1 li RESOLUTION No A RESOLUTION OF THE CITY OF SALISBURY, MARYLAND AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT BETWEEN THE CITY OF SALISBURY, MARYLAND AND WICOMICO COUNTY, MARYLAND FOR THE DELIVERY OF FIRE, RESCUE, ADVANCED OPERATIONS AND EMERGENCY MEDICAL SERVICES ( FIRE SERVICES AGREEMENT). WHEREAS, the Salisbuy Fie Depatment is equipped to povide fie, escue, advanced opeations sevice, and emegency medical sevices to the esidents of the City; and WHEREAS, Wicomico County desies that these sevices be povided to the esidents and popety ownes outside of the City of Salisbuy copoate limits; and WHEREAS, the City has ageed to povide these sevices to the esidents and popety ownes outside of the copoate limits in the aea designated as the Salisbuy Fie Distict in exchange fo financial eimbusements and contibutions fom the County; and WHEREAS, the City desies to coopeate with the County to povide these sevices to the esidents and popety ownes outside of the City of Salisbuy copoate limits. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY OF SALISBURY, MARYLAND that the City Council heeby appoves the ageement negotiated by the Mayo and authoizes the City to ente into a Fie Sevices Ageement with Wicomico County, Mayland pusuant to the tems set foth in the attached Ageement Between The City of Salisbuy, Mayland And Wicomico County, Mayland Fo The Delivey of Fie, Rescue, Advanced Opeations And Emegency Medical Sevices, a copy of which is attached heeto fo the pupose of enhancing public safety. THIS RESOLUTION was duly intoduced and passed at a meeting of the Council of the City of Salisbuy held on Apil 24, 2017, and is effective immediately upon adoption. Afte months of had wok the City is happy to shae that the Mayo and County Executive have a signed ageement. This ageement is based on calls fo sevice and emoves the past pactice of stipends. We believe this is a stong ageement that we can wok with fo many yeas. The ageement with a of map fie disticts is attached.

4 THIS AGREEMENT enteed into this day of 2017, by and between the CITY OF SALISBURY, MARYLAND (heeinafte efeed to as " City"), a municipal copoation of the State of Mayland, and WICOMICO COUNTY, MARYLAND heeinafte efeed to as " County"), a body politic and copoate of the State of Mayland, heeinafte efeed to as the" Ageement"), to wit: WHEREAS, the City of Salisbuy Fie Depatment is equipped to povide fie, escue, advanced opeations sevice, ( including, but not limited to, hazadous mateials( Hazmat), technical escue, tench escue sevices), and emegency medical sevices to the esidents of the City; and WHEREAS, the County desies to povide these sevices to esidents outside of the City copoate limits in a coopeative effot with the City; and WHEREAS, the City will extend these sevices to esidents and popety ownes outside of the copoate limits in the aea designated as the Salisbuy Fie Distict in exchange fo financial eimbusements and contibutions fom the County. NOW, THEREFORE, THIS AGREEMENT WITNESSETH, that fo and in consideation of the pemises and of the mutual covenants and ageements heein made by and between the paties, and othe good, valuable and sufficient consideations, eceipt of which is heeby acknowledged, the paties heeto covenant and agee as follows: A. Geneal. 1. The City agees to povide within the Salisbuy Fie Distict full and complete fie potection and escue, including advanced opeations sevice, and emegency medical 2IPage

5 esponse and tanspot( EMS) and advanced life suppot and tanspot( ALS) at the same level of sevice that it povides such sevices to esidents of the City. 2. The City agees to povide advanced opeations sevices to the aeas of Wicomico County that ae outside of the Salisbuy Fie Distict. 3. In etun fo said sevices, the County agees to pay unto the City, the sums of money as descibed in Section C, Reimbusement, of this Ageement. B. Sevice Aea Scope of Sevice. 1. The City shall povide fie, escue, and advanced opeations sevices to the aea known and efeed to as the Salisbuy Fie Distict. The Salisbuy Fie Distict shall include all of the sevice aeas fo each of the depatment' s fie stations( 1, 2 and 16), including all incopoated aeas of the City and all aeas in the County outside of the copoate City limits but within the boundaies as established though the Wicomico County Chiefs Association, as defined in Appendix A. The Salisbuy Fie Distict may only be amended by ageement of the County, the City, the Wicomico County Chiefs Association. 2. The City shall povide emegency medical sevice( EMS) and advanced life suppot emegency medical esponse and tanspot( ALS) to the Salisbuy Fie Distict in accodance with the Tems and Conditions in Chapte 39 of the Wicomico County Code, " Fie and Ambulance Companies and Rescue Squads." 3. The City shall povide advanced opeations sevices to the Salisbuy Fie Distict. Upon mutual aid equest, the City shall povide advanced opeations sevices to all aeas of Wicomico County, including aeas that ae outside the Salisbuy Fie Distict. Advanced opeations sevices may include, but ae not limited to, hazadous 31

6 mateials ( Hazmat), confined space enty/escue, tench collapse/escue o othe technical escue sevices developed and implemented by the City at a futue date. C. Reimbusement. 1. The County heeby agees to pay to the City fo fie, escue, advanced opeations sevices, advanced life suppot and emegency medical esponse and tanspot sevices, accoding to the following schedule: a.. Fie- Rescue Call Reimbusement: The numbe of 911 Cente confimed dispatches X $ pe call X pecent not coveed by insuance eimbusement. See Appendix B) b. No Tanspot EMS and ALS Calls Reimbusement: The numbe of 911 Cente confimed EMS and ALS calls X $ X pecent not coveed by insuance eimbusement. ( See Appendix B) c. Tanspot EMS Calls Reimbusement: The numbe of 911 Cente confimed EMS calls X$ X pecent not coveed by insuance eimbusement. ( See Appendix B) d. Thee will be an ovehead eimbusement fom the County to the City in the amounts listed below. This will not change the eimbusement to the City by the esponsible paty fo bills fo sevice accoding to County Code Chapte 158. 7 D. Annual Review. 1. In Januay of each yea, the County and the City shall eview the insuance eimbusements pecentage fo all calls set foth in Paagaph C( I)( c) above fo the pio twelve( 12) months. The County and the City shall agee upon a evision of the insuance eimbusement pecentage by Mach 15 of each yea o the insuance eimbusement pecentage shall emain unchanged. Any change in the eimbusement pecentage shall be effective on July 1' of the next fiscal yea. 2. The City and County shall ely on the statistical data povided by the City of Salisbuy Fie Depatment, the County Depatment of Emegency Sevices, the County G. I. S. office, and the Mayland Depatment of Assessment and Taxation in eviewing the amount of insuance eimbusement and ates. E. Collection The City will initially pefom collection effots on all calls descibed above in Paagaph( C)( 1)( c). By July 31' of each yea, the City shall povide the County with any uncollected accounts outside of the City copoate limits, and the County may commence independent collection effots. F. Mutual Aid Calls Neithe the City no the County shall eceive any eimbusement fo mutual aid calls fo fie, escue o emegency medical sevices. The City may, howeve, bill the ecipient fo emegency medical sevices as is its cuent pactice. 5 II' _ -

8 G. Self-Dispatched Calls Neithe the City no the County shall eceive any eimbusement fo selfdispatched calls fo fie, escue o emegency medical sevices. The City may, howeve, bill the ecipient fo emegency medical sevices as is its cuent pactice. H. Length of the Ageement The paties heeto agee that this Ageement shall be fo a tem of five( 5) yeas; commencing on July 1, 2017, and teminating on June 30, If the eimbusement fomula set foth in Paagaph C becomes financially untenable fo eithe paty due to mateial unfoeseen changes in insuance coveage o payments, then eithe paty shall have the ight to teminate the Ageement by giving at least six months advance witten notice to the othe paty. I. Othe Consideations 1. The City shall povide pofessional consultation and coopeation fom the Salisbuy Fie Depatment to any County office o agency on issues affecting fie esponse, pevention, escue, emegency medical sevices o disaste esponse. 2. This Ageement and the Appendices heeto constitute the entie ageement between the paties with espect to the subject matte heeof and supesede all pio ageements and undestandings, oal o witten. 3. No paty heeto shall be liable o bound to the othe in any manne except as specifically set foth heein. 4. Nothing in this Ageement, expess o implied, is intended to confe upon any thid paty any ights, emedies, obligations o liabilities unde o by eason of this Ageement, except as expessly povided in this Ageement.
