Kachow was slow to begin. Chaos Theory jumped away awkwardly. Leaving the front straight on the first occasion River Dancing, which was inclined to lay out, had to be steadied when tightened to the inside of Just Junior that shifted in. As a consequence Chaos Theory, which was trailing, had to be checked to avoid the heels of River Dancing. No Imperfections raced three wide through the early stages before obtaining a position outside the leader near the 1300 metres. River Dancing raced wide without cover for the majority of the event. Chaos Theory was eased to a four wide position at the 1000 metres. Upon return to scale rider T Neve reported that Chaos Theory was inclined to hang out but when the pace slackened, she elected to improve her position into the race.

2 Yukari became unbalanced approaching the 1200 metres. When questioned, rider J Todd explained the filly, which was having its first race start, was inclined to shift in and away from River Dancing and over reacted, becoming unbalanced. J Todd added that he could offer no further explanation for the poor performance of Yukari, which was beaten seventy three lengths. A post race veterinary examination failed to reveal any obvious abnormality. Connections were advised that a warning had been issued against the filly for its uncompetitive performance. Rider B Egan (Freddie Two Shoes) was questioned regarding his actions over the latter stages, in particular, his reasons for failing to ride his mount through to the finish from the 100 metres. B Egan explained that Freddie Two Shoes felt uncomfortable in its action and for this reason he failed to ride his mount out in his normal manner. A post race veterinary examination revealed the gelding had cast it s off fore plate and was short in front. As a consequence no action was taken against B Egan other than to remind him of his obligations to report to Stewards upon return to scale, any matter that may have affected his mount s performance. Stewards were satisfied that the actions of B Egan did not affect the placings. Trainer B Cozamanis will be contacted in the ensuing days to see how the gelding pulls up. A post race veterinary examination of River Dancing, which tired over the latter stages, failed to reveal any abnormality. Race 2 GROWLERS BAR & RESTAURANT MAIDEN PLATE metres: Human League was slow to muster speed and settled at the rear of the field. Upon return to scale, rider A Stead reported Human League, which performed below market expectations, felt uncomfortable on the synthetic surface. A post race veterinary examination revealed the gelding to be suffering a cardiac irregularity.trainer J Sadler was notified that prior to Human League racing again he must provide a veterinary certificate of fitness including the satisfactory results of an ECG performed at rest and a cardiac auscultation performed within 30 minutes of a satisfactory gallop over at least 1000 metres. Passing the 200 metres Innovate (NZ) shifted out to obtain a clear run and in doing so brushed Rentrice. Subsequent to the event rider J Todd reported that Regal Sanctum felt uncomfortable in its action. A post race veterinary examination revealed mild lameness in the near fore. Trainer A Homann was notified that a veterinary certificate of fitness is required prior to Regal Sanctum racing again. Race 3 WYNDHAM RESORT F&M MAIDEN PLATE 1000 metres: Stewards ordered the late withdrawal of Maccas Princess at 8.36am after it was reported that the mare was lame in the off side fetlock. After being mounted and when being led by the Clerk Of Course (B Challis), Dark Storm became fractious, got its head up, striking B Challis in the face, resulting in him having to receive medical attention. As the remaining Clerk of Course was in the process of leading Candy Art to the start, Dark Storm could not leave the enclosure until his return. Due to both incidents the start was delayed by approximately ten minutes. Trainer A Sexton was advised

3 that a warning was placed on Dark Storm for the mare s pre race manners. Upon further examination, B Challis was stood down from his duties by the medical officers. On leaving the gates Maggie Mayhem, which was slow to begin, shifted in making contact with the hindquarters of Dark Storm and as a result then shifted out abruptly unbalancing J Lyon and losing ground. Candy Art was slow to begin. Dark Storm lay in passing the 800 metres and had to be corrected by its rider. Maggie Mayhem was under pressure from the entrance to the straight and was placed last. Rider J Lyon reported the filly, which was having its first race start, raced greenly. A subsequent veterinary examination did not reveal any abnormality. When questioned regarding the tactics adopted on Rattlin Red Rosie, which settled directly to the outside of the leader, rider I Gundogdu reported that he was instructed to lead at all costs. He added that his mount did not have sufficient speed to cross the race leader, and eventual winner, Navorina. Race 4 THE BEACH HOTEL JAN JUC 0-68 HANDICAP metres: The start was delayed several minutes when, at the first attempt to affect the start, the barriers failed to open due to a power failure. All runners were subsequently removed and the barriers tested. As a consequence a manual start was utilised. Famous By Name (NZ) was slow to begin. Rich Faith lay in over the latter stages. Race 5 SURF COAST TIMES TORQUAY CUP metres: After being placed in the barrier Banker On Nine became fractious, lunged forward and made contact with its head to the front of the gates. Consequently Banker On Nine was removed, examined by the veterinary surgeon and passed fit to race. This delayed the start by four minutes. Banker On Nine and Blooded bumped shortly after the start. Numen Lumen shifted in abruptly after the start checking God s Secret. Approaching the 1100 metres Pelikaan Start had to be steadied when tightened for room to the inside of Banker Of Nine, which was taken in by Blooded, which in turn had been taken in marginally by Watasham. Rider I Gundogdu (Watasham) was spoken to advisedly and reminded of his obligations to ensure he is sufficiently clear when shifting ground. Numen Lumen and Bangatang raced wide without cover. Numen Lumen was inclined to lay in for the majority of the event.

4 Watasham, which lead the field, hung out rounding the home turn and in the straight. Rider I Gundogdu reported that he was placed under some disadvantage due to Watasham hanging. A post race veterinary examination revealed the gelding to be lame in front. Trainer D Brown was notified that a veterinary certificate of fitness is required prior to Watasham racing again. C Robertson (God s Secret), reported that the gelding did not feel right in its action throughout the race. A post race veterinary examination did not reveal any abnormality. Rider J Lyon reported his mount Constant Rhythym also hung. R McLeod, declared rider of Constant Rhythym, was fined $200 under the provision of AR120B for failing to fulfil his engagement on that mare due to being overweight. R McLeod was replaced by J Lyon. Race 6 TORQUAY HOTEL 0-58 HANDICAP metres: Frenchkook, which was having its first race start since November, 2011, underwent a pre race veterinary examination and was deemed fit to start. Prior to the running of race 1 trainer A Bodey advised of a change of tactics to be adopted for Almighty Flash. It was the intention for Almighty Flash to be ridden from a mid field position, circumstances permitting, after the gelding led and weakened at its most recent start. Almighty Flash was slow to begin and settled worse than mid field. Just after leaving the gates I m A Soldier became badly unbalanced and lost ground after being bumped by Hylena, which shifted out slightly. Almighty Flash was slow to begin. Broken Jaw jumped awkwardly. Broken Jaw and Viva La Show raced wide without cover. Frenchkook hung out rounding the home turn and near the 400 metres had to be checked to avoid the heels of Bel Shandy. Frenchkook was eased down by its rider over the final 200 metres. A post race veterinary examination failed to reveal any obvious abnormality. Rider D Thornton explained that Frenchkook did not feel comfortable and for this reason he eased the gelding down. He added the gelding had suffered a fractured leg last preparation however, its recent work and trials had been good. Stewards will follow up with trainer G Thornton. When questioned regarding the performance of Rock The Ballet (winner), trainer S Hasan explained that Rock The Ballet has shown significant improvement since wearing blinkers for its last two starts and in his opinion is better suited over today s distance. J Duffy (Composing) was fined $100 for breaching the provisions of AR137(A)(5)(a)(ii) in that he used his whip on eight occasions in a forehand manner prior to the 100 metres. Race 7 TORQUAY MITRE HANDICAP metres:

5 After being placed in the barrier Fiji Princess became cast. Fiji Princess was removed and underwent a veterinary examination and was deemed unfit to race. Fiji Princess was withdrawn at 5.15pm. All monies bet for a win and /or place and concession betting onfiji Princess to be refunded. All successful bets on the horses prior to the time of withdrawal are subject to the following deductions in the dollar from the face value of the ticket: Win bets 6 cents, place bets (winner) 6 cents, place bets (second) 6 cents, place bets (third) 7 cents. Jestarossa was slow to begin. Kayarbee jumped awkwardly. Bedouin Express commenced awkwardly. Chrissieboo raced three wide from the 1200 metres. Binjai over raced through the early and middle stages. Jestarossa over raced through the middle stages. Dancez Vous (NZ) was inclined to lay out rounding the home turn and in the straight. When questioned regarding the performance of The Norman, R Wheeler reported the gelding failed to respond to his riding when placed under pressure and was disappointing. A post race veterinary examination did not reveal any abnormality. A subsequent veterinary examination of Rock To Success did not reveal any abnormality. Race 6 Almighty Flash Race 1 Freddie Two Shoes Race 5 - Frenchkook Supplementary Reports Niall Phillips Inquiry On 21 February 2013, Stewards concluded an inquiry into an incident that occurred 26 December On the evidence Niall Phillips was found guilty of a charge under the provisions of AR. 175(j) that states: AR 175 The Committee of any Club or the Stewards may penalise:

7 (j) Any person guilty of improper or insulting behaviour at any time towards the Committee of any Club or Association or any member thereof, or Stewards, or any official, in relation to their or his duties. It was alleged on 26 December 2012 at the Geelong Racing Club s Boxing Day meeting, Mr Phillips engaged in a conversation with Veterinary Surgeon Dr Chris Richards outside the Trainers Bar. During the course of this conversation, Mr Phillips directed improper language at Dr Richards. Mr Phillips was fined $1000 with that penalty fully suspended for a period of 12 months pending no further breaches of this rule. Geelong Inquiries On 21 February 2013, Stewards concluded several inquiries involving Nathan Smith that occurred 24 December 2012, 7 January 2013 and 10 January In relation to the matter on 24 December 2012, on the evidence Nathan Smith pleaded guilty to a charge under the provisions of AR.175(j) that states: AR 175 The Committee of any Club or the Stewards may penalise: (j) Any person guilty of improper or insulting behaviour at any time towards the Committee of any Club or Association or any member thereof, or Stewards, or any official, in relation to their or his duties. It was alleged on 24 December 2012 at the Geelong racecourse, Mr Smith did speak to Gary Dendall (Geelong Racing Club Trackwork Supervisor) in a threatening and improper manner. Mr Smith had his stablehand licence suspended for a period of one month effective immediately. Stewards directed Mr Smith not attend any racecourse during the period of his suspension, however ordered he be permitted to attend his father s registered training stables. In relation to a second incident that occurred 7 January 2013, where it was again alleged Nathan Smith made improper comments to Mr Dendell, due to insufficient corroborating evidence, no action was taken. A third incident that occurred 10 January 2013 involving Nathan Smith and Kody Eldred resulted in the following action. Kody Eldred pleaded guilty to a charge under the provisions of AR.175(q) that states: AR 175 The Committee of any Club or the Stewards may penalise: (q) Any person who in their opinion is guilty of any misconduct, improper conduct or unseemly behaviour. It was alleged on 10 January 2013 at the Geelong racecourse, Mr Eldred engaged in a verbal altercation with Mr Smith using foul language. It was further alleged in the vicinity of the

8 horse stalls, Mr Eldred engaged in a physical altercation with Mr Smith. It was alleged Mr Eldred s conduct was improper. Mr Eldred was fined $500. Mr Smith also pleaded guilty to a charge under the provisions of AR.175(q). It was alleged on 10 January 2013 at the Geelong racecourse, Mr Smith engaged in a verbal altercation with Mr Eldred using foul language. It was further alleged in the vicinity of the horse stalls, Mr Smith engaged in a physical altercation with Mr Eldred. It was alleged Mr Smith s conduct was improper. Mr Smith was fined $500. During the course of today s inquiries, Stewards had further reason to question Mr Smith in relation to his conduct. Nathan Smith pleaded guilty to an additional charge under the provisions of AR.175(q). It was alleged on 21 January 2013 at the Geelong racecourse, Mr Smith made an inappropriate hand gesture to a licensed person. Mr Smith was fined $250.
