4 After a lifetime of milking cows Andrew Speed has decided to cease milking at Ashfields Farm, Alsager Staffordshire and as a consequence is dispersing his entire commercial herd at Beeston Castle Auction on Thursday, 6 th September. It cannot be emphasized enough how good a herd of cows this is, they are strong and wide, in superb condition, have wonderful udders and good legs and feet, and they can milk too! In the sale there are 160 cows and milking heifers, plus three stock bulls which run Beef Shorthorn. They follow an all year round calving pattern with no particular bias to any period of the year, selling in an attractive state with 69 having calved since May, plus 45 due to calve before Christmas. The herd is managed very well indeed, performing very well on strict commercial management, and at this stage Andrew would like to pay tribute to the staff who have helped look after the herd for all these years, in particular Marshall Barber, Steve Fox and Jon Randles. The herd average, based on milk sales, is currently rolling at 9024 kg, 4.11% butterfat, 3.27% protein and cell counts 150. This is achieved on a simple system of grazing the herd in summer, fed self-feed silage at the clamp, plus mixed maize and silage in ring feeders, along with molasses via tanks in winter and concentrates strictly according to yield. The herds ability to convert fodder into large volumes of milk is perhaps its most appealing feature. There is no doubt that this is a tremendous herd of cows that is not only robust and durable but also stylish and very productive. All those in search of quality cows that milk and are genuine need look no further than this super herd of dairy cattle. SPECIAL NOTES VACCINATIONS: The herd is vaccinated for BVD, IBR and Leptospirosis. There is no evidence of there being any Johnes Disease in the herd. TB: The herd is on a 6 month testing cycle and passed its required pre-movement test on 30 th July

63 BREEDING GUARANTEE All cows and heifers that are stated in the catalogue of Sale to have been served not less than ten weeks before the date of Sale, or to have been running with a bull between dates (the latter of which is not less than ten weeks before the Sale) will be guaranteed the vendor to be in-calf either to the date or one of the dates of service if more than one is stated, or to a service between stated running dates and to the bull stated in the catalogue of sale unless any alteration is announced the auctioneers at the time of the Sale. Should any animal prove not to be in-calf, any claim under this guarantee must be made to the auctioneers in writing within 7 weeks of the date of sale. Should any animal which is declared to be in-calf prove not to be in-calf to the date or one of the dates of service or to some date within the running period or periods or to the bull stated as above any claim must similarly be made immediately any evidence in support of such a claim is available and in any case not later than 28 days after the date on which the animal was due to calve according to the date or dates in the catalogue of sale. UDDER WARRANTY Unless otherwise stated or announced, any cow in-milk or any heifer in-milk at the time of the sale shall carry a guarantee that she is sound in udder and teats at the time of sale, but no claim under such guarantee can be entertained unless made to the auctioneers within an hour of the close of the is extended to two hours after the close of the last lot. 64 SALE OF GOODS BY AUCTION GENERAL CONDITIONS 1. Lots 1.1 The Buyer is deemed to have inspected any lot he buys and accordingly the lots are not sold sample The Buyer admits that he has not been included to bid any description representation measurement or statement made or on behalf of the Seller and agrees that (apart from the agreed price and any matter confirmed in writing the Auctioneers) these Conditions constitute the whole of the contract The Auctioneers act only as agents for the Sellers and will not be liable to the Buyer in any circumstances and have no authority to make any such descriptions representations measurements or statements. 1.3 No warranty is given or implied as to fitness for purpose or the quality of lots sold. 2. Sales 2.1 The highest bidder for any lot shall be the Buyer and the contract shall be concluded on the fall of the hammer. 2.2 The Buyer may not retract his bid in any circumstances. 2.3 On the fall of the hammer the Buyer will immediately give to the Auctioneers his full name and address and if required will pay the full purchase price. 3. Title to and Removal of Lots 5.1 All lots purchased shall be removed on the date of sale at the Buyer s expense. 5.2 The Buyer will be responsible for any age caused in the course of such removal to other lots or to any part of the premises on any part of which the auction is held regardless whether such age is caused the Buyer, his employees or agents or otherwise and whether such age is a result of negligence or otherwise. Notwithstanding Condition 3.3 and the removal the Buyer of any Lot, title to such Lot shall not pass to the Buyer until: The Buyer shall have paid the Purchase price in full and No other sums whatever shall be due from the Buyer to the seller or the Auctioneer. 5.3 In respect of any such age if so required the Auctioneers the Buyer will pay the cost of repairing all such age (as estimated the Auctioneers whose estimate shall be final and binding) before removal of any lots. Until such payment is made the Buyer grants the Seller and/or the Auctioneers a lien over any lots bought him. 6. Conduct of the Auction 6.1 The Seller may offer any lots subject to a reserve price. 6.2 The Seller or the Auctioneers may: Bid up to such reserve price Withdraw from sale any lot without disclosing a reserve Rescind any sale within 3 hours of the final lot being sold if the lot has been sold under any reserve. In the event of such rescission the purchase price or any part already paid the Buyer shall be repaid but the parties and the Auctioneers shall be under no further liability to each other. 6.3 The Auctioneers may refuse the bid of any person without giving a reason and may regulate bidding as they see fit. 6.4 No bidder may advance less at a bid than the sum named from time to time the Auctioneers. 7.
