STEWARDS: J Walshe (Chairman), B Gray & J Whitney General: Trainer Mr J Marzol pleaded guilty to a charge under AR80E(1) in that when visited by Racing NSW Stewards on Wednesday 18 November 2015 he was found to have two unlabelled Schedule 4 substances on his stable premises. Mr Marzol was fined the sum of $200. Mr Marzol pleaded guilty to a further charge under AR178F(1) in that during the same visit, he was found to have failed to keep updated records of treatments and medications administered to horses in his care. Mr Marzol was fined $200. Stewards also inquired into the circumstances that Bish N Borg, being trained by Mr J Marzol, had to be euthanised following a trackwork incident at Moruya Racecourse on Wednesday 23 December On the evidence it was established that the gelding, which had been unruly, and had had a history of demonstrating similar behaviour in the past, dislodged its rider and broke through the running rail and sustained injuries for which it had to be euthanised. General: The following apprentice riders were each fined the sum of $50 under LR68 for failing to produce letters of authorities from their masters: J Innes, N Heywood, Ms K Nisbet and Ms J Brookes. Supplementary Report: Nowra 11 January 2016 Race 4: My Travel Expert Nowra Class 1 Handicap 1400m In the days subsequent to the uncompetitive performance of Princess Kashema in the above-mentioned race, trainer Mr R Price provided the results of a veterinary check conducted by his stable veterinarian which revealed the filly to be mildly lame in front. Mr Price also provided his stable treatment and medications records which displayed no veterinary issues or treatments provided to the mare at all relevant times leading into the above-mentioned race. Trainer Mr Price advised that it was now his intention to give the filly a let-up. Mr Price was told that he would be required to provide a veterinary clearance prior to the filly also being required to barrier trial to the Stewards satisfaction prior to being permitted to race again.

2 RACE 1: Stonefish Wines Maiden Handicap 1200m Cabaret Prince A pre-race veterinary examination of the gelding which had hair loss across its back due to rain scald, cleared the gelding fit to start. Dr Henleigh Trainer Mr T Robinson was fined the sum of $50 under LR35 for the late declaration of app A Williams as the rider of the gelding. Contacted on jumping by Moonlit Cloud which shifted out. Dance Harder Son Slow to begin. Minaret Slow to begin. Kalaru Girl Slow to begin. Ariake Fire Slow to begin and obliged to race wide throughout. The Arod Got its head up when inclined to over-race passing the 1000m. Greenback Boogie Raced wide throughout. Following the race rider app J Devrimol sought the attention of the Club s ambulance officers due to feeling unwell because of the effects of wasting. After being monitored by the ambulance officers and undergoing a further assessment, app Devrimol was subsequently cleared to fulfil his remaining riding engagement in Race 6. Dance Harder Son Raced wide throughout. Rose Affair Held up rounding the home turn. Passing the 300m was disappointed for a run between Dance Harder Sun and Moonlit Cloud. After the 200m was eased when tightened by Dance Harder Sun which shifted out slightly. Myint Slow to begin. Held up for clear running from the 300m until passing the 150m when, after being crowded between Grizabella and Caption which shifted in slightly, the filly was shifted to the inside of Grizabella to continue into clear running. RACE 2: Waterfront Hotel Maiden Plate 1010m Rosaruby The filly, which had a minor healing laceration to its off-hind leg, was examined by the Club s veterinary officer and passed fit to race. Little Bit Trashy Slow to begin (2L) and then slow into stride. Lucky s Lil Girl Raced wide throughout. Redominanced When questioned regarding the performance of the mare which was on debut, rider app Ms K Nisbet stated that her mount travelled well in the early and middle stages, however blundered rounding the home turn and again near the 150m, and shortly after straightening did not respond to her riding and gave ground inside the final 200m. A post-race veterinary examination of the mare did not reveal any abnormality. Trainer Mr L

3 Pepper stated that when the mare returned to scale he had observed that the mare had got its tongue back which he suggested she may have done so in the race and he advised that he would apply a tongue-tie at the mare s next race start. Mr Pepper also undertook to report any condition which may become apparent in the days subsequent. RACE 3: Alan May Holden Autogroup Benchmark 60 Handicap 1010m Jayko Slow to begin. Lighthouse A little slow to begin. Passing the 200m had to be restrained between Jayko which was laying in and Hawaiian Heart (app B Ryan) which shifted out way from Yarragee Road which shifted out. In all circumstances app Ryan was advised to exercise more care and told that he should initially have attempted to correct his mount. Yarragee Road Was eased over the concluding stages due to narrowing running between Sticky Danish and Hawaiian Heart. Mr Burns Held up for clear running until passing the 200m where, when held up, it had to be restrained from the heels of Yarragee Road and shifted in, and passing the 150m was steadied when held up on the heels of Sticky Danish and shifted in to obtain clear running. Held up again held up over the final 50m and was largely untested in the straight. RACE 4: Nicholson s Tyres Dunlop Super Dealer Benchmark 59 Handicap 2000m Fastnet Flyer Slow to begin. Held up for clear running in the early part of the straight. She s Back Over-raced for some distance after passing the winning post on the first occasion. Standoubt When questioned regarding the performance of the gelding, rider B Ward stated that his mount travelled well until the home turn, however at this point his mount did not respond to his riding and proved disappointing in the straight. A post-race veterinary examination of the gelding did not reveal any abnormality. Trainer Mr N Olive could offer no tangible explanation for today s performance. Shoulder Charge When questioned, rider N Perryman stated that after passing the winning post on the first occasion, his mount commenced to over-race and after entering the back straight and from the 1400m, the gelding hung out badly. He added that when the gelding continued to hang with him rounding the home turn he was unable to place his mount under pressure nor use the whip as he was concerned that his mount may run out badly and as a consequence, whilst the gelding was nevertheless under pressure shortly after straightening, he was unable to test the gelding. A post-race veterinary examination of the gelding did not reveal any abnormality. Trainer Mr C Pearson advised that in his view, when the gelding was inclined to over-race it may have got its tongue over the bit and he would experiment with a bit-lifter. Mr Pearson further advised that he was confident of the gelding s prospects today and had advised the owner of the same. After considering the evidence and betting support for the gelding, Stewards accepted the evidence of N Perryman in respect to the racing manners of Shoulder Charge. Trainer Mr C Pearson was

4 told that the gelding would be required to barrier trial to the Stewards satisfaction prior to being permitted to race again. Four Fortyfour Rider J Kissick reported that his mount felt uncomfortable in its action throughout the event and upon pulling up had realised that his mount had gone amiss. A post-race veterinary examination revealed the gelding to be lame in its off-foreleg. On Mr Law s assurance that the gelding would now be retired from racing, no further action was required. RACE 5: Brian Pop Williams Class 2 Plate 1200m Perash Trainer Ms L Dean was fined the sum of $50 under AR140A for presenting the gelding in the mounting enclosure with blinkers which were not part of the gelding s approved racing gear. Winterland Slow to begin. Raced keenly and wide throughout. Canny Palance Slow to begin. Bill N Eve Momentarily got a leg up on the running board prior to the start being effected. When questioned, rider M Cahill stated that his mount was slow to begin, never travelled at any stage of the event and was most disappointing. A post-race veterinary examination of the gelding revealed no abnormality. Trainer Mr J Marzol advised that it was his intention to now have the gelding subjected to an endoscopic examination, the results of which he undertook to report to Stewards. RACE 6: Mitre 10 Ulladulla And Moruya Moruya Town Plate 1300m Abishadow Slow to begin. Hill Spy Slow to begin. Over-raced in the middle stages. Twisted Miller Raced wide throughout. Deb s Hope Over-raced in the middle stages. Fire And Flood Over-raced in the middle stages. Hello Schumann Laid in in the straight. Chasing Charlie When questioned regarding her tactics, rider app C Frater advised that her instructions were to lead and further to maintain her lead prior to placing her mount under pressure. She added that her mount, which had had blinkers re-applied today, raced keenly during the middle stages after finding the lead and whilst she was aware that her mount was travelling at a solid tempo she had been told not to overly restrain her mount during the run as it had previously choked down. She added that bearing in mind her instructions, she allowed her mount to commence to stride along from the 550m. Co-trainer Mr P Jones confirmed the general nature of the instructions however advised that his instructions were not for the gelding to be pressured as early as it had been and he would have preferred

5 Chasing Charlie be held up longer before being asked for an effort. App Frater was told that in the view of the Stewards she should have ridden the gelding more conservatively prior to and rounding the home turn. RACE 7: North Ryde RSL Moruya Cup 1650m Imminent On return to scale rider M Travers reported that his mount hung out badly throughout the event and as a consequence he was unable to test the mare. A post-race veterinary examination of the mare did not reveal any abnormality. Trainer Mr M Stephens advised that he would have his equine chiropractor complete an assessment of the mare in the days subsequent and also have his stable veterinarian complete a veterinary full veterinary examination of the mare. Mr Stephens was told that Imminent would be required to barrier trial to the Stewards satisfaction prior to being permitted to race again. Hot Ruby When questioned, rider app N Heywood stated that his mount travelled well in the early to middles stages of the event however was under pressure from the 800m and did not respond to his riding in the straight. A post-race veterinary examination revealed the mare to be lame in its off-hind leg. Trainer Mr B Cox advised that he would now send the mare for a spell, and would barrier trial the mare prior to her resuming racing. RACE 8: Moruya Golf Club Class 3 Handicap 1425m We Are Young Was a late withdrawal at 8:20am when found to be lame in its near fore foot. Chief In Command Slow to begin. Laid in in the straight. Damysus Slow to begin. Cape Henry Slow to begin. Cos Can t Wait Laid in in the straight. War Prodigy Slow to begin. When questioned, rider G Buckley stated that his mount raced flat today and was disappointing. A post-race veterinary examination of the colt did not reveal any abnormality. Darbalara When questioned, rider B Ward stated that his mount was unusually relaxed today, never travelled well at any stage, gave ground from the 600m and was uncompetitive. A post-race veterinary examination of the gelding did not reveal any abnormality. Trainer Mr M Miladinovic was told that the gelding, which was beaten 48.9L would be required to barrier trial to the Stewards satisfaction prior to being permitted to race again. Captain Haddock A post-race veterinary examination revealed the gelding to be lame in its off-hind leg. Trainer Mr S Vella was advised that he would be required to provide a veterinary clearance prior to the gelding being permitted to race again.
