At the December 5, 2016 Regular Meeting, Cuncil reslved, "That staff reprt back with infrmatin n emissins as a result f idling cars, and n any steps taken t create a plicy n drive-thrugh facilities in Delta including plling ther municipalities n what plicies they have." Previusly, n March 8, 2010, Cuncil discussed drive-thrugh restaurants at a Cuncil Wrkshp titled "Drive-Thrugh Restaurants & Their Envirnmental Impact". Fllwing this wrkshp, Cuncil pted t cnsider specific mentin f drive-thrughs and recmmended lcatin criteria in a review f the zning bylaw. See Attachment 'A' fr summary ntes f the March 8, 2010 Cuncil Wr~shp. Althugh Delta Zning Bylaw N. 2750, 1977 des nt cntemplate drive-thrugh businesses, it des define a 'Restaurant, Drive-in' as "The use f land, buildings and structures fr the sale f fd t be cnsumed either inside the building, in a vehicle parked n the premises, r elsewhere." The frthcming zning bylaw will clarify the definitin t specifically reference 'drive-thrugh', and fr the purpses f this memrandum the tw terms are treated the same. Drive-thrugh businesses in Delta In recent years, the number f drive-thrugh businesses in Delta has remained relatively stable with ne being added since Currently, there are 15 businesses in Delta with drive-thrugh facilities: nine restaurants r cffee shps, three banks, tw liqur stres, and ne cleaner. Drive-in restaurants in Delta are permitted n prperties zned as Service Cmmercial an'd there are n specific restrictins related t ther

When drive-in restaurants adjin mst residential znes r a persnal care zne, a fence f 1.8 metres in height is required where the znes adjin and the required setbacks fr the restaurant are 6 metres n all sides except the side n a flanking street. When the restaurant des nt adjin these znes, the fence requirement des nt apply, the frnt setback is 6 metres, and all ther setbacks are 3 metres. F I. f Other Municipalities in Metr Vancuver Staff reviewed ther Metr Vancuver municipalities' regulatins related t drive-thrugh businesses (Attachment 'B'). Municipalities that specifically regulate drive-thrugh businesses in general, r drivethrugh restaurants in particular, d s thrugh their zning bylaws. One municipality, New Westminster, has restricted all drive-thrugh businesses since 2012, while all ther municipalities that specifically cnsider drive-thrugh businesses allw the businesses t perate within certain guidelines. Similar t Delta's drive-in restaurant regulatins, mst municipalities in Metr Vancuver regulate drive-thrugh businesses by restricting.them t certain znes and requiring setbacks, typically between 4.5 metres and 7.5 metres. Sme municipalities require landscaping t separate streets r residential prperties frm drive-thrugh businesses. Sme municipalities als have additinal requirements fr drive-thrugh businesses n sites that adjin residential prperties, such as: Lcating drive-thrugh services and vehicle lanes as far frm adjacent residential develpment as pssible, separated by pen space r landscaping Separating audible cmmunicatin equipment frm the residential prperty by distance r a physical barrier Lcating a building between the drive-thrugh and the lt line f. the residential prperty Jurisdictins beynd Metr Vancuver Beynd Metr Vancuver, the issue f drive-thrugh businesses has been well-analyzed, particularly in Ontari. Sme municipalities in Ontari have full plicies', sets f guidelines, r ther details related t drive-thrugh businesses that g well beynd the basic regulatins

While many guidelines make sense fr sme municipalities, strict plicies can restrict Cuncil's ability t judge each ptential drive-thrugh business n its wn merits based n its lcatin and benefit t the cmmunity. Envirnmental and Scial Cnsideratins Drive-thrugh businesses ften elicit cncerns regarding envirnmental impact. Idling vehicles are significant generatrs f carbn dixide, the main greenhuse gas linked t climate change. Accrding t Natural Resurces Canada, carbn dixide emissins culd be reduced by 1.4 millin tnnes annually if Canadian drivers avided idling fr three minutes each day f the year. This wuld be the equivalent f remving 320,000 cars frm the rad fr the entire year. As a practical guideline, Natural Resurces Canada recmmends turning the car ff if it will be stpped fr mre than 60 secnds, althugh idling fr mre than 10 secnds uses mre fuel and prduces mre carbn dixide than restarting the engine. Drive-thrugh businesses result in idling vehicles and therefre carbn dixide emissins are significantly higher at a drive-thrugh business than a cmparable nn-drive-thrugh business with adequate parking. Drive-thrugh businesses ffer scial benefits t peple with disabilities, senirs, and sme families with children. Aviding the need t exit the vehicle t access services ffered by a drive-thrugh business can allw peple t cntinue living independently and t mre easily g abut their daily lives. Drive-thrugh businesses therefre can supprt an imprtant segment f the ppulatin that might therwise be unable t access sme f the services prvided by businesses in their cmmunity. Next Steps Currently, Delta's regulatins related t drive-in restaurants cmpare well with ther Metr Vancuver municipalities. Rather than restricting Cuncil's decisin making prcess thrugh a prescriptive plicy related t drive-thrugh businesses, staff recmmend maintaining the existing case - by ~ case apprach, being mindful f residential prperties adjacent t prpsed drive-thrugh businesses as new applicatins fr drivethrugh businesses arise.

There is limited scientific infrmatin n the envirnmental impacts f vehicle idling assciated with drive-thrughs. Vehicle emissins assciated with drive-thrugh uses are difficult t assess and distinguish frm emissins frm ther types f vehicle idling, particularly as drive-thrughs tend t be lcated alng heavy travel crridrs. The Delta Zning Bylaw is utdated and des nt define drivethrughs specifically in relatin t any f the standard cmmercial. znes. In recent years drive-thrughs have been explicitly. allwed r prhibited in certain Cmprehensive Develpment (CD) znes.. Several ther municipalities have explred regulating drivethrughs, but nly ne municipality (Cmx) has adpted a bylaw. The Cmx bylaw restricts the lcatin f drive-thrughs t arterial cmmercial znes and requires that the buildings be LEED certified. Restaurants tend t encurage drive-thrugh use by ffering faster service t drive-thrugh custmers. Larger chains such as McDnald's are expanding drive-thrugh facilities. An applicatin fr McDnald's n 120 Street will be brught frward fr Cuncil cnsideratin in the cming weeks. A similar applicatin fr McDnald's n Harvest Drive was recently apprved. Several members f Cuncil cmmented n traffic issues that culd result frm queuing vehicles. The Tim Hrtn's at Mathews

Queuing vehicles spill ut nt the highway causing traffic and safety cncerns. There was cncern that banning new drive-thrughs in Delta wuld cause them t lcate in Surrey r elsewhere in the regin, wuld nt curb vehicle emissins, and wuld create an unlevel playing "field fr businesses. At the same time, it was generally agreed that applicants fr drive-thrughs in Delta shuld be made. t demnstrate that there is sufficient capacity within the site fr vehicle queuing with n impacts t public rads. Althugh staff recmmended that the questin f envirnmental impacts f idling at drive-thrughs culd be cnsidered by the Climate Change Inter-Departmental Wrking Grup, Cuncil did nt refer the matter t the '!'Jrking Grup. The fllwing directin was prvided t staff; As part f the Zning Bylaw review, staff shuld include specific mentin f drive-thrughs and recmmend lcatin criteria. Traffic studies shuld be required fr any new drive-thrughs r changes t existing drive-thrughs. Staff shuld wrk with new applicants t address prper circulatin, adequate queuing lanes, and recmmend signage denting the pint in a queue where patrns wuld be faster served by parking and rdering inside. Staff is prcessing an applicatin fr McDnald's n 120 Street t expand the existing drive-thrugh and upgrade the parking area and building. Cuncil requested that the staff reprt include infrmatin n traffic impacts and mitigatin, ptential access thrugh the mall parking lt rather than 120 Street, and landscaping imprvements t minimize impermeable surfaces. Bylaw Enfrcement staff was requested t increase enfrcement at the Tim Hrtn's at Mathews Interchange in relatin t the existing 'N Parking' regulatins and t ensure that vehicles accessing the restaurant and drive thrugh are nt blcking traffic.
