3 GENERAL INFORMATION & SALE NOTES LOCATION: The sale will be held at RUGBY FARMERS MARKET LTD THE CHAROLAIS PAVILION, AVENUE M, STONELEIGH PARK, KENILWORTH, WARWICKSHIRE CV8 2RG TEL: FAX: STEVE MARTIN: METHOD OF SALE: All sheep will be sold in guineas and in catalogue order unless any alteration is authorized and announced by the Auctioneers. CONDITIONS OF SALE: The sale is held subject to the LAA Conditions of Sale in addition to the Auctioneers General Conditions of Sale. UPSET PRICE: All sheep will be sold subject to an upset price of 200gns. SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due to the Auctioneers immediately at the close of the sale. No animals will be permitted to leave the premises without an official pass obtainable upon settlement. DELIVERY OF SHEEP SATURDAY 8 TH DECEMBER am 9.00am PRE-SALE INSPECTION: All sheep forward for the sale will be subject to a Society inspection. Any animal which does not reach the Inspection standard will not be eligible for show or sale. The inspection decision will be final and any animal failed will be removed from the sale and forfeit the entry fee. SOCIETY LEVY: The Society Levy of 1% will be deducted from Vendors and paid to the Society following the Sale. TRANSFER FEE: A Transfer fee of 5 per sheep is payable by the purchaser.

5 IMPORTANT NOTICE TO PROSPECTIVE PURCHASERS SETTLEMENT & CLEARANCE OF STOCK Please note that all lots must be settled on the day of purchase Completion of a buyers slip is essential for parties who have not dealt with the company before New customers and agents wishing to purchase on behalf of another party must contact the companies main office 48 hours prior to a sale *No Lots can leave the market without a pass slip being issued by the main office * Purchasers from Outside the United Kingdom Invoices will be raised in pounds sterling. We request that payment is made to us in pounds sterling by cheque/bankers draft on the day of sale. NO CARD PAYMENTS

6 WARRANTY FEMALE SHEEP NOT DESCRIBED AS IN LAMB Vendor s warranty The vendor warrants that a female sheep not described in the catalogue or at the time of sale as in lamb at the time of sale is not in lamb at the time of the sale. This warranty is a 14 week + 5 day warranty. Purchaser s rights If the purchaser proves a breach of warranty, then at the purchaser s option, either the purchaser may exercise his rights under the auctioneers conditions or the vendor shall pay the purchaser as liquidated damages, a sum equal to the amount paid for the sheep. Notice of a claim must be supported by a veterinary surgeon s certificate or a slaughter-house manager s or other competent person s certificate confirming the sheep was in lamb. FEMALES SHEEP DESCRIBED AS CORRECT Vendor s warranty The vendor warrants that all female sheep described in the catalogue or at the time of the sale as correct are sound in the mouth and udder, that they are not lacking any of the 8 broad teeth and do not have any damaged or worn teeth or a defective udder. This warranty is a 5-day warranty. Purchaser s rights If the purchaser proves a breach of warranty, then at the purchaser s option, either the purchaser may exercise his rights under the auctioneers conditions or the vendor shall pay to the purchasers as liquidation damages a sum equal to the amount paid for the sheep. Notice of a claim must be supported by a veterinary surgeon s certificate. All disputes are between vendor and purchaser STOCK RAMS Vendor s warranty The vendor warrants that any ram sold as a stock ram is capable of or effective at natural service. This is a 10-week warranty. Purchaser s rights If the purchaser proves a breach of warranty then the purchaser may return the ram to the vendor who shall, at the purchaser s option, either replace the ram with another ram of equal value, which is capable of and effective at natural service, or refund the purchase price. The purchaser shall have no rights to claim damages from the vendor, in respect of indirect or consequential loss such as (but not limited to) loss of profit or any other loss whatsoever. Notice of a claim must be supported by a veterinary surgeon s certificate confirming that a) The ram s incapacity or ineffectiveness is not the result of injury, accident or illness happening after the time of sale; and b) The purchaser s breeding stock are not responsible for the ram s incapacity or ineffectiveness.
