This is a must attend event for all Angus breeders and supporters. As always there is something for everyone. The heifer calves may be next year s 4H project, a fancy show prospect or excellent future brood cows for starting a new herd or expanding and improving your existing herd. The bred division has depth with many early services to some of the breed s leading sires. Brad is the son of a long time Angus supporter and enthusiast Doug Mewhinney. Brad was in a dirt bike accident in October and is now paralyzed from the waist down. The family needs help to adjust their home to Brad s new needs and this is one small way we as Doug s friends in the Angus family can help. Individual donations of $50 to $100 will be accepted. After the donation round - the donation holders will then collectively sell the heifer with the proceeds going to the Mewhinney family. The Mewhinney family will then receive 100% of the donations and sale proceeds. Please contact any Central Director to make your donation ahead of time. 2

18 Angus Futurity Terms TERMS - The terms of the sale are cash or cheque payable at par at the sale location unless satisfactory credit arrangements have been made previous to the sale. ALL CHEQUES SHALL BE MADE PAYABLE TO ONTARIO ANGUS ASSOCIATION (OAA). Due to problems in the past, no sale will be considered valid until and unless payment made out to OAA is received and cleared. The right of property shall not pass until after settlement is made. The OAA reserves the right to require a certified cheque at settlement before releasing any cattle. Should any purchaser fail to settle for his purchase, OAA reserves full power to resell the animal to the best advantage either publicly or privately, without further notice. Any loss arising from such resale together with keep and all other expenses shall be payable by the defaulter. ALL SETTLEMENTS MUST BE MADE WITH THE CLERKS OF THE SALE BEFORE ANY CATTLE WILL BE RELEASED. BID - Every animal consigned to the sale will be sold by auction to the highest bidder. DISPUTES - In case of disputes, bidding will be reopened between the parties involved. If no further bid is made, the buyer will be the person from whom the auctioneer accepted the last bid. The auctioneer s decision in such matters will be final. The auctioneer shall have the right to refuse bids from anyone who has a previous record of default in payment or who has not made proper credit clearance prior to the sale. PURCHASER S RISK - Each animal becomes the risk of the purchaser as soon as sold. Animals will be cared for at the purchaser s risk for a reasonable length of time. ANNOUNCEMENTS - Announcements from the auction block will take precedence over the printed matter in this catalogue. Buyers are therefore cautioned to pay attention to such announcements. CERTIFICATE OF REGISTRY: the proper Registration or Recordation paper, as the case may be, will be duly transferred and furnished to the buyer for each animal after settlement has been made. BREEDER S GUARANTEE BULLS - Should any bull fourteen (14) months of age or over, fail to prove a breeder after being used on cows known to be breeders, the matter shall be reported in writing to the seller within six (6) months following date of purchase or six (6) months after the bull has reached fourteen (14) months of age. The seller will have the right and privilege of six (6) months to prove the bull a breeder. No guarantee is given that semen collected from the bull will be suitable for artificial insemination. FEMALES - Cows represented as being pregnancy tested, safe in calf have been examined and declared by a veterinarian s certificate to this effect. They are considered breeders without further guaranteed. Cows with calves at side shall be considered breeders also without further guarantee; cows and heifer s represented as bred are not guaranteed safe in calf but they and open heifers selling as individual lots are guaranteed to be breeders. No guarantee shall apply to suckling calves. In the event a female is claimed to be a breeder and after having been bred regularly to a bull known to be a breeder and after having been treated by a licensed veterinarian, the matter must be reported in writing to the seller within six (6) months of sale day. For heifers under twelve (12) months of age and purchased as single lots who fail to conceive to the services of a bull known to be a breeder, the matter must be reported in writing to the seller before the heifer reaches (8) months of age. The seller shall have six (6) additional months in which to prove any such female a breeder and may use any registered bull of the breed available to him. Any female returned will be at the purchasers risk. No guarantee is given that a pregnant female will deliver live calves nor that she will carry calves full term nor that the calf carried will not be mummified. The seller is not responsible for damage caused by foreign bodies after the animal has been sold nor for sickness not apparent at sale time. EXCEPTION TO GUARANTEE: Transportation charges on animal returned to the seller are for account of the purchases. No incidental expenses such as feed, AI signing fees, interest, veterinary charges etc., will be charged by either party when making settlement. If the seller is successful in proving the animal a breeder, the said animal will be reclaimed by the purchaser at his expense. Should the seller fail to so prove the animal a breeder, then the buyer is guaranteed a satisfactory replacement, F. O. B. ranch or location of origin or a refund of the actual purchase price paid F. O. B. selling point. In no event shall the seller be responsible for more than the purchase price. Should a dispute arise over the quality of the replacement animal, the Sales Management will appoint a mediator. HEALTH - All animals will have passed the required tests as determined by Agriculture Canada at sale location. It is the buyer s responsibility to determine health requirements for importing any animal into his province, state or country. ACCIDENTS - Although every precaution will be taken to protect the safety and comfort of buyers, neither the Owners, Sales Management or Staff assume any responsibility in this matter and disclaims any liability legal or otherwise in the event of accident or loss of property.
