3 "Your Source for Success" I would like to welcome everyone interested in Red Brangus,Red Angus or Angus Plus,to our Sixth Annual Source for Success Sale. hope you all have had a good year.we continue to have a lot of change in our lives. We sold the Staples ranch, but have leased it back.we have also purchased a ranch in Yancey,Texas.We will be eliminating our fall calving herd. My wife, two daughters and I have moved to Austin just last month.we are optimists and believe the best is yet to come. This is particularly true if you have been selecting the best genetics.we don't all live in the same environment.but it is much easier for cattle raised under harsh conditions to prosper with lush conditions.i think this another first rate set of cattle.while all the cattle in this sale won t fit everyone,we do feel that the genetic variety we have for you to choose from will allow you to get what you need.we strive to produce functional, efficient cattle.in our operations how many of us can really afford to pour all that feed into our cattle? This year we are selling all of our fall calving Red-Brangus (except the very old and a handful that have ET calves at side.) So several of the cows selling represent some of my purchases in creating the R Squared Ranch herd. One year,i hope to be able say that all of the cattle and all of the dams were bred here as well.i am very excited about the future of red cattle. I think we are making great progress at developing the fertile,heat-tolerant,easykeeping,high-grading red cattle,which we all need. All of our cattle work in our central Texas conditions.they are not pampered.our cattle have survived this year's drought fairly well. Other than the sale cattle,they only get grass,grass hay,mineral and MIX-30. It hasn't been the easiest year for many of us.the drought has hit many of us hard. Both the sale bulls and the open sale heifers have been on light feed for about 60 days prior to the sale.people seem to prefer cattle with a little more condition than just their working clothes.but let us know what you think.send us ;visit our website;give us feedback.we always like to hear more from our customers. We don t sell heifers private treaty.i know that has lost us some show heifer sales for children that need to use a scramble certificate in the spring.i don t think it s fair to let any buyer go out in the pasture and pick.everyone should have the same chance.we sold some heifers at our Junior Jackpot this spring and think that worked out well for all concerned. We will be continuing our Junior Jackpot Futurity again next year.the rules will remain the same.i will post them on our website shortly. Next year s Jackpot will be held on Saturday April 21st.We will officially add the Junior Showmanship prizes and buckle that we added at the Jackpot this year. The prizes will include over $16,000.We will offer $75 for second in class,$200 for first in class,$400 for Reserve Division, $750 for Division winners(including showmanship divisions),$1,500 for Reserve Showmanship,$2,000 for Reserve Grand Champion,$2,500 for Showmanship Champion,and $4,000 for Grand Champion Heifer. This futurity attracted members of the American Junior Red Brangus Association and the Junior Red Angus Association of America. Katy Knox of Hempstead, Texas exhibited the grand champion female with her entry R 2 Miss Olive 719R born February 12, Knox also topped the junior calf champion heifer division with Miss Olive. She was awarded a total of $4,950 in prize money. George Silvas, Jr, of Wharton, Texas showed the reserve grand champion with a March 1, 2005 heifer, R 2 Gloria 844R. She was also the reserve junior calf champion heifer. Silvas received a total of $2,100 for his reserve champion. The exhibitors of the grand champion and reserve grand champion heifers also received trophy belt buckles. Other division winners were shown by Lawrence Padalecki, Jr., St. Hedwig, Texas; Dollie Petrosky, Boling, Texas; Austin Acord, Madisonville, Texas; and Cameron McConathy, Angleton, Texas. Division champions were awarded $750 and reserve division winners earned $400 each. Each class winner received $200 and second place class winners received $75. In the showmanship division George Silvas, Jr. was selected senior champion and overall showman champion. He was presented a belt buckle and a check for $3,000. Cameron McConathy was chosen as reserve senior champion and reserve overall champion showman. He received $1,500 and a trophy belt buckle. In the junior showmanship division sisters Lakeyn and Lauren Fontenot of Lake Charles, Louisiana earned the top two spots. More the $16,000 in prize money was paid to the junior exhibitors who participated in the futurity. Victor Guerra, of La Muneca Cattle Company of Linn,Texas served as judge of the futurity and the showmanship contest. Guerra also conducted an extensive hands-on showmanship clinic. 25 Bulls And Herd Sire Prospects Lots This is a great set of young bulls ready to go to work for the registered or commercial cattleman. The bulls that we are selling this year were raised on grass and mineral and wintered on oats and mineral. They don't have the weaning and yearling weights, ribeye size or marbling of cattle that are fed. But you know that they will thrive on our Texas grass without a feed bucket. 32 Except for those stated in the terms and conditions below, there are no warranties, either expressed or implied, as to the merchantability or fitness for a particular purpose with respect to the cattle being sold at this auction.the warranties and guarantees set forth in these Terms and Conditions are in lieu of all other warranties, either expressed or implied, and the remedies provided herein shall be the sole and exclusive remedy for the buyer, or any party through the buyer, for any breach of warranty or guarantee herein provided, and all other obligations or liabilities. A. The following terms and conditions of sale are adapted from those recommended for use by all members of the Red Angus Association of America. B. Copies of those terms and conditions of sale are available upon request from the Red Angus Association of America. All cattle in this sale are offered according to the laws of the State of Texas.The right to bid, as provided under law, is reserved for all sellers unless otherwise announced. 1. BIDDING: The auctioneer in charge will settle any disputes as to bids, and his decision shall be final. 2. TERMS: All terms are cash or check unless satisfactory credit arrangements have been made with sale management prior to sale. 3. PURCHASER S RISK: Each animal becomes the risk of the buyer as soon as sold, but it shall be the obligation of the seller to see that animals are fed and cared for free of charge to buyer, until loaded for shipment or until the expiration of 48 hours after the sale, whichever occurs sooner. 4. CERTIFICATE OF REGISTRY: A transferred certificate of registry will be furnished to the buyer for each animal. 5. HEALTH: All animals are eligible for interstate shipment, except as otherwise announced. Interstate health papers will be furnished for each animal requiring Tuberculosis and Brucellosis tests in accordance with federal regulations. 6. AI/NON-OWNER BULL PERMITS: AI/Non-Owner Bull Permits shall be furnished by the seller, at no cost to the buyer, for all females bred artificially or naturally to bulls not owned by the seller. 7. ANNOUNCEMENTS: Any changes from information of any kind in this catalog will be announced from the auction box and such announcements shall take precedence. 8. BREEDING GUARANTEE: A. All animals are guaranteed by the seller to be breeders with the exception of, (1) Calves less than 12 months of age. a. Animals shown by the purchaser after the sale.the breeding guarantees, if any, shall be as agreed upon between seller and buyer. b. Gross negligence or willfulness misconduct on the part of the buyer. B.Bulls are guaranteed breeders if not allowed to run within herd until at least 14 months of age. Any bull that either, (1) settles one-third or more of the healthy cows he serves, (2) is the sire of 20 or more animals, or (3) settles cows by natural service and passes a fertility test made by a competent veterinarian during any six-month period of trial (provided for in paragraph 10B of Options and Privileges of Return or Adjustment, in this section) shall be considered a breeder. Any guarantees with respect to the ability to freeze semen shall be by separate agreement between buyer and seller. C. Safe in Calf Females have been examined by a competent veterinarian and are so guaranteed. D. Served females are believed to be in calf but are not so guaranteed. E. Pasture-bred females have been exposed but are not guaranteed to be safe in calf. F. Open females have not been served and are so guaranteed. 9. IDENTIFICATION: Seller offers each animal with readable tattoos or brands corresponding to its registration. 10. OPTIONS AND PRIVILEGES OF RETURN OR ADJUSTMENT: A. All claims for adjustment or refund must be made in writing within six (6) months of the sale date or not later than six (6) months after the animal reaches 18 months of age, with the exception of claims involving defect of parentage. B. In the event an animal is claimed to be a non-breeder, the animal may be returned to the farm/ranch of the seller if in good condition and complying with the health requirements of the seller s state.the seller shall be entitled to six months trial following the return of the animal in which to prove the animal is a breeder. If at the end of six months the seller is unable to prove the animal is a breeder, the seller, at the option of the buyer, shall replace the animal with another of equal value or refund the purchase price. The return of the full purchase price shall in any case be deemed full satisfaction and settlement. Any expenses incurred for transporting an animal claimed to be a non-breeders shall be the responsibility of the buyer; except that the seller shall be responsible for transportation cost in excess of the distance between the buyer s farm/ranch and the location where the sale took place. If the seller proves the animal to be a breeder, it shall be the obligation of the buyer to take delivery of the animal and pay all expenses incurred for transportation. C. If a female sold as safe in calf proves not be in calf, the buyer may receive service from the bull previously used. If the bull is not available, the seller shall be obligated to make a satisfactory adjustment to the purchase price upon return of the animal to the farm/ranch of the seller. Any adjustment provided for herein shall absolve the seller from further liability, except in the case such as female proves to be a non-breeder. If a female represented as safe in calf at time of sale proves to have been bred to a different bull, the seller shall be obligated to make a satisfactory adjustment on the purchase price upon return of the animal to the farm of the seller (adjustments shall not be considered to be a breeding fee or an allocation of the purchase price to any unborn calf.) Any expense incurred for transportation shall be the responsibility of the buyer, except that the seller shall be responsible for transportation cost in excess of the distance between the buyer s farm/ranch and the location where the sale took place. 11. DEFAULT: In the event of the buyer defaults on payment, the buyers shall be responsible for all costs, including attorney s costs, incurred by sale management or seller in connection with collecting, or attempting to collect, payment due. 31

33 12: GENETIC DEFECT AND PARENTAGE GUARANTEE: A. All animals are guaranteed by the seller not to produce calves with the following defects: DWARFISM, DOUBLE MUSCLING, PARROT MOUTH, OSTEOPERTOSIS (marble bone disease) and SYNDACTYLISM (mule foot).the parentage of all animals bred by the seller is guaranteed to the extent that the animal is by the sire and out of the dam that is indicated on its registration paper.these guarantees are effective for a period of two years from date of sale only under these conditions. 1. The buyers shall notify the seller in writing immediately upon birth of calf suspected of being defective or immediately after determination is made that such calf is defective or if parentage is suspect or found to be in error. 2. The seller, as his expense shall be permitted, and proved with reasonable opportunity, to obtain blood samples of alleged defective calf and its sire and dam for the purpose of DNA or blood type analysis to establish parentage. In the case of suspect parentage, the buyers, at his expense, shall be permitted, and provided with reasonable opportunity, to obtain samples of the animal in question and its sire and dam for the purpose of DNA or blood tope analysis to establish parentage, If sire and dam, as indicated on the animal s registration certificate, are proven to be in error by such analysis, seller shall reimburse buyer for cost of analysis. 3. The animals will be returned by the buyer to the seller at the buyer s expense, provided the animals meet the health requirements of the seller s state. 4. The replacement of an animal with another of equal value or the refund of the purchase price in connection with a defect producing animal or an animal whose parentage is in error shall be deemed full satisfaction and settlement. 5. In the event there is a dispute as to whether or not a calf is defective, or parentage is in error, determination refereed to in above, shall be made by a person or persons acceptable to both the buyer and seller, and in the event the buyer and seller cannot agree on the selection of such a person or persons then each of them shall appoint a representative to make the determination. In the event that such representatives fail to agree, a third person selected by the representatives of the buyer and seller shall make the determination. 13. SELLER S SEMEN RIGHTS: Any semen rights retained by the seller must be announced from the auction box at the time of the sale, if not already printed in the sale catalog. 14. RIGHTS AND OBLIGATIONS: 1. The above terms and conditions of sale shall constitute a contract between the buyer and seller of each animal and shall be equally binding upon both. Each sale or resale of an animal constitutes a separate transaction. 2. Unless specially stated herein, neither the sale management nor the Red Angus Association of America shall have any liability for any event or occurrence related in any manner to this sale. All persons who attend the sale do so at their own risk. The seller, the owner of the sale facility, nor any person connected with the management of the sale assume no liability, legal or otherwise, for any accidents that may occur.
