The design change prcess requires judgement and a gd understanding f the applicable Civil Aviatin Rules. The licensed aircraft maintenance engineer is required t use experience, training, and familiarity with the Rules t cmplete the varius activities invlved. The CAA, hlders f inspectin authrisatins and Part 146 certificated design rganisatins are thers wh may play a part in the prcess and be called upn fr assistance. 5 Advisry Circular AC43-9 Revisin 3 Sectin A General General Part 43 prvides fr general maintenance f an aircraft and includes the means t embdy a design change t an aircraft. Hwever, it is imprtant t differentiate between a design change t an aircraft and maintenance which ensures the cntinued airwrthiness f an aircraft. Rule Part 1 defines a design change as a change t the type design. In ther wrds, has the aircraft r cmpnent changed frm hw it left the factry r frm hw the riginal manufacturer designed it? Fr example, the additin f a skin dubler repair patch r the replacement f a GPS unit with a newer mdel are design changes. Maintenance is ensuring the aircraft r cmpnent stays airwrthy as designed. Fr example, replacing a faulty piece f equipment with an identical, airwrthy cmpnent r carrying ut rutine inspectins, are maintenance activities. The first questin t ask is whether r nt the wrk being perfrmed is a design change r simply maintenance? Part 43 Maintenance Embdiment f a Design Change Type Certificate change Supplemental Type Certificate Mdificatin Repair using acceptable technical data OR Maintenance Ensuring cntinuing airwrthiness using acceptable methds, techniques, and practices. Figure 1: Initial decisin prcess fr a design change As mentined abve, Part 43 prvides fr the practical applicatin f design changes in the aircraft maintenance envirnment. It is Part 21 that prvides the certificatin basis and the prcedures that enable design changes t be apprved. Aircraft and ther type certificated prducts can be changed in a number f ways: Changes t a type certificate. These are design changes that are prpsed by the type certificate hlder. Part 21 Subpart D prvides the prcess and criteria fr changes t a type certificate. This type f design change is typically issued as a Service Bulletin. Supplemental type certificates (STC). These are design changes that are (usually but nt always) develped by sme-ne ther than the type certificate hlder. Supplemental type certificates can be prpsed by anyne and wuld typically include thse prpsals that frm a kit t be sld fr incrpratin by third parties int a type certificated prduct. Part 21 Subpart E prvides the requirements fr apprval f an STC, including the respnsibilities f an STC hlder. Repairs. These are a design change required t rectify a discrepancy, usually n an individual aircraft, and ften structural. A repair, while resulting in a change t the type design, is intended t restre the prduct t the same peratinal capability as befre. Fr example by the additin f a skin dubler and fasteners t restre strength t a cracked panel, r by a bush in a wrn bearing cmpnent. Part 21 Subpart M states that repairs are 11 Nvember CAA f NZ

6 Advisry Circular AC43-9 Revisin 3 t be treated as design changes and apprved in accrdance with Part 21 Subparts C, D and E. Mdificatins. These are design changes that are nt changes t type certificates nr supplemental type certificates. (Althugh the term mdificatin is ften used generally by industry t describe any design change.) Like repairs, mdificatins are nrmally individual changes, althugh under specific cnditins mdificatins can be duplicated n aircraft f identical make, mdel and mdified cnfiguratin. Mdificatins are apprved by apprving the technical data in accrdance with Part 21 Subpart N. This advisry circular cvers the apprval prcess fr mdificatins and repairs nly. Fr STCs, refer t advisry circular AC Fr changes t a type certificate, cnsult the CAA Aircraft Certificatin Unit. Mdificatin and Repair Prcess There are tw imprtant aspects t carrying ut a design change n an aircraft. Firstly the technical data used t manufacture and install the change must be acceptable and secndly, the effect f the mdificatin must be classified (i.e. majr r nt). 7 Advisry Circular AC43-9 Revisin 3 Acceptable Technical Data? Rule requires that technical data be used nly if it is apprved, r is acceptable t the Directr. If the mdificatin r repair is nt defined by apprved r acceptable technical data then, referring t Figure 2, t prceed with the embdiment f the mdificatin, apprval f the data is first required. The apprval f technical data in accrdance with Part 21 Subpart N may be dne by the Directr r an aircraft Part 146 certificated design rganisatin wh emplys a senir persn hlding a delegatin frm the Directr t apprve mdificatins and repairs. Acceptable technical data and the technical data apprval prcess are discussed further in Sectin B. Is the mdificatin r repair majr? The embdiment f the design change must then be assessed fr the pssible effect f a failure. This is dne using the criteria given in the definitin f a majr mdificatin r repair. The assessment is made using the experience and judgement f the licenced aircraft maintenance engineer invlved. Cnsideratin shuld be given t the type f mdificatin, the difficulty f applicatin, the likelihd f an errr being intrduced, and ther safety implicatins. Referring t Figure 2, when the mdificatin is determined t be majr, an IA r a persn authrised by a Part 145 certificated maintenance rganisatin, will have t be cnsulted and used t certify cnfrmity f the majr mdificatin t the acceptable technical data. Sectin C prvides further guidance n the definitin f a majr mdificatin r repair. Frm 337: Apprval f Data / Cnfrmity Certificate Referring t Figure 2, there are tw separate purpses fr which the frm CAA 337 is required. Firstly, Part 21 specifies the use f the frm CAA 337 fr the apprval f technical data. Secndly, Part 43 Subpart E specifies the use f the frm CAA 337 t recrd the check f a majr mdificatin fr cnfrmity with the acceptable technical data. Once the cnfrmity inspectin and the frm CAA 337 have been cmpleted, the CAA 337 frm must be included in the aircraft maintenance recrds. The frm CAA 337 prvides sufficient detail t maintenance persns and the IA when assessing the cntinuing airwrthiness f the airframe, engines, prpellers, rtrs, and ther equipment. This advisry circular examines the frm CAA 337 in particular but the requirements shuld be read acrss t thse Part 145 certificated maintenance r Part 146 certificated design rganisatins using ther frms, fr cnfrmity r apprval respectively. 8 Advisry Circular AC43-9 Revisin 3 Sectin B Technical Data General Fr any design change, there must be technical data which cmpletely defines the design change. This enables it t be manufactured and installed n an aircraft, and t be used fr cnfrmity fr any design change classified as a majr mdificatin r majr repair. Rule (a) requires that technical data shall nly be used if it is apprved r acceptable t the Directr. Acceptable Technical data Part 21 Appendix D lists technical data which the Directr has fund t be acceptable fr use in New Zealand. This list basically includes: technical data that has been apprved by the Directr technical data that ther peple have apprved and that the Directr has fund acceptable t use technical data that the Directr has reviewed and fund acceptable t use T have smething apprved and t have smething accepted bth require the presentatin f that data t the Directr. The bvius difference is that the Civil Aviatin Rules has defined apprved t mean apprved in writing by the Directr unless used with reference t anther persn. Part 21 Appendix D places cnditins n the use f acceptable data that include the data must be apprpriate t the prduct, cmpnent, r appliance, and directly applicable t the wrk being carried ut fr a freign supplemental type certificate r supplemental type apprval the data must nt intrduce a cmplete new flight manual (because the flight manual is referenced n the airwrthiness certificate) nt re-designate the aircraft type (because the Directr wuld need t amend the Aircraft Register and the aircraft dcuments wuld need t be re-issued) reference the particular freign type certificate accepted by the Directr. (This is t ensure the same certificatin basis was used fr apprval f the STC. This als means having the same certificatin categry. eg an STC apprved in the restricted categry wuld nt be acceptable technical data fr an aircraft which had been type accepted in the standard categry.) NOTE: STCs which d nt meet the abve cnditins, r which are frm a cuntry nt listed in Appendix D, may still be eligible fr acceptance under rule (a). An applicatin shuld be made t the Directr fr review and acceptance f the data. The installer has the written permissin f the supplemental type certificate r apprval hlder. (S that the hlder can cntact the installer n matters f cntinuing airwrthiness) The data prvided by the manufacturer f a cmpnent must nt cnflict with data prvided by the manufacturer f the prduct r assembly f which the cmpnent is t frm a part Acceptable technical data is nt necessarily in a frm that is able t be used immediately. Fr example, AC43-12 states that the use f nn-aernautical lead acid batteries is acceptable. This des nt say that the installatin f nn-aernautical lead acid batteries is apprved in all aircraft. Fr the particular installatin the technical data describing the actual installatin wuld require apprval as a design change. 11 Nvember CAA f NZ

9 Advisry Circular AC43-9 Revisin 3 Anther example f inapprpriate use f acceptable technical data is the installatin f electrical equipment where that equipment has the pssibility f verlading the aircraft electrical system. Fr all design changes which result in a change in electrical lad, an Electrical Lad Analysis (ELA) shuld be cnducted t verify the aircraft s electrical system can cpe. It may nly take an additinal 1amp lad t invalidate an aircraft s emergency battery time. This is ften frgtten but is just as imprtant as checking fr weight and balance effects. Nte: This includes data prvided by the manufacturer f a cmpnent f a prduct where that cmpnent is a part f the apprved type design f the prduct. AC B, issued by the United States f America Federal Aviatin Administratin data included in, and specific t the categry f, an airwrthiness certificate data that has been accepted by the Directr under rule (a) by issue f a letter f acceptance e.g. EASA supplemental type certificates which have been individually accepted by the Directr. data that has been accepted by the Directr under rule (a) by issue f ntice given in a type acceptance reprt e.g. acceptance f EASA & FAA STCs fr the Bell 429 series when the type acceptance is based n a Transprt Canada Type Certificate. A similar ntice is listed in the AS350 type acceptance reprt. 10 Advisry Circular AC43-9 Revisin 3 As a general rule, the test as t whether any technical data issued by a manufacturer is cvered by this list is whether it has been apprved. Fr example a signed and apprved drawing wuld be cnsidered part f the apprved type design, as wuld a frmal mdificatin bulletin. Hwever a letter frm their sales supprt department saying it is a gd idea, wuld nt. Neither wuld a letter frm their design ffice stating that the ffice had n bjectin t the technical change. Apprval f Technical Data Mdificatin r repair data may be develped by any persn. Hwever, as the data must still be reviewed and apprved by either the Directr r a Part 146 certificated design rganisatin, the develper shuld cnsult with the apprving rganisatin at an early stage t ensure the data will be suitable fr apprval and use. Fr ther than very basic mdificatins r repairs, it is recmmended that a Part 146 certificated design rganisatin shuld be cntracted t develp, shw cmpliance and apprve the technical data based upn the custmer s requirements. Nte: The Directr will nly accept applicatins t apprve technical data fr minr mdificatins r repairs which d nt require any flight testing r cmpliance inspectins, and fr which the dcumentatin is cmplete. Fr all applicatins, a minimum applicatin perid f 60 days will apply prir t the CAA reviewing the applicatin. Alternatively, the applicant can seek a Part 146 certificated design rganisatin fr the review and apprval f the technical data. Develpment f data As the mdificatin is develped the assembled technical data frms the mdificatin r repair package. This package includes descriptive data, cmpliance data, perating and maintenance data and any ther data needed t supprt the embdiment f the mdificatin. Descriptive data, such as manufacturing drawings and installatin instructins, is required t be sufficient fr the manufacture f parts and the embdiment f the mdificatin. If the mdificatin/repair is limited t a single installatin the descriptive data may be less frmal but must still cmpletely define the design change (fr example by marked-up phtgraphs). Cmpliance data, such as engineering reprts, lad analyses and testing results, refers t data that shws the design change is cmpliant with the applicable airwrthiness design standards. This data is generally prepared by the Part 146 certificated design rganisatin. Operating data, such as flight manual supplements, weight and balance changes, and Instructins fr cntinued airwrthiness, is required t ensure the safe peratin f the prduct with the design change embdied. This reinfrces the fact that the technical data itself is apprved, nt the embdiment f that 11 Nvember CAA f NZ

11 Advisry Circular AC43-9 Revisin 3 mdificatin/repair. The embdiment f the mdificatin/repair relies n acceptable techniques, methds, and practices in accrdance with Part 43. In mst cases apprvals will be fr a single installatin in a prduct. Hwever, an apprval may be granted which allws duplicatin f the mdificatin/repair n ther identical aircraft makes and mdels prviding it is nt majr and the data presented with the frm CAA 337 is in sufficient detail t ensure accurate and repeatable installatin. Fr the apprval f a majr design change r fr acceptance by a freign regulatry authrity, a Supplemental Type Certificate (STC) wuld generally be necessary. Part 21 Subpart E and AC21-8 cver STCs in mre detail. Apprval will be based upn the mdificatin package meeting the applicable airwrthiness requirements. Part 21 requires cmpliance with these standards, and ther airwrthiness requirements, t be indicated by a statement f cmpliance issued by a Part 146 certificated design rganisatin r the Directr. The apprving persn will cnsider all aspects f the prpsal s design, its applicatin, and its pssible effects. A persn apprving a design may indicate n the frm CAA 337, in their pinin, whether the mdificatin r repair is classified as a majr mdificatin, r repair, r nt. Prprietary infrmatin T what extent is the technical data available after it is apprved? The actual apprval certificate f a mdificatin is publicly available infrmatin because it is an aviatin dcument defined by the Civil Aviatin Act Persns submitting technical data n the frm CAA 337 shuld ensure that infrmatin they cnsider t be cmmercially sensitive is nly listed n and attached t, rather than entered n, the frm CAA 337. Fr any mdificatin r repair which has been apprved fr multiple installatins, the frm CAA 337 standard wrding requires the installer t have the permissin f the wner f the design apprval. Figure 4 shws the relatinship between prprietary infrmatin and public infrmatin. If the technical data used was apprved n a frm CAA 337, it shuld be included in the maintenance recrds t indicate that the previusly unapprved data has been apprved. The persn perfrming the mdificatin is primarily respnsible fr making the determinatin f whether the mdificatin r repair is majr r nt. If the mdificatin r repair is cnsidered t be majr, r the persn embdying the mdificatin is in anyway unsure, an IA shuld be cnsulted and will be required t certify cnfrmity f the mdificatin/repair t the applicable technical data. This assessment relies upn the experience, training, and familiarity f the licensed aircraft maintenance engineer with the tasks invlved t determine if the mdificatin r repair is majr r nt. Appendix A t this advisry circular prvides examples f mdificatins that may be cnsidered t be majr, and is useful fr judging whether t cnsult an IA. 11 Nvember CAA f NZ

14 Advisry Circular AC43-9 Revisin 3 Sectin D The Frm CAA 337; Instructins fr Use General The frm CAA 337 serves t track the mdificatin r repair prcess frm cnceptin t embdiment. The frm CAA 337 can recrd bth technical data apprval and cnfrmity certificatin. The frm shuld be raised when n acceptable technical data exists, r when the use f that data cnstitutes a Majr mdificatin/repair. The frm CAA 337 prvides wners and peratrs with a recrd indicating details and apprval f majr mdificatins and majr repairs and prvides the CAA with a cpy f the details and apprval fr the aircraft recrds. Part 43 Subpart E requires that majr mdificatins and majr repairs be certified fr cnfrmity by an IA r a persn authrised by a Part Nvember CAA f NZ

The IA shuld determine the airwrthiness f the prduct by inspecting majr repairs r majr mdificatins fr cnfrmity t the applicable technical data and cmpatibility with previus repairs r mdificatins made t the aircraft. As part f this task, the IA shuld ensure that the applicable technical data is apprved r acceptable. Each term referred t abve describes a different aspect f the mdificatin prcess. Prcess The persn wishing t perfrm a mdificatin r repair shuld determine if acceptable data is available prir t cmmencement f the wrk. If there is n acceptable data, r the acceptable data is nt applicable t the wrk being carried ut, a frm CAA 337 will need t be raised t apprve the technical data. The descriptive, cmpliance, and ther data may be entered n, r preferably cntained in ther dcuments which are referenced n the frm CAA 337. The technical data and the frm CAA 337 apprval certificate cmprise the mdificatin package r repair scheme. The data must be apprved by the Directr r a senir persn emplyed by a Part 146 certificated design rganisatin delegated the pwer t apprve design changes. An IA cannt apprve data. The apprving persn will assess the cntent f the mdificatin package and, depending n the requirements f the riginatr and the detail f the package, apprve the technical data fr embdiment n ne r mre aircraft. The apprving persn may als suggest whether the mdificatin r repair cnstitutes a majr mdificatin r majr repair. Sectin B f this advisry circular prvides an verview f the apprval f technical data. Once the technical data has been apprved, the persn wh is authrising the mdificatin/repair fr release t service shuld determine whether the wrk is majr r nt. Sectin C f this advisry circular prvides mre guidance n this determinatin. In this case ne frm may be used fr bth purpses and all blcks will be cmpleted. It is imprtant that the technical data describing the design change is apprved first t ensure it becmes acceptable technical data. Nte: When a majr mdificatin/repair is made t a cmpnent nt fitted t the aircraft, the serial number and registratin sectins f this blck will be left blank. List the acceptable technical data t be used as the basis fr certifying the mdificatin/repair, including the revisin number r date. Fr example, the reference simply t FAA AC B is insufficient whereas the reference t a specific sectin and paragraph r figure number enables the clear identificatin f the wrk cmpleted. The descriptin shuld state the lcatin f the mdificatin r repair, relative t the aircraft r cmpnent.
