3 PART ONE THE CODE CONSULTATION NOTE: In NSW there is a mratrium n skin nly harvesting. As part f cnsultatin OEH is seeking cmments n the reintrductin f skin nly harvesting and will cnsider all cmments befre finalising the Cde. Nature and purpse f this Cde 1. This Cde is made under sectin X f the Act. 2. The bjectives f this Cde are: a) t ensure that the cmmercial kangar harvest is eclgically sustainable and b) t ensure kangar harvesting is humane and minimises the pain and suffering f the animal. 3. Kangar ppulatins are mnitred by OEH thrugh scientifically rbust ppulatin survey methds apprved by the Chief Executive. Qutas are allcated as a percentage f ppulatin estimates that have been demnstrated t be eclgically sustainable. Infrmatin n ppulatin survey methds can be fund here: htm 4. Cmplying with this Cde is a defence t the ffences f harming and dealing in animals. 5. Failure t cmply with this Cde means that an ffence is cmmitted and may be subject t a cautin, penalty ntice r prsecutin. 6. Nthing in this Cde allws a persn t keep, trade r sell live kangars. 7. This Cde is fr use by any business r individual harvesting kangars fr cmmercial purpses, including the cmmercial use f prducts derived frm kangars. This includes kangar harvesters, whlesalers and chiller premises peratrs. 3

4 Definitins 8. The definitins in the Act apply in this Cde. 9. The fllwing definitins als apply in this Cde: Act: Bidiversity Cnservatin Act 201X. Buy: this term is defined in the Act and includes advertise r hld ut as being prepared t buy. Carcass: the entire bdy (including skin) f the kangar excluding the head and viscera. Chief Executive: the Chief Executive f OEH. Calendar quarter: the fur perids, spanning 1 January t 31 March, 1 April t 30 June, 1 July t 30 September r 1 Octber t 31 December. Chiller peratr: a cmmercial peratr wh is registered by the Chief Executive t perate a Chiller premise. Chiller premise: a refrigerated facility used fr the temprary strage f kangar carcases until cllectin and transprt t a prcessing wrks. Cde: the Cde f practice fr cmmercial kangar harvesting in NSW. Cmmercial peratr: any persn wh carries ut activities which are regulated by this Cde. Exprt: this term is defined in the Act and includes advertise r hlding ut as being prepared t exprt. Harvest: in relatin t kangar harvesting, means harm fr cmmercial purpses. Harvester: a persn wh harvests kangars fr cmmercial purpses and prcesses meat and skin. Imprt: the term is defined in the Act and includes advertise r hlding ut as being prepared t imprt. Licence: a licence issued under the Act. OEH: Office f Envirnment and Heritage. Pssess: this term is defined in the Act and includes having custdy r cntrl. Prcessing: means t remve the skin r cut up the carcass Registered premise: a premise registered by Chief Executive in NSW fr the temprary strage r prcessing f kangar carcases. Regulatin: any Regulatin made under the Act. Sell: this term is defined in the Act and includes advertise r hld ut as being prepared t sell. Tag: a tag issued by OEH fr the current calendar year fr the purpse f cmmercial kangar harvest. Whlesaler: a cmmercial peratr registered by the Chief Executive t accept carcasses frm nminated harvesters and chillers, and t trade kangar prducts t market, r t imprt r exprt frm NSW. 4

5 PART TWO REGISTRATION Registering fr cmmercial kangar harvesting 10. A cmmercial peratr must register with the Chief Executive and prvide the infrmatin utlined belw at clauses 15 and A cmmercial peratr must nt carry ut any activity regulated by this Cde unless the cmmercial peratr is registered by the Chief Executive. 12. A cmmercial peratr becmes registered nly nce they receive written cnfirmatin frm the Chief Executive with a registratin number. 13. Cmmercial peratrs must apply fr registratin either in writing r via the website: If registering in writing, cmmercial peratrs must write t the Chief Executive at the address prvided at the beginning f this dcument and prvide the infrmatin required at clause 15 and 16. If registering via the website, cmmercial peratrs must prvide the infrmatin utlined belw as instructed by the OEH website. 14. The registratin prcess prvides fr businesses and individuals t register under the cde f practice. 15. Businesses must prvide OEH with the fllwing infrmatin (as relevant t the activities they are undertaking): Fr a business: a) Name f business, and b) Nature f business (harvester, chiller, whlesaler, imprt/exprt frm NSW), and c) Australian Business Number, and d) Nminated cntact persn fr dealing with OEH, and e) Business address, and f) Address/s f all lcatins where activities will be taking place, including harvesting activities and g) Phne number, and h) address, and i) Vehicle registratin details f all vehicles that will be used t undertake harvest activities r t transprt kangar carcasses, and j) Other cmmercial peratrs yu will be dealing with in carrying ut activities in accrdance with this Cde (including whlesaler and chiller premises), prvide the nature f the business, name f the business/individual, address/s f business, cntact details (phne and/r ), and OEH registratin number, and k) GPS crdinates f any chiller sites where activities will be carried ut in accrdance with this Cde, and l) Indicate if the business wishes t imprt kangar carcasses int NSW r exprt kangar carcasses frm NSW as part f their peratins. OEH will assess this 5

6 request nting that if apprved this nly relates t NSW and apprval may als be required frm the ther state r territry. 16. Individuals, whether trading as part f a business r individually, must prvide OEH with the fllwing infrmatin (as relevant t the activities they are undertaking): Fr individuals: a) Nature f business activity (i.e. harvester, chiller, whlesaler, imprt/exprt frm NSW), and b) Name, and c) Address, and d) Address/s f where activities will be taking place, and e) Phne, and f) , and g) Vehicle registratin details f all vehicles that will be used t undertake harvest activities r t transprt kangar carcasses, and h) Other cmmercial peratrs yu will be dealing with in carrying ut activities in accrdance with this Cde (including whlesaler and chiller premises), prvide the nature f the business, name f the business/individual, address/s f business, cntact details (phne and/r ), and OEH registratin number, and i) Prvide GPS crdinates f any chiller sites where activities will be carried ut in accrdance with this Cde, and m) Authrisatins and licences: valid firearms licence, valid firearms shting accuracy accreditatin, and certificate f cmpletin f Australian Game Meat Handling and Hygiene curse thrugh TAFE NSW, and n) Indicate if the individual wishes t imprt kangar carcasses int NSW r exprt kangar carcasses frm NSW as part f their peratins. OEH will assess this request nting that if apprved this nly relates t and apprval may als be required frm the ther state r territry. NOTE: Individuals perating in accrdance with this Cde under a business registered in accrdance with clause 15, must als prvide the infrmatin required under clause Cmmercial peratrs must ntify the Chief Executive in writing r via the website if the details prvided thrugh registratin change. A cmmercial peratr may nt carry ut any activity that is regulated by this Cde if the peratr s details have changed but the Chief Executive has nt been ntified f the change. 18. Cmmercial peratrs must nly participate in the activities fr which they are registered. 19. Cmmercial peratrs must pay a registratin free at the time f registratin. Whlesaler and chiller premises 6

7 20. Any whlesaler r chiller premises must be registered with the Chief Executive. NOTE: This registratin ccurs thrugh the registratin f a business that will be perating these premises. 21. Any whlesaler r chiller premises must nly accept the kangar carcass f the species listed in this Cde. 22. Any whlesaler r chiller premises must nly accept a kangar carcass with a valid tag attached. A valid tag is a tag that was issued in the same calendar quarter as the date when the carcass is accepted and which is fr the same species as the carcass. 23. Cnfirmatin f registratin frm Chief Executive must be displayed n the premises where the activity is being undertaken. 7

8 PART THREE RECORD KEEPING NOTE: an bligatin t keep recrds is an bligatin t keep written recrds that are true and accurate. It is an ffence under the Act t keep written recrds which are nt true and accurate. NOTE: an authrised fficer under the Act has the pwer t request, inspect and cpy recrds withut prir ntice. It is an ffence under the Act t fail t prduce recrds when requested. Registratin details 24. Cmmercial peratrs must keep a cpy f the registratin details they have prvided the Chief Executive and a cpy f the registratin cnfirmatin. 25. Cmmercial peratrs must recrd and reprt t OEH any nn-cmpliance with this Cde immediately after becming aware f the nn-cmpliance. Reprts t OEH must be made via Envirnment Line (see cntact details at page 2 f this Cde). Keeping recrds 26. Cmmercial peratrs must make a recrd f infrmatin required by this sectin relating t kangars immediately upn cmpletin. 27. A harvester s recrds must include: a) Written landhlder cnsent, and b) Fr each kangar harvested: Date harvest ccurred, and Prperty where harvest ccurred, and Species, and Weight, and Gender, and Tag number used, and Chiller r Whlesaler where the carcass is delivered, and c) Number f lst tags, and d) Number f returned tags and their tag number, and e) Number f underweight carcasses, and f) Number f kangars sht in the bdy. 28. A chiller peratr s recrds must include: a) Fr each carcass purchased r received and fr each carcass received: Name and registratin number f cmmercial peratr the carcass was received frm, and Date received, and Species, and 8

9 Weight, and Gender, and b) Whlesaler the carcass is delivered t. 29. A whlesaler s recrds must include: a) Fr each carcass purchased r received and fr each carcass sld: Name and registratin number f the cmmercial peratr the carcass was received frm, and Date received, and Species, and Weight, and Gender. NOTE: the OEH website will have a template t assist cmmercial peratrs t keep true and accurate recrds f each activity relating t kangars. 30. Cmmercial peratrs must keep recrds at each registered premise. 31. Cmmercial peratrs must reprt all infrmatin they are required t keep under clause 26, 27, 28 r 29 t OEH n a quarterly basis in writing r via the website, r as directed by OEH. a) Fr the calendar quarter 1 January t 31 March, infrmatin is t be prvided n 15 April. b) Fr the calendar quarter 1 April t 30 June, infrmatin is t be prvided n 1 July. c) Fr the calendar quarter 1 July t 30 September, infrmatin is t be prvided n 1 Octber. d) Fr the calendar quarter 1 Octber t 31 December, infrmatin is t be prvided n 1 January. 32. Where a cmmercial peratr has nt undertaken any kangar harvest activities in a quarter they must reprt that fact in the timeframe required by clause 32. Written landhlder cnsent 33. Cmmercial peratrs must have written cnsent frm each landhlder if they are harvesting kangars n land nt wned by the cmmercial peratr befre carrying ut harvesting n that land. 34. Cmmercial peratrs must keep a recrd f any written landhlder cnsents. 35. The written landhlder cnsent must include the fllwing 1 : a) Address, and b) Pstal address, and c) Dates that harvesting can ccur, and 1 An example is available is at Attachment B 9

10 d) Landline phne number, r e) Mbile phne number, and f) Landhlder name, and g) Signature f the land hlder and a statement authrising the activity, and h) Letter f authrity if a manager r representative r family member is signing n behalf f the wner. 10

11 PART FOUR HARVESTING KANGAROOS Species 36. This Cde des nt apply t any kangar fund dead. 37. Only fur species f kangar may be harvested in NSW. These are: a) Red kangar Macrpus rufus b) Eastern grey kangar Macrpus giganteus c) Western grey kangar Macrpus fuliginsus d) Cmmn wallar Macrpus rbustus ssp. rbustus Harvest area 38. Kangars may nly be harvested n land that: a) is privately wned land, and b) is within the NSW kangar cmmercial management zne. The NSW kangar cmmercial management zne is the part f NSW in which cmmercial kangar harvesting is permitted. An indicative map f the NSW kangar cmmercial management zne is available at Attachment A. 39. Cmmercial peratrs must nly harvest n land where the address has been prvided as part f their registratin and which has been cnfirmed by the Chief Executive f OEH as land within the NSW kangar cmmercial management zne. 40. Kangars must nt be harvested within 200 metres f a dwelling r 500 metres f land zned as residential. 41. Fr the purpses f this cde land zned as residential refers t land zned as RU5 Village, R1 General Residential, R2 Lw Density Residential, R3 Medium Density Residential, R4 High Density Residential, R5 Large Lt Residential under a Lcal Envirnmental Plan, r, in any ther case, as land therwise zned as residential (but nt rural-residential ), village r twnship under an envirnmental planning instrument r having regard t the purpse f the zne, having the substantial character f a zne s designated. Shting kangars 42. Cmmercial peratrs must nly harm kangars in accrdance with the Natinal cde f practice fr the humane shting f kangars and wallabies fr cmmercial purpses. That cde f practice is available n the website f the Cmmnwealth Gvernment Department f the Envirnment: Kangars sht in the bdy 43. A kangar that is sht in the bdy must be tagged and left in the field. 11

12 44. A business r individual must nt pssess, sell r transfer a kangar with a bullet wund in a lcatin ther than the head. 45. Cmmercial peratrs must reprt any kangars sht in the bdy t OEH, immediately via the Envirnment Line n r at inf@envirnment.nsw.gv.au Using tags NOTE: Guidelines abut hw cmmercial tag allcatin perates are available n the OEH website. 46. Cmmercial peratrs must nly use tags purchased frm OEH. 47. Cmmercial peratrs can nly harm as many kangars as the number f cmmercial tags they have purchased frm OEH. 48. Tags must nt be affixed t an animal ther than in the same calendar quarter in which they were issued. 49. Tags must nt be transferred t anther cmmercial peratr. 50. All unused tags must be returned t OEH by 31 st f January in the year fllwing the date f issue. 51. A tag must be fixed t any kangar harvested. 52. A tag must be fixed immediately after the kangar is sht. 53. A tag must be fixed adjacent t the rectum n a kangar carcass. 54. Tags must nly be used fr the species they identify. Cmmercial tags are clur specific fr each species f kangar. 55. Cmmercial peratrs must nt sell, purchase r have in their pssessin a kangar carcass that des nt have a tag affixed. Carcass requirements 56. Cmmercial peratrs must nt harvest, pssess, sell r purchase a kangar carcass that weighs less than: a) 14 kilgrams, in the case f a carcass frm which the heart, liver, lungs, tail, frearms (belw elbw) and feet (belw tarsels/tibula jint) have been remved. b) 15 kilgrams, in the case f a carcass t which any f the abve listed bdy parts are still attached when weighed at the pint f delivery t a registered premise. 57. Cmmercial peratrs must nly stre kangar carcasses at a lcatin registered with OEH and specified in the cmmercial peratr s registratin. 12

Cmmercial peratrs are required t prvide the address f premises where activities will be taking place in accrdance with this Cde, fr harvesters this includes the prperties they plan t harvest n. As a part f reviewing registratin infrmatin OEH will check that these prperties are within the NSW kangar cmmercial management zne. 13
