All UK Pedigree Holstein ORDER & METHOD OF SALE: ALL Cattle will be sold in Pounds ( ) and strictly in Catalogue order unless any alteration is authorised by the Auctioneers. COMMISSION BIDS: Commission Bids are welcome and will be treated in the strictest confidence of the Auctioneers. Telephone bidding can be arranged provided prior notice is given. SETTLEMENT & CLEARANCE OF STOCK: Settlement in Full is due to the Auctioneers immediately at the conclusion of the Sale. No animal may be removed from the Sale Premises without an official CREDIT and DEBIT CARD FACILITIES are available at this Sale. Please note there is a 2% charge on ALL Credit Cards. PEDIGREE CERTIFICATES: All relevant Certificates will be handed out on Sale Day or forwarded on to Purchasers after the Sale RICS CLIENT MONEY PROTECTION SCHEME: All financial transactions within this market are conducted with the Auctioneers acting as Principal. Sale proceeds are not paid into a client bank account and, consequently, the RICS Client Money Protection Scheme (CMPS) will not apply to protect the Vendor AGENCY BIDDING: Customers are reminded that if they are bidding as Agents they must produce to the Auctioneers before the Auction Sale a written authority from the person or persons on whose behalf they are bidding. If they do not, the Auctioneers are entitled to treat them as bidding on their own account and will invoice them personally for any purchase made. 6 SALE ORDER - MILKING CATTLE The process for cataloguing and producing Sale order changed in MARCH It is still in letters. The order for the next Two years is detailed below. However the Catalogue and Sale Order has now been split into four groups and will be sold in the following order: * UNREGISTERED MILKING AND DRY COWS * PEDIGREE/REGISTERED MILKING AND DRY COWS * UNREGISTERED MILKING HEIFERS * PEDIGREE/REGISTERED MILKING HEIFERS The Alphabetical Selling Order will be applied to all Four Groups * IN-CALF and SERVED HEIFERS Late Entries: If a Vendor who has entered in a Sale and wishes to bring extra animals, he may do so and have them sold and stalled with those lots already entered, providing notification is made to our Pedigree office by 9.30 am on the day prior to Sale. A Vendor, who has NOT already entered into the catalogue, may still make a consignment to the Sale, but these will be sold FIRST if they are Cows and LAST if they are Milking Heifers. DOUBLE TAGGING The regulations with regard to Cattle identification clearly state that all Cattle entering the market born after the 1 st January 1998 MUST HAVE 2 EAR TAGS. Cattle without two tags born after that date CANNOT BE SOLD and will be licenced back home by Trading Standards, and will trigger the 6 day rule. Anyone handling stock should wash their hands after handling stock * Disinfection points will be provided around the market which must be used regularly, particularly when leaving cattle penning areas. * You need only C & D your stock trailer or lorry in the market if you are taking stock out again. If you do not clean out you will have to complete a C & D exit form indicating when and where you will C & D before carrying livestock again. All rules will have to be rigidly enforced or a licence will be at risk of cancellation NOTE: Please note that the entrance for all stock will be at the entrance nearest The Wild Boar. No entry for any vehicles or people will be permitted at the Main Entrance by the railway bridge. ANIMAL TRANSPORT REGULATIONS From 5 th January 2007 New Regulations came into force affecting anyone who transports live animals. Anyone moving animals more than 65 kilometres (40 miles) will require a LICENCE. For the majority of farmers who are likely to fall in this category, they will ne suspended and a copy of this will be required to be carried whenever stock are moved. The distance of 65km is defined as the travelling distance, not as the crow flies. 26 BREEDING GUARANTEE All cows and heifers that are stated in the catalogue of Sale to have been served not less than ten weeks before the date of Sale, or to have been running with a bull between dates (the latter of which is not less than ten weeks before the Sale) will be guaranteed by the vendor to be in-calf either to the date or one of the dates of service if more than one is stated, or to a service between stated running dates and to the bull stated in the catalogue of sale unless any alteration is announced by the auctioneers at the time of the Sale. Should any animal prove not to be in-calf, any claim under this guarantee must be made to the auctioneers in writing within 7 weeks of the date of sale. Should any animal which is declared to be in-calf prove not to be in-calf to the date or one of the dates of service or to some date within the running period or periods or to the bull stated as above any claim must similarly be made immediately any evidence in support of such a claim is available and in any case not later than 28 days after the date on which the animal was due to calve according to the date or dates in the catalogue of sale. UDDER WARRANTY Unless otherwise stated or announced, any cow in-milk or any heifer in-milk at the time of the sale shall carry a guarantee that she is sound in udder and teats at the time of sale, but no claim under such guarantee can be entertained unless made to the auctioneers within an hour of the close of the last lot except is extended to two hours after the close of the last lot. If the auctioneers are satisfied that the udder is not sound in all respects, the sale of the animal must be cancelled. adequate facilities for udders to be inspected and for adequate milking facilities to be available for the purchaser in accordance with the warranty. 26

30 SALE OF GOODS BY AUCTION GENERAL CONDITIONS 1. Lots 1.1 The Buyer is deemed to have inspected any lot he buys and accordingly the lots are not sold by sample The Buyer admits that he has not been included to bid by any description representation measurement or statement made by or on behalf of the Seller and agrees that (apart from the agreed price and any matter confirmed in writing by the Auctioneers) these Conditions constitute the whole of the contract The Auctioneers act only as agents for the Sellers and will not be liable to the Buyer in any circumstances and have no authority to make any such descriptions representations measurements or statements. 1.3 No warranty is given or implied as to fitness for purpose or the quality of lots sold. 2. Sales 2.1 The highest bidder for any lot shall be the Buyer and the contract shall be concluded on the fall of the hammer. 2.2 The Buyer may not retract his bid in any circumstances. 2.3 On the fall of the hammer the Buyer will immediately give to the Auctioneers his full name and address and if required will pay the full purchase price. 3. Title to and Removal of Lots 5.1 All lots purchased shall be removed on the date of sale at the Buyer s expense. 5.2 The Buyer will be responsible for any damage caused in the course of such removal to other lots or to any part of the premises on any part of which the auction is held regardless whether such damage is caused by the Buyer, his employees or agents or otherwise and whether such damage is a result of negligence or otherwise. Notwithstanding Condition 3.3 and the removal by the Buyer of any Lot, title to such Lot shall not pass to the Buyer until: The Buyer shall have paid the Purchase price in full and No other sums whatever shall be due from the Buyer to the seller or the Auctioneer. 5.3 In respect of any such damage if so required by the Auctioneers the Buyer will pay the cost of repairing all such damage (as estimated by the Auctioneers whose estimate shall be final and binding) before removal of any lots. Until such payment is made the Buyer grants the Seller and/or the Auctioneers a lien over any lots bought by him. 6. Conduct of the Auction 6.1 The Seller may offer any lots subject to a reserve price. 6.2 The Seller or the Auctioneers may: Bid up to such reserve price Withdraw from sale any lot without disclosing a reserve Rescind any sale within 3 hours of the final lot being sold if the lot has been sold under any reserve. In the event of such rescission the purchase price or any part already paid by the Buyer shall be repaid but the parties and the Auctioneers shall be under no further liability to each other. 6.3 The Auctioneers may refuse the bid of any person without giving a reason and may regulate bidding as they see fit. 6.4 No bidder may advance less at a bid than the sum named from time to time by the Auctioneers. 7. Neither the Seller nor the Auctioneers shall be liable in any way for any loss or damage on any part of the premises on any part of which the auction is held. 8. In the event of breach by the Buyer of any of these conditions the Auctioneers may rescind any contract with the Buyer and put up and re-sell any lots the subject matter of such contract and the Buyer will immediately pay to the Auctioneers as a liquidated demand any deficit arising on the second sale.
