the Yellow marked water hazard you may proceed to play from the drop area provided or exercise Rule 26-1 of the USGA rule book. (Drop behind the water hazard, on the extension of the line from the hole through the point where the ball last crossed the margin of the hazard or as near as possible to where the original ball was played or play the ball from the hazard without grounding the club) If your ball enters the Red marked Lateral Water Hazard you cannot use the drop area and must exercise Rule (In addition to above options, drop within two clublengths from the point where the ball last crossed the margin of the lateral hazard, no closer to the hole) Hole #8. Drop area is artificial turf left side of cart path. Ball may be placed. St. Augustine grass along far western edge of pond left of green is ground under repair Hole #9. A ball resting in the ditch left of the green is in a lateral hazard. A ball coming to rest beyond the ditch is out of bounds. Stoke and distance penalty apply Hole #11. St. Augustine grass right of cart path is ground under repair. Pond right of cart path is a lateral water hazard. Out of bounds line is water s edge on opposite side Hole #12. Ball left of fence is out of bounds and stroke and distance penalties apply.

7 Area left of cart path from tee to short of 150 yard marker is St. Augustine grass. Drop right of the cart path, no closer to the hole. Mulch in same area next to fence play ball as it lies. The coquina surfaced area beyond the hole is designated a waste bunker. Play ball where it lies without penalty, club may be grounded Hole #13. If any shot enters the Yellow marked water hazard you may proceed to play from the drop area provided or exercise Rule If your ball enters the Red marked Lateral Water Hazard you cannot use the drop area and must exercise Rule Hole #14. If a ball enters the water hazard beyond the 200 yard marker, the first drop area may be used. A second drop area (front of 100 yard marker) may be used if ball enters water directly in front of the green Hole #15. If ball enters the Yellow marked water hazard through the fairway, you may proceed to play from the drop area provided or exercise Rule If your ball enters the Red marked Lateral Water Hazard you cannot use the drop area and must exercise Rule Hole #16. The area left of the concrete wall that remains right (fairway side) of the white out of bounds poles is designated ground under repair. Drop right of the cart path without penalty. The caution yellow line on top of the curb is not a hazard marker and should be ignored for play Hole #18. The coquina left of cart path is waste area, play the ball as it lies and you may ground club. If any part of the concrete or palm tree support braces interfere with stance or swing, you may take free relief but remain in waste area. A ball in the Bermuda left of cart path, play the ball as it lies. Ball in pond, play two club lengths in Bermuda from point of entry. Mulch area left of cart path short of Bermuda is in play. 6.0 HANDICAPS: IRCC s USGA Course and Slope Ratings are listed in Attachment An essential element of a handicap system is the requirement that the club records member s scores and publishes handicap indexes. The Handicap Committee ensures the integrity of the handicaps issued by making certain all members comply with the rules for the handicap system. 6.2 The scores of five 18 hole rounds of golf played at IRCC will be considered sufficient to establish a handicap for a member to participate in Club-sponsored golf events. The handicap scores for guests will be determined by utilizing their handicap indexes. 6.3 All players are expected to turn in a score after completing all rounds at IRCC and elsewhere. Failure to do so may result in the Handicap Committee assigning a score for the round for the player in violation. Men s and ladies scores will be entered into the computer by the Golf Pro Shop. Handicaps will be updated and posted twice a month. 6.4 Equitable stoke control sets a maximum number strokes a player can post on any holes depending on the players course handicap EIGHTEEN HOLES Course Handicap Maximum Number Posted on any Hole

8 9 or less Double Bogey or more NINE HOLES Course Handicap Maximum Number Posted on any Hole 4 or less Double Bogey or more Competition Between Players Playing Same or Different Tees Players competing using the same tees will use their respective handicaps However, when competition involves players using different tees, i.e., a player playing the white tees and a player playing the black tees, the handicap of the player(s) playing the shorter course shall be adjusted down by the number of strokes equal to the difference between the course ratings with.5 or greater rounded upward as stated in Section 3, par. 3.5 of the USGA Handbook System Manual This policy shall apply to all regular, special and tournament play. 7.0 IRCC SCRAMBLE RULES 7.1 On all shots, players will lift, clean and place the ball in the area designated in the following paragraphs. The order of play is optional. 7.2 If the ball that is selected is in the fairway, it will be marked with a tee or similar object, and all players shall play from within one club length, no nearer the hole, from the fairway. 7.3 If the ball that is selected is in the rough, it will be marked with a tee or similar object, and all players shall play from within one club length, no nearer the hole, without gaining relief from the rough. 7.4 If the ball that is selected for play is on the fringe of the green, players shall play from within 6 inches, staying on the fringe no closer to the hole. 7.5 If the ball that is selected for play is in a sand bunker, players shall play from within 6 inches, remaining in the bunker, no closer to the hole. After each shot, the sand may be raked and the next ball placed. 7.6 If the ball that is selected for play is on or within water hazard lines, all players shall play from within one club length, placing the ball no nearer the hole, without gaining relief from the hazard.

9 8.0 TIE-BREAKING PROCEDURES FOR COMPETITIONS USING SCORECARD 8.1 Medal Play: Individual and Team Play: Handicap Stroke Play: Use score on last 9 holes minus ½ handicap If still tied: Use last 6 holes minus 1/3 handicap Use last 3 holes minus 1/6 handicap Use last hole minus 1/18 handicap If still tied repeat using front nine. Note: Fractions below.5 are disregarded,.5 and above add one stroke Scratch Competition do not deduct handicaps. 8.2 Match Play: Individual and Team Play: Match cards starting on the hole the match started First to win a hole wins the match. Handicap strokes apply same as during match. 8.3 IRCC Holiday or Special Tournaments: Tournament will be flighted accordingly by players handicap indexes. Any scores tied for places will be paid not broken. 9.0 TIE-BREAKING PROCEDURES FOR CLUB CHAMPIONSHIPS 9.1 The following rules apply unless otherwise noted prior to a tournament start Individual Stroke Play Championship: Men and Women: Hole playoff or if not feasible: hole, 6 hole, or 3 hole playoff selected by committee President s Cup: Committee Decision Hole playoff using 1/2 of handicap Hole playoff using 1/3 of handicap Hole playoff using 1/6 of handicap. 11 11.2. All players must have an assigned tee time for the day of play or an assigned tee for shotgun starts. To obtain one, call Tee times are taken on a first-come firstserved basis. Ladies sign up in ladies locker room for group activities Tee times should be cancelled by 3:00 p.m. the day prior to the scheduled tee time Requests for tee times will be honored as closely as possible to requests. Those with an assigned tee time shall report to the Pro Shop at least fifteen minutes prior to the scheduled time. Singles and twosomes will be paired with other players when possible. Those not ready at their assigned tee times shall be delayed to a time determined by Pro Shop personnel Golf members may reserve tee times seven days in advance. Non-members may reserve tee times two days in advance PRACTICE 12.1 All Residents and Golf Members are permitted unlimited practice balls from the Pro Shop Practicing on the golf course, other than on the aqua range, putting green and/or chipping green, shall be allowed only when approved by the Pro Shop and when it does not interfere with tournaments or other regular play. Practicing golfers shall yield to group play Removal of range balls from the practice areas is strictly forbidden. THEY SHALL NOT BE USED FOR PLAY ON THE COURSE. They shall not be retained in golf carts Children under the age of thirteen shall not be allowed on the practice tee or the practice greens unless accompanied by an adult. Appropriate golf attire required Carts are not permitted on the practice driving range ATTIRE 13.1 Proper golf attire is required at all times on the golf course, as well as the driving range and putting greens Men shall wear shirts with sleeves and collars or mock turtlenecks, slacks or Bermudastyle shorts Women may wear round, v-neck or collared shirts with or without sleeves, and slacks, skirts or shorts. Low neck t-shirts, tank tops, halters, or short shorts are not permitted No golfer may wear blue jeans or shoes with steel spikes ETIQUETTE:

12 14.1 No player shall strike a ball until the preceding group has cleared the landing-area FILL DIVOTS WITH SAND AND REPAIR BALL MARKS ON GREENS Enter and leave bunkers at the nearest level spot to the ball. Rake sand upon leaving a bunker. Leave rakes inside of bunkers Players on the correct fairway have the right-of-way over those playing on an adjoining hole Members shall, as is reasonable, pick up all rubbish on the course and place it in an appropriate container. Members are encouraged to remove all broken tees from teeing surfaces Sportsmanship, courtesy and good manners are an essential part of etiquette. Quiet on the course should be maintained. Consideration of other players will make the game enjoyable for all MISCELLANEOUS 15.1 Golf cart storage may be provided for an additional fee to a non-resident annual golf fee paying member. (Attachment 2) 15.2 Report broken windows to the Pro Shop; golfers are not responsible for repairs Report all accidents to the Director of Golf who will make a written report to the General Manager Walking groups are permitted with permission from Pro Shop. Walking groups shall allow cart groups to pass through at all times Employee golfing privileges are specified in the IRCC Employee Handbook Requests for free golf passes to be used for charitable purposes shall be referred to the IRCC General Manager through the Director of Golf for approval/disapproval A fee-paying golfer who fails to complete play because of inclement weather, shall be entitled to credit for fees charged for the round based on the following formula: 4 or less holes completed 18 hole raincheck 5-12 holes 9 hole raincheck 13 plus holes No raincheck 15.8 Domestic pets shall not be permitted on the golf course or to ride in players carts during playing hours, normally 7:30 A.M. until dark. Pets may ride in carts when traveling with owners using the cart path as a normal route to activities Golf course cart paths are joint use path ways with priority given to golfing players. These paths are an amenity paid for by all residents to use to reach the At Ease Club and adjacent activities. In addition, travel on foot, bicycle, or cart on paths other than

13 direct club house routes is permitted for the enjoyment of the green space, lakes, wildlife, and physical exercise. Tours for prospective buyers along the golf course are a major marketing tool frequently conducted by agents and residents. Travel on the cart path is an important part of IRCC's life style as long as it is used safely by all. All users should give way to golfers before proceeding and all golfers should be on the alert for traffic as they play ADMINISTRATION 16.1 Violations of these policies and other rules established by the Board of Directors, General Manager or the Director of Golf regarding golf play may result in the suspension or revocation of private cart privileges and/or playing privileges as determined by the Board of Directors pursuant to Section 3.7 (Enforcement of Rules) of the IRCC Bylaws. 14 Attachment 1 Golf Course Trail Fee Agreement Golf Course Trail Fee Agreement THIS AGREEMENT, made on, between Indian River Colony Club, Inc. (IRCC) and, Owner. Background: The owner desires to own, maintain and use his or her own battery powered private golf cart on the IRCC Golf Course. IRCC will agree to permit such use subject to the terms and conditions provided for in the agreement. In consideration of the mutual covenants and promises of the parties, it is agreed as follows: 1. IRCC will permit the undersigned owner to use his or her own battery powered private golf cart at IRCC. 2. IRCC will permit the undersigned owner to use his or her own private golf cart on the IRCC Golf Course for a period beginning October 1 st and ending on September 30 th, the following year at the annual fee established by IRCC. This period will be extended automatically each year unless member or IRCC indicates otherwise. 3. All golf carts operating on IRCC property must be insured and registered by IRCC. A registration decal will be issued and will be affixed to the lower left inside corner of the windscreen, or if a windscreen is not available, on the front section of the cart where easily visible. It will be reissued from time to time as determined by the General Manager. 4. An annual trail fee decal will be issued. This decal will be affixed to the lower left inside corner of the windscreen DIRECTLY ABOVE the IRCC registration decal, or if a windscreen is not available, on the front section of the cart where easily visible. It will be reissued annually in a different color. 5. Rules applicable to the use of privately owned golf carts at IRCC and on the golf course are as follows: a. The golf cart may only be operated by the member s household or houseguest within the IRCC community. b. Only the owner and members of the owner s family (those who reside permanently with the member) may drive the privately owned golf cart covered by this agreement, for golfing purposes at IRCC. The owner shall not lease, rent, nor loan his golf cart to any other person for golfing purposes to avoid the payment of daily cart fees. Members may loan golf carts to the Pro Shop for tournament purposes. The Tournament Chairman is not personally responsible for the use of these loaned carts. IRCC assumes liability for any damage resulting from use of these loaned carts.

15 c. All golfing shall begin at Hole No. 1 or as directed by the Recreation Manager or starter. The owner and family members shall not begin a round of golf at any other hole. Golfers beginning a round of golf after the Pro Shop is closed will report to the Pro Shop the following day to pay all appropriate charges, i.e., cart, green fees, guest fees. d. Golf carts shall not be used by more persons than available seats on the cart nor for more than two golf bags at any time. e. No person under 16 may drive a golf cart on club property without a valid driver s liscense/permit. f. Domestic pets will not be allowed on the golf course during play, including as golf cart passengers. g. In accordance with the current procedure the golf cart must be equipped with necessary and proper safety equipment. (At minimum, working parking brake and reverse gear warning horn.) 6. Remedies: Violation of any of the foregoing rules shall be grounds for suspension of the use of a privately owned golf cart on the IRCC Golf Course and/or within the IRCC community. 7. IRCC will store and charge privately owned or leased golf carts for non-resident members only when an appropriate contract with IRCC is made and storage space is available. 8. Owner agrees to obtain, at his expense, a policy or policies of minimum liability insurance equal to automobile coverage required by law for injuries or death of person or persons. Policy or policies will be standard auto liability policies (if carts are a coverable item) or recreational vehicle policies with a golf cart endorsement. All premiums are to be paid by the owner. This minimum liability insurance is to be kept current during the term of the Agreement. Reference Procedure Insurance Required for Golf Carts. 9. Discontinuance of trail fees, to include medical reasons, must be requested through the Administration Office who will remove the trail fee decal and make billing adjustments. A listing of members paying trail fees will be maintained in the Administration Office and at the Pro Shop. 10. This Agreement may not be assigned to any other person. Sale or transfer of the golf cart will terminate this Agreement. The owner agrees to pay the annual trail fee (billed monthly) as determined by the Board of Directors. 17 Attachment 2 Golf Cart Storage Agreement Golf Cart Storage Agreement The Indian River Colony Club (IRCC) will provide storage for one golf cart, described below, owned or leased by the below signed member, who is a non-resident member of IRCC and is paying annual fees for Trail and Golf. This arrangement is subject to all IRCC rules and those rules set forth in the IRCC Golf Course Trail Fee Agreement. In consideration of the mutual comments and promises of the parties, it is agreed as follows: 1. IRCC will permit the undersigned owner to park/store his/her privately owned or leased golf cart in the IRCC Cart Facility for a period of one year, beginning. This period will be extended automatically each year unless the Member or IRCC indicates otherwise. This agreement will end upon termination of owner s membership or with 30 days written notice by either party. 2. An annual cart charge of $ will be paid by the member in $35.00 plus tax monthly increments included in the monthly billing. 3. IRCC retains the right to use member s cart as part of the IRCC fleet at times when member is absent from the area or has no scheduled tee time. Such use will be limited to those times when all IRCC carts have been assigned to play. IRCC retains all rental fees and will notify member when his/her cart is used by the Pro Shop. 4. This agreement may not be assigned to any other person. 5. Access to carts or cart storage facility is limited to regular business hours (7:30 a.m. to 3:30 p.m.). Carts returned after 5:00 p.m. will have to be left outside until next morning when the facility opens at 7:30 a.m. Pro Shop and Recreation employees are not responsible for carts and any personal property left on carts at any time. 6. Members using IRCC cart storage facility agree that IRCC and its employees are not liable for any damage or theft, including personal items left in cart. Members agree by signing this contract that they will absorb all costs for repairs from any damage to carts or personal property while cart is stored in IRCC cart facility. 7. Disclaimer: The member is responsible for all maintenance and repairs of their personal or leased golf cart. IRCC shall not have any responsibility or obligation to maintain or repair the golf cart of a member, while in storage. In addition the member is responsible for maintaining insurance on his/her golf cart at all times, including those times when the golf cart is being used as part of the IRCC fleet. IRCC s sole responsibility or obligation with regard to the member s golf cart is to maintain liability insurance covering use of the cart when the member/owner s golf cart is being used as part of the IRCC fleet.
