1 INTRODUCTION The Bard f Directrs f the Darien Swim and Racquet Club t gvern the safe and sanitary peratin f pls and facilities related theret has adpted the fllwing rules and regulatins. They are fr the benefit and prtectin f all the members and are subject t change at any time by actin f the Bard f Directrs. The manager in charge is authrized t initiate temprary plicies r rules at any time such actin in his/her pinin is necessary. Thse rules and regulatins required by the State f Illinis may nt be altered. Pl supervisry persnnel and the Pls and Grunds Chairman are respnsible fr the enfrcement f these rules and are authrized t suspend pl privileges fr vilatins in accrdance with the bylaws: Article III, Sectin 7. Parents are requested t cautin their children t bserve all rules and bey instructins f the staff in rder t prmte the SAFETY, CLEANLINESS, AND ENJOYMENT OF ALL. Family members are respnsible fr any and all guests being aware f these rules and regulatins and the cmpliance therewith. 2 GENERAL REGULATIONS All persns using the Club facilities d s at their wn risk. The Club is nt respnsible fr any accident r injury n the premises and is nt respnsible fr lss, theft, r damage t clthing, autmbile, bicycles, r any ther persnal effects. Animals are nt permitted n Club prperty. All deck furniture (lunges, deck chairs) is limited t ne persn. Use f lunges is restricted t adults nly (eighteen years f age r lder) at all times. Anyne nt ccupying deck furniture shuld relinquish same by remving persnal belngings, therwise, such belngings are subject t remval. Bicycles must be parked in the area prvided. Any cmplaints with respect t emplyees shuld be reprted t the Pl Manager. Members and their guests are requested nt t shrt cut thrugh private prperty t btain entrance t the Club facilities, nr shall members enter the pl area except thrugh the prper entrance. Lunge chairs may nt be used behind diving bards, r in the cncessin stand area, unless apprved by the Pl Manager. The pl may nt be used unless supervisry persnnel are n duty. Running, pushing, dunking, hrseplay, imitating the actin f a drwning persn, thrwing bjects, etc., are frbidden. 3 GENERAL REGULATIONS (Cnt.) Flating bjects will be allwed in the pl nly when specific permissin is btained frm the lifeguard n duty. Ball games, water pl, hrse and rider cntests, and ther games are prhibited. The use f glass r metal in any frm is frbidden in the pl area. The last fifteen (15) minutes f each hur will be reserved fr adult swimming (18 years f age r lder) in the large pl. A lap lane will be maintained at all times. Bathers using suntan ltins, cream r il are required t shwer befre entering the pl. N ne will be permitted in the diving area that cannt demnstrate t the satisfactin f the guard n duty the ability t swim twenty-five (25) yards. Pl persnnel may require prf f swimming ability fr entrance int the large pl. Snrkels, masks with glasses, and scuba diving equipment will nt be allwed in the pl. Use f nerf balls will be allwed at the discretin f the pl management. Members are permitted t bring alchlic beverages in the cncessin stand area. Intxicated persns shall nt be admitted t the pl and any persn becming intxicated will be required t leave the Club facilities, upn request f the Manager. 4 STATE OF ILLINOIS REGULATIONS Admissin t the pl Is refused t all persns having any venereal disease, cntagius disease, infectius cnditin such as clds fevers, ringwrm, ft infectin, skin lesins, carbuncles, pimples, inflamed eyes, ear discharges, etc., r any ther cnditin which has the appearance f being Infectius. Persns with excessive sunburn, abrasins which have nt healed, crn plasters, bunin pads, adhesive tape, rubber bandages, etc., r ther bandages f any kind will nt be admitted. N fd, drink, gum, tbacc, r alchlic beverage will be allwed in pl area except when authrized by the Bard f Directrs. All persns will be required t take a shwer in the nude with sap and warm water befre being allwed in the pl area. Bathers wh leave the pl area fr any reasn are required t shwer befre returning t the pl. The pl manager shall have the authrity t adpt requirements, which wuld require swimmers with lng hair t wear bathing caps/tied up. All persns shall be subject t any ther rules and regulatins, which the pl management may deem necessary fr the gd and safety f all. Persnal cnduct in the pl and bathhuse must be such that the safety f the self and the thers are nt jepardized. Peple in street shes, and ther spectatrs, are nt allwed in the pl deck area. Whenever additinal rules are deemed advisable fr prper cnduct f this pl and the prtectin f the health and safety f its patrns, the management is authrized t issue and put int effect such rule, either printed r verbal. All bathing apparel wrn in the pl must be clean and sanitary. 6 ADMITTANCE REQUIREMENTS Individual must be a member r guest f a member. Children under ten (10) years f age must be accmpanied by a respnsible member thirteen (13) years f age r lder. The ttal number f such underage children under the supervisin f a single member thirteen (13) years r lder shall be limited accrding t the discretin f the Pl Manager r his/her designated assistant. A parent may accmpany any number f his r her wn children. Use f wading pl shall be limited t children three (3) years f age and yunger. A respnsible persn must supervise children using the wading pl. The wearing f diapers is nt allwed. Training pants and plastic pants r swim diapers may be wrn. The intermediate pl is intended fr children seven (7) years f age and yunger. Picture identificatin cards must be displayed fr entrance t the pl. Duplicate ID. Cards can be rdered frm the pl ffice fr $5.00 each. The time schedule fr taking duplicate pictures will be psted. Cst f any prperty damage will be charged t the membership hlder, whether a family member r guest caused damage. 7 GUESTS DARIEN SWIM & RACQUET CLUB A "Guest" is any nn-member accmpanied by a member f at least 13 years f age- Guest fees and resident bundary restrictins apply All rules and requirements applying t members als apply t guests. The Pl Manager r his/her designated assistant has the authrity t limit guest admittance as the cnditins warrant. Members shall register their guests with the Pl Office and receive prper receipts fr their guest. Members are respnsible fr paying the guest fee fr their guests n the day the guest is registered. N payments will be accepted frm nnmembers. Guests will be required t shw prf f residence. Under NO circumstances will any guest be allwed int the pl unless accmpanies by a pl member. All guest fees must be paid befre any guest can gain admittance t the pl. ABSOLUTELY NO FEES WILL BE CARRIED OVER; THEY MUST BE PAID AT THE TIME OF ENTRY. All guest fees must be paid by check r pre-paid cupn. N cash will be accepted. Cupn bks are nt replaceable if lst r stlen. Any member permitting an unauthrized guest t use his/her identificatin t enter the pl will be penalized as fllws: First Offense - Warning t member. Secnd Offense - Fine f $10.00 and a seven-day suspensin fr the entire family. Third Offense - Fine f $25.00 and a seven-day suspensin fr the entire family. 8 GUESTS (Cnt.) Guests shall be thse persns wh live utside the area bunded: On the Nrth by 63rd Street, The Suth by Interstate 55, On the West by Wdward, And n the East by Highway 83. 9 DIVING DARIEN SWIM & RACQUET CLUB > N ne is permitted under the bards at any time, either n the deck r in the water. > Only ne persn is allwed n a bard at any ne time. > Cautin is necessary befre diving r jumping int the water. > N diving r jumping ff the sides f the bards. > N diving ff the edge f the pl in the diving area. > N swimming in frnt f the diving bard area. Persns under the age f 8 may nt use the high bard. Exceptins may be made at the management discretin. > Exit frm the diving pl area shall be limited t the ladders and big pl. 10 CLUBHOUSE RENTAL > The Clubhuse is available fr rental bth t members and nnmembers, n a first cme first serve basis. A security depsit f $ is required f everyne renting the Clubhuse. Members receive a substantial discunt. The capacity f the Clubhuse is 150 peple. T rent it yu must cntact the rental chairpersn. There is a $50.00 nn-refundable depsit in rder t reserve a date fr clubhuse rental. The $50.00 is included in the rate, nt in additin t the current rates. The $50.00 depsit must be received within 5 days f the bking r the date will be canceled. The swim fee fr the nnmember guest will be at a discunted rate, see Rental Chairpersn fr pricing > Fees d nt include set up f tables and chairs. Any requests nt cvered by the abve rules will be referred t the Bard f Directrs. > The Bard f Directrs reserves the right t interpret and/r change the abve rules at any time. These rates include cleanup. 11 SOCIAL ACTIVITIES > The scial activities will be listed in the newsletter. > Adults may use the Gas Barbeque grills anytime. > If yu wuld like t vlunteer, please cntact ur Scial Cmmittee. > Fr scial functins nt invlving the pl, a maximum number f reservatins may be established by the Scial Cmmittee and a reservatin deadline set. Upn expiratin f the deadline, and prviding the maximum has nt been reached, the reservatins may be pened t guests, regardless f address. 12 NANNIES/GUARDIANS A qualified guardian must accmpany children under the age f 10 at all times (See belw). A qualified guardian is smene wh meets at least ne f the fllwing criteria: Any member f at least 13 years f age A nn-member relative f at least 18 years f age Designated "Nanny" with valid Nanny Pass (See Belw) Suitability f selected guardians is subject t apprval f pl management. Nanny badges are available t members fr the purpse f allwing an individual (i.e., nanny) t accmpany member's children t the pl. The Membership Cmmittee will issue a special Nanny badge upn receipt f the apprpriate Nanny fee. Nannies will be permitted entry t the pl areas upn shwing the special badge at the pl entry and nly if the children f the member purchasing the badge accmpany them. Nannies will nt be allwed entry fr just themselves. Nannies attending the pl with any member will be treated as a guest even if the member's children are in attendance. The issuance f a Nanny badge is a special privilege ffered by the Club. Imprper use f the Nanny badge can result in cnfiscatin r ther actin deemed apprpriate. A "Nanny" is... 13 CONCESSION AREA Entry t the cncessin area frm the clubhuse is prhibited. > Members are respnsible fr cleaning their wn area in the cncessin area. Available t members and guests are garbage cans fr refuse, sap and water t clean tables and chairs, and a hse t wash the surrunding cncrete area. Be curteus t thers while cleaning. Please keep yur cncessin area clean. PRIVATE SWIM LESSONS > Private swimming lessns are nt a sanctined functin f the Club and, therefre, nt cvered by Club insurance. Members are advised that private swimming lessns are an agreement between themselves and instructr, and that any incident shall be reslved between them withut any Club invlvement. > Members will be required t reimburse the Club fr any csts incurred related t private swimming lessns. 13 Last Revised and Apprved by Bard f Directrs n May 7, 2003

14 MEMBERSHIP DISCIPLINARY ACTION PROCEDURES Members and their guests are subject t published rules and regulatins at all times while n Darien Swim and Racquet Club grunds. Serius infractins f these rules and regulatins include but are nt limited t the fllwing examples: Vilent r threatening behavir twards ther member's guests r staff Making physical cntact (i.e. fighting with) ther members, guests r staff Ignring any direct instructin frm n-duty management Egregius vilatins f pl safety rules and regulatins > All members are t be held accuntable fr the behavir f their guests. The fllwing prcedures will be fllwed whether the member r his/her guest cmmitted the vilatins. Guests can be ejected and/r banned frm the pl at any time at the discretin f management. First Warning - The Facilities Manager r Pl Manager issues the first warning bth verbally and in written frm. The dcument will be mailed t the member's address alng with a cpy f this dcument that utlines further actin as prvided. 15 MEMBERSHIP DISCIPLINARY ACTION PROCEDURES (Cnt.) Secnd Warning The Facilities Manager r Pl Manager issues the secnd warning bth verbally and in written frm. In additin t afrementined dcumentatin, the member will have their pl privileges suspended fr a perid f n less than ten (10) days. Final Warning/Expulsin - If the Facilities Manager r Pl Manager needs a t issue a third infractin ntice t a member, that member's status will becme immediately suspended pending a special meeting f the Bard f Directrs at which the bard will vte n the expulsin f said member. > Grunds fr Immediate Terminatin f Membership - The Bard f Directrs reserve the right at any time t suspend and r expel any member fr any serius vilatins f the published rules and regulatins. 15 Last Revised and Apprved by Bard f Directrs n May 7, 2003

Entire Physical Operatin f the Pl including Maintenance, Supplies and Equipment management Making final payrll apprval and management f payrll budget Pl Manager - Primarily respnsible fr pl peratins. Management and scheduling f all guards and staff. Assist CPO with maintenance. Will assist CPO with hiring and evaluatin f guard staff. Has authrity t recmmend the terminatin f emplyees including verbal and written warnings t emplyees. Respnsible fr annual review f emplyees. Assistant Pl Manager/Head Guard - Assumes peratinal respnsibilities in the absence f bth the Manager and CPO. Assists management as assigned by Pl Manager.
