The manual does not authorze the use o any SERE techn ues as approved ntellgence nterrogaton technques. The US () also conrmed ther ntenton to amend DoD Drectve , "DoD ntellgence nterrogatons, Detanee Brengs, and Tactcal Questonng," wth the same prohbt n. (U) The revsed DoD Drectve was ssued on October 9,2008, and ncluded the ollowng requrement: Survval Evason Resstance and Esca e Techn ues. Use o SERE technques aganst a person n the custody or eectve control o the Department o Deense or detaned n a DoD aclty prohbted. (U) U.S. Jont Forces Command. T e Commander, USJFCOM, ssued a Personnel Recovery Memorandum to hghlght p lcy gudance prohbtng the use o SERE technques or nterrogatons and to re pond to the OG report, "Revew o DoD-Drected nvestgatons o Detanee Abuse" (Se Appendx A). The June 17, 2009, Memorandum or the Servces and the U.S. Specal peratons Command speccally states that the "SERE technques or nterrogatons 0 personnel n DoD custody or control s prohbted. " (U) Scope and Methodol gy (U) We conducted ths eld vercat n rom June 19,2009 through September 18, 2009 n accordance wth Councl o the ns ctors General on ntegrty and Ecency Qualty Standards or nspectons. Those stan ards requre that we plan and perorm the nspecton to obtan sucent approp ate evdence to provde a reasonable bass or our ndngs and conclusons based on our nspecton objectves. We lmted our scope to DoD Level C SERE tranng and cond cted on-ste nspectons o sx schools and the Personnel Recovery Academy. (U) Background (U) The Tranng Envronment. CoC Level C tranng s the most challeng g and, n order to enhance student learnng, requres hghly traned SERE nstruct rs who use physcal and psychologcal pressures. As stated n DoD nstructon "Code o Conduct (CoC) Tranng and Educaton," January 8, 2001, the Secretares oth Mltary Departments are requred to develop and establsh a Level C tranng program or personnel whose jobs ental a sgncant or hgh rsk o beng solated behnd enemy r es as an evader or a captve and who are vulnerable to greater-than-average ex lotaton by a captor. Level C SERE tranng ncludes a smulated prsoner o war aptvty stuaton desgned to create a seres o dlemmas n a dynamc, yet cantrolle, tranng envronment. 3

13 (U) CoC and SERE tranng are a o o combat tranng that uses "controlled realsm" to conront students wth actual deten on and nterrogaton experences that requre them to apply survval and resstance prne pes, procedures, and technques. Speccally, resstance to nterrogaton tranng n ludes all the tools and technques used to deend aganst a captor's explotaton plan. (U/r'OUO Resstance tranng expo es each student to the captvty envronment and nterrogaton approaches that they m encounter n a hostle stuaton. n order to enhance tranng, SERE nstructors u e technques that are desgned to realstcally project students' ocus nto the tran g scenaro. The ntent s to smulate harsh condtons assocated wth the captv envrorunent and assocated captor explotaton eorts. The applcaton o physcal p essure enhances the correct psychologcal projecton students requre and better repares them to respond avorably to stressul events. By ntroducng eectve cop g sklls beore 'real le' exposure, stress noculaton tranng prepares ndvdu s to respond more avorably to hgh stress events. "Controlled realsm" pressures allow reasonable means to tran or the most challengng captvty envronment where captors 0 not abde by the Geneva Conventon. (U) The physcal and psychologcal p essures developed or CoC and SERE tranng were not ntended or real-world nte ogatons. ntellgence resstance tranng does not qualy a SERE Specalst nstructor t conduct nterrogatons or provde subject matter expertse to those who are traned n t at specalty. At the concluson o tranng, SERE students must undergo a debremg/se nar sesson to clary ther resstance tranng experence; even then they are only e posed to the detals that apply to the learnng process., - (U) Actons Taken CU) The USD() amended DoD Drec ve , "DoD ntellgence nterrogatons, Detanee Brengs, and Tactcal Que onng," to nclude a prohbton on the use o SERE technques aganst a person n t e custody or eectve control othe Department o Deense. 14 (U) Feld Vercaton (U) To determne USJFCOM gud ce was mplemented, we vsted the sx Level C SERE schools and the Personnel Re overy Academy to observe the relevant tranng classes. (U) The Tranng Facltes. The JP only has drect cognzance over the Personnel Recovery Academy. The Secretare o the Mltary Departments are responsble or the CoC tranng at the remanng sx Le el C SERE schools (See Table 1). The Mltary Departments are requred to manta energetc, unorm, and contnung tranng programs or personnel at derent vels. The advanced Level C tranng must provde personnel consstency n all DoD Co and SERE-related educaton and tranng based on Combatant Command-establshed re urements and Executve Agent-establshed jont SERE tranng standards. The SERE tranng program dstngushes etween resstance tranng and nterrogaton operatons. (U) Wthout excepton, the sx Level SERE Schools and the Personnel Recovery Academy ncluded the prohbton as art o the mandatory endo-course revew (See Table 2). (U) DoD nstructon , "Code o Conduct Tranng and Educaton," January 8, 2001, provdes gudance to develop d execute CoC tranng or U.S. personnel The JPRA employs the Executve A ent nstructons as the gudance document used to certy and evaluate CaC related tra ng throughout the DoD. The two JPRA Executve Agent nstructons, "Requrements:6 r Wartme Level C Tranng n Support o the Code o Conduct" and "Requrements or eacetme Level C Tranng n Support o the Code o Conduct" establsh the mnmum ERE tranng outcomes or hgh-rsk-o-capture personnel. The Level C tranng pro ams must enable graduates to acheve the termnal learnng objectves. The specc en lng learnng objectves and content requrements are desgned to ensure unormty, co sstency, and adequacy o tranng as dened n governng drectves. However, the RA has not yet revsed these nstructons to nclude the prohbton. Not only s e revson needed to nsttutonalze the prohbton, but also to ensure contnued compl ce throughout the oversght and evaluaton process. (U) We recommend that the Drect r, Deense Prsoner o War /Mssng Personnel Oce: (U) ncorporate gudance n rat DoD nstructon , that SERE tactcs, technques, and proc dures are not to be used or operatonal nterrogaton o detanees un ess speccally permtted by DoD Drectve or the law.
